The National Association of REALTORs was in the news last week concerning two policies. One was changed and the other was upheld.
First, NAR voted to end the requirement of NAR membership to gain access to REALTOR owned MLSs. This is a great policy change but did the change go far enough?
Secondly, NAR failed to approve the required disclosure of referral fees in a real estate transaction. This is a very bad look for the Association especially when you hear the amount of support in the Association for the change.

There is a brand-new study being touted in the industry that discusses the state of your commissions/fees since the Sitzer Burnett settlement.
The study by the Consumer Policy Center is eye-opening in the omissions and obfuscations made to reach the predetermined conclusion that real estate agents are doing workarounds in order to preserve pre-settlement commission rates. Oh, the greed that you must possess for wanting to get paid for your work.
The study ignores the new settlement rules in place and places outweighed value on agents trying to maintain status quo instead of following market forces.
The study also suggests that real estate agents, unlike any other profession, should cut commissions and fees simply because it would be good for the consumer!!!!! Try to get your doctor to cut his fee because it would be good for you. What a joke!!

Why do builders offer a buyer agent incentive?
It is very simple; to convince you to show their house over the competitors and so you will advocate for the builder when the buyer is choosing between multiple houses. Congratulations you just described commission steering. See the problem with that? You are supposed to advocate for your client and not the seller!

I have spent a lot of time lamenting over the destruction of Clear Cooperation. The biggest threat to CCP is Robert Reffkin, CEO of Compass. With a possible Anywhere merger at hand, many in the industry fear that he will push the policy over all Anywhere brand platforms.
Today, I have a copy of the advertisement Compass uses to sell clients on the Compass Private Exclusives and boy is it bad. It is pure propaganda that tries to convince a seller to go against what is best for him by promising better offers by limiting the exposure of the house. Pure non-sense.

The Central Carolina REALTORs Association has amended its' sales contract. The contract that will go live near the end of September 2025 and includes new provisions on agent compensation, seller transaction costs, authority to sign and home warranties.

FinCEN will simply not go away. We thought it was over last year when the government halted the requirement to file your business entity disclosures. But now the anti-money laundering portion of FinCEN requirements for cash transactions involving a corporate entity purchasing property must provide a 120 plus item disclosure which will cost your clients hundreds of dollars and hours of time.

There continues to be massive numbers of people without power in the Upstate and even here in the Midlands of South Carolina. Today I discuss what agents need to know on how lenders and insurance companies may treat closings moving forward this week.
I have had many conversations with Realtors who espouse their anger over how things are being run at NAR. In fact 62% of Realtors in a national poll have stated so. Today I offer Ten "suggestions" for NAR that will help it suck less.
In providing this list it is done with a belief that NAR is probably the only group standing between you and the morons in the government screwing you more. And it is also done with a belief in the value of SCR and the local associations.

As we enter the second full week of the implementation of the settlement, I began getting many calls for me to draft an Exclusive Right to Sell Agreement that is NOT broker to broker compensation. Brokerages have already started to recognize that the traditional system of broker to broker compensation is not only on the endangered list but is also a liability nightmare.

I have been warning agents that the NAR Settlement was just the beginning of this. More lawsuits and government intervention would soon follow. Today I discuss a $3.29 million settlement/fine involving real estate agents and title insurance.

Two things are 100% expected. You will always have to pay taxes, and the national media is a joke. They lie and obfuscate. They work an agenda and allow half-truth and inuendo to take over. Moreover, there is zero intellectual curiosity in the media. That just spout talking points and never examine the issue to see if the points are truthful.
Case in point, the LA Times has already issued a "news story" making all kind of ridiculous claims that are unsupported. Of course, chief among these is that the price of houses "could" go down as a result of the settlement. I will expose the media bias and lack of investigation on today's episode.

In May 2024 Governor McMaster signed the revised SC Code §40-57-10 into law. In that statute that governs the practice of real estate in South Carolina there are several provisions dealing with "wholesaling". Today we will examine the statutes to determine if wholesaling is illegal or not in South Carolina as well as why real estate agents should consider adding several investors as clients.

Finally, South Carolina is at the forefront of something good. South Carolina is one of the first states to prohibit and void the 40-yearlong listing agreements that are recorded at the register of deeds office and binds even future owners to the agreement. As if almost on cue, another real estate agent commission lawsuit dropped last week. This time it was filed against 50 to 60 mainly local South Carolina agencies. Notably missing this time were the large brokerage that settled their lawsuits with the Sitzer/Burnette plaintiffs. What does this mean for the market?
Also, there is bi-partisan opposition to a bizarre title insurance proposal where Fannie Mae would assume the title risk in place of title insurance companies. It is truly preposterous. Learn if it would affect your closings.

Is it illegal for a real estate agent to post a picture of your listing on social media asking potential buyers to contact them to see it? Many, if not all of you, are familiar with MV Realty's "Homeowner Benefit Program" that pays the homeowners a small sum of cash in exchange for what amounts to a 40-year lien on the property. This lien requires the homeowner and all future owners to use MV Realty as the listing agent for the entire 40-year term and contains stiff penalties for failing to do so. Luckily, these may be coming to the end as MV Realty made a huge move that may spell the end of this arrangement.

In June 2022 the South Carolina REALTORS revised the "State" contract removing the repair procedure section. Now that the latest version of the contract is about 8 months old, it is a good time to look at other changes that are needed in the contract. Today I finish up with Part 2 of the Central Carolina REALTOR Association contract changes. It is always a big stress as a real estate agent to learn a new contract.
On January 1, 2023 the Central Carolina REALTORS Association will begin using its' new and improved contract in the Midlands of South Carolina. Even if you mainly use the SCR State Contract you need to learn the CCRA contract as we are seeing more and more outside market contracts being presented everyday. Many consumers think that interest rates are at an all-time high and that buying a house is so much more expensive now than it was this summer. That would be incorrect. As of the first of December 2022 interest rates are lower now than in June and just slightly more than in April. But even if rates go up or are higher than this spring and summer, buying a house is vastly cheaper in most cases because of the end of the appraisal gap and multiple offers.

We complete Real Estate Agent safety month with this episode. Today we examine the dreadful case of the Beverly Carter kidnaping and murder. Beverly was a real estate agent, mother and wife. She was living and working near Little Rock, Arkansas when she was attacked, abducted and murder by a husband and wife criminal team at a real estate showing. The attack was pre-planned and specifically targeted Beverly because "she was a woman and a rich, real estate agent who works alone."

One of my passions is Major League Baseball. I have personally been to 22 of the 30 stadiums and I live and die by the Atlanta Braves. The real estate industry as a whole is very slow to change. It took many years for technology and apps to take hold in the market. Today we are staring at a dramatic change in how real estate closings will be performed in South Carolina beginning in 2023 and beyond. The introduction of In-person Electronic Notary (IPEN) will create tremendous structural changes. If the Congress passes nationwide Remote Online Notary (RON) then the distance closing will also change dramatically. All of this is for the better.

While the contract is more or less the same, two major deletions to the previous contract completely changed the contract for the better. Did you know that waiting just 20 minutes to respond to a lead has the same conversion rate as waiting 24 hours? And that conversion rate is not very good! Real estate agents spend an inordinate amount of money buying leads and even generating their own leads but often never examine the effectiveness of their response or the time that it took them to respond. Responding timely can increase your likelihood of conversion by 391%. Maybe the problem is not the number or types of leads you get but rather the failure to respond timely. The good news is that is easily fixable.

As we observe National Estate Planning Week, people are beginning to realize that estate planning is not just for the wealthy. Anyone who owns an asset that they want to leave to another needs a Will. But, everyone needs a Health Care Power of Attorney, Living Will and Durable Power of Attorney. Real estate agent, Jason Compton, shares his harrowing story of being held at gunpoint while showing a house. Hear the entire story as well as how he survived and what happened to the assailant. It is guaranteed to scare you and make you mad.
Unfortunately, attacks like Jason's are not unusual in the real estate profession. Nine percent of all real estate agents reported being attacked in 2019. Twenty-three percent of real estate agents even said that at some point in the past year they felt unsafe in their profession. The number rises to 41% for female agents. Only 5 percent said they never felt unsafe at work.

I have been doing real estate closings for 26 years. Criminals have always seen the real estate transaction as a area ripe for fraud and other shenanigans. In this episode I give you the Top Six real estate scams for 2021 that are not wire fraud. Of course, wire fraud continues to be the top dog in real estate fraud, but everyone should know that by now. The Multiple Listing Service is the lifeblood of the real estate agent. But the processes and rules aren't always clear cut and easy to ascertain. One of the first things a real estate agent completes on a contract is the party's name. The last thing the real estate agent does is have the contract signed.
Are you listing the name correctly and is the person signing the contract authorized to do so? Too many agents gloss over the importance of getting this correct. The real estate market is on fire. Multiple offers are being made in a matter of hours. Most of the offers are for asking price or higher. Sometimes an offer will be for $50k, $60k, $70k or more over asking. But is this offer legit or fake? Lexington County just implemented a six month moratorium on all new developments. This governmental overreach will result in less housing inventory, higher prices and the end of affordable housing in the County Plus it will do nothing to stem the growth demand in the county. Every real estate agent works in fear of having a grievance filed against them with the Real Estate Commission. Many agents think because they are a good and ethical agent that no one will ever file a grievance against them. That is just plain wrong. Most of the agents I represent before the Real Estate Commission are top agents in the MLS and are pillars in the real estate community. These are the agents that sit on real estate boards and mentor agents. The truth is any agent can have a grievance filed against them. In this podcast I bring my experience of representing over 50 real estate agents before the real estate commission to explain the grievance process. I also provide you several ways to protect yourself now so if a grievance is filed you will have the ammunition to defend yourself.

Is your brokerage and closing attorney harming your business because of a financial arrangement between the two?
When your brokerage enters into a financial arrangement with a closing attorney, do you really benefit ? The answer is clearly no. Not only are most of these arrangements questionable in their legality, the benefit never makes it way down to you, the agent.
But even worse, these fee sharing arrangements could be costly to your business. When your brokerage pushes you to use a closing attorney based on its' financial arrangement and not based on cost, speed and quality, your client can pay higher fees, receive lower customer service and lose the freedom of choice. All this adds up to an unhappy client who is less likely to refer business to you.

Earnest money became a big problem for real estate agents due to a South Carolina Real Estate Commission ruling a few years ago. Since that ruling, most real estate agencies quit holding earnest money. Today, closing attorneys typically hold the earnest money in trust. In this podcast I discuss how some restrictions can prevent a homeowner from adding solar panels to their home. I also discuss issues that a seller faces in selling a house with solar panels. Does the seller have to pay off the solar panel lease before conveying? Is the lease agreement a lien against title? Can the seller assign the solar panel lease to the buyer? Does the buyer have to assume the maintenance agreement and does the buyer assuming the lease affect the buyer's ability to purchase the house?
