Shreve currently claims he is trying to protect the Second Amendment, but he was not trying to protect it when he was running for Indianapolis mayor. The NRA has also given him an ‘F’ rating for his updated NRA rating. However, it is also an integrity issue with Shreve. Rahimi is not somebody you want to have over for Thanksgiving dinner. Guy has serious concerns regarding the outcome of this Supreme Court case. Should someone lose their constitutional rights over a civil matter. The outcome of this case may decide that.

Guy Relford begins tonight's show talking about the consequential 2008 Heller Supreme Court case which was decided by a slim 5-4 majority. 4 Justices believed that individual citizens did not have the constitutional right to have a firearm to defend themselves in the home. In the 2022 Bruen Supreme Court case, SCOTUS threw out the notion that one must have a "need" to carry a firearm. Guy re-iterated that the Bill of Rights is not the Bill of "Needs". The Supreme Court agrees with this understanding. The Rahimi case being argued in the Supreme Court right now is worrisome because Rahimi is a very unlikable individual. Because of Rahimi's very unsavory character, the concern is that the guarantees that Heller and Bruen brought us may be blurred by Rahimi. Guy provides his opinion on how the Supreme Court may swing on this case.

After a late-night shooting that killed three people last Sunday, the Broad Ripple Village Association sent a letter to Mayor Hogsett asking to make Broad Ripple Avenue a "Gun Free Zone". Guy Relford after the announcement said that he had legal challenge 90% written should the city move ahead with the plan. On his radio show, Guy said that the proposal is in clear violation of the pre-emption act, and that the city has no legal authority to enforce a "Gun Free Zone" in Broad Ripple. The only possible way around the pre-emption act is the so-called "Jim Irsay exception" where private organizer of an event leases property from the city and can prohibit firearms at the event.
The problem with this strategy is that the proposal from the Broad Ripple would not cover a particular event, the proposal is to cover any typical weekend night in the area. The association appeared to be trying to shoehorn their plan into the exemption of the pre-emption act. Guy wasn't buying into this pretense and called them on it.

2nd Amendment Rights defender Guy Relford is one of the few coming in support of the 5th Circuit Court of Appeals U.S. v. Rahimi, a post-Bruen Second Amendment ruling. To the layman, it appears that the court is okay with dangerous domestic abusers having the right keep their weapons that they will ultimately use against their victims. But the ruling is far more nuanced than that. The ruling maintains that one's Second Amendment right cannot be infringed if they have not been convicted of a crime. Domestic orders of protection aren't necessarily a result of a crime that has been committed. The 5th Circuit has ruled that the order of restraint alone cannot erase one's 2nd Amendment rights.

Fresh off of attending the annual NRA meeting in Downtown Indianapolis last week, Guy Relford talked about the speakers he saw there. Former President Trump was the most prominent of the speakers. While the show was winding down, Guy talked about a message he received on Twitter stating, "I'm surprised President Trump got an enthusiastic response from the NRA members since he's an enemy of the 2nd Amendment."
Guy responds that he understands where this individual is coming from. First off, President Trump after the Las Vegas mass shooting directed the ATF to find a way to ban Bump Stocks. President Trump set a precedent we don't like. After the Parkland mass shooting, President Trump was talking about a national red flag law. One of his cabinet members, or a member of congress responded, "what about due process". President Trump said, "Take the guns first, due process comes later.", and a whole bunch of us said "Whoa, hold on.. I have a problem with that."
Guy ends the discussion with the argument that there may be other candidates in 2024 that a have a stronger record on the 2nd Amendment than the former President. Guy can see that.

Indiana Attorney General Todd Rokita joins the Gun Guy Show to talk about his lawsuit with other states against the ATF and Attorney General Merrick Garland regarding their Pistol Stabilizing Brace rule. The new regulations require anyone using pistols with stabilizing braces to provide their fingerprints to the ATF, be registered in a federal database and pay applicable taxes, among other things. The overriding concern regarding registration, is that registration leads to gun grabs. Rokita has been a big defender of Hoosiers' 2nd Amendment rights, and this is a great fight to have. Guy talks about the case of Daniel Perry, an army sergeant convicted of murder in Austin Texas. Perry shot and killed Garrett Foster who approached his car with an AK-47 rifle during the George Floyd riots in 2020. While it may be an obvious case of self-defense on Perry's part, Guy discusses the mistakes Perry made prior to the fatal shooting that led to his conviction. Guy talks about the rules that preclude a defendant the argument of self-defense. The prosecution was able to submit into evidence social media posts that Perry made that worked against him in his trial. The prosecution pointed out that Perry chose to drive towards a protest, when he could have avoided it. Guy points out that while one has the right to be in a dangerous situation, it's not necessarily smart to do so. "There's legal and then there's smart... You don't ever go to jail for a conflict that never happened." Perry's posts helped the prosecution make the case that he was looking for a conflict, which led to his conviction.

Gun Relford returns to the 93.1 WIBC studios for another edition of the Gun Guy Show. In the first hour, Indiana Rep Jim Lucas calls in to discuss his bill HB 1177, which would create specialized firearms safety, education, and training curriculum for teachers, school staff, and school employees. Lucas dispels some of the disinformation out there regarding his bill. Critics of such bills often make the argument that such bills would turn our schools into the Wild West. But Lucas disagrees and says it does quite the opposite. For about the same price of resource officer, 40 staff members could be properly trained with a firearm. Armed teachers and staff make a potential shooter less likely to act, since he won't know who is armed. Lucas adds that it's just misguided to rely on the police to protect our children. In fact, courts have ruled that they are not obligated to.
"Our highest courts of the land have ruled that we are on our own" says Lucas.

Indiana Rep Jim Lucas calls in to discuss his bill HB 1177, which would create specialized firearms safety, education, and training curriculum for teachers, school staff, and school employees. Lucas dispels some of the disinformation out there regarding his bill. Critics of such bills often make the argument that such bills would turn our schools into the Wild West. But Lucas disagrees and says it does quite the opposite. For about the same price of resource officer, 40 staff members could be properly trained with a firearm. Armed teachers and staff make a potential shooter less likely to act, since he won't know who is armed. Lucas adds that it's just misguided to rely on the police to protect our children. In fact courts have ruled that they are not obligated to.
"Our highest courts of the land have ruled that we are on our own" says Lucas.
