In 1994, Congress enacted section 245(i) of the INA, permitting certain individuals who were otherwise ineligible for adjustment of status in the United States to pay a penalty fee for the convenience of adjusting status without leaving the United States. Divorce is a painful and complex end to a relationship, but it can be incredibly challenging if your immigration status is in the middle of it. When you obtain a green card through marriage, it might be a 2-year conditional green card, and in order to lift the conditions after two years, you need to prove that you and your partner are still married (Form I-751).
