Partner Visa Relationship & Application Timeline (Full Case Study 1)
In this video our principal immigration lawyer, Martin Salvo, discusses the full case study for Partner Visa Relationship Application Timeline for couples.
Key Topics Covered In This Video:
TIMESTAMP 00:50 - It's really about showing you an example of what an approved partner visa looks like with regards to a couple's relationship timeline, and also their application timeline.
TIMESTAMP 3:51 - There isn't a definitive blanket equation to determine when a couple become de facto in all honesty really just depends on all of their relationship facts and what they did prior to the claim date.
TIMESTAMP 5:56 - We suggest that it would be better to try to bring the partner here first, to apply for a travel exemption.
TIMESTAMP 8:31- We had all the relationship evidence on file, we had the police clearances on file and we had already organized medicals meaning that in street lingo partner visa street lingo, it was decision ready.
TIMESTAMP 9:40 - The stronger an application is, the stronger the couple. The stronger the relationship, the faster it can be processed by the department because there's less questions that need to be asked.
TIMESTAMP 10:48 - The sooner that you can do that in your relationship timeline, the stronger your relationship facts are going to be when the visa is applied for.
TIMESTAMP 11:28 - The case officer will look at two things, the couple's relationship statements, and then the couple's relationship timeline image.
Breaking Down The 2nd Stage Permanent Partner Visa Application Process
In this podcast our principal immigration lawyer, Martin Salvo, discusses INSERT SUMMARY
Insert quick recap of key topics here...
Key Topics Covered In This Video:
TIMESTAMP 1:35 - There are three partner visa options to Australia. Some for OFFSHORE applicants, and one for ONSHORE applicants.
TIMESTAMP 3:31 - Applying as a married/spousal couple or defacto couple is still really the same thing - you both need to show you are more than just dating according to the four aspects of your relationship.
TIMESTAMP 5:25 - Case officers have complete discretion to determine if you are in a defacto or spousal relationship (or neither) when you submit your application.
TIMESTAMP 5:40 - Getting legally married does not automatically mean you will be able to evidence you are in a married/spousal relationship.
TIMESTAMP 8:11 - Where the applicant intends to be will determine the type of partner visa that may be best suited. Onshore or offshore?
TIMESTAMP 9:16 - Couples that initially apply for a PMV and then marry overseas whilst the visa is processing must convert their application to a 309.
Which Scenario are you? Onshore, Offshore or Apart?
In this video our principal immigration lawyer, Martin Salvo, discusses the different scenario of the relationship of the partner visa applicants and sponsors whether they are Onshore, Offshore or Apart.
Key Topics Covered In This Video:
TIMESTAMP 1:20 - The most ideal scenario is where the couple is already here, living onshore and looking to apply for an onshore partner visa.
TIMESTAMP 3:58 - For offshore couples that are looking to come quickly, applying for a temporary visa and come onshore will suit you. Onshore applicants has more benefits as well.
TIMESTAMP 6:35 - For offshore applications, there's competing timelines. How long will the offshore partner visa take versus how long do you have left on the temporary visa that's been granted to you.
TIMESTAMP 7:27- The good news is currently, onshore and offshore partner visas can be processed relatively quickly compared to the last couple of years where you may have been waiting 12, 18, 24 months.
TIMESTAMP 9:29 - We ensure that whatever we do, we are reducing any possibility for couples to be separated.
TIMESTAMP 9:48 - For couples that are physically apart, you may find it more difficult to obtain and accumulate the types of documentation and evidence which are required to prove that you're in a de facto or spousal relationship.
TIMESTAMP 11:39 - The visa options that would work best for you would really depends on your scenario, whether or not you are onshore, both living offshore or currently living apart.
Do Age Gaps Really Matter in an Australian Partner Visa Application?
In this video our principal immigration lawyer, Martin Salvo, talks about the 'elephant in the room' when couples present age gaps in relationships, to what extent they can affect an Australian partner visa and what couples can do to address any potential issues head on.
Key Topics Covered In This Podcast
1:07 - The law does not specify that an age gap will lead to a partner visa refusal, however, it can be part of the overall assessment of the genuineness of a relationship.
1:59 - Age gaps can play a role in the level of scrutiny in a Partner visa application.
3:25 - An age gap in a relationship can present an 'elephant in the room' which should be addressed head-on in a couple's relationship statements.
4:35 - If applicable to your facts, ensure your friends and family comment on your age gap in their supporting statements.
5:04 - It is a misconception that family overseas cannot complete Form 888s.
6:05 - It is important that you normalize any age gap in your Partner visa application. Address it, explain it, give it context and show the DHA your love is ageless!
7:02 - Younger male applicants from high-risk countries of passports are, in my humble opinion, more likely to face scrutiny surrounding any age gap.

In this video our principal immigration lawyer, Martin Salvo, discusses what to do if you receive a Request for Information from the Department of Home Affairs for your Australian Partner visa application.
Insert quick recap of key topics here...
Key Topics Covered In This Video:
1:29 - Acknowledgement Letters are typically generated instantly after lodgement of an Australian Partner visa
2:16 - The DHA are actively prioritizing Partner visa applications that have all relationship evidence, medicals and required police clearances from Applicants & Sponsors.
4:33 - In my experience, 9 out of 10 well-prepared Partner visas will only be requested to provide outstanding Medicals and Police Clearances, if at all.
5:21 - Attaching evidence that you 'intend to provide' any requested documentation or information from your application should prevent a refusal if things are still missing after 28 days.
6:31 - Attaching a signed statement to your application explaining that you are in the process of providing requested documentation is always advisable.
7:07 - You should always rename your documents to demonstrate to the DHA you intend to provide requested items, such as 'Character - Indian PCC - Intention to Provide - Receipt for Application'.
8:26 - People panic when they receive a 28 day deadline on an RFI because they do not know how to correctly deal and keep the DHA informed on how they are going obtaining what has been requested.

In the video you will see me explain the three main considerations in determining when might be a safe and appropriate time for a couple to press submit on their application keeping in mind the importance of Time of Application Criteria for most Australian partner & spouse visa subclasses.
Key Topics Covered In This Video:
01:15 For onshore Partner visa applicants, a visa expiry is often the key determining factor in when a Partner visa is submitted.
02:08 The temptation to submit your Partner visa just to secure your Bridging Visa should not outweigh getting the partner visa granted
04:13 Couples should be strategic and possibly look to delay the lodgement of their Partner visa, but of course, factoring in any visa expiry date.
05:27 Given current processing times, its never been a better time to submit a Partner visa if you meet the requirements.
07:01 Certain couples may elect to first extend their current temporary visa with the intention to apply for their Partner visa later in their timeline when it is safer.
07:52 If you are overseas, then the two prevailing factors in when you should apply for your partner visa typically are a) When do you want to be here, and b) When will you meet the visa requirements?
08:42 The three key factors
All of this, and more, is covered in this video.

In Episode 12, our Senior Immigration Lawyer, Martin Salvo, looks at 3 different topics that will help you on your Australian Partner Visa journey.
The 5 Pieces of the Partner Visa Puzzle
There are 5 pieces of the puzzle that everyone seeking an approved Australian Partner Visa needs to check off before they submit their application. These are broken down into:
a. Awareness of the law
b. Understanding the legal criteria
a. Correctly completed DHA required forms
b. Comprehensive, organised and optimised evidence
c. On-going attention and support
Inconvenient Truths
When you begin your Australian Partner Visa journey, oftentimes clients are focused on the positives and the end result, which is fantastic! But today we are dishing out some of the realities about the Australian Partner Visa process, so that you can understand what you must overcome outside of the legal criteria and required forms in order to get your Australian Partner Visa approved.
Getting Your Ducks In A Row
What do ducks have to do with your Australian Partner Visa? When we say this, what we mean is getting organised as far in advance in your relationship timeline as possible.
There are two moments in time that your Australian Partner Visa Application is going to be assessed on - Time of Application (ToA) and Time of Decision (ToD).
With current processing times ToD is unlikely to be an issue, as during this period a couple will naturally strengthen their facts and their evidence as they have been together for a longer period of time. Where couples CAN run into problems is ToA. As soon as your application is submitted, it’s time stamped and that is your ToA, and when the Case Officer does eventually pick up your application, they will go back in time and look at what relationship evidence you had in place at that ToA. This is why it is most important to start gathering your relationship evidence as early in your relationship timeline as you can.

In this episode, we get back to basics and look at the legal terminology used to determine what is deemed to be a SPOUSAL RELATIONSHIP and what is deemed to be DE FACTO RELATIONSHIP.
When a case officer picks up your Australian Partner Visa application, you may be surprised to know that they are not assessing it against the requirements outlined on the Department of Home Affairs website. They are required, at law, to ensure that your application meets the criteria set out by the Migration Act 1958 (Cth) (the Act) and the Migration Regulations 1994 (Cth) (the Regulations).
So it makes the most sense that we cut straight to the chase and look at what the law actually says.
The definition of spouse and de facto are close to identical.
Both types of couples must prove (on paper) that at the Time of Application:
You are probably thinking “well, what can I provide to show the case officer that I meet the above criteria?”
This is where the Regulations come to the rescue!
The Regulations set out that the case officer must consider all of the circumstances of the relationship, including:
Here at Salvo Migration we refer to these as the FOUR PILLARS, and understanding these four aspects are the key to preparing your best possible Australian Partner Visa Application.

Some very common questions we get from those people looking to prepare their own Australian Partner visas surround when you are considered to have been in a de facto relationship for 12 months and the process of uploading and attaching your evidence in support of your Partner visa application. In this long-awaited episode, Martin discusses the impacts of COVID to all couples looking to apply for an Australian Partner visa, and the options available.
Situation 1 - Both the Applicant & Sponsor are Inside Australia.
Situation 2 - The Applicant and Sponsor are both physically offshore and typically living together looking for ways to enter Australia.
Situation 3 - The Applicant and Sponsor are physically separated, typically with the Applicant offshore, and the Australian onshore, looking for ways to be reunited in Australia.
This audio was taken from our most recent Partner Visa Secrets LIVE 3 Day Training.
What is the 12 month rule applicable to couples applying for Australian partner visas under the grounds of defacto?
How is it assessed and applied by DHA case officers?
How can you remove this from the assessment of your relationship?
We discuss this, and more, in this PVS Podcast episode!
A very common question for those who are in Australia on a student visa relates to when can they cease studying if they apply for an Australian Partner visa from onshore.
Obviously there are benefits to ceasing your study, arguably one of the most logical is that, if you no longer need to study, you no longer need to continue paying for your tuition fees. And that can save you a lot of money depending on exactly what it is you're enrolled to study here in Australia!
Unfortunately however, the visa system in Australia does not make it easy, and applying for an Australian partner visa whilst you still hold a valid student visa doesn't necessarily mean that you can stop studying without having to face possible complications with regards to your student visa.
Senior Immigration Lawyer and Registered Migration Agent, Martin Salvo, explores these topics in this video.
COVID-19 has impacted every facet of our lives and each day, we are all faced with new and different challenges.
In my humble opinion, nothing impacts us more as humans than our ability to be with the ones we love and for those reading this, perhaps you are in the middle of navigating through what can already seem as confusing and overwhelming Partner visa criteria and procedural requirements.
Many of you may even be considering submitting your applications much sooner than what you originally had anticipated, fuelled by the uncertainty of the ongoing and far-reaching impact of COVID-19 and wanting to get some sense of control back by lodging your visa.
However, the one thing I want to make clear to all of you is NEVER RUSH INTO APPLYING FOR AN AUSTRALIAN PARTNER VISA.
Why?
Because of what is known as Time of Application (TOA) criteria.
TOA means that when your application is submitted it is ‘date stamped’ and even though it may take two years for your application to be assessed, when the case is eventually opened by the department, the case officer will, figuratively speaking, go ‘back to the date of the application’ and assess whether or not the four aspects of your relationship demonstrate that you were in a de facto, or married relationship at the time of application (for those applying for the 820 or 309).
When couples run into problems with Partner visas, it rarely revolves around their facts at the Time of Decision (TOD). This is logical though right? If an application takes 24+ months to process, assuming the couple continues to maintain their relationship, in 2 years time they would have naturally accumulated more evidence (i.e. lived together longer, more joint bills, deeper pooling of their finances, purchases more things together, taken more holidays, etc). These are all clear positives, however, they do not necessarily solve or help to strengthen the TOA facts of the relationship.
Now, there is, of course, a bit of a balancing act here.
On the one hand, you're trying to submit a partner visa either to keep your partner lawfully in the country or looking to get it in the queue if you apply from offshore.
But on the other hand, you don't want to bring the assessment of ‘time of application’ in your relationship unnecessarily too soon in your timeline.
The rule of thumb is, and this is something that I talk about with all couples, the longer that you can wait to apply for a partner visa, the stronger your relationship will naturally be.
Of course, there are benefits to applying for a Partner visa (i.e. Work Rights once on the bridging visa and access to Medicare), and there are certain situations where couples are forced to submit quickly (i.e. a visa expiring and lack of alternative options).
However, all I am encouraging you to do is weigh up the requirements, look at your evidence & four aspects, consider your personal circumstances, and ultimately make a decision that gives your Partner visa application the best possible chance for chance for approval.
