The family of a 3-year-old New Jersey child who was severely burned in 2018 when a cup of hot water was knocked over by a convenience store clerk as her mother was paying for her purchases has reached a $3 million settlement with the Wawa store chain.
The child and her mother were in a Wawa store in Neptune, N.J., on April 25, 2018, when the clerk accidentally knocked over one of two cups of hot water, which dislodged the cup’s lid and spilled its hot contents onto the little girl, according to an April 20 story in the New Jersey Law Journal.
Hot water from the overturned cup splashed all over the child’s upper body, arms and torso, causing second- and third-degree burns over 15% of her body, the story reported.
In a lawsuit filed against Wawa, the girl’s mother, Roya Konzman, alleged that the hot water was dispensed from a hot tea machine in the store at a temperature hotter than necessary, which contributed to her daughter’s injuries, according to the story. Konzman also sought compensation for emotional distress due to witnessing her daughter’s injuries to her daughter and for the pain and suffering they caused.
“The suit claimed the hot water, which came from a Cecilware water dispensing machine, was dispensed at a dangerous temperature that would immediately cause burns if spilled on flesh,” the story reported. “The suit claimed Wawa knew of the hazard and acted with disregard for the safety of its customers.”
The settlement was approved by U.S. Magistrate Judge Tonianne Bongiovanni on March 30, including $2,550,000 to the child, which is to be split between a support trust and a structured settlement annuity, and another $450,000 to her mother, the story reported.

Two New Jersey motorists who were seriously hurt when the vehicle they were riding in on the New Jersey Turnpike in 2017 was struck by a Lakeland Bus Lines motor coach have reached a $2.4 million settlement with the bus company.
The couple, Victor Ibanez, then 42, and Danet Ibanez, then 35, were heading south at mile marker 107.3 in Essex, N.J., toward Newark on Aug. 22, 2017, when the bus crossed two lanes of traffic from the right lane of the highway and struck the Ibanez vehicle, according to a Feb. 13 story on Newsarchyuk.com.
The crash pushed the Ibanez vehicle into the highway median. The bus was being driven by Lakeland Bus Lines driver Jose Hurtado.
Victor Ibanez suffered injuries that required a two-level spinal fusion at the cervical level, while Danet Ibanez underwent a one-level fusion and a one-level laminectomy, both at the lumbar and left knee arthroscopy, according to the story. They both underwent treatment and were eventually able to return to their jobs, he as an independent flooring contractor and she as a controller.
The couple’s lawsuit alleged negligence by Hurtado and the bus company. “Hurtado said the steering on the bus worked poorly, causing him to lose control,” though there was no evidence presented to prove the assertion, the story reported.
The lawsuit was settled Jan. 28 after mediation sessions when the bus company agreed to make the payment.

An Illinois woman who suffered permanent life-altering injuries when the car she was driving in November 2017 in Oak Brook, Ill., was struck by a vehicle speeding at 98 mph will receive an $8.1 million settlement to help provide her long-term care.
The victim, Annette Kimmons, was driving her car when it was struck in an intersection by a vehicle being driven by Paul J. Murtagh, who ran a red light while traveling at high speed, according to a Feb. 25 story by the Chicago Law Bulletin. Kimmons’ husband, Eugene, was a passenger in the car she was driving.
Murtagh’s speeding vehicle also struck a second car in the intersection at the same time, killing the driver of the second vehicle, Tien Chen, who was 84 years old, according to the story. That consolidated case was recently settled for $3.2 million after Chen’s son, Thomas Chen, sued on his family’s behalf. The cases were consolidated in June 2018.
“Murtagh was transporting display booth materials to the Illinois Tollway Authority conference in Oak Brook on behalf of his employer, the Construction Business Development Center at Prairie State College,” the story reported. He was registered to attend the conference.
Following the crash, Murtagh’s vehicle landed on top of the vehicles being driven by Kimmons and Chen. An analysis of the crash determined that Murtagh was driving at 98 mph at the time.
Annette Kimmons’ injuries included a C1-C2 joint dislocation and spinal cord injury, broken ribs, lacerations to her liver and one of her adrenal glands and a traumatic brain injury, according to the story. Eugene Kimmons suffered back and chest wall pain from the crash, but had no broken bones.
Annette Kimmons’ injuries were permanent and life-altering injuries,” according to one of her attorneys.
In his defense, Murtagh “asserted an Act of God defense, claiming he suffered an ‘unforeseeable and unpreventable’ blackout due to his low blood sugar,” the story reported. Court records and testimony, however, indicated that his endocrinologist had previously instructed him to check his blood sugar three times a day and before he got behind the wheel each time, but that Murtagh hadn’t checked his blood sugar for three days prior to the crash. Murtagh had been diagnosed with diabetes at age 3.
Prairie State College contended that Murtagh was not acting in the scope of his employment at the time of the incident, the story reported.

The family of a 20-year-old father of two children will receive a $1 million settlement after he was killed in 2018 when his car was T-boned by a drunk driver who had just left a bar in Scranton, Pennsylvania.
The victim, Robert Ortiz, died when his car was struck at the intersection of Breck Street and Pittston Avenue in Scranton early on the morning of April 6, 2018, by a car being driven by Noah Cohen, who had a blood alcohol level that was more than three times the legal limit, according to a March 31 story by PAHomepage news.
Cohen had left the nearby Levels Bar & Grill at 519 Linden Street minutes before the crash and was speeding down Pittstown Avenue when he T-boned Ortiz’s vehicle on the driver’s side, causing Ortiz to be ejected from the vehicle and suffer fatal injuries, the story reported. Cohen had a blood alcohol content of .25% at the time of the crash. He later pleaded guilty to DUI and reckless endangerment and was sentenced to five to ten years in prison in May 2018.
Ortiz’s mother, Anna Ortiz, filed a lawsuit against Cohen and the Levels bar that served him before the crash that killed her son, according to a March 30 story by The (Scranton) Times-Tribune.
Cohen’s car was speeding down the street in excess of 85 mph when it ran a red light and struck Ortiz’s car, the story reported. The speed limit on the street was posted at 25 mph.
Under the settlement, $950,000 will be paid by Levels to the Ortiz family by its insurance company, while the remaining $50,000 will be paid by Geico to settle auto insurance claims, the story continued. The money will be paid by the bar in a structured settlement for the benefit of Ortiz’s two children, ages 1 and 4, according to filings in Lackawanna County Court. The youngest child was born one week after Ortiz died in the crash.

Owners of General Motors cars and trucks who claimed their vehicles lost resale value because they were built using defective ignition switches that lead to the deaths of at least 124 motorists since 2004 will be eligible to receive a slice of a new $120 million settlement just reached with the automaker.
The preliminary settlement, which still requires court approval, resolves the last major piece of litigation related to a series of deaths and resulting lawsuits from ignition switches used in GM vehicles that could turn themselves off, causing the vehicles to shut down and the airbags to be turned off, according to a March 27 story by Reuters. GM denied liability in the cases but agreed to settle the matter, court papers revealed.
More than 2.6 million GM vehicles have been recalled by the automaker since 2014 over the switches, which included vehicles dating back more than a decade earlier. GM also had to pay more than $2.6 billion in penalties and settlements in the cases, including $900 million to settle a U.S. Department of Justice criminal case, the story continued.
The latest settlement is meant to specifically resolve claims by GM vehicle owners who said they “suffered economic losses from buying vehicles they thought were defect-free, only to see the ignition switch problem hurt GM’s brand, reputation and resale values,” the story reported. About $70 million of the settlement will come from GM, with the other $50 million coming from a trust that was set up in connection with the Detroit-based automaker’s 2009 bankruptcy, according to Reuters. GM will also pay some $34.5 million to cover legal fees and expenses of lawyers for the vehicle owners.
About 216 plaintiffs were named in the settlement, according to a March 28 report by Car & Driver magazine. The settlement for vehicle lost value, however, is much lower than what plaintiff’s lawyers expected when the class action lawsuit was filed in 2014, the story reported. GM covered up the ignition-switch defect for 13 years, according to Car & Driver, and eventually and secretly redesigned the switch without changing the part number. The original, defective switches were “manufactured with torque thresholds that were low enough that the key could slip out of the run position, thereby disabling the engine, power assists, and safety features that included airbags,” the story continued.

We are, however, 100% operational. MyPhillyLawyer is continuing to sign new clients remotely, and we are continuing to work tirelessly and advocating on behalf of our current clients. I’ve been working from home as has my entire staff of lawyers, paralegals and support workers.
In preparation for such an event, our offices are 100% cloud-based, which was set up long ago to ensure that we would be able to stay in operation during any kind of emergency disruption, whether caused by severe weather or any other circumstances.
We are still at work, remotely, speaking with clients who are concerned about their cases, continuing to speak with insurance companies about potential settlements and doing everything we can on behalf of our clients every day. As the managing partner of MyPhillyLawyer, I am continuing to call and speak with insurance company representatives every today and am communicating those discussions with our clients.
We look forward to getting through the current coronavirus emergency together and once again getting back to our personal meetings with clients, and to our core business of representing you in person, in court and in other legal proceedings.
This truly is an unprecedented time in our history, when life as we know it is seemingly under attack.
Yet at the same time, we are buoyed by the everyday heroes who are helping us all get through this crisis – from the doctors and nurses who are treating patients, to hospital staffers and janitors and equipment technicians who are continuing to keep operations going, to emergency responders in our communities who are caring for patients and residents in their communities.

Then there are the everyday heroes we maybe didn’t even see in that way a few months ago – the grocery store workers who continue to stock shelves and run checkout lines and the truck drivers who are continuing to move food and groceries, medical supplies and a wide range of other critical supplies to where they need to go across our communities and our nation.
There are farmers and farm workers, including migrant workers, who are continuing to raise and harvest and transport crops, as well as restaurant workers who are continuing to go to work to cook and prepare take-out meals for residents in their communities who are trying to give those establishments some business so they can survive this crisis. There are the food delivery drivers who are still heading out to pick up and deliver those food orders, even when others just want to stay safe in their homes at this point.
Then there are our mail carriers, our package delivery people, our utility workers from electric companies to gas companies to cable TV providers, our car and truck mechanics, our road crews, our mass transit drivers and operators, and many others who are all continuing to go to work at some risk to ensure that we will all as a society get through these frightening and uncertain times with some semblance of normalcy.
Here at MyPhillyLawyer, we have been witnessing the bravery, selflessness and dedication of all these vital people in our communities, these oft-unnoticed heroes, and we salute each and every one of them. They are the heroes who are helping to keep us all safer as we go through these experiences together.
They are the epitome of the American spirit and we could not win this battle against the COVID-19 coronavirus without them.
So, please stay in, stay safe, practice social distancing and please wash your hands with plenty of soap and water for at least 20 seconds using warm or hot water as often as possible when at home or when you have to go out for groceries, prescriptions or doctor’s visits. Remember to sing the Happy Birthday song twice as you wash and scrub ad soap up your hands – that will let you know you have washed for the full 20 seconds at least.
Better safe than sorry, my friends. We can get through this together even if we temporarily have to be apart.
