In this episode, Billie speaks with Susan Magestro, a criminologist, interventionist, and expert witness who specializes in one of the most challenging and underreported issues facing families today: domestic violence perpetrated by children against their parents. Susan brings decades of experience working with families where parents live in fear of their own children, along with her expertise in crisis intervention and de-escalation strategies.
This conversation addresses the uncomfortable reality that many parents face but rarely discuss—when their child becomes violent, threatening, or abusive within the home. Susan explains the difference between explosive and implosive rage, shares red flags that parents should recognize, and discusses her innovative tools like the "anger wheel" for de-escalating volatile situations. The discussion also covers how divorce and family trauma can manifest in children's behavior, when reunification therapy is appropriate, and practical strategies for families caught in these devastating cycles.
What You'll Learn
✔ How to recognize the difference between explosive and implosive rage in children, and why many parents miss the warning signs of escalating dangerous behavior
✔ The "anger wheel" technique and other de-escalation strategies that help identify root causes of children's violent behavior and create pathways for healing
✔ Why parents often hide their fear of their own children due to professional concerns, community judgment, and family dynamics, preventing them from seeking help
✔ How divorce trauma and poor co-parenting communication can fuel children's anger and violent behavior, and the importance of "good divorce" practices
✔ When to pursue reunification therapy versus other interventions, and how to determine the best custody arrangements when children are struggling with anger and violence

In this episode, Billie sits down with Nathan Williams, a professional counselor at Arizona Counseling Collective who specializes in forensically informed therapy and high-conflict co-parenting situations. Nathan brings years of experience working with families navigating the complex intersection of therapy and family court, including therapeutic intervention (TI) appointments, court testimony, and helping parents transition from dysfunctional spousal dynamics to effective co-parenting relationships.
This conversation tackles the challenging questions that attorneys and their clients face daily: When should therapists maintain confidentiality versus reporting to parents? How can parents move from adversarial dynamics to neutral co-parenting? What's the real success rate of therapeutic intervention, and why do so many therapists avoid this work entirely? Nathan provides practical insights on everything from parental alienation concerns to the reality of 50-50 custody arrangements, offering both legal professionals and parents a clearer understanding of how mental health intervention actually works in family court cases.
What You'll Learn
✔ The key differences between court-appointed therapeutic intervention and private therapy, including confidentiality boundaries and reporting requirements
✔ Why the "neutral co-parent" approach is essential for moving beyond dysfunctional spousal dynamics into effective business-like co-parenting relationships
✔ How to properly communicate with your co-parent about children's concerns using the BIFF method (Brief, Informative, Friendly, Firm) without creating additional conflict
✔ The realistic success rates of therapeutic intervention (approximately 50%) and what factors determine whether families will benefit from court-ordered counseling
✔ Practical strategies for helping children maintain relationships with both parents while teaching them healthy conflict resolution skills rather than withdrawal patterns

In this special edition of the Modern Arizona Podcast, host and family law attorney Billie Tarascio interviews Maricopa County Attorney Rachel Mitchell, who has been front and center when it comes to criminal charges related to youth violence across Arizona’s largest population base. The two attorneys delve into pressing issues such as gang violence, the changing dynamics of gang activities, and the significant impact of video and social media on these trends.
Rachel shares her three decades of experience as a prosecutor, shedding light on how gangs have evolved from geographically and racially homogenous groups to more diverse, social media-connected entities. She also highlights the disturbing rise in violence among youth who seemingly have all they need materially but lack empathy and possess a strong sense of entitlement.
The conversation takes a deep dive into the relationship between law enforcement and the prosecutor's office. Rachel explains the collaborative efforts between police and prosecutors from the outset of investigations, particularly in serious cases like homicides. She provides insights into the investigative grand jury process used to gather testimony and evidence, which played a crucial role in the case of Preston Lord's homicide. She explains the complexities behind prosecuting cases involving social media videos and the legal limitations that sometimes result in lesser charges. Rachel candidly discusses the challenges of securing harsher penalties within the current legal framework and her plans to propose legislative changes to better address group assaults and increase penalties for such violent acts.

In this episode of the Modern Divorce podcast, host Billie Tarascio sits down with Gina Godbehere, candidate for Maricopa County Prosecutor, to discuss local crime and the justice system. The conversation begins with a focus on the Gilbert Goons, a group recently classified as a gang, and the complications of prosecuting their crimes without sufficient evidence to prove gang-related motivations.
Gina elaborates on the difficulties in tying crimes to gang activities, noting that traditional gang identifiers, such as markings and territorial threats, are missing in this case. Despite the group’s gang-like intimidation tactics, there was insufficient evidence to charge them under gang-related statutes. This nuanced explanation sheds light on the frustrations felt by the community regarding the prosecution of these crimes.
The discussion then shifts to recent plea deals offered to members of the Gilbert Goons, including notable cases involving Christopher Fantastik, DeLeon Haynes, Jacob Pennington, and Garrett Bagshaw. Gina explains the implications of these deals, particularly how some offenders might only end up with misdemeanors, raising concerns about the potential for future criminal activity without a lasting felony record.
A significant portion of the podcast is devoted to Gina’s critique of Rachel Mitchell, the current county attorney', and her more lenient approach to diversion programs and plea deals. Gina emphasizes the need for a balanced justice system that ensures accountability and protects victims' rights. Gina also touches on supervised probation and the challenges in effectively monitoring offenders to prevent recidivism.
The episode wraps up with Gina’s reflections on her campaign and her commitment to restoring balance in the justice system, advocating for both victim support and fair prosecution. For more information about Gina, go to Gina for Justice, to learn more.

Both guests bring unique perspectives as former members of the Mormon church. They explore the intersection of religion, parenting, and the extreme measures that led to Ruby Franke's arrest. The conversation highlights the influence of Mormon doctrines and cultural practices on the case, offering listeners a deep dive into the complexities of faith and family dynamics.
Beth Griffith and Jennie Gage discuss their backgrounds and how
their upbringing in the Mormon church has shaped their understanding of the
Ruby Franke case. Jennie, who left the church amidst domestic violence
struggles, and Beth, who turned to true crime content after her volatile
upbringing, provide insights into the cultural and doctrinal aspects that may
have influenced Franke's parenting methods. They emphasize that while Ruby's
actions were extreme, they reflect certain teachings and cultural norms within
the church.
The discussion also covers the specific disciplinary actions
taken by Ruby Franke, such as removing her child's bed and withholding food,
and how these practices might be influenced by Mormon teachings on obedience
and discipline. Beth and Jennie delve into the concept of "milk before
meat" in Mormonism, where members are gradually introduced to deeper,
sometimes more radical, doctrines. They argue that Ruby's actions were not
isolated incidents but were deeply rooted in her religious beliefs and the
pressure to achieve "perfect obedience."
Lastly, the podcast touches on the role of mental health and
support within the Mormon community. Both guests express concern about the lack
of adequate mental health resources and the emphasis on religious solutions to

pressure to conform to religious standards. Overall, this episode of Modern
Divorce offers a compelling examination of the Ruby Franke case through the

In recent months, community members have loudly demonstrated their outrage in the city's response to gang violence, with the current mayor offering to step down at the end of her term.
The two discuss DiBernardo's key policy initiatives, including enhancing public safety in light of recent violence by the so-called "Gilbert Goons," promoting responsible urban growth, and improving infrastructure to match the town's rapid expansion. She highlights the necessity of bridging the communication gap between the government and its citizens, advocating for increased transparency and collaborative problem-solving sessions.
Bringing a personal touch to her political vision, DiBernardo shares her family's tragic experience with violence, underlining her commitment to addressing systemic issues within policing and public safety. Her approach centers on empathy, accountability, and community unity, aiming to steer Gilbert towards a future where leadership is responsive and inclusive of all residents' voices.
The episode not only outlines DiBernardo's strategies for tackling Gilbert's challenges but also serves as a call to action for residents to engage actively in their community's governance. It underscores the importance of leadership that is in tune with the community’s needs, advocating for a collaborative path forward in addressing the town’s growth and safety concerns.
What if your teen got into a group fight that caused someone’s death resulting in a murder charge? In Arizona, says criminal defense attorney Mark Mendoza, a conviction on murder charges is a minimum sentence of life in prison. One of the teens charged with murder by a Grand Jury in Maricopa County was included because he recorded the incident on his phone.
That should strike fear into any parent whose kiddo hangs out with the wrong crowd or gets involved in the type of fight clubs that spawned the so-called Gilbert Goons. Charges also have been filed against parents of one of those charged, similar to the now-jailed parents of a teen who was found guilty in a school shooting.
Today’s episode is from the March 7 2023 live stream with host Billie Tarascio and Mark Mendoza, a former Maricopa County prosecutor, who answer parents' questions and talk about the arrests and murder charges against 7 teenagers in Gilbert Arizona who are being charged with the tragic murder of 16 year old Preston Lord who died after a beating at a Halloween Party in 2023. The Gilbert Goons story, and the murder charges are a cautionary tale that parents need to hear, and they need to share with their teens.
In the wake of harrowing incidents of teen violence that have shaken an Arizona suburb, the Modern Divorce Podcast presents a powerful narrative of redemption and advocacy. Host Billie Tarascio sits down with Eric Hebert, a man whose turbulent past led him down a path of incarceration and unexpected fatherhood at just 14. Now, armed with hard-earned wisdom and a fervent desire to make a difference, Eric shares his journey from youthful missteps to community activism.
As the details of the tragic event unfold – seven arrests, potential life sentences, and the loss of a 16-year-old – Eric's story offers an honest and unique perspective on the consequences of impulsive decision-making. With candor and courage, he reflects on the circumstances that led to his own imprisonment and the profound impact it had on his life and those around him.
But Eric's narrative is not one of despair; it's a testament to the power of second chances. Through his transformation from inmate to advocate, he is speaking out to keep teens from going down the same path. Ultimately, he says, the key to safeguard kids is in the hands of parents. Eric offers practical advice to parents grappling with the fear of their children being caught up in the same cycle of violence.
Join Family Law Attorney Billie Tarascio on the latest episode of the Modern Divorce Podcast as she delves deep into the heart of Maricopa County's criminal justice system alongside guest Gina Godbehere, candidate for Maricopa County District Attorney. With a surge in teen violence and recent headlines dominated by the tragic murder of 16-year-old Preston Lord, families are questioning public safety officials about how they’re doing their jobs. Gina doesn't shy away from tough questions about the state of Arizona's criminal justice system. From concerns about downgraded cases to the need for firmer accountability measures, she lays out a compelling case for change.
Gina brings a wealth of experience to the table, drawing from her 25-year tenure with the Maricopa County Attorney's office. Her insights shed light on pressing issues such as the rise of the Gilbert Goons and the challenges posed by an increasingly porous border. Through her nonprofit, 'Speak up! Stand up! Save a Life', Gina champions proactive community engagement as a vital tool in crime prevention, urging listeners to confront the root causes of violence head-on.

In today's episode, Modern Divorce Host Billie Tarascio, mom to teens in Gilbert, brings in Richard Lyons, a trial attorney who is the first to file civil charges against the Gilbert Goons, their parents, and the schools for not taking appropriate actions to stop the violent bullying that hurt so many, and caused Preston Lord's death.
The so-called Gilbert Goons have been entertaining themselves by randomly beating up local teens in Phoenix's East Valley . While some criminal charges have been filed, law enforcement and prosecutors have not done nearly enough to satisfy parents and residents in the local communities.
It's the first long interview by Lyons, who explains the drivers behind the civil lawsuits against parents of the Goons, and the Chandler School District. The $6 million lawsuit goes after a host of players who are being asked to damages for not keeping kids safe or removing known violent bullies from the classroom.
For anyone who is sick of rampant bullying that goes unchecked in schools, and those who have been following the Goons case, this is a must listen with plenty of legal sauce and behind the scenes insight.
Can we actually stop violence in schools that authorities have not been able to shut down? Host Billie Tarascio, in another special edition podcast, is back to talk more about the Gilbert Goons situation in Gilbert, Arizona. Mayoral candidate for the City of Gilbert, Shane Krauser joins the program to talk about how to rebuild the community's trust in the wake of the Goons mess, and the death of teen Preston Lord.
The city, and other cities in the Phoenix area, are dealing with angry citizens who demand to know why authorities have not more responsive in shutting down teen violence that led to Preston's death. Several other teens have been victims of the Goons who have entertained themselves with seemingly random beatings, intimidation and threats. Shane, who has experience prosecuting gang violence as an attorney, talks about how he'd approach the problem and how to clean up the city.
Wouldn't you like your child to have the "cheat code" to success for the rest of their life?
Heck, yeah! Today's kids are growing up connected more to their devices than to each other, creating an unprecedented change in children leaving them vulnerable to isolation, with an extra helping of helplessness. For listeners of the Modern Divorce Podcast, it may be a child suffering the emotional issues of a newly split family. But that can change, with real relationships that develop emotional intelligence and self confidence.
But how do we get there? In today's episode of the Modern Divorce Podcast, Host Billie Tarascio talks with Jilli P and Mary Fran, the founders of Girls Mentorship, a program to help girls from 9 and up to find new connections with real depth and meaning with not only their peers, but others from different age groups.
Jilli P and Mary Fran talk about what it takes to get both girls (and, coming soon, boys) to a position of strength and confidence. You can find out more about the program at GirlsMentorship.com
In the wake of a criminal case that found a mother guilty for manslaughter in the school shooting committed by her teenage son, the stakes for a child acting out are high. While most situations are far less explosive, there are nevertheless situations where kids acting out inappropriately can put a parent in legal jeopardy, and threaten to tear a family apart.
What to do? In this episode of the Modern Divorce podcast, host Billie Tarascio talks with Modern Law Attorney Maleah Woodward, who brings her perspective on mental health and parental responsibility in the courtroom.
Maleah, who started as a licensed family and marriage therapist, found herself working with families with juveniles who had committed a sex offense. It was in the courtroom that she discovered her help might be more strongly delivered as an attorney. She also adds her insights as a single mom taking on foster children who she later adopted.
This is a must-listen for anyone struggling with the behavior of their kids, particularly in a household split by divorce.

When Gilbert, Arizona resident Rick Keuhner was forced to send his teenage son out of the country to live with his mom, it was the last straw. His son had been beaten three times by local thugs, dubbed the Gilbert Goons, who continuously threatened the boy via social media and in school. A video of the latest beating and texts identifying the perpetrators were handed to police and the school, yet nothing was done to keep the teen from being terrorized.
Still worse, when local boy Preston Lord was murdered by a similar beating at a Halloween party in 2023, with videos showing the event, no arrests were made, in part because police had not thought to link any of the local beatings by many of the same kids.
Modern Divorce host and attorney Billie Tarascio talks with Rick about what happened, when, and why Gilbert police Chief said there was "no probably cause" to arrest the one responsible, much less his cohorts. This episode looks at the legal issues at hand, and what to do when your child is bullied. When adults don't help, what happens when a child is pushed beyond their limits?
How do you get back into dating after a divorce while avoiding poseurs, thieves and players? Can an intelligent professional woman find someone decent online?
Modern Law Attorney and 2016 Marathon Olympian Lanni Marchant joins Modern Divorce host Billie Tarascio to talk about online support groups for women: specifically the "Are We Dating The Same Guy" group.
As an attorney, Lanni has a special interest in watching the areas that overlap into family law, and her involvement in the group brings some interesting insights for newly divorce women looking to jump back into the dating game after being dissatisfied with dating apps filled with questionable hookups and men pretending to be something they're not.
Gilbert Arizona is a highly sought-after suburb of Phoenix where parents can find nice homes in safe surroundings. But that visage of safety was shattered when a teenager, Preston Lord, at a 2023 Halloween party was murdered by a mob of Gilbert and neighboring Queen Creek teens who call themselves the Gilbert Goons. As social media pages started lighting up with videos of the event, along with other disturbing pictures of random Fight Club-style beatings, drugs and weapons appeared. Parents began demanding police take action.
One of many issues in the community is the time that has passed since many of the crimes by the Goons have taken place. Has law enforcement and schools done enough to weed out the criminals?
In today's episode of the Modern Divorce Podcast, host Billie Tarascio steps into the world of a criminal defense attorney, Ryan McPhie of the Grand Canyon Law Group, who shares a deep dive into what teens and parents who are protecting them could be facing when it comes to the charges that are still to come. Will they be facing jail time, fines or more?
As of this recording, the first assault charges were announced as of January 10, 2024 against a few of the Goons, but the community is still clamoring for more, and still asking when will someone be arrested for the murder of Preston Lord?
Is your Soon To Be Ex hiding money or keeping you from having access to it?
Look, we know domestic violence is abuse. But what about when one spouse keeps the other from having access to money, including some or all accounts, along with hiding statements, credit cards and bills.
It's called financial abuse, and it plays a part in many a divorce. In today's episode of the Modern Divorce Podcast, Arizona family law attorney and host Billie Tarascio, and New York attorney Lisa Zeiderman, talk about how to spot financial abuse, and what can be done about it.
Pro tip: for those who have not yet filed their divorce, the differences between how New York and Arizona (and many other states) treat financial calculations for child support and alimony, aka spousal support, is very different, and it can make a difference in the outcome of one spouse's financial status over the other at the end of a divorce. If you have your foot in two states, and not sure where to file for divorce, listen in to find out more.

Something very weird is going on in our host's backyard, the town of Gilbert, Arizona. Billed as one of the safest cities of its size in the country, the facade has been pierced by the October murder of a teenage boy in a nearby town with ties to a 'fight club' group based in Gilbert calling itself the Gilbert Goons.
Parents have been alarmed at uncovering a collection of ill-conceived social media posts among high schoolers in the area showing drugs, weapons and "thrill beatings" that have been taking place with some regularity over the past year - all without any apparent action by law enforcement.
In this special episode, Billie Tarascio, as a concerned mother of teenagers, talks with criminal defense attorney Lance Standage, based in Kansas, who pulls back the curtain on what happens when gang-like activity occurs and how police and the FBI put together a case.
As an ardent social media poster herself, Billie has been getting private messages from many local parents who have asked her to explain the legal aspects of the case, and shed some light on why no arrests have been made so far.

What is custodial interference and how is this used to keep one parent away from another?
In this episode of the Modern Divorce Podcast Host Billie Tarascio, along with Modern Law contributor (and mom) Nancy Conrad, discuss in depth a unique custodial interference case from Arizona, where a teenage son, Blaze Thibaudeau, was abruptly taken out of state and into the wilderness by his mother. The case was unusual because it involved a potential harm to the child due to the mother's belief in an impending apocalypse.
The father's lawyer successfully argued that the teen was in immediate and irreparable harm, leading to an arrest warrant and charges being filed. That allowed the FBI to step in and arrest the mother as she tried to enter Alaska through Canada.
This particular case is compared to two other outrageous custodial interference cases that Billie has worked on. For anyone concerned about their child's safety around the other parent, and worrying about whether their child will be "kidnapped" by family, this is a must-listen for what to do, when to do it, and how to make it happen.
After a long-time marriage, how do you juggle the emotional needs of the kids after a divorce while rebuilding your life?
Joining Modern Divorce Podcast Host Billie Tarascio is Zach Dees, a business owner who found himself divorcing two years ago after running out of options to fix his marriage. In today's episode, Zach talks about how he navigates the muddy world of single dad dating, and the sometimes bewildering transition into single life when there's no playbook for doing it right.
When a Maryland judge, who recognized the signs of domestic violence in a divorce proceding, ruled against a father, he had little idea that he would be shot to death in his driveway just hours later. Elsewhere, in Arizona, a judge asked for an armed guard to be present at all times in the divorce courtroom, yet the children of the marriage were still allowed to stay with dad without any oversight or conditions.
What's happening with domestic violence cases in the courtroom, and why are the grim statistics getting worse? In today's special episode of the Modern Divorce Podcast, host Bille Tarascio presents a sobering picture of domestic violence cases that's put everyone on edge.

Tough guys need a break sometimes. Since men are often encouraged from an early age to suppress their emotions, it can significantly and detrimentally affect their emotional intelligence. Studies show this can affect their earning power as well. So how do you fix that?
Dr. Audra Horney, a Mesa, Arizona-based psychologist, says her clientele is mostly men who need to find a safe space to cry, unload, process and delete some of the emotional turmoil of a divorce. In this episode of the Modern Divorce Podcast, host Billie Tarascio hears from a therapist in the trenches with men, who are finding it's okay for them to seek mental health assistance through a particularly trying time.

Dr. Carolyn Kurle joins Modern Divorce Podcast Host Billie Tarascio to talk about the mental and emotional challenges that come with a divorce, like knowing when to leave, understanding your urge to stay, and when it's okay to let yourself off the hook for decisions made when you first decided to marry.
It's a complicated process, but one Dr. Kurle says is pressured by false stories we tell ourselves. If we can learn how to quiet our minds and listen to our gut level instincts that come from wisdom rather than outside influences, then we can understand whether leaving a marriage and dealing with the future from this new perspective is something we're ready for.
Dr. Kurle’s book, The Guidance Groove, teaches how to recognize our internal false stories so we can learn to discover where they come from and how they breed inauthenticity.
For anyone who is second guessing their choice to leave a marriage, this podcast promises to shed some clarity on those decisions.
"Leave him," they say (Or her, as the case may be) when there's violence and abuse involved. Dr. Fontes, author of Invisible Chains: Overcoming Coercive Control in Your Intimate Relationship, also works as an expert witness in legal cases related to child abuse and intimate partner violence (or coercive control), particularly where cultural issues are relevant. As a fluent speaker of Spanish and Portuguese, she researches and trains in these languages as well as English, across the U.S. and other countries.

Lacking the funds to hire an attorney is a big problem in the U.S., but a new alternative to using an attorney for your divorce was recently made legal in Arizona. Combining the detail work and "heavy lifting" of document preparation from a paralegal, and mixing in the courtroom work of an attorney, is the newly designated licensed Legal Paraprofessional.
In today's Modern Divorce Podcast, host Billie Tarascio talks with Christy Farmer, one of the first LP's licensed in Arizona and already taking on divorce cases that would otherwise need an attorney. Christy describes what it takes to step into this new role and how she has adapted from being a paralegal to standing up in court and arguing cases for clients. Hint: She loves that part!
So far, Arizona, Oregon, Utah, Colorado, New Hampshire, and Minnesota have active licensing programs, while California, New Mexico, South Carolina and North Carolina are considering creating of similar programs to help legal consumers.
Divorce can be the most dangerous time for those who have experienced domestic violence. It can also be tricky inside the law office working on your case, if your ex is crazy, angry and ready to lash out.

Caitlin talks about the training and steps to take to protect yourself both at your workplace and your home.

In this episode of the Modern Divorce Podcast, Host Billie Tarascio talks with relationship sleuth and divorce coach Johanna Lynn of the Family Imprint Institute who specializes in finding and resolving emotional and relationship patterns that can lead to breakups.

Almost everyone who gets divorced struggles with the trauma and depression that comes with it. Plus, there's often a cycle of toxicity in the relationship that some people have a lot of trouble breaking free from. Do you want to release your demons and patterns that drive you crazy? Listen up.

With so many helpful tools and apps out there, it was only a matter of time before something would come along which would help divorced parents figure out a fair way to split up their parenting time. The Custody X Change app helps single parents describe a schedule using the correct legal terminology, while also creating a professional-quality calendar you can present in court or negotiations to bolster your case.

For Joshua, it's about feeling like he belongs as-is, but legal clients are looking for that same feeling as well.

In this episode of the Modern Divorce Podcast, host Billie Tarascio talks with Chris Beck of Soberlink, a company that makes a real-time instant test device with verifiable evidence to let everyone know if someone is drinking or not.

Common practice among divorcing parents is to make the other parent look bad either overtly, or by fixing the other parent's failings by coming to the rescue for the child in the middle. While rescuing the child every time Mom or Dad fails may be well-meaning, it's the child that suffers as a result. That's just one of the examples Despina reveals in this podcast, which is a must-listen for divorcing parents.
Kids can take the biggest hit in divorce because their lives are in someone else's control, leading to alienation, depression and broken relationships. In this episode, clinical psychologist Dr. Don Gordon, the designer of the Children In Between online program for children of divorce, talks about the ways to mitigate the impacts of divorce on children.
According to Dr. Don, there's a lot of fear and anxiety about the unknown for children seeing their parents split. The online course is inexpensive, fulfills the court parenting class requirement, and comes with a program just for kids as well.

While an attorney can navigate the legal aspects of divorce, the CDFA can create the financial plan to get through the divorce so that you are best positioned to survive and thrive after the judge signs the divorce orders.
Taking a second home while letting your ex keep the first? Not so fast. A CDFA can show you how you might get slammed with capital gains taxes and come out with far less in the end, without taking the right steps. Trading IRA funds to buy out an ex's stake in the family home? A CDFA can help you decide if that's the best move for your bottom line and how to make that move.
This discussion is perfect for anyone who is concerned about their finances and making a budget work in divorce. To connect with Shanna, go to heritagefinancialAZ.com
In this Modern Divorce podcast, Arizona family law attorney Billie Tarascio and Virginia family law attorney Devon Slovensky break down the elements that you need to take into account when deciding whether to sell the family house and start new elsewhere - or if you can keep the house during and after the divorce process.
Each state has its different rules, but the same emotional elements will be at play in any state you divorce in. Some people trade a stake in the house for part of a 401(k) when splitting assets, but there will be differences in the way each asset grows over the years, and the tax implications.
This episode is specifically for anyone contemplating divorce and whether to stay or go: it's the all-important question and one that can have years of after effects on your life and finances.

Pop artist Britney Spears, at 39, is still not in charge of her own life. The #FreeBritney movement, spurred further by a New York Times documentary airing on Hulu, looks at why she is still enduring a court-sanctioned conservatorship managed by her father, and whether her adult rights are being unfairly or criminally curtailed.
In this fascinating episode of the Modern Divorce podcast, family law attorneys Billie Tarascio and Darin Colburn of Modern Law break down the areas that make them suspicious of - even angry at - these arrangements, and how they'd approach the situation as attorneys. In fact, the conservatorship, and her father's behavior, has been used against her, to limit her time with her own children.
For anyone who is following the #FreeBritney movement, or is interested in the effects of conservatorships in family law, this is a must-listen.
In this fascinating episode of the Modern Divorce Podcast, host Billie Tarascio talks with Dana Lam, founder of the Surprise Date Challenge on how to save a marriage from divorce with some simple steps that anyone can do. The conversation also covers when you'll know if it's "over," and Dana's own rocky path to understanding these steps after suffering a divorce to her children's father.
Keeping a marriage and a relationship together is said to take "work," but in this episode, Dana explains how her Surprise Date Challenge came to be. She's also written a book on the subject by the same name.
When a professional person who runs a business, like a dentist, doctor, lawyer, or accountant, is in a divorce, the "goodwill" value of that business and professional value can be a key sticking point.
Professional business valuations can be thousands of dollars different depending on how, and who, does the valuations.
In this episode, Modern Law Attorney Billie Tarascio talks with Chris David, of Health Value Group (healthvaluegroup.com) about the process for setting a valuation and what factors are taken into account.
This episode is a must-listen for anyone divorcing who operates a business based on their professional training and education. It's a technical area of law that affects average people divorcing in community property states where assets are customarily split in half. How do you place a value on an accountant's book of business? What happens when one spouse has student loan debt accumulated during the marriage?
You may have to listen to this one twice, and take notes.
Spousal maintenance - what used to be called alimony - can be a key negotiating point in a divorce. In this episode of the Modern Divorce Podcast, Family Law Attorney Billie Tarascio talks with Ryan Claridge, a Modern Law attorney, who talks about the strategies involved when it comes time to asking for spousal maintenance.
It's not a divorce penalty, Ryan says, but it is a bridge for one spouse who makes less money than the other, to receive income from the other spouse for a period of time. Sometimes courts look at spousal maintenance as "compensatory," such as when one spouse supports another while getting a college degree, for instance.
For anyone who is in the midst of splitting up and potentially receiving - or paying - spousal maintenance, this discussion is all about your money and how you can make the most of it.
In this Modern Divorce Podcast, we do a deep dive into the common issues that come up for divorced parents who are jointly raising children. And there are problems aplenty - which can sometimes be solved beforehand in a well drafted parenting plan.
What if mom doesn't want the kiddos to have cell phones because they aren't doing their school work? But dad disagrees because he pays the cell phone bills. That could be part of a parenting plan. But how should issues like children's doctors and discipline be addressed? How should a parent react when the other uses corporeal punishment like spanking when the other is strictly against it?
Colombian-born family attorney Henry Alzate talks with Modern Law's Billie Tarascio about how to navigate these very difficult waters, and how to handle communication issues that surround disagreements. Building a parenting plan may need to include details for dealing with a teenager when that child is currently five.
Henry Alzate has a private practice in the Phoenix area, and can be reached at 602-290-5487. You can also reach Billie Tarascio at info@mymodernlaw.com or at MyModernLaw.com
When it comes to splitting up property and money with your ex, are you leaving too much money on the table? Can you get a better deal with your spouse if you negotiate harder, or in a better way?
In this Modern Divorce podcast episode, your host, Billie Tarascio talks with her Modern Law colleague Darin Colburn about the asset and money split between Amazon owner Jeff Bezos, one of the richest men in the world, and his ex wife MacKenzie Scott. The discussion has some critical negotiating points for anyone splitting up assets in a divorce, including things you are absolutely entitled to, and assessing your real value and contributions during a marriage.
Some people may be interested in striking a quick deal and getting OUT of the marriage, but in other cases, people may be more interested in doing a deep dive into hidden assets or mis-valued assets. This is a fascinating breakdown of things you need to know during a divorce.

In this episode, she shares with host, and Family Law Attorney Billie Tarascio, all the details of the good and bad of nesting, and what happened to her family during the process.

So now that your marriage is over, what happens to your kids if something happened and you died? Who would take care of them? Do you want your ex and family to keep your parents and family members from seeing the kids. Probably not.
In this episode, family law attorney Billie Tarascio talks with divorced dad, and estate planning attorney Rilus Dana, where they walk through the process of how to do a quick and legit will naming guardianship and then how to make sure your assets go to your children and not to your ex (unless that's what you want!).

How do you deal with an ex in the middle of a divorce (or even after a divorce) when emotions are running high and a new conflict may erupt at something unexpectedly? Therapist Erik Gagnon explains some of the rules to avoid and resolve conflict using these key elements:
"We don't want to go back to something that happened six months ago or six years ago," Erik explains in the podcast. "Because then we bring up more of those kind of specific resentments that won't get us to resolving the conflict. It really needs to be about how we're feeling at this time and how those feelings interject in our arguments or our discourse."
This discussion, with divorce attorney Billie Tarascio, takes a critical look at the things that need to happen to put out the emotional fires in those unavoidable conversations with your former partner.
Divorce is hard enough without having to deal with the fallout with children. At our law practice, much of the focus of divorcing parents is on helping the kiddos and teens survive the split.
