If you're involved in a real estate transaction in the United States, you had better know about FIRPTA — the Foreign Investment in Real Property Tax Act.
Today we talk with FIRPTA expert Julie Lepore of FIRPTA Solutions, who wants Realtors, homebuyers and home sellers to be aware of the risk of not considering FIRPTA when property changes hands. FIRPTA is a tax law enacted in 1980 that imposes U.S. income tax on foreign persons selling U.S. real estate. Under FIRPTA, if you buy U.S. real estate from a foreign person, you may be required to withhold 15% of the amount realized from the sale.
Standard Florida real estate contracts contain explicit language about FIRPTA, which buyers and sellers ignore at their own risk. Sometimes, buyers fail to check the nationality of the person selling the property, which may result in the buyer holding the bag for estimated tax payments that should have been collected at closing. Closing is not the time to verify nationality, says Julie, who has long evangelized a "FIRPTA-first" approach to real estate deals.
She says she's actually heard "grown men sobbing" after finding out they are responsible for the payments after failing to verify a seller's place of birth.

There are lot of crooks out there and some of them want to steal your land. On this episode, we talk with real estate fraud expert Julie Lepore, who regularly sees the red flags common with property theft in her job at FIRPTA Solutions in Cape Coral.
Working with locally based Secret Service agents, she has learned the warning signs of land sale fraud, which has become far too common in Southwest Florida. Julie describes what to watch for and how Realtors can protect their clients from unscrupulous characters.
The most common scenario she sees — and there were about 50 fraud attempts identified through her office in recent months — involved foreign "property owners" wishing to sell vacant lots they don't own in Lee County and beyond. In most cases, she says, phony documents — especially passports — are presented as "proof" of ownership by the scammers.
Sadly, the scam isn't discovered until the real owners try to sell the lots themselves. In some cases, buyer-victims build houses on the lots only to have to remove them and lose large sums of money.

Mortgage expert and podcaster Scott DiGregorio joins us to talk home financing. Scott describes the breakdown of loan originators into three categories — mortgage brokers (middlemen), traditional banks and mortgage bankers like himself — and explains the pros and cons of each business model.
He discusses how to compete with all-cash buyers and a hybrid approach called delayed financing. He also discusses consumer protections built into today's mortgage market. and offers advice for aspiring mortgage originators who are looking for a quick and easy way to make money. Hint: "There is nothing quick and easy about this business," according to Scott.

Real estate broker and educator Caroline Boland joins us again for a deeper dive into the NAR Code of Ethics.
On this episode, she delves into Article 1 of the code, which states that Realtors must be honest and fair in dealing with clients and all parties involved in a transaction. She also discusses Article 4, which is related to Realtors' disclosure of any personal interest they have in a sale.
And what about disclosure of so-called distressed properties, where there was a recent homicide, for example? In Florida, Caroline says, there is no legal requirement to disclose that information. But is it ethical to withhold it? She also touches on the Code of Ethics language related to making or sharing false or misleading statements about other Realtors.

Ethics are everything in the real estate business. So much so, that development of a Code of Ethics was one of the first orders of business tackled by the National Association of Realtors in 1913. Since then, the NAR Code of Ethics has been continually revised and updated to stay in sync with the modern world.
Today Realtors must complete ethics training every three years to fulfil membership requirement at local Realtor associations. Our guest today, Caroline Boland, is a certified NAR ethics instructor who has taught thousands of Southwest Florida real estate professionals both the basics and the finer points of the code.
Caroline explains the origins of the NAR code and why it is essential to the industry. She says she loves discussing the code of ethics with Realtors, particularly when she tackles questions that begin, "Is it OK if..."

The professional pest remover has served more than 4,000 clients in Southwest Florida, including homeowners, property managers and businesses such as Wal-Mart, Home Depot and the Southwest Florida International Airport.

Bill Steinke, RPCRA's 2022 president, joins us in the studio to talk about his real estate career journey and a look ahead at the Southwest Florida real estate market in 2022.
Before becoming a Realtor, Bill was in the financial services business, and was later a restaurateur in Fort Myers. As the association's president, he says much of the focus will be on RPCRA's community involvement opportunities. He believes that by spreading the word about how much real estate professionals are active in their communities, the public will gain a better understanding of the value they offer to consumers.

Cape Coral Realtor and stand-up comic Sheena Reagan has a message for the business world: lighten up! On today's show, she talks about how the appropriate use of well-timed humor can reduce tension in real estate deals. But that's not to say selling houses isn't serious business — and not everyone appreciates humor.
Sheena was named Florida's Funniest Female in a statewide competition in 2018. But her heart also lies in the world of real estate, which provides most of her income. In our conversation, she describes the impact of Covid on both comedy and real estate and how the latter has exploded in Southwest Florida since 2020.
She also recounts her funniest moment in real estate, which occurred spontaneously during her live virtual showing of a fixer-upper in Matlacha.

If you've ever thought about becoming a property manager, this show is for you. In studio with us is Tommy Senatore, an experienced investor, Realtor and property manager, having concurrently managed more than 800 units in Lee County, Florida.
Tommy touches on some of the pitfalls of the occupation, including squatters, evictions and government rent subsidy programs. Still, it can be a rewarding business once you get a feel for tenant relationships and how to work your way around governmental regulation and laws affecting tenant rights.
He says a license is not required to manage your own property, and anyone can do it if they're willing to put in some hard work. Tommy recommends a creative approach to resolving any issues that come up and describes how he navigated the recent Covid epidemic and the temporary rules that were put in place as an emergency measure.

Can you really negotiate anything? Yes, you can, and you can WIN, says real estate educator Josh Cadillac. In this episode, Josh details proven techniques for Realtors® who want to achieve the best results for their clients. When negotiating price (of anything) for example, he recommends alerting the other party that you are working under the constraints of a budget. Another technique involves pointing out that you are restricted by policy in your negotiations — and you won't believe his example for how you can do just that! Part 1 of 3 shows with Josh.

If you thought there were no bargains left in real estate, this episode may change your mind. In studio with us is Tommy Senatore, a Cape Coral, Fla., Realtor and author who's snagged LOTS of deals over the years. And, he says, you can too!
Tommy is a tax lien sales expert who literally wrote the book on the subject. On this episode, he describes the tax lien sales process in detail. Once on a dare, he says he bought a small canal home at auction in Port Charlotte, Fla. — sight-unseen — and flipped it within a week, making a profit of $11,000!
He says you've got to know what you're doing, but you can learn how to avoid the pitfalls. One important rule, he says, is don't invest money in a tax lien sale that you can't afford to lose in case something goes wrong.

Florida has one of the most generous Homestead Exemption programs in the United States. But how do you take full advantage of it? On this episode, we post that question to Homestead exemption expert Ned Hale, a real estate lawyer in Southwest Florida.
Ned says the Homestead exemption has three main characteristics: a tax benefit, asset protection and protection for your heirs after your death. He says you must apply for the exemption — it's not automatic. But as long as you meet the requirements and submit the proper documentation, you can get it without the need to re-apply annually.
The law has its nooks and crannies, however, and Ned explains how to navigate the common ones. For example, if your homestead is within city limits of any Florida municipality, Homestead protections differ somewhat compared to those who live in most rural settings.

Got the blizzard belt blues? You're not alone! Southwest Florida continues to see strong population growth and most of the new folks are from cold-weather states. That's perfectly understandable, as tropical beaches are a wonderful remedy for the cold of a northern winter.
Today we talk with real estate broker Jennifer Desrosiers — herself a transplant from New England — about what to consider before moving the family down south.
The Bokeelia Realtor says that Covid accelerated the pace of growth in Southwest Florida for a variety of reasons. And when the new transplants arrive at their new home, they may be in for a few surprises — mostly good ones! Florida has no state income tax, motor vehicle inspection requirement and all the sunny weather you can stand! But, Jennifer says, you have to be ready for a few changes, particularly when it comes to code enforcement and local regulations affecting real estate.
If you have school-aged children, she recommends choosing a school first, then looking for a home within that school district. Her No. 1 tip for any new resident is one we agree with — get a friend with a boat!

Many Realtors in Florida will begin using a new sales contract beginning Nov. 1, 2021. It's called the FR/BAR contract — shorthand for Florida Realtors/Florida Bar Association — but what's new and different from the current contract?
On this episode, attorney Ned Hale breaks down the new language and explains what's good, what's not-so-good and why Realtors, homebuyers and home sellers should care. As Ned explains, the 2021 revisions affect the sections on financing, calendar-driven deadlines, pandemics and appraisals and more.
Ned also advises Realtors that if they find the contract confusing, it's not their fault! Any confusion, he says, was caused by those who drafted the document.

On this episode, we pull back the curtain on the murky world of probate. Florida real estate Attorney Al Nicoletti is with us to explain in layman's terms what probate is, how it works and why it's a good idea to be up to speed on it before you die.
In simple terms, real estate probate is the legal process of moving the title from the deceased to the heirs, which enables them to sell the property or make other arrangements.
Al says that contrary to popular perception, probate needn't be a long-drawn process. He also talks about Lady Bird deeds, spousal inheritance, durable power of attorney and other aspects of probate in Florida. And we learn a little more about Al when he plays the Lightning Round!

Jeff has been involved with the MLS for several years and is now learning about the unique real estate market here in Southwest Florida. He's already become well acquainted with this land of waterways, golf courses and vacation homes, and how it differs from the American Southwest. He quickly noticed that in SWFL, there is an MLS field for Gulf access comments. You may not know that RPR also provides marketing and other materials to commercial Realtors. On this episode, we talk with RPR Director of Commercial Services Nathan Graham, who outlines the many services available for those who deal with land sales and commercial properties. For example, RPR offers — at no charge to Realtors — ESRI Tapestry Segments that really drill down on demographic data and provide insights into local trends. After a year coping with a pandemic and enjoying historically low mortgage rates, it's clear that we're living in interesting times. In the real estate world, that has meant fewer listings available, while at the same time, buyer demand for housing continues to surge. For Realtors® who are willing to work hard, it's still possible to get 50 or more listings a year, says real estate broker Dave Dettmann, our guest on this week's episode. He says one thing that has not changed in the current market: It's a numbers game. With about 20 percent of the agents selling 80 percent of properties, those agents are getting the job done by putting in the necessary work, according to Dave.

Restaurateurs know the value of good online reviews and Realtors® should too, according to Jason Jakus. The author and former RPCRA president explains why on this episode of the podcast. Jason says Zillow and Google have the most credible reviews because they require login credentials, which greatly discourages bogus writeups. One key to building up a strong reservoir of reviews, he says, is to earn a large quantity of the five-star variety, thus minimizing the impact of the occasional bad review — an inevitable consequence of inviting the public to opine.

Realtor®, author and national speaker Jason Jakus explains why "red carpet" customer service is the name of the game for successful real estate pros. Florida Gulf Coast MLS Director Matt Magowan and Cindy Cornman explain the NAR Clear Cooperation Policy in the Short Takes episode.
