When we talk about alimony, the question is often raised if I filed do I waive the alimony? If the other side files what is the interplay between who files and alimony? Can my ex avoid paying alimony or is he obligated? In Michigan law, there is really no interplay between who files first and who gets alimony. The first one to file may be able to control the narrative at the beginning of the divorce process. Of course, the court in the divorce will be able to discern enough. The facts from both sides will be enough to make the appropriate determination later. Alimony is based on factors and sub-factors. A major factor is going to be how long the spouses were married. What is the respective income of the parties? Are there disposable assets to pay for alimony?
