A court in Saskatchewan has ruled on the constitutionality of breath testing at the roadside with no suspicion of impairment, or even alcohol consumption. He found that it is a violation of Charter rights against search and seizure, but that this violation was justified under s. 1 of the Charter, which means that the law is constitutional. Lawyer Ian Runkle discusses the case, and examines what it may mean for Canadians--especially in cases of certain physical or mental disabilities.
