In situations where the  parties have liquid assets, the division of the asset will be simple. For situations where it is a mix of liquid and non-liquid assets, the division of assets may not be that simple. For example, a 401K may not be worth it's face value when you liquidate it. A 401K may have a lesser value once liquidated because it will be paying for taxes. There could be early withdrawal penalties. You have to ask yourself, how can I strategically divide my assets? In liquidating a mix of liquid and non-liquid assets, the concept of fair may not necessarily mean equal. Your attorney can come up with approaches on how to strategically divide assets. You can simply take your 401K and split the lesser net value. Or you can replace the share of your ex-spouse with another asset. If not, you can take on a liability to replace the share with a more liquid asset.
