🎧 The NJ Cannabis Legalization Series continues on the NJ Criminal Podcast. Meg is joined by Middle Township Police Chief, Christopher Leusner, to discuss the use of cannabis by off-duty police. 🍃

Chief Leusner began his career in law enforcement in 1997 and was promoted to Chief in 2009.

A graduate of Middle Township High School, Gloucester County College, and Saint Leo University, he holds a Master's Degree in Administrative Science and a Certificate in Law and Public Safety Leadership. He also graduated from the FBI National Academy Session 234.

In 2000, he joined the Township SWAT team, and served as a member for nine years. Leusner later became the commander of the Cape May County Regional SWAT Team. He was also promoted to Sergeant in February 2003 and served on the Patrol Squad for three years.

In addition to his responsibilities as a police officer, Chief Leusner is also the past President of the Cape May County Chiefs of Police Association and the New Jersey State Association of Sheriffs. He has served as a member of the Cape Regional Wellness Alliance since 2016. He has been active in promoting a healthier and more active lifestyle in the Cape May area through his involvement with the Adverse Childhood Experiences (ACE) project. In addition, he has developed Law Enforcement Summer Youth Camps in four high-risk areas in Cape May County.

We are honored to bring back one of our favorite guests, Christopher Maag. 👮🚨🚓🚨👮 Chris is a reporter for The Record and USA Today. He joins Meg to discuss the case of Khalil Wheeler-Weaver, who was convicted of killing three women and attacking a fourth in a span of 84 days in 2016. He describes the timeline leading to the arrest, in large part, due to the actions of the women involved.

In October 2021, Wheeler-Weaver was sentenced to 160 years in prison. In March 2022, he was charged with the additional murder of a 15-year-old girl.

Meg and Jeff Horn, Toms River family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions.

In State v. Steven Bookman, the New Jersey Supreme Court granted cert to address the issue of whether it is permissible for police officers to enter a third party home under the hot pursuit doctrine when they are chasing someone in an attempt to execute an Automated Traffic System warrant and the person flees.

Meg and Jeff wrap up their 5-part series on 2021 New Jersey Supreme Court decisions by reviewing State v. Gabriel Garcia in which the New Jersey Supreme Court admonished a prosecutor for exploiting an evidentiary ruling favorable to the State, thereby presenting a false narrative during his closing argument.

Justice Albin sternly reminded all prosecutors that they are “required to turn square corners -  because their overriding duty is to DO JUSTICE.”

Meg and Jeff Horn, Toms River family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions.

In October and November 2021, the New Jersey Supreme Court granted cert in two cases dealing with Miranda and the admissibility of a defendant’s statement to police.

In State v. Jamal Wade, the Court agreed to address the question of whether the defendant, who contends that he was not informed of the nature of the charges against him or that he was under arrest, knowingly and voluntarily waived his Miranda rights.

In State v. Abayuba-Rivas, the Court agreed to address the question of whether the suppression of the defendant’s statement to police due to a violation of his right to counsel requires the suppression of defendant’s later statement to the police made the following day.

Meg and Jeff Horn, Toms River family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions.

In Episode 3 of this NJ law podcast, Meg and Jeff discuss several cases dealing with New Jersey motor vehicle statutes prohibiting license tag frames that conceal a portion of the license tag and New Jersey motor vehicle statutes prohibiting tinted windows, in terms of when the police can lawfully stop a driver who is violating these laws.

In the consolidated appeals of State v. Darius J. Carter and State v. Miguel A. Roman-Rosado, the New Jersey Supreme Court decided to narrowly interpret NJSA 39:3-33, which makes it illegal to have a license plate frame that conceals any part of the tag.  Earlier this year the New Jersey Supreme Court granted cert in State v. David L. Smith, a case dealing with NJSA 39:3-74 and -75, the law prohibiting tinted windows.  We are anxiously awaiting the Court’s decision next year on this issue

Although these motor vehicle statutes may seem minor, a stop due to a violation of them may have grave consequences due to the domino effect of a subsequent search and seizure of alleged contraband on the person or on the vehicle of the driver.

A 1979 graduate of Rutgers Law School in Camden, Don was working as a litigation associate for one of the oldest and most venerable law firms in Chicago when, in 1986, he volunteered to serve as a pro bono attorney for the American Bar Association’s Death Penalty Representation Project.  Don was assigned to represent Tommy Hamilton, who at the age of 20, shot and killed his boss in Alabama and was sentenced to death.  Summary Judgment is a firsthand account of Don’s efforts to save Tommy’s life.

Monday 6/15/2020 – US Supreme Court declined to hear 8 cases involving qualified immunity - – 7 of which involved police accused of excessive force / misconduct – 6 of the 7 involved plaintiff’s suing police and lower courts protected officers by saying qualified immunity applied 2 ways a case gets to the US Supreme Court

  1. Original Jurisdiction – cases between two states / cases involving ambassadors / public ministers

  2. Appellate Jurisdiction – cases on appeal from lower courts

a. Litigants ask them – file a writ of certiorari (ser shee or rare ee) “grant cert”

b. 4 of the 9 justices must vote to hear it

c. Only agrees to hear 100-150 of the more than 7000 cases it is asked to review each year

Court basically said we won’t even hear this case. We won’t even consider it.

Justice Clarence Thomas disagreed – wrote a 6 page dissent in one of the cases involving a guy in Tennessee who was bit by a police dog and who said he had put his hands up in surrender

Justice Thomas said he continues to have “strong doubts” about the qualified immunity doctrine and he would grant the petition for cert No relief = No accountability Scales of justice unbalanced If SCOTUS won’t revisit – Congress should

MEG NOTESWhat rights do you have when you’re protesting??

If police aren’t accountable, how can you protect yourself from criminal charges or worse yet – physical harm?

**1.Can you protest?

Absolutely**

**2.Where can you protest?

Public** (Streets, Sidewalks, Parks)

If on private property could be charged with trespass

Can’t block vehicle or pedestrian traffic

3. Can you use cell phone / other device to record?Public property – YES - Can photograph / video

Police can’t seize and/or search cell phones without a warrant

Use care - Audio – Wiretap laws (NJ – only record audio if party to conversation)

**4. Can police interact with the public?:

-**A. Police have a duty to protect the Constitutional rights of individuals

a. 1st Amendment right - Peaceably assemble

-B. Field Inquiry: Police always have the right to approach someone and ask then if they would be willing to answer questions with zero level of suspicion

a. Individual under no obligation to answer questions

-C. Stop / Investigative Detention: RAS person has committed a crime (ex. marijuana smell)

a. No right to Miranda

b. Pat down for safety if RAS armed and dangerous (example don’t remove hands from pockets / furtive movement and then lie about it) (not a search)

i. PC for weapon / contraband (search)

-D. Arrest: Probable Cause

a. Search Incident to Arrest

5. What if you are stopped and/or that stop escalates to an arrest?Am I free to leave?

Don’t argue

Don’t resist

If under arrest:

Ask why

Don’t argue

Don’t resist- even if you believe arrest is unlawful!! (Obstruction)

Remain silent

Ask for a lawyer

Don’t consent to any searches or anything

-If you feel rights are being violated – take note of officer name / badge number

-not all officers wear BWCs / have MVRs

6. What DOESN’T the First Amendment protect:Trespass on private property

Disorderly conduct

Hindering apprehension /OBSTRUCTION

Excessive noise

Looting

Violence

Resisting arrest

Assault on officers

7. When can police use force?Officers trained on de-escalating situations and using least amount of force

Oftentimes this doesn’t happen and force escalates

Use of force continuum:

Constructive Authority (ex. Issues commands)

Physical contact (ex. Hand on arm)

Physical force (ex. Wrestling suspect to the ground)

Mechanical force (ex. Use of baton, canine, chemical spray)

Lethal – to protect officer or another from death or serious bodily harm

Conclusion: Important to know and assert your Constitutional Rights – oftentimes as important, if not more important, to know the Limitations on those Rights to protect yourself from criminal charges and worse yet - physical harm

The DOC / Medical Review Panel will asses release on the following priorities: 

1 - 60 yrs of age with compromised health 🚑

2 - 60 yrs of age OR compromised health

3 - Denied parole in the last 12 months

4 - Release date in the next 90 days
