The Right To Cure Defects in a real estate transaction can be hard to understand. More difficult is how to apply it in a transaction whether you are buying real estate or selling it. 

Identifying what is considered a "Defect" is really the first thing to understand. Once you have an idea of how to define a Defect, and what is considered to be a Defect, only then are you able to dive into understanding the Right To Cure. Whether selling or buying, having an understanding is important to negotiating the best deal possible. 

Every seller wants the Right To Cure and most Buyers don't wish to give the Seller the Right To Cure. In competitive situations, like we see in today's current selling environment,  a Buyer is generally forced to give the Seller the Right To Cure. When the Buyer knows a Seller is receiving multiple offers, the Buyer has to do everything in their power to present the best offer. The Seller has the upper hand in today's market. Whether the Buyer elects to give the Seller the Right To Cure or not, there are still ways to ensure the Buyer is treated fairly.

Most will remember 2020 as the year of COVID-19. But there were many other things of significance that occurred. A nation that seemingly became divisive, political unrest, incredible Wisconsin weather - so much more defined what 2020 became to be.

Ask any realtor and they'll tell you that the home inspection can be a double-edge sword. 

On the selling side, the inspection could present issue sin the home the seller did not know about previously. The seller might not have any idea that there was mold in the attic, or movement in the foundation walls.

Photography is EVERYTHING - literally. Although all components are important to selling a home the fastest and for more money, great photography is the most important when buyers eventually find your home for sale online. Although they are not required, and the decision to conduct is between the seller and the realtor, most listings conduct "opens" because they are expected to do so.

Tell It To The Judge!

When someone hears that phrase they often depict a traffic cop telling a speeding motorist to address their concerns over a speeding ticket to the presiding judge. However, what happens when a Seller doesn't disclose known Defects in a property they are selling? This episode addresses the interesting, and ever-so-important topic of Disclosure.

Imagine if you were Buying a home and a Seller didn't disclose leaking pipes. or a known condition in the home. Imagine that you, as the Buyer, found out from the neighbor that the previous owner knew of those issues and didn't disclose them in the Seller's Condition Report.

State law mandates that Seller's complete, and relay, known Defects in a Property they are selling. Yes sometimes Sellers decide not to mention the tree roots that occasionally creep into the sewer laterals, or the occasional leaking roof when ice dams form.

John addresses how to protect yourself as a Seller and how to proceed as a Buyer when it comes to Disclosures. The Wisconsin Real Estate Condition Report is covered, as well as the other disclosure forms when selling vacant land or a commercial property.

Everything you need to know as a Seller is in this episode when it comes to disclosing. In one word, as John puts it, "Over-disclose" at all times. Tell the Buyer more than you think you might need to. And when in doubt, or you consider not disclosing, picture yourself sitting on the witness stand in court testifying in front of a judge or a civil jury.

For decades all parties in a real estate transaction attended closings - it was just the norm. In fact, all parties used to close at the same table! This has changed significantly today, however. Buyers close in a different room than sellers for privacy reasons. Buyers usually have to attend closing in most cases. Sellers show up mainly to get their proceeds checks. Once closed, Buyer's lender congratulated the buyers that they "bought a house" and everyone celebrated. The title closer walked into the room where the sellers were and gave them their check and asked "Do you want to meet the buyers?" Awkwardly the seller agreed.

Seller and buyer finally met and began to size one another up. Seller told the buyer what day garbage collection is, which neighbor was the greatest and so on. Usually this "hand-off" goes pretty well. If the buyer & seller didn't experience a great set of negotiations, then they quickly said "good luck" and the seller left. Or worse yet, they almost started fighting.

It only takes one bad scenario to place the seller in a VERY bad spot in many aspects.

In this episode John explains that there is NO REASON for a seller to attend a closing - in fact, he nearly always advises his clients to avoid going altogether. Seller can be represented by the title company, closer, attorney, or agent...and never have to come face-to-face with the buyers. Is this too harsh? Everyone wants to see their beloved home go to a nice family following them, but in today's litigious society sellers are tempting their own legal fate.

Imagine meeting the buyer before walking out the door and the buyer asks any of the following:

  • "Mr. Seller, can I ask you what caused those dark areas in the southeast corner of the basement again? I know you mentioned something in your condition report about it but thought you could tell us a little more?"
  • "Which neighbors have kids and which ones are the ones we should get to know first?"
  • "Does the neighbor's dog bark a lot? We're curious because it was while we were there recently."
  • "Can we get your cellphone numbers and email addresses in case we have any other questions?"
  • "There was an outlet in the hallway where we couldn't find what it controls; can you tell us please?"

While some of these may seem simple and innocent, imagine how you would feel if the buyer didn't like the immediate neighbors and called you to tell you about it. Or if the hallway switch was actually a Defect you knew nothing about when you sold the home. Or if the buyer started calling you repeatedly because the neighbors dog wouldn't stop barking.

A good realtor will never encourage you not to disclose known Defects in your home, nor hide information from a prospective buyer. However, closing is not the time for a curious buyer to start asking questions a seller doesn't anticipate and that puts the seller in a very precarious position.

Let's face it, sometimes the honeymoon ends quicker than anticipated. You hired what you thought was is a great agent who now isn't so great - what do you do? You might be staring at substandard photos, marginal marketing, and an agent that doesn't quite have the experience they claimed to have had when you hired them.

What can you do, especially if you are selling your home? Are you tied into the remainder of your listing contract? Can you "get out of" the contract if the agent isn't good?

How do you get back "on track" with your agent and to ensure that expectations are known to each other. When things go bad, it usually is because communication broke down somewhere. Here are some of the main complaints John addresses in this episode:

1) What equipment did the real estate use to photograph your home?
2) What is your agent doing specifically to market the home, and not just at open houses?
3) Why did the communication break down?
4) How can we fix things with our agent - we like him or her but they aren't meeting our expectations?
5) Can I get out of my current contract if I want to make a change?

Maybe there wasn't enough "due diligence" when you first met the agent, but it isn't too late to right the wrongs and move forward with or without your current agent.

How do you best prepare your home for showings?

As a seller, this is your MOST important time! How do you best prepare your home to be shown to prospective buyers? What things are most important? Should we bake chocolate chip cookies? What scents are off-putting to buyers? How can sellers best create a successful buyer experience which will result in a quick sale for more money?

Here are some of Johns' top talking points & lessons from his episode:

  • Above all, sellers need to understand they are creating experiences, not merely trying to sell homes. Just like major hotels, resorts, and attractions, sellers are using great sights, sounds, and smells to create an unforgettable showing that attracts buyers who are willing to pay top dollar with the best terms.
  • Sellers must be ready once they are "live"...no more living with toilet seats up and underwear lying around...even when a seller heads to work they could get showings requests while they are gone and they always need to be ready.
  • Neutral colors and smells are usually best - work with your experienced realtor to decide the best approach long prior to listing your home
  • If a showing is scheduled for an hour, be sure to leave at least 15 minutes prior to and arrive well after 15 minutes after just in case the buyers are running early or behind.
  • Multiple showings at any given time is a great things for the seller - buyers tend to look at one another and start to wonder why the other buyer is in "their" house.
  • Lighting throughout the house should be consistent. LED lighting is okay but should not look like fluorescent lighting.
