On October 21, 2022 the New Jersey to Supreme Court logjam was officially broken. Rachel Wainer Apter and Douglas M. Fasciale were both sworn in. As of recording of the podcast, the new Justice’s biographies are not up on the website yet. I will use their Wikipedia pages for bio background.

State v. Mackroy-Davis - Importance of Speedy Trials for 6000 accused detained pending trial.
State v. Clark - Suppression of recorded statement upon invocation of counsel.
State v. Goldsmith - Suppression of gun recovered from improper stop.

I recently saw (through a zoom arbitration) Judge Mary Catherine Cuff - Retired PJAD who served “temporarily” on the NJ Supreme Court from 2012 - 2016 until the appointment of Justice Walter Timpone. The Arb was a pleasure and the Judge issued a lovely hand-written Arb Award. The interaction prompted the ringing of the bell in the Trenton clocktower - the NJ Supreme Court is down (2) Justices and Justice Albin is a mere (2) months from retirement. BRRRRRING!!
State v. Konecny - DUI, PCR, DWS - driving while suspended. The NJ Supreme Court did note extend Laurick relief to multiple DUI offenders who were represented by counsel. Laurick is NOT traditional PCR - it only addresses uncounseled defendants - not defendants who allege ineffective assistance of counsel in the context of PCR.
Haviland v. Lourdes Medical Center of Burlington Co. - AOM - Affidavit of Merit is not required where plaintiff asserts vicarious liability against a licensed actor if the tortfeasor is an unlicensed person.
Dobco, Inc. v. Bergen County Improvement Authority - A bidder cannot complain that a bid process is illegal while participating as a bidder for a public contract. A resident officer of a bidder may seek injunctive relief, outside of the company’s claims, but must file a certification indicating that the individual is not taking direction from the bidder and personally paying legal fees without reimbursement.

Justice Jaynee Lavecchia retired forever effective December 31, 2021. Senior App Div Judge Jose Fuentes is temporarily assigned to the NJ Supreme Court by Chief Justice Rabner.

US Supreme Court Won't Take up Smart Phone Password Case
State v. Andrews - the United States Supreme Court is following the lead of the New Jersey Supreme Court. In 2020 the New Jersey Supreme Court in a split 4-3 decision found that compelling a criminal defendant to disclose mobile phone passwords is permissible and does not violate the 5th Amendment right against self-incrimination. Justice Solomon wrote the majority opinion. Justice La Vecchia wrote the dissent. In not taking the case up, the US Supreme Court put its stamp of approval on New Jersey's interpretation of the current state of the law. This is a fast-moving evolution and certainly not the last word on technology, passwords and access to the merging of the human brain and Technology.
Sen Weinberg Signs off on Rachel Wainer Apter - New Jersey Supreme Court nominee has two of her four home county senators and needs two more in order to have her nomination considered by the Senate Judiciary Committee. Sen. Loretta Weinberg -NJ-37 - Senate Majority Leader has signed off.

What do the NJ Attorney General, Assoc of Criminal Defense Lawyers and NJ State Bar Association have in common? They all push to advance the cause of justice, but from different angles and inspired by competing agendas. Except in the unanimous opposition to conducting Virtual Grand Juries.
The 1947 Constitution and Winberry v. Salisbury gave the NJ Supreme Court clear authority over the running of the Court system. A unanimous NJ Supreme Court upheld its own policy and virtual grand juries will continue through the pandemic.

Hager v. M&K Construction - NJ Supreme Court makes a big splash ordering a workers compensation carrier to pay for the injured workers medical marijuana. The Court explained although marijauna remains illegal per federal law, Congress has expressly deprived federal law enforcement of funds to interfere with state medical marijuana regimes for (7) consecutive years. Competent medical testimony reveals marijuana as the best pain management (20) years after a concrete truck explosion that flattened him like a pancake. A pebble in the pond of marijuana law with plenty of ripples!
State v. Ramirez and Orozco - accomplice liability jury charge clarified after horrible death of a two year old child at the hands of one or both of the baby’s parents - remand for re-trial on manslaughter.
Huggins v. Aquilar - car dealer loaner car “garage policy” may not have an escape clause excluding coverage. Dealer policies must have $100,000/$250,000 policies - the NJ Supreme Court reformed the garage policy accordingly.

Two cases this week.
Maison v. NJ Transit
Answers the question of whether NJ Transit is a “common carrier.” Answer = yes. The court imposes common carrier liability duties on NJ Transit. The duty is more than getting people from point A to point B. The court also crafted a specific jury charge for the allocation of damages across the agency, the agency’s employee and an unrelated tortfeasor. At stake a $1.8 million award to the plaintiff.
Goldfarb v. Solimine
Equitable remedies and statutory Securities Law collide when a financial analyst’s promise of employment never materializes. The required written term sheet never materialized either. The court found the plaintiff’s claims are limited to “reliance damages” not “benefit of the bargain” damages. He can recover what he would have earned had he not relied upon the oral employment promise.

Justice Stein's first “judging” job was as a referee for the Duke varsity basketball game scrimmages. The pay was $1 per day.

We discussed Vince’s journey from a young attorney when the divorce and family law business was itself a new phenomenon to the evolution of statutory and court rule changes that have pushed the practice into a negotiation, mediation, and arbitration centered business. Phil was raised in the economically, racially, and ethnically diverse town of Lakewood in Ocean County, New Jersey. He credits his upbringing with helping him learn to deal with people.
He began his college career as a pre-med student at Emory University then switched to Rutgers University as a psychology major. He got the itch to pursue a career as a lawyer when he defeated his college landlord's refusal to return the security deposit to him and his college roommates. His adversary thought he might have a knack for the law business.
He went on to Rutgers University Law school in Newark and a clerkship in the Ocean County Vicinage. He clerked for four judges – Huber, Giovine, Kearney and Fall. He got the most out of his clerkship by creating binders full of useful papers filed by the capable lawyers that appeared in front of the judges he clerked for. He went on to work with attorney Kevin Kelly, who is well known for his role in the Robert Marshall prosecution that resulted in the Joe McGinnis book and TV movie Blind Faith. Phil worked for the firm of Kelly and Villano. The Villano of the firm was Judge Barbara Villano, now retired from the Ocean County Vicinage. Phil then became partner and the firm of Kelly and Miller was formed. They were later joined by attorney Patricia Roe who also became a Superior Court Judge, and just retired last week.
Phil is an expert in the administration of justice and operation of the Municipal Courts in New Jersey. On the surface, the Municipal Court may seem like a lowbrow affair. To the contrary, Phil shares with us that the Municipal Courts of New Jersey handle some 7 million cases per year. Phil served as a Municipal Court judge for over 20 years in the Township of Barnegat, appointed by elected officials from both sides of the aisle. He has also been assigned, by the Ocean County Vicinage Assignment Judge, to the Central Judicial Processing Court where he handles cases requiring bail determinations.
Phil’s BIG ASK is that the court system takes the very serious policy associated with the prevention of domestic violence and apply it at the Municipal Court level where so many of these matters are addressed without the resources that are brought to bear in the Superior Court.

We did not touch on any of Joe Hayden's honors and accolades here’s a link to his bio page. The reason I did not spend time on the podcast was that it would take me an hour to read all of these have honors and recognitions!
Joe humbly sheared is two things one hard work into right place at the right time. He went from nearly failing out of Boston College to graduating near the top of his class at the Rutgers Law School. He participated in the Selma marches and even wound up arrested but not booked. That experience shaped his thinking and view of the justice system. He also served the system during the 1967 Newark riots and saw how quote powerless people are in the system." He went on to clerk in the New Jersey Supreme Court for Chief Justice Joseph Weintraub, served as a Deputy Attorney General until starting a career in private practice.
He asserts that law is a people business and that it is a privilege to work as a lawyer. He commands to all of us to quote put out good stuff – do favors and say Thank You!

Dan is an embryonic immigrant whose parents moved from the oppression of the Soviet Union to the US while his mom was pregnant with him. He is a graduate of Lehigh University and Seton Hall Law School. He operates his law firm – Dan Barli and Associates – out of multiple locations. His journey to practicing law took a severe turn on the first night of Hanukkah soon after the passed the bar exam. His cancer doctor called him at 7:30 pm to tell him that his leukemia had returned. Dan has put significant energy into getting healthy, including undergoing a bone marrow transplant. It took two years for Dan to get back on his feet. Although the real estate market was still very soft, he put on his suit and went knocking on the doors of real estate brokers letting them know he was open for business.
Outside of the law, Dan is an avid real estate investor and learner. We are both fans of the “Bigger Pockets” podcast.
He has also founded a coaching program to help people achieve financial goals called Financial Freedom Universities.

John Koufos has had a wild ride: rising star criminal defense lawyer, incarcerated in Bayside State Prison for 17 months, and now advisor to Presidents and Governors on Access to Justice initiatives, inmate re-entry, and a ton of Bi-partisan policy initiatives. Listen to the narrative that put John behind bars and has made him a zealous advocate for those emerging from prison.
He is the National Director of Right on Crime - a think tank that utilizes unique approaches to facilitate inmate re-entry to the community. Right on Crime focuses on common sense initiatives like identification, driver's licenses, wiping out small fines, and leaving a pathway to “Safe Streets.”
