Jon is an Associate with Samfiru Tumarkin’s Labour and Employment practice group in Toronto and Vancouver. He has successfully advocated for clients before the Ontario Labour Relations Board, the Human Rights Tribunal of Ontario, and both the lower and Divisional Court levels of the Ontario Superior Court of Justice. Jon's practice includes wrongful dismissals, constructive dismissals, severance negotiations, human rights, employment standards, and contract negotiations. Jon's trial wins include Papp v. Stokes, a landmark ruling that reassures employers that they can and should give honest job references without fear of liability for a defamation lawsuit. He was also lead counsel on behalf of a former employee in Nemirovski v. SoCast Inc., which explored the dramatic impact of a non-competition agreement on the amount of damages an individual can receive in a wrongful dismissal.

Employment Lawyer Jon Pinkus, partner at Samfiru Tumarkin LLP, clearly explains that Ontario's new Regulation 228/22 (which makes a temporary change to layoff regulations in an attempt to help employers struggling during the coronavirus pandemic) does not really change an employee's right to claim constructive dismissal if their pay or hours have been reduced, or placed on a temporary layoff.
The new regulation may actually be disastrous for employers, many of which incorrectly believe that they can make any change they want, in the name of COVID-19, without triggering a constructive dismissal claim that leads to severance pay for the affected worker. In reality, this new regulation may lead to an increase in claims against employers, and more payments to employees in the form of severance pay or termination pay.

Ontario has introduced Regulation 228/20 in the Employment Standards Act, which seemingly eliminates an employee's rights to severance pay if they have been laid off, or changes have been made to their job (cut in pay or hours).
The Regulation is misleading for both employers and employees! Non-unionized employees in Ontario are still owed severance pay if their employers have made significant changes to their job. Employers can't make a change to their workers' terms of employment without risking a constructive dismissal claim for severance pay.

Employers will reduce employee pay or lay them off believing that they won't have to provide severance, when in fact they will still owe severance pay through a constructive dismissal claim legally under common law, with help from an employment lawyer. Why does Regulation 228/20 particularly hurt low-income workers in Ontario? Will the federal government successfully implement a program providing 10 days of paid sick leave.

Via Rail says partial passenger train service will not resume this week — as was previously announced — while the company moves to temporarily lay off nearly 1,000 people.
On Tuesday, CN rail announced that it would temporarily lay off approximately 450 of its employees due to train cancellations and suspensions.
Both layoffs are a result of the blockades by protesters who oppose a British Columbia LNG pipeline.

"I was paid in Scene points," the former host of Cineplex's pre-movie show told media after being let go by Canada's biggest movie theatre chain.

Metrolinx has adopted a policy that would prohibit workers from using marijuana, even when they’re not on the job.

The Quebec Human Rights Commission has sided with a Filipina live-in caregiver and orders she be compensated $41,600 in damages by her former employer.
Gelyn Dasoc-Hilot left the Philippines in 2012 for a better life in Canada. She arrived in Montreal with a work permit and a job lined up: she was hired to take care of a Côte Saint-Luc woman's four children.
But she didn't expect she'd be working, at times, for free. "I work at 8 a.m. or 7 a.m., and I finish at 10 or 11 o'clock," she said. "But they only pay me a minimum."
Dasoc-Hilot said her responsibilities also included, cleaning, cooking, washing the family vehicles, caring for pets and doing the yard work. She said her contract stipulated a 40-hour work week, but she worked 65 hours.
The overtime was not paid.
Dasoc-Hilot said when she asked to be paid, her employed threatened to have her deported.

Saying efforts to narrow the gender wage gap are not working, the Ontario government will soon force firms to disclose salary ranges in jobs ads and also report to the province what they pay their employees.
Jon Pinkus, Employment Lawyer at Samfiru Tumarkin LLP, told host Bill Kelly on Global News Radio 900 CHML that he believes that this new legislation will have a big impact on salary negotiations between employees and employers in Ontario.

On November 22, 2017, the Ontario government passed Bill 148, Fair Workplaces, Better Jobs Act, 2017. This legislation brings significant changes to the Employment Standards Act, 2000 (ESA), which is the law that governs most workplaces in Ontario. Many of these changes take effect on January 1, 2018. Other changes will occur on April 1, 2018.
But does Bill 148 go far enough to protect employee rights in Ontario?
