When I first spoke with Alyson Seligman, I was struck by her incredible story of resilience and determination after being suddenly paralyzed thirteen years ago due to a rare, chronic condition. Not only did she overcome this challenge, but she now uses her voice to educate and empower others who may be dealing with similar invisible illnesses, as well as helping businesses create a more inclusive environment for employees with disabilities. In this episode, we have an eye-opening conversation about the importance of understanding and complying with the Americans with Disabilities Act (ADA) and how employers can better support their employees with invisible illnesses.

Throughout our discussion, Alyson shares valuable insights on the ADA's interactive process and the steps employees can take to request and receive the accommodations they need to thrive in the workplace. We also explore how employers, HR professionals, and coworkers can make a difference by fostering a welcoming and inclusive environment, providing reasonable accommodations, and avoiding judgment of those making requests for accommodations. Alyson's personal experience managing her invisible illness and working remotely offers a powerful perspective on the benefits and challenges of accommodating disabilities in the workplace.

Finally, Alyson provides practical tips for employers to engage in the interactive process effectively and shares information about her own speaking engagements. As a motivational speaker, Alyson is passionate about helping businesses and individuals create supportive cultures that empower employees with disabilities and invisible illnesses. So, give this episode a listen, and don't forget to rate and review the show to help us reach more listeners who are interested in creating a more inclusive workplace and complying with the Americans with Disabilities Act.

In this episode, you will hear about:

  • Navigating Invisible Illness
  • Accommodating Invisible Illnesses in the Workplace
  • Remote Work as a Reasonable Accommodation
  • Training Employers and Management Teams on the Americans with Disabilities Act

The Pregnant Workers Fairness Act (PWFA) is a new law that requires covered employers to provide “reasonable accommodations” to a worker’s known limitations related to pregnancy, childbirth, or related medical conditions, unless the accommodation will cause the employer an “undue hardship.”

Reasonable accommodations” are changes to the work environment or the way things are usually done at work.

The House Committee on Education and Labor Report on the PWFA provides several examples of possible reasonable accommodations including the ability to sit or drink water; receive closer parking; have flexible hours; receive appropriately sized uniforms and safety apparel; receive additional break time to use the bathroom, eat, and rest; take leave or time off to recover from childbirth; and be excused from strenuous activities and/or activities that involve exposure to compounds not safe for pregnancy. Employers are required to provide reasonable accommodations unless they would cause an “undue hardship” on the employer’s operations. An “undue hardship” is significant difficulty or expense for the employer.

The PWFA goes into effect on June 27, 2023.

Did you know the word “listen” contains the exact same letters as the word “silent?” Are you truly silent when listening, and if not, how does this affect your ability to lead others in the workplace?

This week on the podcast, I had a fun and informative conversation with Miriam Meima of 2M Leaders about Stephen Covey’s Five Levels of Listening, as applied to the workplace. Miriam tells us that most people are at a level three of listening (at best), but we should strive to be at a level five.

In this episode we discuss the following:

[4:39] What communications you are missing when you aren’t fully listening

[4:55]: How to avoid unnecessarily escalating issues to HR through active listening

[10:38] How people “trip” into ignoring someone at work

[13:14] How to know if you are a “pretend” listener and how this effects other’s perception of you as a leader

[18:52]: How to know if you’ve reached “true listening”

The war for talent is more competitive than ever before. How do you determine the “market rate” for workers, and how do you attract and retain a team without burning more cash than necessary? Most organizations just guess, or use a limited set of data points. Others ask their HR leaders to benchmark compensation. However, many HR professionals don’t have expertise in this area, and may not even know where to get started.

In this episode, my guest, Andrew Bartlow and I are talking about how HR and businesses can develop a compensation philosophy, understand pay transparency tradeoffs, determining market rate and accelerate their efforts in this critical area to support your business.

Here are the timestamps for this episode:

[6:40]: Finding the “Goldilocks zone” and why pay transparency can be a double edge sword.

[10:40] What should employers share with employees to create pay transparency

[13:00] what is distracting to employees when disclosing benchmarking data

[17:05] How companies can begin the benchmarking process

[21:05]: How to match your organization’s jobs with benchmarking data

Artificial Intelligence can be used to streamline the various processes used in the recruiting and hiring process. There are many benefits including a reduction of time for all parties involved, as well as a decrease in expense, greater efficiency and overall standardization of the hiring process. However, there is a concern that the information inputted into the system may have the opposite of the intended effect, and rather than standardize the process, may overly limit or even disqualify members of a protected class. This creates potential liability and risk for the employer.

in the episode, I discuss the use of artificial intelligence in the workplace, and best practices to help ensure compliance with the law.

I have litigated many employment lawsuits over the years and can typically pin point the reason why the employee decided to sue the employer, rather than just moving on. Here are the top reasons why:

  1. The employee was terminated but wasn't aware he was doing a bad job at work.
  2. Employee didn't know why he was fired
  3. Employer gave a negative reference to the new prospective employer
  4. Other people did the same things and got away with it
  5. Toxic managers
  6. The employee was forced to quit because of the toxic environment
  7. Things changed after they complained to HR.

Listen to the episode and let me know what you think.

There are approximately 60 million full time workers in the US who have the ability to work remotely. 30% of those workers report that they NEVER want to return to in person work again. Allowing employees to work remotely has so many benefits, but how can a company effectively engage remote workers so they don’t get “overlooked” online.

My guest this week is Tom Ziglar, CEO of Ziglar, Inc. an executive coaching and leadership company that has motivated and inspired more than 250 million people worldwide.

Tom Ziglar has dedicated his career to developing coaches and leaders so they can effectively coach their own team towards internal motivation. In this episode, Tom and I discuss the various ways to effectively lead a remote team. Listen as Tom explains that, in order for leaders to effectively lead, they need to choreograph the dance between flexibility and autonomy.

In this episode, we discuss,

The importance of a leadership mindset shift when leading a remote team

(1) Why top down management doesn’t work

(2) Why the Navy Seal Mission is important

(3) why T-Rex managers are extinct

(4) The top three things need to retain high level employees

(5) The importance of knowing your team’s personal goals

(6) The importance of a remote first policy

(7) How to address the lack of in person and interaction with remote work

(8) How to execute a one on one intentional weekly conversation with your remote team

In this episode, we will discuss termination of employees. Employees my be hired with the best intentions for the work relationship to work out. However, sometimes the relationship breaks down, and the employer and employee need to part ways. If the employer determines it must fire an employee, can it give a vague reason, such as "its not working out" or does the employer need to give the reason for the termination? HINT: The answer to this question, and my recommendations for best practices (in certain situations) are different.

The onboarding process is very important for several reasons. First, it’s one of the first impressions the company will make on the new hire.

The systems, processes, how he/she is introduced to the day to day of what he/she will be doing. If the first impression is chaos, confusion, overwhelm, this is how the employee will perceive that the entire company is run. In comparison, if the employee is met with a warm welcome, properly intrude to the processes and systems, and has a chance to experience the culture, he/she will feel better about the decision to join the company. In the long run, this will serve to Limit overwhelm and reinforce the clear expectations and improved retention rates.

In this episode, we will discuss:

  1. Automations
  2. New hire paperwork
  3. The first day of work
  4. Key employment policies
  5. Follow up

Are you interested in scaling your business by hiring? Do you know the steps you need to take to hire your first employee? After the interview, the offer letter is potentially the next major interaction a prospective employee may have with your business. Offer letters are important for legal purposes and to prevent litigation. Many states have at-will employment, so there may not necessarily be a contract at the time of hire. However, for at will employment states, there should be an offer letter.

In this podcast episode, we are discussing the dos and don’ts of offer letters. I discuss what should be included, and what you should not include. For example, include specifics like start date, rate of pay (include hourly or annual salary) and when bonus or commission will be paid. You will also want to include that the employment is at will. A few things you want to keep out are verbiage that mentions the duration of the job or what constitutes grounds for termination, as this may inadvertently create a contract in an otherwise at will state.

What do businesses needs to look out for in terms of employment laws in 2022? In this episode, we are discussing the top employment law areas for 2022. There were a lot of changes with the pandemic, whether employers had to require certain protective measures, allow employees to work from home or require vaccines. Even though compliance with employment issues surrounding the pandemic is important, it is key to keep a pulse on the other more common everyday areas.

Knowing what is ahead can help you plan the areas you need to watch out for, and keep an eye on. Here is what we discuss:

  1. [3:50] Work from home requests disguised as request for an accommodation based on a medical condition.
  2. [6:35] Online Harassment - employees may be less professional when communication is online, which may lead to more harassment type claims
  3. [7:46] Wage and Hour Issues - improper time keeping; contacting employees after hours by text/phone; employees arriving to work late

Cannabis is currently illegal at the federal level, but over half the states have a comprehensive medical marijuana program and others allow for recreational use (as of the date of this recording.) Due to the constant change of the law in this area, employers have many unanswered questions about what is and is not permitted relative to cannabis in the workplace.

My guest this week is Rachael Ardanuy, Denver-based Cannabis Business attorney and founder of a boutique law firm specializing in cannabis law for businesses. Rachael has dedicated her career to advising, educating and advocating for entrepreneurs, business owners and other cannabis industry participants.

Listen as we discuss the current state of the law, areas where employers need to proceed with caution, and best practices for business moving forward.

In the episode, we discuss the following:

  1. Can Employers fire someone for marijuana use?
  2. What happens when a new hire tests positive on a drug test?
  3. Will Employers be liable for discrimination if I terminate an employee who fails a drug test?

Who knew you could have so much fun taking about tax and remote employees? Tax attorney, Jamie Szal explains the various tax implications for employers with remote employees during and after the pandemic. During the pandemic, states treated business with remote employees differently for tax purposes. For example, some states took a hard line approach and announced the pandemic-necessitated remote working created nexus for the employer for all purposes, while some states announced they would not enforce nexus against out of state companies by virtue of the pandemic-related in-state presence of telecommuting employees.

If your business has employees working outside of the state in which the company does business, it is important to determine what state the employee is actually working in, as there may be additional tax considerations. Some states have allowed a waiver period, and some did not. Some states have allowed a transition period, and some have not. In addition to identifying where the businesses employees were located during the pandemic, businesses should also take proactive steps to determine if it will allow its employees to continue working remotely going forward relative to tax and other compliance issues.

TAKEAWAYSNow is the time to engage in strategic planning business considerations. Businesses who have not already don't so need to determine:

  1. Where the employees have actually been working throughout the pandemic.
  2. Will the business continue to allow a remote or hybrid workforce.
  3. Where the businesses' employees will be working in September 2021.
  4. What are the going-forward tax implications of the work environment.
  5. Will the business hire remote employees.

Here is a very common scenario: Your company conducts an annual or monthly performance evaluation. There is one employee who believes you are “targeting” him or picking on him or holding him to a higher standard because of a protected class.

Despite the employers best efforts to implement a fair evaluation system and ensure that managers apply performance standards consistently, employees may complain that their evaluations were unfair or inaccurate for discriminatory reasons.

This actually happens all the time, and is a tricky situation. Listen for more information on how the employer can conduct a proper investigation and take steps to help ensure proper protection.

The discrimination and retaliation laws protect job candidates at the time of the interview, and even if the person is not hired. Therefore, it is important that employers and hiring managers stay away from asking questions during an interview that may be deemed discriminatory. Many of these questions may seem innocent and might be asked in order to get to know the applicant and build rapport. However, these questions could land your company in trouble. This week’s episode discusses what you should not say during an interview. Listen in and let me know which one resonated with you the most.
