Employment Lawyer Jon Pinkus, partner at Samfiru Tumarkin LLP, clearly explains that Ontario's new Regulation 228/22 (which makes a temporary change to layoff regulations in an attempt to help employers struggling during the coronavirus pandemic) does not really change an employee's right to claim constructive dismissal if their pay or hours have been reduced, or placed on a temporary layoff.

The new regulation may actually be disastrous for employers, many of which incorrectly believe that they can make any change they want, in the name of COVID-19, without triggering a constructive dismissal claim that leads to severance pay for the affected worker. In reality, this new regulation may lead to an increase in claims against employers, and more payments to employees in the form of severance pay or termination pay.

Ontario has introduced Regulation 228/20 in the Employment Standards Act, which seemingly eliminates an employee's rights to severance pay if they have been laid off, or changes have been made to their job (cut in pay or hours).

The Regulation is misleading for both employers and employees! Non-unionized employees in Ontario are still owed severance pay if their employers have made significant changes to their job. Employers can't make a change to their workers' terms of employment without risking a constructive dismissal claim for severance pay.

What they discussed: What change has the government made to the Employment Standards Act and employee rights in Ontario during the coronavirus pandemic? Why does Regulation 228/20 particularly hurt low-income workers in Ontario? Will the federal government successfully implement a program providing 10 days of paid sick leave.

The Quebec Human Rights Commission has sided with a Filipina live-in caregiver and orders she be compensated $41,600 in damages by her former employer.

Gelyn Dasoc-Hilot left the Philippines in 2012 for a better life in Canada. She arrived in Montreal with a work permit and a job lined up: she was hired to take care of a Côte Saint-Luc woman's four children.

But she didn't expect she'd be working, at times, for free. "I work at 8 a.m. or 7 a.m., and I finish at 10 or 11 o'clock," she said. "But they only pay me a minimum."

Dasoc-Hilot said her responsibilities also included, cleaning, cooking, washing the family vehicles, caring for pets and doing the yard work. She said her contract stipulated a 40-hour work week, but she worked 65 hours.

The overtime was not paid.

Dasoc-Hilot said when she asked to be paid, her employed threatened to have her deported.

The Green Party announced Thursday that an external investigation concluded that accusations levelled against longtime leader Elizabeth May do not constitute workplace harassment.

The now-dismissed complaints came from three former party employees, who accused May of creating a toxic work environment with behaviour that included yelling at staff and putting them down in front of their colleagues.
