So since the COVID19 pandemic, the US Trustee has announced all 341 meetings will be held telephonically until at least July. I am hoping they will continue this. In my opinion, it is much more convenient for the debtors, attorneys, courthouse staff, and the Trustees all the while covering the requirements!

What have I done in response to the CoronaVirus? As of March 17, 2020, my office is working remotely...I can't have my awesome employees getting sick! Seriously though, I set up my office to have this capability and within a day, everyone was up and running. Of course we are no longer having in office meetings at this point, but we can utilize the phone, email, snail mail, etc to communicate and send/receive documents to and from our clients and prospective clients. The goal is to still provide excellent customer service throughout this crazy, unprecedented time. Stay safe!

Many times clients are nervous, scared, can't sleep, or are unsure of what happens at the 341 meeting of creditors after they file bankruptcy. Don't be nervous! Normally the 341 meeting occurs roughly 30 days after the case is filed. It is a public "docket call" with the bankruptcy Trustee. If you have an attorney, they should go through with you what to expect during the meeting. The meetings generally lasts 3-6 minutes and involves the Trustee swearing you in and asking general questions about your case. If there are specific issues in your case, they may ask about that as well.

A common misconception of a Chapter 13 bankruptcy is that you have to pay back all of your debt. Most of the time you don't. Student loans can be very difficult to discharge in a bankruptcy. There is the Brunner Test, the Courts can use the totality of the circumstances or a combination of both. Discharging other debt can free up money to allow payments to student loans, ultimately paying them off.

Should you file a chapter 7 or 13 bankruptcy? That is only a question you can answer. And you can't answer that question without good information. A bankruptcy case can be complicated and involves a lot of data. Is some of your property exempt, if so what? Do you have to pay to keep some property? What, if any, property is non-exempt? When you file a bankruptcy, you are required to list any collections of value you may own. These collections are generally considered non-exempt property. So if you want to keep them, you will have to pay the value to keep it or turn it over to the Trustee, who will sell it and take the proceeds to pay creditors. I explain that I collect older Hot Wheels and that would be something I would have to disclose if I were to file a chapter 7 or 13.
