Free Speech vs Hate Speech

  • 1st amendment
  • Hate Speech: abusive or threatening speech or writing that expresses prejudice against a particular group, especially on the basis of race, religion, or sexual orientation.
  • Freedom Of Speech: the right to express any opinions without censorship or restraint.
  • “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”
  • The U.S. Supreme Court has repeatedly ruled that hate speech is legally protected free speech under the First Amendment. The most recent Supreme Court case on the issue was in 2017, when the justices unanimously reaffirmed that there is effectively no "hate speech" exception to the free speech rights protected by the First Amendment.
  • Freedom of expression is recognized as a human right under article 19 of the Universal Declaration of Human Rights (UDHR) and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). Article 19 of the UDHR states that "everyone shall have the right to hold opinions without interference" and "everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice". The version of Article 19 in the ICCPR later amends this by stating that the exercise of these rights carries "special duties and responsibilities" and may "therefore be subject to certain restrictions" when necessary "[f]or respect of the rights or reputation of others" or "[f]or the protection of national security or of public order (order public), or of public health or morals".[3
  • Categories of speech that are given lesser or no protection by the First Amendment include obscenity (as determined by the Miller test), fraud, child pornography, speech integral to illegal conduct,[10] speech that incites imminent lawless action, and regulation of commercial speech such as advertising. Within these limited areas, other limitations on free speech balance rights to free speech and other rights, such as rights for authors over their works (copyright), protection from imminent or potential violence against particular persons, restrictions on the use of untruths to harm others (slander and libel), and communications while a person is in prison. When a speech restriction is challenged in court, it is presumed invalid and the government bears the burden of convincing the court that the restriction is constitutional.’

  • On Dec. 31, the government in Wuhan, China, confirmed that health authorities were treating dozens of cases of pneumonia of unknown cause.
  • On January 11 2019, a 61 year old man died from the virus in Wuhan. He was the first person to die from the 2019 novel coronavirus. He was a regular customer at the market in which the virus originated.
  • The United States, Japan, South Korea, and Thailand all confirmed cases of the Coronavirus on January 20th. These were the first cases of the virus outside of mainland china.
  • On Jan. 23, Chinese authorities closed off Wuhan, a city of more than 11 million, by canceling planes and trains leaving the city, and suspending buses, subways and ferries within it. At this point in time , at least 17 people had died and more than 570 others had been infected
  • The World Health Organization officially declared the 2019 novel coronavirus a public health emergency of international concern on January 30.
  • On Jan. 31, Delta Air Lines, American Airlines and United Airlines said they would suspend service, for at least two months, between the United States and mainland China. The Trump administration said it would suspend entry into the United States by any foreign nationals who had traveled to China in the last 14 days, which is the maximum time it takes a person to become sick after being exposed to the virus. By this date, 213 people had died and nearly 9,800 had been infected worldwide.
  • Dr. Li Wenliang, a Chinese doctor, died on February 7 after contracting the coronavirus. He was deemed a hero after raising alarm early on that the virus could spread quickly and easily and spin out of control. However, Chinese authorities silenced him and forced him to sign a legal agreement denouncing his warning as an unfounded and illegal rumor. Dr. Li’s death provoked anger and frustration at how the Chinese government mishandled the situation by not sharing information earlier and by silencing whistle-blowers.
  • Chinese officials said the death toll had reached 1,016 while the number of infections had grown to 42,638 on Feb. 11.
  • After widespread public outrage, the Communist Party in China fired top government officials in Hubei province and Wuhan.
