Every decision has a consequence, even in law school. And host Virginia Tehrani, Esq., has had EIGHTEEN (!) years to figure out what her best and worst decisions were in law school. How do juries really get chosen? In this episode, our dynamic duo takes on the world of jury exclusion, discussing how and why some jurors are taken out of a jury pool and excused for cause and how others are removed for no good reason at all. In particular, we take a look at the little known use of Batson Challenges during jury questioning, through which an attorney can challenge the exclusion of a jury member. These challenges go to the heart of the Equal Protection Clause of the 14th Amendment, because they claim that a jury member is being excluded only on the basis of discrimination.

What is the difference between civil and criminal law? In Part 3 of this 3-part series, our legal team wraps up its discussion of the O.J. Simpson and Rodney King cases from the 1990s that were pivotal, and are still instrumental, in explaining the fundamental differences in the civil and criminal law.
