Following the recent announcement of new OFAC General Licenses that allow for expanded humanitarian relief work in many high-risk jurisdictions, this episode will dig into what grantmakers need to know about the changes and how it will affect grants made to those countries. This podcast reviews the 5 important changes that have been made to India's FCRA law as a result of the September 28, 2020 Amendment. CAF America will review the new prohibition on Indian nonprofits re-granting funds received from foreign donors to other FCRA registered nonprofits. The Amendment reduces the cap on the use of foreign funds for administrative expenditure to a maximum 20%, requires Indian nonprofits wishing to receive foreign funds to open an FCRA Bank Account with State Bank of India, it grants the power to FCRA to freeze the funds in the FCRA bank account in case of non-compliance with the FCRA requirements, and enables the Ministry of Home Affairs to suspend FCRA registration of an organization for more than 6 months. Also, the provisions of the Amendment state that renewal of the FCRA license will happen every six months provided the applicant is not fictitious, not convicted for triggering communal tension, and not guilty of diversion of funds.
These provisions will greatly impact cross-border giving to India. CAF America is committed to keeping abreast of the changing regulatory environment and to maintaining full legal compliance within Indian laws.

Some employees have found themselves suddenly jobless or temporarily living with drastically-reduced wages, whereas others are left figuring out how to care for their children or elderly parents.
Our special guests will help listeners learn how Employee relief funds (ERFs) can provide immediate charitable support to employees and their dependents who are facing financial difficulties because of personal hardship or disaster. However, these programs are complex to design and manage, attention to detail is key to regulatory compliance. CAF America President & CEO Ted Hart and his guest expert David Shevlin, Partner at Simpson Thacher, discuss the new charitable giving rules that became law as part of The Coronavirus Aid, Relief and Economic Security (CARES) Act. The $2 trillion coronavirus stimulus bill includes provisions meant to encourage Americans to donate to charity. The move is meant to encourage additional contributions to the nonprofit sector, which is the third-largest industry in the country. Four specific provisions of the CARES Act will be discussed on this podcast, each provides incentives for individuals, families and corporations to give, but to receive the associated tax benefits, the new rules must be followed. Listeners will learn the steps necessary to qualify for the new "universal deduction", learn how those who itemize their deductions, can take the new 100% deduction off their adjusted gross income, learn how donor-advised funds are implicated in the new rules and how charitable contributions for corporations, that make cash contributions in 2020, can deduct 25% taxable income (up from 10%).

On January 1, 2017, the “Law of the People’s Republic of China on Administration of Activities of Overseas Nongovernmental Organizations in the Mainland of China” (colloquially known as “China’s Overseas NGO Management Law”) went into effect. The law requires that foreign NGOs coordinate their efforts with the Ministry of Public Security (MPS) and provides the framework within which they can continue their activities in the country: (1) opening an office in China, or (2) applying for a temporary activity license.
Earlier this year there was a general initial wave of confusion due to the lack of clarity and guidance on the implementation of the law, as the year progressed the Chinese government provided additional guidance. It is because of the complexity of this matter, and persistent concerns regarding regulatory compliance that we are producing this education program. CAF America helps grantmakers and philanthropists translate into practice the proper way to reach regulatory compliance when granting to charitable organizations and projects in China.

New IRS guidelines took effect on September 14, 2017. What do they mean? What do you need to know?
In Rev. Proc. 2017-53, the IRS has provided guidelines that CAF America will use in our grantmaking to foreign grantees utilizing equivalency determination protocols that the grantee of a grant made for Code Sec. 170(c)(2)(B) purposes is a qualifying public charity.
In this program CAF America's President and CEO, Ted Hart and Elizabeth Kingsley of Harmon Curran Spielberg & Eisenberg LLP will provide expert analysis and practical advice on implementation of these new guidelines.
Rev. Proc. 2017-53 provides further guidance regarding what it means to makes a “good faith determination” that a foreign grantee qualifies as a qualifying public charity (as defined in section 3.03(3) of this revenue procedure). These procedures validate many aspects of what CAF America has long determined to be best practices in our industry leading validation of foreign grantees. In this program we will share with you what is new and what you need to know about what a strong ED or Equivalency Determination should review and what information must be properly evaluated by qualified professionals. This NEW revenue procedure modifies and supersedes Rev. Proc. 92-94, 1992-2 C.B. 507 and reflects the changes to the equivalency determination final regulations published in 2015 (TD 9740; 80 FR 57709; 2015-42 IRB 573). This revenue procedure also reflects the changes to the public support tests and applies these changes in the context of equivalency determinations. In addition, this revenue procedure includes other updates and changes related to the funding of Terrorist organizations and blocked persons, Hospitals, Religious based schools, as well as changes in the review of lobbying and advocacy efforts of foreign grantees, and many other changes which we will share in this program.

Prior to joining the CAFAmerica staff, Jessie worked for over a year as a volunteer visitor coordinator, tutor, and child caretaker at an orphanage in Tegucigalpa, Honduras. As the visitor coordinator, she successfully coordinated several orthopedic surgical brigades that serviced the home and the surrounding communities.
