"Once someone goes into a nursing home, there's nothing you can do." "You can't protect assets if you need care in the next five years." "It's illegal to give your stuff away within 5 years of the nursing home." These are all comments we have heard from our clients and other lawyers. Unfortuantely, they're all untrue.
The 5 Year Clock is one consideration for getting the government to pay for your nursing home. It's not the only consideration. Rules have exceptions. Let's learn a few strategies that might just save your live savings.
The primary role of a parent is to raise good humans. This duty exists even if parents pass away young due to an accident. We can't let our childrens' future depend on our good health. We need to plan. On this episode, I'll teach you how to set up an estate plan that actually works.
The Pittsburgh Post Gazette reported on June 9, 2024 that 21 long term care facilities have filed for bankruptcy protection since the beginning of May. Separately, 2 others are simply closing their doors.

If you've been listening a while, you know that most of our conversations are about retirees. So, we thought we'd do something a little different. In this episode, Tim explains effective estate planning for families with younger kids. Great ideas in this episode for your kids and grandkids.

For years there was something that bothered me about my estate planning practice and I could never quite tell what it was. We had lots of clients. They chose the plans they though fit the need. What was wrong?
The problem was that the clients didn't know what they needed. How could they? They don't have a crystal ball and they don't know what problems they will face in the future. It was all a guess about which tool they may need.
So, we eliminated the guessing game. We just provide a toolbox to our clients that has all the tools they could likely need.
Listen to this episode to figure out how we cracked the code on giving your family the best possible plan.
You read that title correctly. In Pennsylvania, nursing homes can sue adult children for their parents' care under our Filial Support law. It only applies in limited situations and can be avoided with proper planning. Listen to this weeks episode to learn how to avoid this nightmare.

This isn't fun to think about... but it's necessary. Let's be bold.

In this episode, Tim discusses how to preserve a legacy for your kids long after you're gone.
The senior living landscape is a complicated one. There are different levels of care available at different types of facilities. Each type of facility accepts different payment sources. All of this will impact how you receive your care and how much it costs. It's confusing to say the least.
In this episode, Tim discusses your different care options and how you can get the government to help pay for some of it. A good listen if you're trying to understand the long term care system.
Each year, the PA Department of Human Services releases the average monthly cost of a nursing home bed in the state. This year has the biggest jump in recent memory (probably the biggest jump ever) from $11,000 to $14,676. A 25% increase in the cost of a nursing home in just the last 12 months!
So, now that you know that, what are you going to do about it? What are you going to do to protect yourself and your family from these expenses.
Listen to this episode to learn about your options and how an asset protection plan may be the solution you need.
I never met my grandfather. He died very young. If I had the chance, though, there are lots of questions I would want to ask him. Where did you grow up? What was it like there? Tell me about your relationships with your siblings. How did you feel the first time you saw my grandma? How did you meet?
I think it's natural that anyone would want to know the answers to these questions about their relatives. So, then, isn't it natural that our kids, grandkids and great-grandkids would want to know the same things about us?
Here's the difference... we now live in a time period where today's technology allows us to record videos of us telling our stories in a format that can be shared forever. How Cool!

Why are we spending money on nonresidents when we could be providing care to our Senior Citizens?
In this episode we discuss these issues and teach you a thing or two on how you can protect yourself. Listen in to learn!

The third week of October is always Estate Planning Awareness Week. If you're like me, you're tired of being told what to be aware of. Someone is always telling me I need to be aware of some social issue that doesn't really impact me.
But this one does. Estate Planning does impact you. Unless you know something I don't, we will all eventually need an estate plan. We will all have an illness. We will all eventually pass away. This isn't optional.
What is optional is whether you have a plan when things do go wrong. Most adult Americans never plan. This is why you'll hear people say "boy when my Dad passed away, it was a mess!".
It was a mess because Dad didn't do an estate plan or didn't have a good estate plan. Don't let this be your fate. Don't let them tell stories about how you didn't plan well. Let's get it done and let's get it done correctly.
Medicare open enrollment begins October 15th which means it is time to consider whether you are in the right Medicare plan. There are big changes coming for 2022.
On this episode, Tim is joined by Sean Horn from Mediconnect, one of the region's largest independent insurance brokerages. Long story short, these guys know their stuff. Listen to this episode to learn all about how to best plan for your family
"All you need is a simple will"
"Trusts are for rich people"
"Irrevocable trusts are no good"
"You should just pay your own way"
All of these pieces of advice are given by accountants, financial advisors and lawyers. All of them may be absolutely terrible advice. So why are these falsehoods being spread? Sometimes the advisor really doesn't know. Sometimes the lawyer has biases. Some times the accountant is making incorrect assumptions. Sometimes they just simply give bad advice.
How do you know what is right for you? Ask the advisor how they work with you to ascertain your goals. Far too often, professionals give advice before truly digging deep enough to uncover the real goals.
Listen to this episode to learn how to sift through all the "stuff" to find the gold.
Let's say you find your self in a situation where a loved one needs care. Where are you going to turn for help? Where is the person going to live? How are you going to pay? Are there government benefits that could help? Should I sign this contract?
Our fragmented long term care system is confusing. The care options themselves are overwhelming: Independent living, care at home, personal care home, LIFE Program, assisted living facility, move in with your kid, skilled nursing facility.... where do you go?
You are in a new game and you don't know the rules. You need a coach. Listen here to find out more.
Everyone seems to want their plan to do the same things:
See, simple right? But not easy. Each of these goals requires some serious thought and planning. Listen to this episode to find out how to plan for your family in a way that accomplishes your unique goals.
1 in 3 seniors dies with dementia.
70% of seniors will need some form of long term care.
Nursing homes cost $130,000+ per year.
What are you doing about it?
Listen to this episode to learn how to protect yourself against the next biggest battle you're going to face in the war against the middle class.
Don't wait for the bureaucrats and career politicians to fix it for you. They aren't going to. You need to take action yourself to protect your family.
Don't believe the lazy lawyers and online purveyors of junky documents. They're not doing you any favors when they tell you, "All you need is a simple will". This is a lie that is told to families way too frequently.
The problem is that complicated situations tend to have complicated solutions. See, there's nothing simple about your family and your goals. If you really sit to think about all of the negative situations your family could face if you got sick or passed away, there's nothing simple about it.
So, there's a simple question you need to ask yourself: Do you want feel better that you have checked the box that you have a will, OR do you actually want to put a plan together for your family that will work?
Put that way, it's a simple decision, right? Listen to this episode to find out how to create a plan (not just a document) that will actually work for your family.
Picture a McDonalds at 7AM. You can smell the hashbrowns and coffee, right? You see the table of the older fellows sitting in the corner? You know what they're talking about every Tuesday morning - giving their house/savings to their kids.
Why do people do this? If you read a newspaper realty transfer section, you'll see transactions by people giving their home to their child. Why?
There are two reasons people do this:
1. the perception that they can save taxes
2. to protect the house from the nursing home
In this episode, Tim explains why the traditional advice of giving your home to your kids is frequently a mistake. It's a tax mistake and an asset protection mistake.
Listen to this episode to avoid the mistake of giving your home to your kids.
"People should just pay their own way when they need the nursing home." I had a lawyer tell me this once. What a shame that this lawyer let his personal screwed-up beliefs prevent him from helping his clients.
A nursing home admission is one of the most stressful situations in someone's life. Not only is the medical issue and the transition stressful, but it is also a financially stressful situation. Nursing homes cost more than $11,000 each month.... to must families this is a heavy burden.
There are steps a family can take to stop the problem. Usually, this involves taking steps to gain eligibility for Medicaid. Medicaid is not a four letter word. Medicaid is the answer that your family may need. If you are concerned about potential nursing home costs, you need to check out this episode.
At the Sechler Law Firm, we get questions daily on whether trusts are a good option. The thing to understand is that trusts can be a very flexible and effective tool. The decision on whether to use a tool begins first with you determining your goals. Once you know where you want to go, we can help you decide if the trust can help you get there.
In this week's episode, Tim talks about what the word "irrevocable" really means - and it's not what you think. Also Tim shares a sad Nursing Home story to help you avoid the same mistake. Hope this one helps!!

Many people are of the opinion that Medicare is sufficient to cover their health care issues during their retirement years. The problem is that Medicare doesn't pay for the single biggest expense seniors face: long term care.
In this episode, Tim discusses Medicare v. Medicaid. He also explains how you can gain Medicaid eligibility, even after a nursing home admission.
Most retirees know they need to do "some planning". But what does that mean? Does it mean retirement planning? Does it mean leaving a legacy to the kids? Does it mean protecting assets from long term care?
A good plan incorporates all three of these ideas. So who do you turn to?
In this episode, Certified Elder Law Attorney Tim Sechler discusses the different roles of financial advisors and lawyers. He also breaks down the difference between effective traditional estate planning and elder law.
A great listen for anyone who knows they need to do "some planning".
Each July 4th we celebrate the signing of the Declaration of Independence. The audacity of the people who signed this document is astounding. They were basically daring the most powerful military on the planet to come hunt them down. They were willing to take this risk in the name of freedom from tyranny and oppression. They wanted a better future.
What about you? Do you want a better future? In this episode, Tim provides his take on some of the forces and laws that are working against Middle Class Americans. Are you ready to declare your independence of these broken systems?
The days and weeks after you've lost a loved one is a confusing time. You may find out that you've been named an executor. In that case, you likely have tons of questions about what you need to do.

If you've ever wondered what the probate process is like, check out this week's episode.
These days, the media and entertainment crowd loves to downplay the role of the Dad. We're exposed to plenty of TV shows where the Dufus Dad is corrected by the wise 10 year old kid. Or, perhaps it's the cliche lazy dad from Married With Children who never leaves his beer and pretzels, it's exhausting.
These characters are also very much unlike any Father I know. The Dads I know and the men I meet as clients, are not like this. They are competent hard workers. They sacrifice time, energy and money for their families. They work hard to provide financially. They strive to provide ethical and moral guidance for their kids.
It's a shame that we don't celebrate Dads more often. This Father's Day episode discusses the true role of Dads and the duties they have to provide for their own absence.
Happy Father's Day
Everyone knows that Medicaid has a 5 year lookback period before going into the nursing home. This generally means that you can't transfer assets before going into a nursing home. However, there are lots of exceptions to this rule. Don't make assumptions about what it means to you.
Listen to this episode to figure out what it means for you!
Most people don't have a will.
Most people think Medicare will pay for a nursing home.
Most people who do plan think a "simple will" is enough.
Most people don't plan for their kids' divorces.
Most people don't plan for their kids/grandkids potential disabilities.
Most people are wrong.
Don't be like most people. Listen to this episode to discover how to create a custom plan that works for your family.
Yes. You read that right. Disney movies must be written by estate planners. Think about it... what do Aladdin, Lion King, Tarzan, Frozen, Cinderella and Nemo all have in common? They all lost a parent at a young age!
In this light-hearted episode, Tim discusses each of these movies and the estate planning take-aways that can help you plan for your kids.
Here's a hint: You want to be the parents in Frozen, not the parents in Aladdin!
If you have a loved one in the nursing home (or could soon), you should listen to this episode. Tim gives some words of caution and also identifies some opportunities that could help you get the care you need - without going broke in the process.
You should think of an admission to a nursing home as a legal problem. If any other creditor was coming after you for over $11,000 per month, you'd probably call a lawyer. The nursing home situation is no different. These laws are complicated.
Listen to this episode to find out how the process really works.
You have beneficiary designations on financial accounts. We all do. But is a beneficiary designation sufficient to meed your estate planning goals? What criteria make up an effective estate plan for you? Have you thought about it?
In this episode, Tim dispenses with the "common knowledge" that all you have to do is place a beneficiary designation on your accounts and everything will be easy.
Listen in to find out how you can create a good estate plan for your family, rather than just scratching it off your to-do list.
Glance around the headlines on any given day and you'll find lots of examples of reasons for proper planning. Whether it's a divorce like Bill Gates, loss of control like Brittany Spears, or coping with the death of a loved one to Covid 10, there are reasons all around us to become prepared.

Our kids need help. Young kids need our help with education, finance, healthcare, morals, values, religion.
Older kids - your adult kids- need different kinds of help. They may need financial support. Advice on grown up decision making. Sometimes they need help protecting themselves from issues like creditors or divorces.
Proper estate planning can transition to meet your kids' needs as they grow. We can't predict when bad things may happen in our families. So, then, an estate plan has to be flexible and anticipate todays problems as well as tomorrow's problems.
This episode teaches you how to do it THE RIGHT WAY

A Nursing Home Admission is a confusing time. Often times families get no advice, or worse, they get bad advice.
Nursing homes in PA cost over $11,000 per month. As a result, the stakes are high if you make mistakes.
The admission of a loved one to a nursing home is a legal problem. Don't rely on what you hear from friends, neighbors or the nursing home billing office. Don't even rely on what the Medicaid office tells you. You need a lawyer.
In this episode Tim discusses a couple of ways to plan and a few steps you can take to get the education you need.

This week in current events, one tragic and one interesting (to me) thing happened in the news. First, the tragic thing...the sports world lost a legend in former NFL player and coach, Marty Schottenheimer to his battle with Alzheimer's Disease.
Second, the legal battle surrounding Brittney Spears' conservatorship came to light.
So what do these seemingly completely unrelated issues have in common? Well, to an estate planning lawyer, they are both situations that require planning. One case likely had outstanding planning in place. The other didn't.
The point is in both situations, for very different reasons, these public figures lost the control of their finances. We should take this as a lesson that events could take place in our own lives that could cause us to lose control.... then we should plan accordingly.
In this episode with a Valentines Day Theme, Tim discusses the promises we make in marriage and with other family members. To have and to hold, in sickness and in health - This isn't just a tagline. It's a promise. It's one we need to keep. Tim will teach you how.
