Taxpayer dollars should not be funding abortion clinics.

This morning, Nebraska Family Alliance joined Governor Jim Pillen and Attorney General Mike Hilgers for a press conference announcing that Nebraska’s Medicaid funds will no longer be used to reimburse or contract with abortion providers.

While state and federal law prohibit tax dollars from directly financing abortion procedures, millions of taxpayer dollars have continued to subsidize Planned Parenthood and the abortion industry through the Medicaid program.

That ends today. A historic executive order signed by Governor Pillen immediately defunded abortion providers, finally stripping them of all Medicaid funds.

Today’s executive order is a direct response to a recent U.S. Supreme Court ruling in Medina v. Planned Parenthood, a case NFA cosigned an amicus brief for and has been closely following, allowing states to defund abortion providers of Medicaid funding.

Nebraska is among the first states to act in the wake of this landmark decision. We applaud Governor Pillen and Attorney General Hilgers for their unwavering, pro-life leadership in protecting life and upholding our state’s pro-life values.

The Nebraska Department of Health and Human Services (DHHS) recently released its annual report on abortions in Nebraska for 2024.

These sobering reports aren’t just numbers and statistics; they represent real people—mothers facing unexpected pregnancies, fathers who will never know their child, and precious boys and girls who were never born. The data provides tangible ways we can strengthen our pro-life protections, provide greater safeguards for women, and advance a culture of life.

In 2024, there were 2,501 reported abortions in Nebraska. Of those, more than 85% were performed on babies conceived out of wedlock. God’s design for marriage and the family is essential for a healthy, flourishing society, and when society rejects God’s blueprint and embraces a culture that devalues parenthood and commitment, the consequences are clear.

The abortion industry sells abortion as “healthcare,” but in 2024, 92% of reported abortions were elective for non-medical reasons, with 42% of women citing financial or social pressure. This isn’t healthcare—it’s a crisis of support, family, and community.

That’s why the work of Pregnancy Help Organizations is essential. They step into the gap with free pregnancy tests, ultrasounds, baby supplies, counseling, and compassionate, life-affirming care. These organizations don’t just provide women with practical support and resources—they offer hope and empower women.

At the same time, ongoing dysfunction, staffing issues, and unsafe conditions at abortion facilities in Nebraska have led to an increase in chemical abortions. 81% of abortions in 2024 in Nebraska were chemical, and a recent study revealed that complications from the chemical abortion pill are 22 times higher than reported on FDA drug labels.

WHAT’S NEXTNothing will change unless we make change.

Our state must enact LB 512, the Chemical Abortion Safety Protocol Act, to establish common-sense protocols for dangerous abortion-inducing drugs to protect the health and safety of women. Key pro-life legislation, such as LB 513, ensures that students receive scientific, factual instruction on when life begins, from fertilization through each stage of human development.

Moving forward, we remain committed to finding effective ways to combat the lies of the abortion industry, support and care for vulnerable women, and promote a Biblical worldview for life, marriage, and family.

Dear Members of Congress,

In November, the American people gave a mandate – it is time for change in Washington. Since then, the White House is taking swift action to stop the Biden abortion agenda and cut government waste. A Republican trifecta presents the opportunity to bolster these efforts by cutting funding for Big Abortion, including Planned Parenthood, through budget reconciliation.

Republican reconciliation bills in 2015 and 2017 included a provision to stop giving hard-earned American tax dollars to Big Abortion. In 2025 it is even more urgent to cut funding for this industry that endangers women and unborn children and spends tens of millions of dollars to promote woke policies and candidates.

Planned Parenthood and groups like it were among those first identified for cost saving measures by Elon Musk who singled them out in the Wall Street Journal last November.3 President Trump has already rolled back funding for abortion groups overseas, but Congressional action is necessary to stop the biggest source of taxpayer cash for the domestic abortion industry – Medicaid.

Planned Parenthood reports raking in a total of $699.3 million, or almost $2 million per day, from American taxpayers in 2023 alone. Meanwhile, Planned Parenthood’s most recent annual report boasted that they performed nearly 393,000 abortions – a 40% market share of the abortion industry in the U.S.

Despite their claims to promote “women’s health,” Planned Parenthood consistently opposes basic health and safety standards for their facilities. The New York Times recently reported a litany of unsafe conditions and botched abortions at Planned Parenthood. For example, in one clinic last year “sewage from a backed-up toilet seeped into the abortion recovery room for two days,” which required employees to shove “exam table pads under the bathroom door to block the leak.” According to the reporting, “[p]atients vomited from the stench.”

While leaving patients vomiting from rank conditions, Planned Parenthood prioritized pouring millions of dollars into woke lobbying and trying to defeat Republicans in races from the school board to the presidency. Planned Parenthood boasts that their advocacy and political organizations spent a massive $69.5 million during the 2024 election cycle.6 Their massive pro-abortion political arm, Planned Parenthood Action Fund, pushes all-trimester abortions and promotes fearmongering lies that put women and girls at needless risk. Their political arm has more lobbyists and spends more on federal lobbying than any other pro-abortion or pro-life group, spending more than half a million dollars in the first quarter of 2023 alone.

Women and children deserve better care. In an era of reexamining federal funding, Congress should start by cutting funding for Big Abortion in the upcoming reconciliation bill.

In the face of the greatest threat to life our state has ever seen, Nebraskans stood up to deliver a historic pro-life victory that is sending shockwaves of hope throughout the nation.

Pro-life Initiative 434 passed, and pro-abortion Initiative 439 was defeated!

The abortion industry’s attempt to create a right to late-term abortion and eliminate our laws protecting women and babies has failed.

Nearly 500,000 Nebraskans voted to protect women and children by voting “for” Initiative 434 in a resounding 55-44% victory. Initiative 439 failed with 436,750 votes “for” and 462,756 votes “against.”

For the first time in history, pre-born babies in Nebraska have a floor of constitutional protection.

By defeating Initiative 439 and passing Initiative 434, Nebraska voters rejected late-term abortion and built a wall of protection from the abortion industry.

Nebraska’s 12-week protection, parental notification, ultrasound requirements, decades of pro-life laws, and our ability to continue fighting for greater protections have been preserved.

Our bold, first-in-the-nation strategy to counter the abortion industry’s game plan with our own pro-life initiative worked. This is only possible because of you.

Your prayers, advocacy, and courage to stand in the gap for women, babies, and truth have saved lives. That courage is contagious and provides hope for the rest of our nation.

The Nebraska Secretary of State’s office has counted and certified competing abortion initiative petitions for the November ballot.

Earlier this summer, the Protect Women and Children ballot initiative turned in more than 205,000 signatures to establish basic constitutional protections for pre-born babies. This was one of the largest grassroots petition efforts in state history, undertaken by 1,200 volunteers in every county in less than 100 days.

County election offices verified 136,000 signatures for the Protect Women and Children petition—far exceeding the 123,000 signatures needed to qualify for the ballot—before they stopped counting to save resources.

The opposing Protect Our Rights ballot initiative to enshrine a right to abortion in the state constitution also collected enough valid signatures to appear on the ballot. Pending legal challenges, Nebraska voters will be the first in the nation to decide between an initiative that affirms life or an initiative that ends lives.

The Secretary of State’s announcement revealed that the pro-life initiative qualified double the counties in less than half the time, collecting signatures from at least 5% of the registered voters in 86 counties, compared to the 47 counties qualified by the pro-abortion initiative.

Both initiatives are being reviewed by the Nebraska Supreme Court, and a decision is expected by Friday, September 13th. The ballot measures will be assigned a number once all the pending initiatives have been processed.

The Protect Women & Children ballot initiative just turned in over 205,000 signatures to the Nebraska Secretary of State—far exceeding the 123,000 signatures needed to put a measure on the ballot to establish basic pro-life protections for preborn children in the Nebraska Constitution.

Not only were circulators able to gather much more than the required amount in just three months, pro-life Nebraskans from every county signed the petition, including at least 5% of registered voters in 91 counties—more than two times the required 38 counties!

Nebraska is a large state with many rural communities. Our dedicated volunteers—consisting of parents and grandparents, pastors, ministry leaders, and business owners—drove countless miles, distributed our resources to their friends and family, and organized signing opportunities in their churches and neighborhoods because they are committed to providing women real care and support while protecting the lives of precious baby boys and girls.

These numbers are historic and speak to the persistent grassroots effort that occurred across all 93 counties to put this issue on the ballot in less than 100 days. We already knew Nebraska was a pro-life state, and these hundreds of thousands of signatures send a clear message that radical abortion policies have no place in our state.

The pro-abortion ballot initiative, which has been collecting signatures since November to permit abortion until birth and reverse our state’s current pro-life protections, also announced they turned in the signatures needed to qualify for the ballot. Because of your efforts and faithfulness, though, Nebraska voters will have a clear choice on their ballot in November.

As we celebrate our most cherished freedoms and unalienable rights to life and liberty this Independence Day, know that this is just the beginning. Now that the signatures have been turned in, they must be certified by election officials (a process that can take up to 50 days) before the two measures are put on the ballot for the upcoming November election.

The Nebraska Department of Health and Human Services just published an annual report that reveals abortions in Nebraska significantly decreased immediately following the passage of LB 574’s Preborn Child Protection Act last session!

The data also revealed that without LB 574, Nebraska was at risk of becoming a “destination state” for abortion. For thirteen years prior to 2023, the Nebraska Legislature was in a deadlock, and abortions were permitted late into the second trimester. As neighboring states strengthened their pro-life laws, abortions in our state began to increase.

That all changed following a historic, hard-fought vote, which finally established greater pro-life protections. Nebraska’s new pro-life statute protects preborn babies at 12 weeks, and because of an emergency clause in the bill, it went into effect immediately. In 2023, abortions in Nebraska dropped from the previous three years, and more than 220 innocent lives were saved!

Last week, Nebraska Family Alliance (NFA) was at the Supreme Court during oral arguments in the FDA v. Alliance for Hippocratic Medicine case. This case was filed by several pro-life doctors and national medical associations after the FDA removed safety protocols for high-risk abortion drugs, abandoning its duty to protect women’s health and safety.

These safeguards included an initial in-person visit to screen for ectopic pregnancies and other serious conditions, and a follow-up visit to check for life-threatening complications like internal bleeding and infection.

Abortion-inducing drugs are dangerous. In 2011, Nebraska prohibited the prescription of abortion pills remotely or over a webcam, and in 2019, we passed a law providing women critical information about medication abortions.

NFA proudly cosigned an amicus brief with several family policy councils and pro-life organizations, asking the Supreme Court to restore FDA safeguards and protect women and girls.

Pray Justices will follow the law and hold the FDA accountable, hearts and minds will be changed, and our culture will see the inherent risks of chemical abortion and embrace life.

This will be the most important election of our lifetime because abortion will be directly on every voter’s ballot like never before.

The ballot initiative being circulated by abortion advocacy groups to create a right to late-term abortion in the Nebraska Constitution is the single greatest threat to parental rights, the health and safety of women, and the protection of innocent babies our state has ever seen.

But now, instead of the abortion industry’s extreme proposal, which grants the abortionist sole authority to determine fetal viability and allows minors to obtain an abortion without parental notification, voters may have a second option on their ballot.

A new ballot initiative called “Protect Women and Children” has been released that seeks to amend the Nebraska Constitution to create a constitutional protection for preborn children in the second and third trimesters.

This initiative establishes a floor of protection, not a ceiling, meaning preborn children must, at a minimum, be protected by the second trimester, and stronger pro-life laws could still be passed going forward. If passed, Nebraska would be the first state in the nation to provide constitutional protection to preborn children in a state constitution.

This is consistent with what our legislature passed last year to prohibit abortion at 12 weeks and would ensure that our existing pro-life laws remain in place while we continue working to create a culture of life that provides love and support to every mother and child.

Nebraska must be the state to turn the tide and stop the abortion industry’s momentum.

In Ohio, a state with all-Republican federal representatives and a pro-life super majority in their state legislature, a pro-abortion initiative to create a right to abortion passed by 13 percentage points despite pro-life groups spending $35 million in a well-organized opposition campaign.

After 50 years of Roe, our culture has been badly damaged. We must remain united in our efforts to defeat the pro-abortion initiative, keep extreme abortion policies out of our state constitution, and protect the pro-life laws we have fought for years to pass while continuing our work to create a state where every life is cherished and protected.

A well-funded petition drive seeking to enshrine a right to abortion in our state constitution is currently being circulated in Nebraska.

Abortion advocacy groups are using misleading language to collect the necessary signatures to place a constitutional amendment before voters in the 2024 General Election that would legalize abortion up until birth.

Two major bills are set for committee hearings this week—one good and one bad—and we need you to submit online comments urging senators to protect children, born and unborn.

Both bills have been designated as priority bills for the 2024 session. This means if they are voted out of committee, they will likely be debated by the full legislature.

Please take a minute to submit a comment in support of LB 1092, which will protect children from the harmful effects of pornography, and in opposition to LB 1109, which will legalize abortions for babies diagnosed with fetal anomalies.

SUPPORT: LB 1092 – Online Age Verification Liability ActLB 1092 requires pornography websites to have a third-party age verification service to verify that the person attempting to access the content is at least eighteen years old.

In states that have passed similar laws, the largest suppliers of pornography have removed their services from the state rather than comply with the requirements, revealing their business model’s dependence on underage users.

While diagnoses of fetal anomalies can often be wrong, babies who do have fetal anomalies, and their families, deserve compassionate care and dignity rather than being abandoned to abortion.

A pro-life proposal in the Nebraska Legislature has a hearing scheduled for this Wednesday, and we need your help to pass this life-saving legislation in our state.

LB 876, the Newborn Safe Haven Act, authorizes Safe Haven baby boxes, safe, padded, and temperature-controlled units, to be installed at approved locations that are staffed 24/7 (including hospitals, fire stations, and police stations) where parents can voluntarily release custody of a newborn infant.

Nebraska’s current law allows for babies to be surrendered only at hospitals if the infant is less than one month old. This legislation expands the available drop-off locations and increases the number of days babies can be surrendered to 90 days. The bill has already received broad bipartisan support and has 33 cosponsors.

Similar programs across the country are saving hundreds of lives because they offer parents who may be facing a crisis a safe, accessible, and life-affirming option to surrender newborn babies where they can be adopted into loving homes.

Safe Haven baby boxes decrease the number of babies who are abandoned or left in unsafe places with the hope they will be discovered. They are generally only used in rare cases, but every life this program could save is valuable and worth protecting in our state. A baby was recently saved through a Safe Haven baby box at an EMS Station in Indiana.

Shortly after the historic passage of legislation protecting babies at 12 weeks gestation, abortion activists launched a ballot initiative called “Protect Our Rights,” seeking to create a “right” to abortion until birth in Nebraska’s State Constitution. If voters approve this in the 2024 election, all pro-life protections will be stripped away, and the health and safety standards for women in abortion facilities will be eliminated.

The language for the ballot initiative seeking to create a right to abortion in our state constitution has been released, and now we know what we’re up against: an all-out attempt to legalize abortion until birth.

Abortion advocacy groups will begin collecting signatures and spending millions of dollars to confuse and mislead voters. NFA will work tirelessly alongside our pro-life allies at Nebraska Right to Life, Nebraska Catholic Conference, and Susan B. Anthony Pro-Life America to help set the facts straight on what this initiative really does and why it must be rejected.

What the Language Says “All persons shall have a fundamental right to abortion until fetal viability, or when needed to protect the life or health of the pregnant patient, without interference from the state or its political subdivisions. Fetal viability means the point in pregnancy when, in the professional judgment of the patient’s treating health care practitioner, there is a significant likelihood of the fetus’ sustained survival outside the uterus without the application of extraordinary medical measures.”

What This Means for NebraskaNebraska law allows abortion in the first trimester and even longer for cases of rape and incest, and we have clear exceptions for the life of the mother and medical emergencies throughout pregnancy. What abortion advocates are proposing in this initiative is late-term abortion throughout pregnancy and the ability for minors to obtain abortions without parental notification.

Viability is defined as being based solely on the abortionist’s judgment and would allow abortions in the second and third trimesters. It is also well established that babies feel pain before viability, at 15 weeks or earlier, meaning babies who can experience pain would be subjected to painful late-term abortion procedures.

The initiative language contains a vague “health” exception that is also determined entirely by the abortionist. Courts have found such exceptions include non-physical factors, such as emotional, spiritual, and financial, and opens the door to abortions up until birth.

A “fundamental right to abortion…without interference from the state” puts existing medical safeguards that protect the health and safety of women at risk of being eliminated. This includes informed consent statutes and requirements that the abortion be performed in person and by a licensed doctor.

“All persons” includes children. This would create a right to abortion for minors and eliminate our parental consent statute, meaning parents will not have any ability to consent or even know if their child seeks or obtains an abortion.

Women, children, and families in Nebraska deserve real love and support, not dangerous proposals to support the abortion industry at the expense of parental rights, the health and safety of women, and the lives of precious baby boys and girls.

What You Can Do Decline to sign. The group supporting this initiative, “Protect Our Rights Nebraska,” has until July 2024 to collect roughly 122,000 signatures from registered voters in Nebraska. If you see someone collecting signatures, decline to sign and politely encourage others in the area not to sign.

Share this information. We need to reach as many people as possible with the truth. Be on the lookout for future updates, resources, videos, and educational tools to share with your friends, family, co-workers, and church community.

Pray. This is not a “political” issue. This is a Biblical issue, and we must pray for life and the truth to prevail in Nebraska.

Today, the ACLU and Planned Parenthood announced the constitutional amendment that would eliminate the state law that protects babies in the womb after 12 weeks.

Based on language related to “viability” and “health,” a right to elective abortions in the second and third trimesters, including up until the point of birth, will be embedded in Nebraska’s constitution if a new pro-abortion ballot measure push is successful.

The measure is part of a nationally coordinated effort by the abortion industry and their allies to remove all rights from the unborn, health protections for women, and parental rights.

In response to the rollout of the pro-abortion amendment, leaders of the Nebraska Pro-Life Coalition issued the following statements:

“Nebraska’s law currently allows abortion throughout the first 12 weeks of pregnancy, but that isn’t enough for the abortion industry and activists who are trying to write second- and third-trimester abortions into our constitution. This amendment would allow for abortion until the moment of birth,” Nebraska Right to Life Executive Director Sandy Danek. “This ballot measure is not pro-choice, it’s pro-abortion, and it does not reflect the values of Nebraskans.”

“Right out of the gate, those behind this ballot measure are parroting the lies told by pro-abortion activists in Ohio by saying women are dying without this amendment. Their claim that Nebraska does not have an adequate life of the mother provision is completely dishonest. The confusion they’re sowing does not just deceive voters but endangers pregnant women in Nebraska who need to know that state law unequivocally allows for them to receive emergency care,” said Adam Schwend, western regional director for SBA Pro-Life America.

“At 12 weeks, a baby’s major organs have formed, and his or her heart has beat over 10 million times. You can find out whether the baby is a boy or girl by 12 weeks, start to see if they resemble mom or dad, and you’ll see the baby suck their thumb on an ultrasound,” said Paige Brown, spokeswoman for the Nebraska Catholic Conference. “The lie Planned Parenthood is selling that it is in a mother’s best interest to end her baby’s life at 12 weeks and beyond is appalling and goes against the science, which shows women are increasingly at risk for complications with abortions beyond the first trimester.”

“Under this extreme amendment, a girl who is not old enough to get her ears pierced or get a tattoo on her own will be able to obtain an abortion without a parent ever knowing. This evisceration of parental rights is something that will concern every mom and dad in Nebraska. Women and children deserve real compassionate care, not lies from the abortion industry,” said Karen Bowling, executive director of Nebraska Family Alliance.

Implications of the abortion ballot measure include:

  • Abortion throughout pregnancy — the amendment leaves post-viability abortion for “health” to the discretion of the abortionist. Without defining “health,” courts have found that it can be based on non-medical factors, including mental, spiritual, financial, or familial health. Furthermore, viability is defined as being based solely on the abortionist’s judgment and would not include any baby who needs “extraordinary medical measures,” which could be as simple as a short stay in the NICU.
  • The elimination of health and safety protections for women — language on the fundamental right to abortion “without interference from the state” puts all of Nebraska’s medical safeguards at risk. This includes obtaining informed consent and performing a medical screening, seeing a physician in person, or even seeing a medical professional at all. It would allow pills to be sold through the mail by people with no medical background.
  • The evisceration of parental rights – by using the words “all persons” rather than “women” in the amendment, this will mean parents will not have any ability to consent or even know if their minor daughter seeks an abortion. They may also have no recourse if their daughter is harmed during the abortion.

We are alerting our network to a serious development that stands to threaten our constitution, the health and safety of women, parental rights, and the lives of pre-born children in our state.

Pro-abortion advocacy groups have filed a ballot initiative asking voters to approve an amendment to our state constitution during the 2024 election to create a “right” to abortion in Nebraska.

This extreme tactic has been used in other states to not only wipe away all pro-life protections, but also to diminish parental rights and eliminate important health and safety standards for women.

The abortion industry knows that if they can succeed here, they can succeed anywhere. It’s up to us to protect women, children, and families in our state.

In the coming weeks, the initiative will begin to be circulated across our state in an attempt to collect enough signatures to place the initiative before voters in the 2024 general election.

A petition drive for a constitutional amendment requires signatures from 10% of registered voters. Roughly 122,000 signatures must be collected by July 2024 and authorized by the Secretary of State’s Office to qualify for the ballot.

While we wait to see what the exact language of this petition looks like, here is what we want you to know:

  1. This is a fight for life and the fight of a lifetime. The abortion industry will pour millions of dollars into our state to support this initiative and mislead voters.

  2. We are ready. NFA is working closely with a coalition of other pro-life groups, including Nebraska Right to Life, the Nebraska Catholic Conference, and Susan B. Anthony Pro-Life America. Today, the Nebraska Family Alliance team joined Governor Jim Pillen and pro-life senators at the Nebraska State Capitol for a special signing ceremony for LB 574, which protects preborn babies from abortion at 12 weeks gestation and prohibits “gender-altering” surgeries on children.

LB 574 is now officially law in Nebraska!

The 12-week abortion restriction takes effect immediately, and the regulation of puberty blockers and ban on gender-altering surgeries for minors takes effect on October 1st.

All session, we have been fighting to advance legislation that will protect the unborn and stop harmful, irreversible “gender-altering” surgeries on minors.

Now, it’s all coming down to a final vote tomorrow. LB 574, which will protect preborn babies from abortion at 12 weeks gestation and prohibit “gender-altering” surgeries on minors, has been scheduled for a final round of debate this Friday, May 19th.

Today, in a major vote, Nebraska State Senators successfully adopted and advanced an amendment to LB 574, the “Let Them Grow Act,” that will protect preborn babies from abortion at 12 weeks gestation in addition to prohibiting “gender-altering” surgeries on minors.

By advancing LB 574 with the 12-week amendment, senators are establishing as much legal protection as possible at this time for vulnerable children while resoundingly rejecting the extreme tactics that have been used to prevent these common-sense proposals from moving forward.

Children who are struggling with gender dysphoria need real care and support, not harmful, irreversible surgeries. Nebraska currently allows abortion until 20 weeks, and our state’s 20-week abortion law has remained unchanged since 2010. Only seven countries worldwide, including China and North Korea, allow elective abortions this late, leaving our state at risk of becoming a destination state for abortion.

As amended, LB 574 will prohibit elective abortion after 12 weeks gestation, protect children from transgender surgeries, ensure no taxpayer dollars are used for “gender-altering” procedures, and establish a stringent rules and regulations process for puberty blockers and cross-sex hormones.

With just 16 days left this session, senators have one last chance to pass pro-life legislation and protect children from “gender-altering” procedures.

Late this afternoon, a new amendment was filed to LB 574, the “Let Them Grow Act,” that, in addition to protecting children from gender “reassignment” procedures, would also prohibit abortion after 12 weeks gestation.

After Senator Riepe withdrew his support for LB 626, the Nebraska Heartbeat Act, and caused the bill to fail, many conversations and much public pressure took place in a concerted effort to find a way to revive the bill. Regrettably, it became clear that there was no path forward for LB 626 to return this year, and if a similar proposal was brought back next year, it would likely receive even less support.

Today, Senator Ben Hansen, the Chair of the Health and Human Services Committee, filed AM 1658 to garner the 33 votes needed to overcome an expected filibuster on LB 574 and create another opportunity to finally move our state abortion law from 20 weeks down to 12 weeks after no other agreement could be reached.

We have and will continue to fight for the lives of every preborn child from the moment of conception because every human life—born and unborn—should be valued, cherished, and protected. A 12-week limit is what can be passed to provide greater protections to unborn children at this time.

Nebraska currently allows elective abortion until 20 weeks, and our state’s 20-week abortion law has remained unchanged since 2010.Only seven countries worldwide, including China and North Korea, allow abortions this late in pregnancy.

If AM 1658 is adopted into LB 574:

    • Elective abortions would be prohibited after 12 weeks gestation.
    • Gender “reassignment” surgeries would be prohibited on anyone 19 and younger.
    • No taxpayer dollars could be used for any “gender-altering” procedures.
    • Puberty blockers and cross-sex hormones would be subject to a stringent rules and regulations process, including a minimum amount of counseling, medical record documentation, and a waiting period.

LB 574 and AM 1658 will be debated soon, and senators need to hear from you.

LB 574 must be pulled back from “Final Reading” for the amendment to be debated on “Select File.” This means the bill must go through two more rounds of debate. Opposing senators have made it clear that they will do everything they can to defeat this proposal, and pro-abortion activists are flooding senators’ inboxes.

Contact your senator now and urge them to better protect innocent human life and save children from irreversible harm in our state. Let your values and voice be heard!

TAKE ACTION AND CONTACT YOUR SENATORThis is not everything we hoped to accomplish this session, but we remain as resolved and committed as ever to continue our work to protect children from harm and establish legal protection for every preborn baby girl and boy.

The current makeup of the Nebraska Legislature will remain unchanged for another two years until new members are elected and sworn in. In the meantime, 2,300 abortions are being performed in Nebraska every year, and our state is at great risk of becoming an “abortion destination.”

Nebraska is a pro-life state, and after the overturn of Roe v. Wade and 13 years of abortions being performed late into the second trimester, we must establish greater pro-life protections in our state.

Today, in a shocking and heartbreaking development, LB 626, the Nebraska Heartbeat Act, failed to overcome a second-round filibuster and fell one vote short of advancing.

This is what happened. Senator Merv Riepe, a Republican state senator from Ralston who campaigned as being 100% pro-life, changed his vote and caused the bill to fall one vote short of advancing. Senator Riepe opted to not cast a vote at all and was “present-not-voting.”

Despite co-sponsoring the bill, voting the bill out of committee, attending the “Advance the Heartbeat Act” rally, and voting for the bill twice during the first round of debate, Senator Riepe chose to parrot pro-abortion talking points on the floor and abandoned his support for the bill and thousands of innocent and defenseless babies in the process. Senator Riepe unexpectedly introduced an amendment last month to gut LB 626’s pro-life protections and permit abortions on 1,700 preborn children every year. His amendment was debated today but ultimately was not voted on because the bill didn’t reach cloture.

During his 2022 election campaign, Senator Riepe claimed to “support legal protection for the life of every pre-born child from the moment of conception, unless the mother’s life is at risk,” and he received endorsements and support from pro-life advocates.

Today’s vote costs lives. Nebraska law currently allows abortion up to 20 weeks gestation, and after the U.S. Supreme Court overturned Roe v. Wade last summer, Nebraska senators had an open path to establish basic heartbeat protections for the unborn and put an end to 2,000 elective abortions in our state every year.

It is unacceptable for senators to be “present-not-voting” on such a momentous vote. I call on Senator Riepe to make a motion to reconsider and stand by the commitments to life he has made in the past.”

Joined by hundreds of pro-life Nebraskans, Senator Joni Albrecht, Senator Carolyn Bosn, Governor Jim Pillen, and numerous state senators urged the Nebraska Legislature to advance LB 626, the Nebraska Heartbeat Act.

The “Advance the Heartbeat Act Press Conference and Rally” was held on the north steps of the Nebraska State Capitol building on Wednesday, April 12th, in-between legislative debate on the bill and co-hosted by Nebraska Catholic Conference, Nebraska Family Alliance, Nebraska Right to Life, and Susan B. Anthony Pro-Life America. The bright and sunny event drew families from across the state and took on a celebratory tone as children wove through the estimated crowd of 300.

Senator Joni Albrecht, the introducer of LB 626, said, “I want to thank everyone who’s standing here today and all of the Nebraskans who have been praying for the last 50 years for these babies with beating hearts to be saved. We’re going to protect those babies with beating hearts, and this is a monumental day in the State of Nebraska!”

The Nebraska Heartbeat Act would require that a doctor, before proceeding with any abortion, first perform an ultrasound in accordance with standard medical practice to listen for a fetal heartbeat. If a heartbeat is present, an abortion may not be performed except in cases of rape, incest, or medical emergencies. LB 626 has 29 co-sponsors, and a recent statewide poll revealed that 58% of Nebraskans support legislation protecting preborn babies once a heartbeat is detected.

In his comments to the crowd, Governor Jim Pillen said, “We, without question, have an overwhelming majority of people who are one-hundred percent pro-life and believe in babies’ right to live. [LB 626] is a priority for me as your governor—that we get this across the finish line—and today is the start.”

Newly-appointed Senator Carolyn Bosn, who filled a vacancy in District 25 left by Senator Geist, signed on to the bill on her first day in office and gave her maiden floor speech in support of LB 626. She said, “LB 626 is common sense, life-affirming legislation. It makes sense to me not only as a former prosecutor but also as a mother who has cherished hearing the heartbeat of my children during ultrasounds. I look forward this evening to joining my colleagues in supporting LB 626 and protecting babies with beating hearts.”

The bill does not impose criminal or civil penalties for physicians who perform abortions. Instead, a physician who violates this law will have their medical license subject to discipline like any other instance of serious unprofessional conduct outlined in Nebraska law.

Dr. Elena Kraus, a Nebraska OB/GYN and maternal-fetal specialist, supported the science underlying LB 626 and underscored the legislation’s support for physicians to exercise their medical judgment.

“Always paramount for me is consideration of the health and safety of the women, yet with care and concern for the human dignity of their unborn babies,” said Kraus. “The Nebraska Heartbeat Act gives broad latitude to physicians in the many difficult and complex medical situations we encounter. I cannot think of a high-risk medical situation where this bill would restrict the available and recommended treatments to patients when based on sound medical reasoning.”

Katie Patrick, a Lincoln mom of three, described the joy and excitement she felt when she first heard her baby’s heartbeat on an ultrasound. “Hearing her little heart beating was an exciting moment—and a relieving one too—because it affirmed the little life that was growing inside of me,” she said.

“Nebraska PHOs stand ready to serve women and their children during pregnancy and beyond,” said Laura Buddenberg, who has worked for over three decades with pregnancy help organizations (PHOs). “We believe providing life-affirming support to women experiencing unexpected or under-supported pregnancies helps women and their families flourish and builds a stronger Nebraska.”

Later that evening, the Nebraska Legislature voted to advance the bill to the next round of debate on a 33-16 vote. LB 626 must go through two more rounds of debate before it is sent to Governor Pillen’s desk.

LB 626, the Nebraska Heartbeat Act, has officially been placed on the legislative agenda and will be voted on soon. Here’s an update on everything you need to know and how you can take action.

The bill is scheduled to be debated this Wednesday, April 12th, with a vote expected later that evening. Pro-abortion senators have promised to filibuster the bill, meaning we need 33 votes to end debate and allow the bill to advance. If the bill advances, it will still need to overcome two more rounds of debate.

Last month, Senator Riepe unexpectedly introduced an amendment that rewrites the bill to only protect life at 12 weeks gestation, removing protections for 1,700 preborn babies every year. His amendment—which is threatening to undermine the bill if 24 other senators support it—won’t be considered until the second round of debate.

A new amendment from a Republican co-sponsor of LB 626, the Nebraska Heartbeat Act, has put the bill in jeopardy.

Yesterday, Senator Merv Riepe unexpectedly filed an amendment seeking to change the heartbeat bill to allow abortions until 12 weeks of pregnancy. This amendment would cost 1,700 lives every year.

LB 626, as introduced, will protect babies when a heartbeat is present. This could stop 85% of abortions in our state and save 2,000 lives every year. In comparison, around 300 abortions are performed in Nebraska after 12 weeks.

Senator Riepe co-sponsored LB 626 when the bill was introduced and recently voted to advance the bill from the Health and Human Services Committee.

Now, Senator Riepe is questioning his support for the bill and filing amendments that would dramatically alter the bill and strip away life-saving protection for thousands of unborn babies.

We need 33 votes in support of LB 626 and cannot afford to lose a single supporter. Without Senator Riepe’s support, the bill is at risk of not passing.

A Majority Of Nebraskans Support The Heartbeat Bill Headed To The Full LegislatureThe Nebraska Health and Human Services Committee advanced a measure to protect the lives of thousands of unborn children who have a beating heart. LB 626, sponsored by Senator Joni Albrecht, requires that a doctor, before proceeding with any abortion, first perform an ultrasound in accordance with standard medical procedure to listen for a fetal heartbeat. If a heartbeat is present, an abortion may not be performed.

Fifty-eight percent of likely voters support the law, based on new polling conducted by WPA Intelligence. Only one-third of voters oppose the bill. The poll also found the abortion-on-demand until-birth position held by the Biden-Harris Administration wildly unpopular amongst Nebraskans, with three-quarters rejecting that stance.

Charlotte Lozier Institute doctors were among those who testified on the bill, sharing the science of fetal heartbeat. Throughout their comments, the doctors revealed facts of development at six weeks gestation, including that an unborn baby has a steady heartbeat of 110 BPM. The presence of a heartbeat indicates that a baby has a remarkably high chance (up to 98%) of surviving to birth, they said.

SBA Pro-Life America’s Western Regional Director Adam Schwend commented:

“Today marks a major victory for the unborn in Nebraska and nationwide. As the first state in the country following the 2022 election to advance legislation to protect unborn babies with a heartbeat, we have the potential to save 2,000 lives every year and to be a shining example to other states that lack these protections.”

Nebraska pro-life leaders praised the committee’s passage, calling for the Legislature to send the legislation to the governor’s desk:

Today, State Senator Joni Albrecht announced she will be introducing two pro-life, NFA-supported bills to protect unborn children and support pregnant women and families in Nebraska.

At a press conference in the Nebraska Capitol Rotunda, the NFA team joined Senator Albrecht and a large group of pro-life senators, medical experts, and other supporters to unveil plans to introduce the Nebraska Heartbeat Act, which will protect the lives of unborn babies by prohibiting abortion when a fetal heartbeat is present.

This could stop 85% of abortions in our state and save 2,000 lives every year!

A heartbeat is a universal sign of life. Under the Nebraska Heartbeat Act, before performing an abortion, a physician must first perform an ultrasound and listen for a fetal heartbeat. If a heartbeat is detected, performing an abortion will be unlawful except in cases of rape, incest, and to save the life of the mother.

We envision a Nebraska where every life is celebrated, valued, and protected. And we won’t stop working towards that goal. This is what we can accomplish in our current Legislature this year to start saving as many lives as we can.

LEARN MORE ABOUT THE PROPOSED LEGISLATIONSenator Albrecht will also be introducing the Nebraska Pregnancy Help Act, which will establish a new tax credit for donations to pregnancy help organizations that provide services that help women carry their pregnancy to term, encourage and enable parenting or adoption, and promote healthy childbirth.

The bill will allow for up to $10 million to be allocated in tax credits every year, which could dramatically increase support for organizations providing vital services to pregnant and parenting women in ways the government can’t.

This is the first time our Legislature has been in session since Roe v. Wade was overturned, and we now have the best opportunity we’ve had in 50 years to save lives and advance a culture of life!

We are proud to partner with Senator Albrecht and all of our courageous pro-life senators to provide significantly greater protection to unborn babies and increase support for parents and families in Nebraska.

In correlation with today’s press conference, NFA also released the findings of a new statewide poll showing that a strong majority of Nebraska voters want to protect unborn children with beating hearts and overwhelmingly reject abortion on demand.

VIEW THE PRO-LIFE POLLING RESULTS58% of likely voters support a law that would protect unborn children from abortion the moment their heartbeat can be detected, and 72% of likely voters oppose legislation that would allow abortion on demand until birth. Abortion is currently legal in Nebraska up to 20 weeks gestation.
