INSOL Talks offers a unique opportunity to listen to and to learn from leading insolvency and restructuring law scholars and practitioners from around the world. Each episode explores the stories, tools and methods of today’s top thinkers. Eager to become better in what you do? Tune in! INSOL Talks is presented by INSOL International. The interviews are conducted by members of the INSOL ERA sub-committee. INSOL ERA (Early Research Academics) brings together postgraduate students and early career researchers interested in insolvency law.
In this episode we talk to Christoph Paulus, Of Counsel, White & Case, Germany, and Francisco Garcimartin, Autonomous University of Madrid, Spain, about the recent developments in EU insolvency law and specifically the proposals for the 28th insolvency law regime. The issue of the EU falling behind the US and China in competitiveness has sparked a strong push for ambitious policy responses, including proposals for the new unified 28th regime.

Insolvency law plays a crucial role in the economy, facilitating the rescue of economically viable enterprises while promoting the value-preserving liquidation of non-viable firms. In his recent book titled ‘Reinventing Insolvency Law in Emerging Economies’ (CUP 2024), Professor Aurelio Gurrea-Martínez, Singapore Management University, observes that many emerging markets and developing economies lack efficient insolvency frameworks. He argues that “the failure of insolvency law in many emerging economies is mainly due to the design of an insolvency legislation that is not tailored to the market and institutional environment generally existing in emerging economies.” The book ultimately proposes that insolvency law needs to be ‘reinvented’ in emerging economies.
