The upshot: It was a dopey idea when it was proposed, and it’s still dopey. Reporter Adam Ferrise offers insight on a fascinating lawsuit filed this week against Cleveland Mayor Frank Jackson. The mother of a man who was shot to death last month says in the lawsuit that Jackson is to blame, because if police and prosecutors had done their jobs, the man she says blames for her son’s death would have been behind bars when her son was killed. Who is the person she blames for the death: Frank Q. Jackson, the mayor’s grandson. We also talk with Adam about the inexplicable decision of Cleveland Police leaders not to fully staff the homicide unit, especially with the number of homicides in which more than one person has been killed in the same shootings. And court reporter Cory Shaffer joins us to talk about his big story from last week, news that jail guards are so overworked and stressed out that they are falling asleep while supervising unrestrained inmates. Cuyahoga County Executive Armond Budish has asked the intriguing question: What if you could walk, run or ride a bike along nearly the entire lakefront in Cuyahoga County? We consider some answers to that question and analyze Budish’s bold lakefront vision on the latest episode of This Week in the CLE. Cuyahoga County suddenly finds itself with millions of dollars because of its lawsuits against companies that created the opioid crisis, and County Executive Armond Budish has some ideas on how best to use that money. That’s where we begin the latest episode of. This Week in the CLE. Budish and County Council President Dan Brady visited with us Thursday to talk about the plans. They want to focus the money on helping people who are addicted to the drugs. Cuyahoga County reporter Courtney Astolfi joins me and cohost Laura Johnston to dig into the proposal. Courtney also discusses the success of bail reform in Cleveland Municipal Court, Budish’s proposal to pay for bail reform in the county courts and the creation of a special docket in the county court system for men at highest risk of beating their spouses or partners. Cleveland City Hall reporter Bob Higgs updates the move by city firefighters to get the fire chief fired for campaigning for Mayor Frank Jackson, in violation of the city charter. Bob offers his perspective on why firefighters so dislike their chief.
Bob also talks about the city’s quandary in dealing with dirt bike riders who stormed city streets recently, blocking off intersections and interfering with traffic. The panel wonders, though, whether this is the big deal that Councilman Mike Polensek makes it out to be. Given all of the other issues in Cleveland, does it matter if people are delayed for a moment by people out joyriding? Listen to the podcast for more information.
Soon to join dirt bikes on the streets: rented scooters. Bob explains how the city is finally allowing the return of the scooters, which are popular in other cities, after ordering them removed last year.
We also discuss the efforts by the Ohio Debate Commission to bring order and value to debates by candidates for office, but the panel also wonders whether the effort is worth the trouble. No matter what the rules, candidates always seem to say what they want to say and avoid answering questions that trouble them. Reporter Mary Kilpatrick covered a City Club forum about the issue and has the details.
We wonder whether a ballot initiative might result in the most expensive campaign spending in history. Jane explains how a move to abolish a bailout of the state’s increasingly obsolete nuclear plants – forced upon taxpayers by the Legislature and Gov. Mike DeWine – could show up on the ballot in 2020, as opponents work to abolish the bailout.
Jane, who handled and outsized portion of the week’s big news, also explains what Ohio Attorney General Dave Yost wants to do to help ensure that a move to legalize hemp in Ohio does not accidentally legalize marijuana. She also provides details of Statehouse reporter Laura Hancock’s sleuthing to explain why Medicaid enrollment has dropped nearly every month since 2017.
Jane also talks about her favorite story of the week, the Ohio Supreme Court’s smackdown of Bratenahl, where elected leaders have been illegally concealing their votes on issues from the public. They have been meeting in public but holding secret ballots. Amazingly, two lower courts said that was okay. The Supreme Court finally weighed in and told tony Bratenahl to obey the law and do business in the sunshine.
Crime reporter Adam Ferrise talks about what he learned from public records about how a man came to be shot to death by an off-duty cop outside a bowling alley in University Circle last year. Adam also offers up the various explanations he was given for why $17,000 in handcuffs sit unused at the Cuyahoga County Jail, even though jail consultants say those handcuffs should be in the hands of the guards.

Seven months after the release of a blistering report about inhumane conditions at the Cuyahoga County Jail, the Cuyahoga County Council has done nearly nothing to oversee reforms, and that might be why we now have two efforts brewing in Columbus to compel change. We talk with reporter Courtney Astolfi and politics editor Jane Kahoun about why the council has been missing in action while Gov. Mike DeWine and two Democratic legislators mount efforts to fix the jail. The county council is composed of Council President Dan Brady, Pernel Jones, Nan Baker, Dale Miller, Scott Tuma, Michael J. Gallagher, Jack Schron, Yvonne Conwell, Shontel Brown, Cheryl Stephens and Sunny Simon. Even without County Council oversight, County Executive Armond Budish says he has made a lot of progress on bringing order to the jail. We did not realize it at the time, but a meeting we hosted at the offices of cleveland.com on Nov. 17, 2017, turned out to be remarkable for the insights it offers into the continuing criminal investigation of Cuyahoga County Executive Armond Budish’s administration.
Budish brought his top cabinet members to our offices to talk about recent items in the news, items that ultimately became part of the criminal investigation. But this meeting was more than two months before anyone in the Budish administration knew about any criminal probe.
We recorded the conversation, and we publish it today in its entirety, along with a transcript of much of it. We think the people who live in Cuyahoga County deserve to hear what their government leaders were thinking as they performed their jobs on the eve of a criminal investigation, before they had any inkling that they might have to defend themselves against potential felony charges.
To understand its importance, you have to consider the timing. County Auditor Cory Swaisgood recently had called out the Budish administration for paying $1.7 million in overtime to salaried county employees, something Swaisgood saw as illegal. They are called salaried workers for a reason. The Budish administration disagreed and came over, in part, to explain to us why. (Even though, it turns out, the administration was wrong and did not have the authority to pay the overtime, the County Council later adopted rules allowing it henceforth.)
You can hear in the recording that we clearly were not buying their explanations, but rather than summarize what they said here, we leave it to you to digest it and form your own conclusions.
With Budish were his then-chief of staff, Sharon Sobol Jordan, then-Law Director Robert Triozzi, then-director of Employee and Labor Relations Edgillo Morales, then-Chief Economic Growth and Opportunity Officer and current interim chief of staff Matt Carroll, Chief Communication Officer Eliza Wing, Director of Communications Mary Louise Madigan and Chief Talent Officer Douglas Dykes.
Dykes is one of the first people to be charged in the criminal investigation, and the recording we publish here could be central to his case. Prosecutors allege that Dykes broke the law – committed theft – by giving Jim Hay, a top executive whom Budish was recruiting, a $15,000 signing bonus. There’s no allegation that Dykes benefitted from what prosecutors say was a crime, and we cannot remember another instance of someone who did not take anything being charged with theft.
In the November 2017 meeting, Dykes sat next to Budish, Triozzi and Jordan – the top three officials in the county at the time – and heard them make vigorous arguments that everything they and Dykes did was legal according to both the county charter and state law. Consider that: The county’s top lawyer argued vehemently, with Dykes at the table, that the administration had full power to determine compensation. Dykes might want to play this recording for the jurors who ultimately consider his case.
The most enlightening part of the recording, however, is the audacity of Budish and his cabinet members as they argue that they are above parts of the law. We now know that they did not have the authority to provide the recruited executive with a signing bonus. (He’s paying it back.) We now know what we argued back then, that the administration is required to adhere to the personnel manual adopted by the County Council. But for a little over an hour in November 2017, one member of the Budish team after another made the case that they could make their own rules.
Another interesting moment comes when Morales argues that unlike in the private sector, salaried workers in the public sector have hourly rates of pay for a good reason. He said governments do this to be accountable to taxpayers, so that taxpayers can rest assured that all county workers are putting in the full hours for which they get paid. Morales says...
