The Integrity, Notification, and Fairness in Online Market Retail Marketplaces for Consumers Act, aka INFORM Act, was approved by Congress in December 2022 and goes into effect June 27. It’s meant to help stem the massive tide of stolen or counterfeit goods sold from ecommerce marketplaces, injecting a level of transparency and accountability.

The Buy Safe Coalition, which includes RILA (Retail Industry Leaders Association), estimated in 2021 that $54 billion was in lost annually from the sale of fraudulent goods online. You can imagine it’s gone up since. Even Amazon, long cited as a source of counterfeit traffic, has been working hard to clamp down, creating a coalition, hiring former federal prosecutors and filing lawsuits.

Under the INFORM Act, the Federal Trade Commission can impose a fine of $46,517 for a first-time violation, while they and state attorneys general can impose injunctions and pursue civil actions against marketplace operators that violate the act, up to and including shutting them down.

In general, the onus is on operators to ensure that their sellers are on the level. They must collect and verify information such as bank account number, contact information, tax ID number and working phone and email address from high-volume sellers. This is defined as those earning $5,000 or more or selling 200+ “new” items for any 12-month period within the last two years.

A new global study by IBM found that 61% of consumer goods and retail leaders are purposefully aligning their sustainability and operational goals, with 77% of the respondents agreeing that sustainability investments will accelerate business growth.

The curious case of Walmart and its venture into creating a stable of hot startup DTC brands has come to a close, with the 2023 sales of Moosejaw, Bonobos and Eloquii in quick succession. So it’s a fitting time to take a look at the six-year-plus journey that began with the massive $3.3 billion acquisition of Jet.com in 2016.

While part of it may look ugly on the balance sheet, especially Jet.com and the 76% discount to Bonobos’ $310 million price tag in 2017, Walmart gained a good deal in terms of market intelligence, entrepreneurial innovation and insights into younger shoppers and fashion.

For one proof point, consider that Walmart’s ecommerce penetration more than doubled in that time, from 5% to about 13% or $80 billion as of Q4. As Adam Sandler would say, not too shabby. Being left in Amazon’s dust was a real fear in 2016.

Raj Konanahalli, a partner and managing director of business advisory firm AlixPartners, said Walmart saw the spree, overseen by former head of ecommerce Marc Lore, as a way to grow its digital presence, compete with Amazon and upgrade its branding. The California Privacy Rights Act (CPRA), an amendment to the 2018 California Consumer Privacy Act (CCPA), went into effect on Jan. 1, requiring publishers and advertisers to ensure compliance with new consumer data privacy guidelines.

CPRA rulemaking is still in progress, and enforcement is set to begin July 1. Other states, including Virginia, Colorado and Connecticut are issuing their own privacy regulations. And in lieu of a national standard, the Federal Trade Commission has issued its own regulations on consumer data privacy, mostly focused on children and healthcare; one area the FTC is looking at is pixel tracking, with actions already taken against two healthcare organizations.

New consumer data privacy requirements under CPRA, borrowing from the GDPR in Europe, include the right to correct inaccurate personal data and the right to limit processing of sensitive personal information.

If you think California doesn’t mean business, Sephora was fined $1.2 million last summer under CCPA for not disclosing the sale of personal information, failing to respect users’ GPC opt-outs and neglecting to correct these infractions. Sephora didn’t have to admit to wrongdoing, but it did have to pony up, rectify its data sharing policy, avenues to opt out and service provider agreements; and report on its progress to the CA attorney general. And dozens of other infractions are listed on the California Attorney General’s website, although it hasn’t been updated since August.

In the 1967 Mike Nichols film “The Graduate,” there’s an iconic scene where Dustin Hoffman’s character Benjamin Braddock is given one word of career advice by a well-meaning family friend at his college graduation party: plastics.

Fast-forward more than 50 years, and there certainly was a future in it. The earth is literally swimming in the stuff, causing some forward-looking companies to pursue solutions that aren’t additive to that sea of petrochemical-based apparel and footwear ending up in landfills or incinerated.

Unless Collective, a Portland, OR startup that is creating plant- and mineral-based footwear and apparel, is one of a handful of companies looking to make a difference by its conscious choice of materials and manufacturing. Co-Founder and CEO Eric Liedtke, a nearly 30-year veteran of Adidas who helped start the company in 2019, said it’s the first brand to pilot what he calls “regenerative fashion” made from a 100% plant and mineral base.

Last month, the Department of Labor proposed a change to the way it determines the classification of independent contractors. If it eventually becomes law, the rule change would have a lasting effect on the gig economy and gig workers. It would replace a Trump-era rule that made it easier to classify workers as contractors, and thus not covered by federal minimum wage laws or entitled to benefits like health insurance and paid sick days. Yet the workforce is shifting to a flex model across the board, and delivery/rideshare drivers are no exception.

The recent AB5 reclassification measure in California has upended things, leading to some port work stoppages by angry contractors in Oakland who favored the status quo. So, of course, the DOL’s move has major implications for a huge portion of the last-mile delivery sector reliant on gig workers and independent contractors for their businesses to operate. Kashyap Deorah, CEO of HyperTrack, which has a logistics tech platform for last-mile providers, discusses how DOL and Congress need to take a balanced approach that doesn’t lean too far toward business interests or workers.

In addition to the Lowe’s agreement, Alen recently launched a mobile app and air quality monitors, syncing its air purification system with the burgeoning smart home trend. There has been a steady proliferation in recent years of vendors making autonomous mobile robots (AMRs), as well as serious investment and some M&A activity. At the same time, demand has grown steadily for this type of automated solution in order fulfillment and other applications, especially given the boom in ecommerce and the difficulty of securing sufficient labor. But can different warehouse robots play nice in the same setting?

To that end, trade group MassRobotics has created an AMR Interoperability Working Group. In May, the group, which includes vendors, engineers and client companies, published a standard to guide robotic automation interoperability. This working document will allow different types of warehouse robots to share data such as status information and operational conventions or “rules of the road” in order to better coexist on a warehouse or factory floor. We just had the third anniversary of the Wayfair decision, i.e. South Dakota vs. Wayfair, when the U.S. Supreme Court eliminated the nexus rule requiring physical presence in a state for sales tax liability. That landmark ruling is still impacting retailers, especially smaller ones, in terms of compliance. Also, with so many companies turning on omnichannel services in the past year as stores shuttered, the addition of new channels has sales tax implications. For instance, curbside or store pickup and shipping within a city can be taxed at one rate, but another rate applies if a store shipment goes to an address outside that jurisdiction.
