Some argue this isn't right and others say yes! "He who has the gold makes the rules" is that accurate? 401(k) funds for a home down payment without the 10% early withdrawal penalty (if under age 59½) is primarily achieved through a 401(k) loan. While some proposals have been discussed to ease this, a direct, penalty-free "withdrawal" is up for debate, new policy may take place under the President's administration.
- Per A.I. on Google: If your employer allows it (about 80% do), you can take a loan from your 401(k) to use as a down payment.
No Penalty/Tax: Because it is a loan to yourself, you do not pay income tax or the 10% penalty, provided you follow repayment rules. Roughly 78% of Gen Z homeowners and 54% of millennials received down payment help from family. Median age for a first time homebuyer is 40 years old according to NAR. It was 38 years old last year.
The typical repeat buyer is now 62. The typical U.S. homeowner stays in their house for 11.8 years, according to Redfin. More than 50% of Gen Zers and nearly 60% of millennials reported that they’re depending on their inheritance to achieve financial security and retire in comfort, per Northwestern Mutual. 2025, 50% of first-time home buyers were married couples. This data comes from the National Association of Realtors' (NAR) 2025 Profile of Home Buyers and Sellers report, which typically covers the period from mid-2024 to mid-2025.

EPISODE 57 | The podcasters, MLB commentators and critics of Devers are falling flat on explaining why they disagree with Devers for not wanting to play 1st base! The narrative put out there is essentially Devers is a big ego maniac and scared to play another position. I unfortunately have to blame the translator for why this narrative is out there. Devers essentially is trying to say, he doesn’t believe he’s a type of player that can easily adapt to a new position. Translator doesn’t even remotely relay that message. Plus the body language of Devers was easy going. His words were delivered ok but this translator came out so serious. Devers understands he’s not a Mookie Betts. That’s tough as hell to move around. Competition is about to get real. With that said, the world leaders are competing with Trump and it appears the "Art of the Deal" may be working for the USA. Homelessness continues to rise throughout the nation but more so in California. Governor Gavin Newsome said he would fix this but there is no end in sight. Measure ULA aka Mansion Tax increases real estate transfer taxes in the City of Los Angeles, which are levied when a property is sold regardless if the property owner nets or loses on the sale. The city of Los Angeles taxes all real estate transactions at 0.45% but with this new additional transfer tax also known as measure ula or homelessness and housing solutions tax. Taxes transactions between $5.15M to $10.3M at 4% of the sale price, and Those valued at $10.3M and above at 5.5% of the sale price.

Crime rates in LA are no joke. We see homelessness and crime occurring often and it could affect house prices.

Real Estate Update and Stocks:
- Stock market soared today a lot having to do with tech companies outperforming so that’s good news. S&P closed today (Jan 19) at record high for the first time in two years.
- This month, mortgage rates have remained in the 6.6% range which has kind of been ongoing since last month. As we can remember in October- rates had hit 8% then floated in the 7% range for some time. The last time rates were this low was in May 2023 when the market was competitive.
- If you bought a $1M home w/20% down payment today using the 6.6% rate you’re looking at about $5,109 vs if all things being the same but the rate is 8% that’s $5,870. So a $761 difference. This is why we are seeing things pick back up.
- You may be curious why rates improved and that’s because of core CPI, which was lower than expected. Core CPI last month came in at 3.9% than a year ago but it was down from the annual rate of 4% from last month. This 3.9% was the lowest level since Sept ‘21
- Core CPI calculates inflation in the country and excludes the food and energy components.
- This at one point this was in the 6.6% range in 2022.
- This fight against inflation has been ongoing and the reason for the Fed hiking fed funds rates 11 times. Last year we heard the Fed may lower these fed fund rates and only time will tell.

NEW DODGER PLAYERS just traded to the team- Pitcher, Tyler Glasnow (5 years for $136.5M w/a $10M signing bonus) and Manuel Margot outfielder from Tampa Bay Rays. Glasnow grew up in Santa Clarita, Calif., about 30 miles north of Dodger Stadium. The 30-year-old will slot into the front end of his hometown club’s rotation.

ECONOMICS AND HOUSING:
- Fed Funds rate left unchanged in December, 5.25 5.5
- Three rate cuts are on the horizon for 2024. Fed’s dot plot- a chart where it’s projected where the fed funds rate will be in the future (4.625%)
- UR from 3.9 to 3.7%
- CPI came in at 3.1% where last year was 4%
- Did 11 rate hikes since March ‘22
- Consumer expenditures price index up 3% on a year- over-year basis, compared with 3.4% in September. Price growth as measured by the PCE index is the Fed’s preferred inflation gauge.
- Luxury market in Orange County (over $2M) (168 DOM) has slowed more so than the general market (60 DOM), if anything this price range has got hot again. These higher price points usually don’t fall much when the market slows down since they usually don’t always feel the pressure of selling. Active listings down about 6% (129 homes) in OC, last year inventory was 46% higher than last year.
- Luxury market in Los Angeles County (over $2M) (269) slowed and general market at 74 days. Active listings down about 2% and last year there was 15% more inventory.

Fed is supposed to provide price stability/inflation and maintain sustainable employment levels. Thier rates influence short term interest rates but they also buy/sell treasuries and MBS. Recently the Fed chairman said, "The American economy remains strong, and Treasury securities are the world’s pre-eminent safe and liquid asset." He said this after the Fed stopped raising rates in November. Markets are convinced it's done hiking and speculate he will cut rates next year. Currently Fed funds rates at a 22 year high!
- Mortgage rates will not go back to 3% – we’ll be lucky if we get back to 5,” per NAR chief economist Lawrence Yun.
- Mortgage apps have gone up 2.8% over the last week. Slow recovery according to Redfin economist and thinks rates have likely peaked.
- Redfin Chief economist mentioned Nepo homebuyers due to affordability so they rely on family for help on the down payment.
- Don’t have enough to put money down, you’ll have a high monthly payment.
- Cash gifts are huge advantages.40% under 30 receive gifts or inheritance.
- New Zillow forecast has a sharp down revision. Lance Lambert tweeted- predicts US prices, measured by ZHVI, will fall -0.1% over the next 12 months. It was only 3 months ago, Zillow issued a bold 6.5% call.
- Orange- inventory up 1.1% in Oct but year to year down -35.5%; San Diego 8.6% and a year ago still down -31%, Los Angeles +7% and year ago-19%. Miami-Dade county up 7.3% and year ago still up 2.5%
- Moodys went negative. National fiscal strength in the government has fallen due to all the debt so they expect Congress not to be able to do anything until 2025. Down grade for next 18-24 months

A lot going on with the economy! Concern increases as treasury yields soar and mortgage rates rise to 8%!
The unknown of whether inflation will continue to increase. CPI increased 0.4% in September, and over the last 12 months it increased to 3.7%. Barry Sternlicht, billionaire of Starwood Capital, private equity firm- who specializes in real estate - sounded the alarms
MORTGAGE RATES
- Average mortgage rate for the last 3 months is about 7%
- There were 1.13M homes for sale at end of September, down more than 8% from a year ago (inventory)
- Lowest levels since Great Recession
Sales of previously owned homes in September dropped 15.4%, compared to September 2022. CA house payment risen 127% since right before pandemic, while house prices has rose 45%
- First time home buyers made up 27% of sales; All cash sales 29% - up from 27% in September and up from 22% in sept last year
- End of year is the best time to buy - less competition since buyers go on vacation and enjoy the holidays
- It is likely the Fed will not raise rates Nov. 1 - “our economy is resilient, unemployment is low and inflation is in check/sticky” - but rates are hanging high.
- Prices fell last year from June 2022 til Dec 22 due to rapid deterioration in home affordability because of higher mortgage rates that hit about 7.4% in Oct. Expected market time went up during this time as well.
- Right now about the avg. days on market is about 80 days, and buyers market is about 120 and more days.

NY Attorney General Letitia James is suing Trump through a civil lawsuit for inflating his (real estate) assets. Says he defrauded lenders, insurers, and others by lying about his wealth for the purpose of seeking favorable loan terms and insurance costs. The judge has sided with the AG saying there’s evidence Trump fraudulently inflated his net worth.
Trump and his attorney’s claim that the lawsuit has no standing because the entities Trump supposedly defrauded have never complained about their dealings to anyone and in fact have profited from working with him, and if this did have any standing the allegations are barred by statute of limitations (deadline for filing a lawsuit) and had asked the judge to throw out the case, arguing that there wasn’t any evidence the public was harmed.

Eli Beracha (instagram- / dreliberacha ) was quoted in “The Sun, New York” article about this topic where he said, “Appraisal values and market values are just not the same thing. It’s a well-known fact. That’s especially true for properties that are unique, and that’s very easy to argue this is a unique property. It is not the job of the county appraiser to assess value. If it was, we wouldn’t need Zillow.” End quote and may I also add, real estate agents among other technologies. “County officials like the ones in Palm Beach County that Judge Engoron cites, merely perform drive by appraisals that are used to assess taxes, not total value.”
- An appraisal that should be considered is by an actual real estate licensed appraiser that looks at comps in the area to determine the home’s actual value. An assessment is a measure of value that indicate how the property will be taxed by the state and local government. In addition, there would need to be a business broker of some sort or some type of entity to evaluate the value of the Mar-a-Lago private club business and the brand behind it which requires a whole other variety of variables besides looking at the financial statements.

- Federal Reserve Leave Fed Fund Rates Unchanged! The Federal Reserve chairman in late August said his plans is to hold interest rates steady but would consider raising rates if the economy doesn’t slow enough to keep inflation down.
- The fed raised rates in July by .25 pts so the fed funds rate now between 5.5% to 5.75% - July CPI 3.2% yearly, now at 3.7%, peak at 9.1% June 2022.
- Growth in economy has propelled yields on longer dated treasury yields to highest level in 15 years, pushing up costs on mortgages, auto loans and credit cards.
- Mortgage rates highest level since 2000 and applications for home purchases fell to their lowest level since ’95 (august)
- Housing market, low supply but high rates to affect demand.
- Baseball potential trades. Ohtani is injured and may leave the Angels? Ohtani leaving the Los Angeles Angels of Anaheim and stay in the West Coast? Certain baseball teams may work best for his cultural preferences.
- Nepo home buyers assisted with buying a home
- Gas prices and other things going up. Rates in the 7% range for over a month now, time will tell.

The real estate market has not only been tough for buyers/sellers but also for realtors. According to Tom Ferry, 60,000 realtors have quit since January 2023 to May 2023 and more will continue to quit.
Inflation is said to lessen in the US just as other countries are still suffering from rampant costs rising, due such things as the Ukraine war and among other variables.

Nationally home prices have softened about 3.2% from the peak, back in June 2022. For the 10 to 20 city indexes, its down 4.6% from the peak. More than overall nation. That’s the latest data provided since last month. For a specific city and/or neighborhood, reach out to Andrew Vargas to provide you the statistics and analysis.
There is a lot of progress right now with mortgage rates improving. As of right now and probably the next few months CPI will probably come down a bit more. CPI for the month of December came in at 6.5% which is a major improvement from the 9% figure earlier last year. Inflation cooling as of lately has helped keep mortgage rates lower.
A flood of homes hasn’t hit the market because it’s said in CA, about 89% of homeowners who have a loan are enjoying a fixed rate at or below 5%.

- House features that were in demand are no longer as popular because of the maintenance and installation costs, POOLS •National association of realtors-- Median home price across USA is up 3.5% In November from the year equating to $370,700 but prices soften month to month for the fifth time in a row

- Case Schiller Home Price Index showed prices fell 0.5% in October. Still up 9.2% yr yr. Pace appreciation decelerated was up 20.8% at peak in March. Prices declined about 3% across nation. 10-20 city index are down about 4.6% from the peak.
