Mediation is the best trial prep ever. Full stop.
First of all, let’s talk about what the process is. In personal injury matters, is really, a professionally guided negotiation between the opposing sides of a case. Typically, there are five players in the room. There is the lawyer for the insurance company, an employee from the insurance company, the plaintiff (also known as you, the client), your lawyer (also known as us), and the mediator. Your mediator will be trained in dispute resolution skills.
The mediator’s job is to try to get both parties to resolve the matter and settling without going to trial.
At Hemminger Law Group Westshore, we like this process for two big reasons. First of all, we might end up resolving your case. From the client’s (and their lawyer’s) perspective, this method is quicker and less stressful than proceeding to trial. Mediation can be over in one day, while a trial easily lasts five to ten days.

Accidents can happen to anybody. If you’ve been injured in an accident, or even if you haven’t, it’s good to know the costly mistakes that should be avoided with respect to your ICBC claim.
Something as simple as not seeing your doctor regularly can have a negative effect should you ever be injured. You’ll also want to hire a lawyer, and right away. We’ve seen countless examples where people who hired and paid a lawyer still pocketed much more money than they would have by accepting the initial ICBC offer.
Val Hemminger of Hemminger Law Group Westshore explains simple but important tips that will keep your injury claim on track.

The job of your motor-vehicle accident lawyer is to get you the most money possible to compensate you for your injuries. This includes pain and suffering, lost wages, medical costs, and out of pocket expenses. Your lawyer will communicate with the ICBC adjuster or another adjuster and tell the story about your injuries and how they’ve impacted your life. If your lawyer is unable to reach an agreement with the adjuster, they must then present your case in court.
Your lawyer’s job goes much beyond simply getting you money. You must feel assured that they are looking after you so you can focus on getting better.

Many times, injured people are not sure about whether or not it is worth it to hire a lawyer. They are often concerned about the cost. At Hemminger Law Group Westshore, it is our view that the best thing to do is meet with one of our lawyers and tell them about your claim. You and the lawyer will discuss whether or not it makes sense to hire a lawyer for your claim.
ICBC does not want you to hire a lawyer. At the initial phases of your case, ICBC adjustors may be very friendly and cooperative. They are like this because it is part of their job. They do not work for you. They work for the Insurance Corporation of British Columbia. * ICBC wants to make sure that you do not seek legal advice. At least, in our experience, if clients have legal representation, they end up getting more money than if they did not hire a lawyer. Such is the case even when they take into account the legal fees they paid.
Of course, every claim is different. We cannot make any guarantees on y [...]

When it comes to child custody battles, fathers may feel like the odds are stacked against them. But, in fact, this is not the case.
British Columbia’s Family Law Act ceased using the word “custody” in 2013, favoring terms such as “parenting responsibilities” and “parenting time,” but still relating to what we think of as custody.
The act considers parenting roles of both parents, and courts often start from the place that a child needs both parents. The best interest of the child is different for each unique case. Sometimes that may be 50/50 but can vary. For example, if one parent struggles to get the child to school on time but has lots of fun on weekends, that would be considered when deciding arrangements.
The focus is on what strengths each parent offers, rather than looking at the negatives.
Cases in which a father does not get to see his children are extremely rare, and when they do happen, are for good reason.
