This discussion was prompted when a doctor had his paper in opposition to one of Darby’s retracted, because the only peer reviewer turned out to be a frequent co-author. The discussion passes through the touted benefits, the rare and common harms, the anatomy and purpose of the foreskin, the changing positions of governments and health authorities around the world and, of course, its role in some religions. It is very interesting to compare male genital cutting with female genital cutting (usually called mutilation, i.e. FGM). Even when FGM is less significant than circumcision (e.g. a symbolic nick in the labia) it is still banned in most countries, yet few want to question the right to circumcise. Preventative mastectomy and tonsil removal are also compared with circumcision. One of the fundamental questions is ethical. Is it right to perform a permanent, irreversible procedure on an infant in order to obtain speculative benefits (which may not even exist), the most significant of which, will only occur when the child reaches sexual maturity?

The local police are taking this seriously, and we are, too. On June 25, 2016, Bobby Russell, a legal plaintiff claiming a false-positive “HIV test,” received four or five threatening calls to his mobile phone. He says that the caller(s), while not explicitly threatening to kill him, made reference to “what you are doing.”
“How Positive Are You” co-host Elizabeth (Beth) Ely thought it best to report this event, to help ensure Bobby’s safety.
It’s been more than three years since Bobby filed suit against his University of Kentucky doctors and about two since the case was dismissed on statute of limitations grounds, that is, not filing within a year of finding harm. A decision on the appeal of that dismissal is long, and strangely, overdue.
A video of the last call, received on or about 10:15 p.m., is linked HERE. It includes the number that showed up on caller ID, and Beth placed a call to that number during this interview. It reached a recording at the U. of K.’s Bluegrass Care Clinic in Lexington, Kentucky.
Since Bobby’s friends first received reports of this “pure harassment” – and even after Beth taped this Episode in July 2016 – several new facts have emerged. They so far argue against blaming U. of K. and its “AIDS” medical services unit:
- Contrary to the impression given in this interview that U. of K. was not cooperating with the investigation and possibly invoking “sovereign immunity,” Bobby has since said that it did turn over phone records after consulting its lawyers, without, he says, knowing that he was the accuser. (Sovereign immunity is currently at issue in unprosecuted sexual assaults within U.S. public universities.)
- Bobby had long discontinued the Bluegrass Care Clinic’s treatments when he received a new phone number that he never gave to them, U. of K. submitted that it has no record of these calls, and he believes his phone and computer have been hacked numerous times.
- Beth has found that, through various mobile-phone “apps,” it is indeed possible to fake a voice and a regional accent and even, apparently, to fake a number on caller ID.
- Bobby is not suicidal, and he verified that in this interview.
His best guess is that somebody is “trying to make me look silly,” as he related separately. But still . . . .
Much is at stake in the Russell lawsuit, especially public opinion of how accurate “HIV testing” is. This is a foundational issue putting at risk literally hundreds of billions of dollars in funding to fight AIDS worldwide; put more simply, people could start questioning their test results and requesting their records for possible lawsuits. Beth expresses a hope that Bobby will stay safe now that they have “turned on the lights” in this Episode.

Her daughter’s death at the hands of emergency doctors unfamiliar with the syndrome led her to research medical malpractice rights and laws. She founded, and now directs, the National Medical Malpractice Advocacy Association in Houston.

In August 2010, WikiLeaks founder Julian Assange refused to take an “HIV test” in Sweden at the request of two young women with whom he had had consensual sex. To avoid extradition to Sweden to face accusations under that country’s “expansive,” and expanding, rape law, Assange has been effectively imprisoned for the past four years in the Ecuadorian embassy in London.
“Only in the shadow of the 1980s HIV/AIDS mushroom cloud, could a broken condom be met with such hysteria, and morph into a criminal drama, involving several governments and millions of dollars,” wrote former “How Positive Are You” co-host Celia Farber. Close to the fourth anniversary of Assange’s exile, Elizabeth Ely joins Celia in her Manhattan kitchen for tea and discussion of her February 2016 New York Observer article on the sexual politics of this unusual case.
A “rock star” like Assange, in his standing up to power, is as attractive as ever to women, feminist or not. One of the two women accusing Assange, Anna Ardin, is reported to have said: “I was so proud, to get the coolest man in the world into bed, and to stay in my apartment.” What happens the morning after, when coolness becomes coldness, and disappointment sets in?
More seriously, what happens when, as in the modern Western world, political correctness rules? As in George Orwell’s novel 1984, love becomes “the most subversive thing almost that you can express.” Says Celia:
So we have a hyper-sexualized society today, and that’s what you see in the Assange saga. They’re not sexually inhibited, but they’re spiritually and emotionally inhibited, and the only thing anybody’s concerned about is protecting against this imaginary deadly virus that seems to me to be the weaponry to crush this thing that once existed between people.
With the ominous screech of sirens in the background, Celia and Beth consider the post-“HIV” climate of accusation, Orwell’s chillingly predictive novel, claims of “feminist extremism” in Swedish law and society, hysteria in an era of sexual confusion, and the paradoxical dangers of living in a risk-averse time and place.
Asks Beth: “Are we living the good life, or just the one where nothing bad happens to us?” We alone choose whether to come from a place of love or a place of fear.
Celia Farber grew up in New York City and, fortunately for this Episode, Sweden. She wants you to read Crowds and Power by Elias Canetti, 1984 by George Orwell, and The New Totalitarians by Roland Huntford. She left no word as to when the quiz will happen, and whether it will affect your grade in this course called life. Only be warned that “when and where there is sex, accusation is lying in wait.”

The Clinton Health Access Initiative advertises its efforts to “help save the lives of millions of people living with HIV/AIDS in the developing world by dramatically scaling up antiretroviral treatment.” This is just one of many large initiatives of the Clinton Foundation. What would that even mean, “dramatically scaling up”?
Strangely enough, the Foundation never received a charter for that purpose. It was established solely to preserve Bill Clinton’s presidential legacy – mainly, by supporting the Clinton presidential library. In his book Giving: How Each of Us Can Change the World, Clinton talks about attending the 2002 Barcelona AIDS conference, where Nelson Mandela and other world leaders asked him to combat AIDS. And yet as Ortel points out, the Foundation’s filings for 2002 do not reflect this mission change.
This is just one of many concerns we discuss in this Episode, including what might be happening to those hapless “HIV/AIDS” patients in rural areas of the Third World.
Nor do other filings lend any accountability to the Foundation’s finances. “The Clinton Foundation has never produced a compliant audit,” he says. “The documents that have been submitted are fake audits, they are not audits.” When comparing outlays to donations, Ortel has found discrepancies of hundreds of millions of dollars.
Ortel’s articles and downloadable reports at his own Web site and at Breitbart.com, mentions at World News Daily, as well as Peter Schweizer’s book Clinton Cash: The Untold Story of How and Why Foreign Governments and Businesses Helped Make Bill and Hillary Clinton Rich, detail serious legal and ethical concerns. Schweizer goes so far as to suggest, in example after example, coincidences in which business deals enriching Bill’s friends have benefited from Hillary Clinton’s voting and policy decisions as a U.S. Senator and, from 2009 to 2013, U.S. Secretary of State.
Regarding AIDS treatment in rural areas of the Third World, we note the potential for abuses ranging from false diagnoses to simply handing out drugs without adequate medical followup.
We know full well that our political bias might be on display by covering this topic just days before a critical vote on Hillary Clinton’s possible presidency in the New York Democratic primary. However, we, “How Positive Are You” co-hosts Elizabeth Ely and (Canadian) David Crowe, have decided to look under the hood at the Clinton Foundation because the evidence of serious legal issues is too obvious. And spreading AIDS treatment and medicines around the world without accountability risks lives.
As an example of the fraud behind calls to lower drug prices, “Dirty Medicine” by Katherine Eban at Fortune magazine recounts how faked quality control and effectiveness trials at Indian generic drug maker Ranbaxy when it supplied the Clinton Foundation with cheap drugs resulted in a $500 million fine in 2013. (World News Daily also covered the story.) We note the “Mobile Health Services” van the company unveiled in 2011 to patrol rural areas and provide medical services to mothers and children in India – including HIV/AIDS treatment, which requires extensive followup and monitoring.
Ortel speaks strongly. He concluded over a year ago that, “this is a highly suspect, in my view criminal enterprise masquerading as a public charity.” It operates as “Robin Hood in reverse” to take from those of modest means and enrich wealthy friends of the Clintons – perhaps even the Clintons themselves, although that is more difficult to trace. “It just reeks of fraud.”
States generally enforce their laws governing nonprofit organizations. But when it comes to the Clinton Foundation, there is no effective enforcement. Even The New York Times seems to have conveniently – for the Clintons – lost its 2013 article, “Unease at Clinton Foundation over Finances and Ambitions.”

“This really rocked a belief that I thought was so solid that it could not possibly be wrong,” says the retired engineer. “It was such a fundamental belief. I really didn’t want to accept the possibility that what everyone is saying could possibly be false.”
How did Borrelli come to change his long-held beliefs about AIDS and health, and what would it take to inspire others to question what they hear – whether they are “HIV positive” or not? Indeed, the consequences affect everyone. Borelli reveals to “How Positive Are You” co-host Elizabeth Ely:
- His many hours spent studying complex scientific papers;
- The realization that the logic is really quite simple, as “[i]t doesn’t take a whole lot of knowledge to know that if your immunity is depressed, you can catch an AIDS-defined, or any kind of, disease”;
- Problems with non-specific antibody testing and the tragic absurdity of “viral load” measurements (including Nobel Laureate Kary Mullis, who has stated that viral load tests misuse the PCR technology he invented);
- AIDS drugs as toxic “chemotherapy”; and
- How he got past his doubts following the deaths of several notable AIDS rethinkers, leading Beth to reveal what is known about how they actually died.
“They’re in the dark, . . . looking for the wrong virus, and then they’re trying to kill the wrong thing with the wrong medicine, and then they’re using the wrong measurement tool [viral load],” Borrelli concludes. “This is a serious problem. It’s cost us billions of dollars. It’s cost us hundreds of thousands or maybe millions of lives worldwide. Why is no one coming forward? Why aren’t [Congressmen] reading [the data]?”
George Borrelli developed a questioning, analytical mind over a long and successful technical and management career in the defense industry. He has applied that discipline to reading nearly a dozen books and studying hundreds of scientific articles on health and medicine. As a lifetime martial artist, he teaches weekly in his own schools and conducts self-defense seminars in government, businesses, and martial arts studios. His interest in martial arts as a spiritual practice has led him to explore healing, including energy healing as a Reiki master, and to speak at local churches and organizations. He lives and works with his wife on a small horse ranch in Colorado.

Regarding our dead friends in this movement, we invite others to look into the other possible reasons for their deaths – other than refusing or stopping treatment with toxic drugs. The day before the Sheen TV drama about being “HIV positive,” the “HIV tests” didn’t detect live, electron-microscopy-viewable virus. After his confession, they still don’t. It’s time to see the fraud, plain and simple. What is Sheen really hiding that might be worse than being “infected” with shame and a “deadly virus”? What is Hollywood in general really up to?
Asking these questions, we might just awaken.
“One of the components in the awakening is that you realize that you’ve been deceived and that, damn it, you don’t want to be deceived anymore, so you start doing research,” says Dr. Marko. “And when you hear something like this – TV is a mind-control device – you dive in and find out.”

Actor Charlie Sheen revealed his HIV status this week. The last time we checked, having sex while positive was no longer a felony, drugs and alcohol caused false positives, and kissing on TV didn’t transmit “HIV.” Why do the media assume otherwise?
Actor Charlie Sheen revealed his HIV status this week. The last time we checked, having sex while positive was no longer a felony, drugs and alcohol caused false positives, and kissing on TV didn’t transmit “HIV.” Why do the media assume otherwise?
“How Positive Are You” co-host Elizabeth Ely looks at the Sheen revelations from a new angle by asking a different set of questions.
Alleging he had been blackmailed for several years, Sheen appeared on the Today show apologizing for the over-the-top lifestyle that led to his firing from sitcom Two and a Half Men nearly five years ago. Not much about the ensuing news coverage makes any sense, scientifically or otherwise:
- Lawyers point out the felony Sheen risks being charged with for having sex without disclosing his test result, yet the Gutierrez court decision effectively reduced these to misdemeanors many months ago;
- “HIV tests” are still not validated back to a gold standard of finding virus under an electron microscope (a service which will soon be available);
- Sheen says he paid up to $10 million to blackmailers, and these might lead him to accept highly paid drug-endorsement contracts to offset his losses (echoes of former basketball star Earvin “Magic” Johnson);
- Too much of this story echoes the Rock Hudson drama of 1984-85, with blackmail, hard drinking and drugging, and speculation about spreading HIV to a TV co-star;
- He claims he is taking AIDS drugs, but this fact is not verified; furthermore, “undetectable” blood levels of HIV are under illogical, inaccurate “viral load” testing;
- His physician isn’t an infectious disease specialist but rather a publicity-seeking reality-TV doctor; and
- Sheen is a well-known questioner of received wisdom on other topics, for instance, the events of September 11, 2001 – why not this one?
A positive “HIV test” is a life-shattering event. Therefore, test accuracy matters – and Dr. David Rasnick is doing something about it. His biotech startup, Viral Forensics, will soon offer “HIV positives” with recent “viral load” results a glimpse of their blood under an electron microscope. Does it contain “particles resembling HIV”?
Consider a viral load result that comes up in the millions. With this many particles in your blood, “we should be able to see it,” says Dr. David Rasnick. If they don’t . . . are you ready for this? . . . you may not be infected at all.
This historic effort will similarly verify the accuracy of other PCR-based diagnostic tests, such as those for hepatitis C and the human papilloma virus (HPV), widely advertised to cause cervical cancer.
Says Dr. Rasnick: “In every case of a pathological organism — that I know of anyway — you can find that organism directly in the person” – except for HIV and HCV. The tests for these infections are indirect, finding non-specific antibodies or bits of genetic material but not actual virus. “The tests really ought to be taken off the shelf, they ought to be banned; they do more harm than good.”
“There’s only a tiny subset of people that are going to have the courage to go after this,” facing down skeptical doctors, hospitals and legal systems, he says. In a break from the usual, easy-sleazy, quick HIV testing the mainstream offers, customers will have to “do their homework,” and Dr. Rasnick is busy creating the Web site to educate them. Viral Forensics will even offer a blog where people can share their stories and questions. We’ll link to the site as soon as it’s up.

David and Beth also discuss a recent article on mainstream AIDS site “The Body” presenting several surprisingly “dissident” arguments, including a proposal to “retire the medical category of AIDS.” As David comments, the author, Todd Heywood, was “forced to confront the inconsistencies in the whole HIV/AIDS paradigm,” when he became seriously ill even while taking the medications and showing a low viral load. Alas, he recommends renaming whatever-it-is “HIV disease.” Is there any way out of this circular reasoning?

Dr. Donald W. Miller, Jr. retired from teaching and practicing heart surgery after a career spanning more than 40 years. He has had a distinguished career as chief of the Division of Cardiothoracic Surgery at the University of Washington School of Medicine in Seattle, medical director of the Swedish Heart Institute, and director of the cardiothoracic surgery program at the Seattle VA Medical Center. He was educated at Dartmouth College, Dartmouth Medical School and Harvard Medical School and served on active duty as a surgeon in the U.S. Navy during the Vietnam War.
In addition to authoring two textbooks on heart surgery, Dr. Miller wrote Heart in Hand, a book considering music, religion, the philosophy of Arthur Schopenhauer, the films of Woody Allen and his own life as a heart surgeon. Dr. Miller continues to write articles on a variety of medical and non-medical subjects for the Libertarian Web site LewRockwell.com. His own website, donaldmiller.com, offers a stimulating reading list on topics as far-ranging as contrarian nutritional advice, the U.S. economy and the beat generation.

Membership in the AAPS and DDP is open to doctors, of course, but not just in the U.S. and not just for doctors. They offer several membership levels including “associate memberships” for related and alternative-health professions. Recently it came to light that Drs. Ron and Rand Paul have been members of the AAPS.

Whether you're “positive” or “negative,” how unbiased will a doctor's judgment on your condition be? Drs. Jane Orient and Donald Miller expose the dire, Kafka-esque situation in American medicine that two independent medical associations address.
Even the mainstream AIDS media are abuzz over this one. Three former employees of the AIDS Healthcare Foundation (AHF) are acting under the federal Whistleblower Act to sue this largest U.S. AIDS medical services provider. At issue is an alleged kickback scheme for patient referrals estimated at $20 million per year.
AHF president Michael Weinstein has answered with the everybody-does-it defense. The rest of the AIDS industry is calling for his head, as it has for the past half-year over his criticism of Pre-Exposure Prophylaxis (PrEP). Weinsten has further self-nominated himself as “czar” to police safe sex in the porn industry.
“It’s like everybody’s singing ‘AIDS Has a Whorehouse in It,’” says How Positive Are You co-host Elizabeth Ely, “to cover up that the whole thing is a whorehouse.”
The kickbacks turn out to be referral bonuses to employees and patients. These are gifts of $50, $100 or a fast-food meal for referring Medicare-, Medicaid- and ADAP-qualifying patients testing positive in the back of AHF’s “Out of the Closet” thrift stores to its own treatment centers and in-house pharmacies.
The government may have encouraged creative incentives through its mandate to identify all the estimated unknown “HIV positives” out there and “link” them to treatment. An organization’s funding might even depend on meeting certain “objectives.” However, federal anti-kickback statutes expressly forbid referring patients in-house, says plaintiffs’/relators’ attorney James P. Gitkin. (Beth asks: Might it encourage unsavory cooperation on outside referrals as well?)
We’re wondering how many people might have been labeled positive because AHF employees wanted those prizes. Who trusts their doctor, only to find out they made extra money for encouraging early treatment with drugs? If truly everybody does this, is the damage so widespread that the lawsuits and mistrust could end the AIDS nonprofit sector?

Curiouser and curiouser . . . “HIV Innocence Group Truth” blogger J. Todd DeShong says he supports Bobby Russell’s lawsuit against his University of Kentucky doctors for the careless practices that led to his false-positive “HIV” diagnosis, but he is not so sure about Clark Baker and the Office of Medical and Scientific Justice (OMSJ), the investigative agency that made that lawsuit possible. It’s not an attack; it’s a “deconstruction.” And we’re not talking about those tests and how misleading they are, even though DeShong is a lab professional who runs diagnostic tests for hospitals and says he is working toward a master’s degree in molecular diagnostics. The tests are “off topic,” he says.

Outside this rabbit-hole Wonderland of DeShong’s own mind, the facts don’t bend. And they’re not so subtle.
DeShong has been running a straight-ahead attack on Baker, OMSJ and the work of its HIV Innocence Group (see Episode 62 for one grateful criminal defendant), and Baker has alleged in court filings that DeShong is not acting alone. Not just a lone blogger, but the whole AIDS-industrial complex, is seriously threatened by OMSJ’s habit of entering the validity of the “HIV tests” themselves into the evidence in criminal and civil proceedings. “Yes, I’ve been on an e-mail chain with a bunch of those people,” DeShong says of the highly placed government- and pharmaceutically-employed critics of OMSJ. What of it?
Here’s what: If someone isn’t talking directly about the issues, they’re hiding their real agenda. It’s OMSJ they’re attacking, and OMSJ they want to stop, because OMSJ is challenging the shaky “HIV testing” on which the whole well-funded edifice stands. The organization is suing DeShong, and yes, the case was still alive as of this taping in February 2015. (UPDATE: OMSJ has, by this posting in March 2015, lost that lawsuit.)
“I don’t want to talk about Clark Baker without him [here] to defend himself,” says this guy who has dedicated an entire Web site to, no kidding, “deconstructing” Baker and the work of OMSJ.
Baker did defend himself, writing to Beth: “His website is a rat’s nest of propaganda – a shell game of junk science that supports itself.” Isn’t that what the AIDS paradigm itself is? It’s a house of mirrors all reflecting “truth” back to one another while ignoring the basic fact that
there
is
no
reliable
test
for
“HIV.”
Baker’s own legal declaration states, bluntly and without nuance, that he is suing DeShong over:
“. . . the continuous, unrelenting, uninterrupted, and ongoing campaign by DeShong and his accomplices since 2008 to interfere with my business and my ability to attract clients, financial donors, and the media, which dissuades, inhibits, and interferes with my ability to locate clients and conduct investigations.”
One of these cases is Gutierrez. Baker alleges that, because of DeShong’s defamatory blog postings, the defendant’s lawyers refused to respond to OMSJ’s offer of assistance and he was convicted of charges related to having sex while “HIV positive.” As of the taping of this interview, David Gutierrez was awaiting an appeal in the nation’s highest military court. (See our Episode 97 on the defendant’s appellate victory.) DeShong admits that discrediting OMSJ and deterring prospective clients is his goal but claims his activities are protected by the U.S. Constitution’s First Amendment right to “free speech.” Tragically, his disinformation sent the military veteran to Fort Leavenworth prison for four years.
Before granting DeShong this interview, Beth asked what useful information it could offer her listeners, besides barely-entertaining theater. She’s guessing it’s the lengths to which the AIDS “establishment” will go to avoid the essential issues of life and death. Notice how carelessly such people dismiss the need to question the medical tests we all depend on. Listen to their strange idea of what love is, as demonstrated in sociopathic attempts like this to find “common ground” with people they attack elsewhere.
Baker responds to allegations of “death threats”:
“I left my name and phone number after contacting DeShong to interview him as part of my investigation. DeShong called me back and I never called him back – although DeShong called me numerous times over the years. DeShong and his mother never notified law enforcement, nor did anyone at my licensing agency ever convey a complaint.”

It's not an attack; it's a "deconstruction." Blogger J. Todd DeShong says he supports the Kentucky lawsuit on a false-positive "HIV" diagnosis but is sounding the alarm about Clark Baker and OMSJ, the investigative agency that made the suit possible.
“. . . Patricia Goodson has actually performed a public service. It is important for people to know that AIDS denialists do indeed still exist.” — so wrote University of Connecticut Prof. Seth Kalichman, who seems to wish they did not. Although some dispute the label “denialist,” Prof. Patricia Goodson of the Department of Health & Kinesiology at Texas A&M University has documented that we who question the science of “HIV” and “AIDS” do indeed still exist. “How Positive Are You” co-host Elizabeth Ely would even welcome a debate on the substantive points, especially whether there is an accurate test for “HIV.”
The very day in September 2014 that the open access journal Frontiers published “Questioning the HIV-AIDS Hypothesis: 30 Years of Dissent,” alarm bells began to ring. The journal responded to complaints by issuing a Statement of Concern and launching an investigation into the ethics of Prof. Goodson’s article. In the end, it only downgraded it to “Opinion” and published Dr. Kalichman’s February 2015 response.
Prompted by “serious effects” from HAART drug therapies as reported in the popular media (some these concerns are documented here) and by a couple of people close to her, Prof. Goodson had “decided to go back and check and see if some of the scientists who were questioning in the beginning, such as Dr. [Peter] Duesberg for instance, were still questioning.” They are, but this is “not very well known,” she says, especially in her mainstream-oriented field of public health education/social science research. Since her review of the unresolved questions appeared, she has received messages from grateful colleagues and students, even ones who held firmly mainstream views on AIDS. They didn’t know the history, and they didn’t know that these questions were still out there.
“I envisioned that there would be a lot of debate,” she says, and open access journals aim to stir up spirited post-publication buzz. A “review” does not present any original data. This one concluded that the issues were still alive and further research was needed to help resolve them.
“There had been numerous complaints from ‘prominent people in public health’ saying that my article stood to ‘cause an issue in public health,'” says Prof. Goodson. “If something like this stands to ‘cause an issue in public health,’ I think that we need to revisit public health. To me that is a telltale sign that something’s not well here, the patient’s not doing too well.”
Says HPAY co-host David Crowe: “In the end, it was, I think, a major victory for the right to have open discussions about public health.”
Interested listeners can learn more about questions raised by mainstream researchers conspicuously not mentioned in the response article. Neither Dr. James Chin nor Dr. Luc Montagnier assert that HIV does not cause AIDS. Rather, Dr. Chin has questioned the quality of epidemiological data supporting global AIDS statistics. Dr. Montagnier has stressed the importance of co-factors and has stated, “our immune system will get rid of the virus in a few weeks, if you have a good immune system.”
Virginia Tech Professor Emeritus Dr. Henry Bauer posted on his blog a discussion of the possibility, which we mention, that UCONN psychology professor Dr. Kalichman conducted undercover research under the persona “Joseph Newton” for his book Denying AIDS. Just like that, about 25 years of risking an “aggravated assault” or similar charge for not informing a sexual partner that you’re “HIV positive” are effectively over. On February 23, 2015, the highest U.S. military court judged the risk of contracting “HIV” from sex as so low that it is no longer a serious crime not to tell sexual partners. Attorney and ex-Marine reservist Kevin McDermott talks to “How Positive Are You” co-host Elizabeth Ely about the decision in United States v. Gutierrez and how it might affect civilian as well as military cases.
The U.S. armed forces mandate “HIV testing” of all active-duty personnel every six months. Testimony in similar court cases has revealed low standards for this testing — and on more health conditions than “HIV.” This has been devastating to the lives, health, careers, reputations, retirement benefits and families of thousands who serve their country. We urge all, inside and outside the military, to review the limitations of HIV testing.
At the time of his arrest in August 2010, Technical Sergeant David Gutierrez had put in nearly 20 years in the Air Force and looked forward to qualifying for an honorable discharge and full retirement in a couple of months. His work record as an aircraft maintenance manager at McConnell Air Force Base in Kansas was spotless. He kept completely separate from this military career the sexually free “swinger lifestyle” he pursued with the consent and participation of this then-wife, Gina Gutierrez, even after “testing positive” in 2007 and 2010. But when the Air Force found out, it charged him with “aggravated assault,” the military’s charge for having sex without disclosing one’s HIV status. He was, and remains, healthy. Not one person alleged he had infected them with HIV.
The Office of Medical and Scientific Justice (OMSJ) assisted the defense on appeal. Under the direction of licensed California private investigator Clark Baker, OMSJ has a successful record of defending alleged HIV positives. Said McDermott, “Without OMSJ’s efforts and diligence, the results in this case could not have been possible.”
OMSJ educates defense lawyers on problems with HIV testing. Unlike other HIV law organizations, it is willing to challenge a defendant’s HIV status by presenting expert scientific witnesses. In Gutierrez, however, it didn’t get the chance to do that on appeal because the original defense team refused to retain OMSJ, as a rumored “fraudulent” agency pursuing “conspiracy theories,” and presented no evidence on testing at the trial level. Nonetheless, OMSJ influenced the appellate decision based on the low probability of HIV transmission and harm.
Gutierrez will get his sentence reconsidered based on a conviction reduced to “assault consummated by battery” and the two upheld convictions of failing to follow a lawful order to practice “safe sex” and inform partners, and “adultery” affecting the discipline and image of the armed forces. He could even be released on time served for almost five years, says McDermott.

Is there life after “HIV”? Twenty-seven years after his “positive” test result, Dr. Manuel Garrido says, “In most cases, the people who live longest and in the best state of health are those of us who do not take the medication.”
The year is 1987, and the world stands in fear of an alleged new virus, “HIV,” with only one treatment in development, a highly toxic drug called AZT. A medical doctor in Spain gets his own test results — “positive” — and descends into alcoholism and despair. Twenty-seven years later, as featured in the new documentary film Positive Hell, he is healthy and proof that there is indeed life after HIV.

In Rappoport’s view, medicine is central to the ability to control large numbers of people. “If you want to do the most horrendous things to people, the best cover story you can have is a virus,” he says.
