The language of the 5th Amendment is unambiguous: [“Nor] shall any person be subject for the same offence to be twice put in jeopardy of life or limb..." Any means any. You can pick any person in America at random, and that individual cannot be tried twice for the same crime, no matter who is doing the prosecuting. If the state tries you and acquits you, the federal government does not get a second bite at the apple. Yesterday the Supreme Court turned the Constitution inside and said, no, you can be tried twice for exactly the same offense. The Constitution? Fuhgeddabout it. 2374 years ago Demosthenes said, "the law forbids the same man to be tried twice on the same issue." He was right then, and he’s still right. Shame on the Supreme Court.
