Not everyone understands the Constitution, but not all misunderstandings of the Constitution are equal. Over the years I've gotten a lot of very bizarre comments that make outlandishly wrong and even conspiracy theory level claims about what is actually in the Constitution, or what has become of it. Is the Australian Government actually a corporation registered in Washington DC? Are Australians secretly classified as cargo under maritime law? Is Western Australia non-existent? Did Gough Whitlam secretly replace the Constitution with a different colour? Of course not. None of these claims make any sense. So to debunk them I've got Professor Anne Twomey, constitutional expert, to explain how it actually works and to encourage people to do the most basic fact checking exercise of all: actually reading things. What is the role of a minister? A minister has a lot of responsibilities, both as an elected representative but also as part of the executive government their role involves managing government departments, formulating government policy, working alongside and taking on board the advice of the public sector, and introducing government legislation. Well, I asked it to explain elections, the Senate, and the House of Representatives and I was initially impressed by what it got right - followed by mortified by just how incredibly blatantly wrong it could be.So, enjoy! To vote in a referendum you clearly mark your ballot with YES or NO. But why not something else like a tick or a cross? Well, it isn't actually as clear as you think and so an incorrectly filled out ballot can't legally be counted if that intention is ambiguous or unclear. To change the constitution in Australia you need a referendum - but how do you vote in a referendum? It's actually incredibly simple! Here's a basic guide as well as a few extra bits of information that's handy to know.

Today's claim: the Voice will abolish private land ownership and revert it all to native title if the Voice referendum succeeds. This is, of course, simply not true. This is actually a bit of misinformation that predates the Voice by a couple of decades and is just being rehashed to stir up the same old unfounded fear for a fresh new audience that doesn't have the historical context. Don't worry: the Voice will not lead to the end of private land ownership - that'd require the nation to actually want to change it collectively, and the Voice's existence or non-existence is not relevant.

There's the claim that the Voice's approval will be required to pass any bill, or that even Parliament would need to consult the Aboriginal and Torres Strait Islander Voice ahead of time before it could pass anything. In this episode I'll explain why that doesn't work either constitutionally or practically, and why the Voice won't even read or examine every single bill let alone wish to comment on or have an opinion on every bill. It's approval also is not a requirement to pass a bill, as the constitution clearly doesn't put that restriction on Parliament.

Claims that the Voice will be so powerful that it'll even be able to stop a future referendum bill from passing, thus ensuring it can never be abolished, are going around the internet - but is there any truth to that? The short answer, of course, is no. The long answer is no - but I explain why it's no so you understand it and can hopefully also explain it to someone who is being misled by this outlandish myth.

A common claim is that the Voice to Parliament will have veto power - but does that have any basis in reality? What argument is there to be had over it? The answer is: none. The wording of the amendment prevents such an interpretation and clearly limits it to just being an advisory body, but on top of that we'd need to radically alter SEVERAL sections across multiple chapters of the constitution for the claim to make sense. Simply put: the idea it has any veto power over the decisions of Parliament, or could hold up/delay/introduce a bill, is just baseless. It's entirely up to Parliament whether or not to vote a bill through, or to send it off for consultation and examination with other groups/bodies (Voice or no Voice).
On top of this: the idea that it could just manipulate the High Court for its own purposes fundamentally also misrepresents the role and powers of the High Court - and so this claim that such a constitutional or legal power exists requires us to ignore/misrepresent every single element involved in every single way. I can't be clearer about this. The only thing the Voice has is the ability to inform and, arguably, influence the decisions of Parliament - but ultimately it still rests in the general public as to whether or not that decision is accepted at the polls next election and so the voters nationwide remain, as always, the ones in control of the democratic process.

Welcome to the first in a series of several debunking episodes where I'll be fact checking and addressing misinformation that's floating around the internet (and maybe the family dinner table). Misinformation naturally happens when there's a gap in someone's understanding, or even just develops out of accidental misrepresentations of something. It's understandable. But we should also try to do our best to combat the spread of these misunderstandings to make sure as many people as possible are informed.

The Indigenous Voice to Parliament will be taken to a referendum at the end of 2023 - but before you vote yes or no you should understand at least some of the basics. What is the Voice to Parliament, what can it do, what can't it do, and how will it work? All these questions and more will be unpacked and also some historical context given.
The proposed change is to create: Chapter IX Recognition of Aboriginal and Torres Strait Islander Peoples 129 Aboriginal and Torres Strait Islander Voice In recognition of Aboriginal and Torres Strait Islander Peoples as the First Peoples of Australia: 1. There shall be a body, to be called the Aboriginal and Torres Strait Islander Voice; 2. The Aboriginal and Torres Strait Islander Voice may make representations to the Parliament and the Executive Government of the Commonwealth on matters relating to Aboriginal and Torres Strait Islander peoples; 3. The Parliament shall, subject to this Constitution, have power to make laws with respect to matters relating to the Aboriginal and Torres Straight Islander Voice, including its composition, functions, powers and procedures.
Some important context is that the proposed wording provides the ability for Parliament to alter it through legislation, which has led to a lot of misinformation. The legislation must still be relevant to its scope and function as an advisory body. The kinds of ways it could be altered involve things like its method of finding members - so the design principles are that members of the Voice would be selected by Aboriginal and Torres Strait Islander communities, not appointed by the Executive Government. Members would serve on the Voice for a fixed period of time, to ensure regular accountability to their communities. To ensure cultural legitimacy, the way that members of the Voice are chosen would suit the wishes of local communities and would be determined through the post-referendum process. This gives different scopes for election methods, either through broad general elections with single/multi-member electorates or local community bodies electing individuals based off certain franchise requirements, meaning not every single person needs to cast a ballot and, unlike general elections, can choose to be disengaged with the Voice if they so wish. While I do describe it as an elected body I do have to clarify that's based off the design principles and co-design report, not a constitutional requirement. The idea is malleable, is designed to take on board local Indigenous feedback, and any alterations are still accountable to the electorate broadly as they can judge the government and its handling of Voice regulations.

The referendum is officially happening! It has passed the Senate and by the end of 2023 the public will cast their votes - YES OR NO - to see if we want to change the constitution to recognise Aboriginal and Torres Strait Islanders as the First Peoples of Australia by creating an Indigenous advisory body known as the Voice.

Australia becomes a country, a nation in its own right, and while there's still a lot more to its journey to becoming fully independent - this is a pivotal moment in Australian history where the federal government was formed, the constitution was written, revised, and tested by the public, and the public rallied behind the idea of uniting as a nation.
This is the story of how people like Henry Parkes, father of federation, helped the movement grow from the 1880s all the way to its eventual success around 20 years later.

Australia has had 31 Prime Ministers thus far - but how many of them share a name? Well, you'll be surprised just how incredibly popular one name is compared to every other. Yes, this is a bit of a silly one but there's a few fun facts in there about names.
There's a few minor sound glitches, so I'll have to check my lapel - but one fun thing that didn't make it in the edit due to sound problems was that Joseph Lyons' name is Aloysius, which is a Latinisation of names like Luigi. I think that's a very cool name and also want to imagine him playing Mario Kart.

What is party membership and what does it involve? Political parties are way more than just Members of Parliament but are actually made up of hundreds (if not thousands) of people coming together to support an idea or cause. Membership is valuable to you as a person in how it gives you a voice and important to shape the party itself - but don't just take my word for it. Parties can't choose your preferences - only the voter can. This is a myth, but it's based off something that did exist in the past, just hasn't since before the 2016 Senate election. It was called a Group Voting Ticket and was abolished. It also has been removed from almost every single state election as well. In this episode I explained how it used to work, why it was like that, and how parties exploited it to get people elected without many votes. Now, however, you are fully in control of your preferences and parties can only merely suggest to you to vote a certain way.

Is voting for someone who won't win a waste of time? No! Because preferential voting exists! Here's how preferential voting works and how it allows you to vote according to your personal opinion of who you like best, while still having your views shape who ultimately does get elected in the end. Preferences mean you can vote for a minor party or independent in the House of Representatives/Legislative Assembly and still make sure the major party you like the most gets elected. It's all about empowering you to best express your views and be part of the democratic process in Australia.
Though important note: when voting in the Senate, as you don't need to fill in every single box, it's possible for you to only list preferences for a limited selection of unpopular candidates and have your vote exhausted before anyone gets elected if none of the people you vote for get a quota. It's still up to the voter whether they wish to allow their preferences to ultimately end up on a major party, or not, and minor parties/independents do have greater success in the Senate.

What do the different political parties stand for? What are the major, minor, and micro parties promising this election? Well here is a few dot points for EVERY SINGLE FEDERALLY REGISTERED POLITICAL PARTY IN AUSTRALIA! Some are very straight forward and some have vast and complex policy platforms that I could only fit a fraction of in this episode.
This is a summary of a few key issues - without any commentary on whether those policies are good, bad, or even practical. It's entirely up to you, the voter, to be informed and express your opinion as you see fit at the ballot. Also, just because I mention an idea or policy for a group of parties doesn't mean other parties don't also agree with it - a lot needs to be removed for the sake of time.

Who is a better economic manager out of Labor or Liberal? Who has higher taxes? Does Labor spend a lot more than Liberals? Well, instead of having a subjective opinion - let's examine 50 years of data to help you understand how to better examine the shifts in taxes, economic growth, spending, debt, and unemployment, and what the figures, trends, and averages actually are. If Labor spends more - we'll be able to find the cold, hard, figures, and see. If Liberals spend less, we can measure it through spending to GDP.
Reminder: it's up to you to decide who you want to vote for and I'm not trying to promote/disendorse anyone, just providing you information to better understand the topic of economic management and how people judge it.

What's the difference between Scott Morrison and Anthony Albanese? Who should you vote for out of Labor or Liberal in the 2022 federal election? I'll compare their voting records to demonstrate what the two major parties have voted for in the past so you can see what they stand for, not just what they say they'll do. While there are plenty of similarities between the major parties (they do want to appeal to as many people as possible after all) there are some differences. This one's really important for helping people figure out who they want to vote for - so if it helped you, share it around! Though do note: this is just about their previous voting record - and won't necessarily be an exact reflection of their election policies, but will help you frame them in context with their track record.

In this video I explain how to fill in your ballots for the Legislative Assembly and Legislative Council as well as explain why the two are different. This is not about who to vote for as that decision is entirely up to you! I also explain the difference between voting above and below the line for the Legislative Council. The next WA election is currently scheduled for 8 March 2025, but can be called early by the Governor.

The Australian Labor Party has one odd mystery... Given that Australian's use British English and spell words like colour, humour, etc with O-U-R, why does the ALP spell their name without a U? The name comes from "labour", because of its origins with the workers movements and unions, but where along the line did the spelling become Americanised?
