A recent court ruling has halted the Department of Labor's proposed salary threshold increase for Fair Labor Standards Act exemptions.
On November 15, 2024, a Texas federal judge invalidated the plan, which aimed to raise the minimum salary for exempt salaried workers from $35,568 to $58,656 starting January 1, 2025. As a result, the current minimum salary of $35,568 remains in effect.
Employers who have already adjusted salaries in anticipation of the change are advised to maintain their current pay structures but should weigh potential legal and morale implications before making any reversals.

It's a hard truth many leaders face: People learn best from their mistakes. However, if you're always stepping in to save the day, your team won't learn how to troubleshoot effectively. This not only leaves you overwhelmed and frustrated but also sends a message that you don't trust or value your team. Leaders must stand up for themselves and their teams, and sometimes that might mean allowing your people to make mistakes that will teach them valuable lessons.
When employees fear making mistakes, they might hide them, try to fix them without your knowledge, or worse, quit. Each of these actions can lead to poor work quality, low morale, and high turnover, which is costly and time-consuming. Remember, high turnover often reflects poorly on the manager, not just the company.
A Gallup survey showed that half of the employees left a job to escape their manager, yet this same group felt engaged when they could approach their manager with any question.
So, what does it mean to be truly engaged at work? It means employees understand the manager's goals and the department's vision. They might not agree with every decision, but they trust in the leadership's due diligence. Unfortunately, 60% to 70% of employees are not engaged, with only about 30% feeling fully engaged, according to various data.
This brings us to the core issue: Engagement flows from the top. As a leader, it's your responsibility to ensure that information cascades properly to every level of staff.
If you're finding management challenging, you're not alone. It's a complex task dealing with unique humans. But remember, one person can make a difference, and that person could be you. You can start by fostering an environment where mistakes are openly discussed and learned from. Schedule regular meetings where teams can share lessons learned without fear. PS: The day that we released this podcast, a federal judge in Texas on Tuesday barred a US Federal Trade Commission rule from taking effect that would ban employers from requiring their workers to sign non-compete agreements. So f you were preparing to comply with the FTC’s ban by the September 4th deadline, you can now put those plans on hold. It’s likely that the 5th Circuit Court of Appeals or even the Supreme Court will have the final say, but given their current makeup, the outcome probably won’t change.
However, the issue of non-compete agreements isn’t going away.Why? Several states already ban them for all employment, and many others (plus D.C.) have restrictions based on income. But for now, any attempts to eliminate all non-competes through administrative action are effectively dead.Wendy and JC as they dive into the hot topic of non-compete agreements. In this episode, they discuss the latest updates from the U.S. Federal Trade Commission (FTC), which issued a regulation banning most non-compete agreements effective September 4, 2024.

Wendy Sellers speaks urgently about the shifting laws regarding independent contractors. This change is set to take full effect in March 2024, replacing the existing rules established in 2021. This mandate prompts employers to pay close attention to their current contractors on their "payroll" or "books". Violating these new laws, either deliberate or accidental, could lead to serious penalties such as fines, imprisonment, or wage-related obligations of exceptional amounts.
Moving forward, these new rules will apply the economic reality test using six factors to distinguish whether someone is an independent contractor or a W-2 employee.
The factors to consider include the role of the individual service to the business, the contractor's investment in facilities and equipment, the nature and degree of control by the employer or contractor, opportunities for profit and loss, initiative with judgement or foresight for success, and lastly, the persistence of the relationship.
A violation identified as willful or intentional may extend the two-year statute of limitations for making amendments to three years.

On March 11, 2024, the 2021 Independent Contractor Rule ends, and the FLSA Rules Change, making it more challenging to classify individuals as contractors.

The Department of Labor's Application of the Economic Reality Test(1) the extent to which the services in question are an integral part of the `employer[']s' business;
(2) the amount of the so-called `contractor's' investment in facilities and equipment;
(3) the nature and degree of control by the principal;
(4) opportunities for profit and loss; . . .
(5) the amount of initiative judgment or foresight required for the success of the claimed independent enterprise[;] and
[(6)] permanency of the relation.”
The guidance cautioned that no single factor is controlling, and “ordinarily a definite decision as to whether one is an employee or an independent contractor under the [FLSA] cannot be made in the absence of evidence as to [the worker's] actual day-to-day working relationship with [their] principal. Clearly a written contract does not always reflect the true situation.”
