Beau Elite is a Sports Law firm in Sacramento California guided by Bryan Pritchard, Solina Sanchez and Gary Alvarez analyze the Pavia Case. Currently, the Diego Pavia v. NCAA case is at the forefront of Sports Law headlines as it calls into question whether an athlete's time at a Junior College should apply when transferring to the University Level. Beau Sports Law analyzes three different perspectives in the ongoing Pavia case and the repercussions they would create for Junior college football athletes. The arguments are as follows:

  1. Diego Pavia: The JUCO rule violates the Sherman Anti-Trust Act by restraining competition among athletes and schools. The JUCO rule should not apply because it is in the student's best interest to maintain the status quo for eligibility as it allows players to maintain longevity in their athletic career. Not allowing the JUCO years to apply would adversely affect low income or first-generation students to transition into the NFL, which secures benefits like NIL revenue at the professional level. More time allows student athletes to train longer and gain an advantage when transferring into the university level, securing victories for their team, school and for the possibility of a professional career later down the line.
  2. School: The eligibility rule restricts economic opportunity in the college athletics marketplace by limiting student athletes' ability to participate and earn NIL money. College sports are currently a real economic market because of athlete's early exposure along with Name, Image and Likeness opportunities. To not count JUCO years falls squarely within the principles of the Sherman Act which protects fair trade by regulating unfair and unreasonable business practices. As it stands currently, the JUCO rule is overly broad and does not serve a clear competitive purpose.
  3. NCAA: Eligibility limits are necessary to keep college sports fair and balanced, not to control the labor market. Eligibility caps prevent older players from dominating college rosters and creating an unfair advantage over younger athletes. JUCO seasons still provide a real competitive experience for student athletes allowing room for their physical and professional development. The Sherman Act isn't a business restriction; it is a rule that regulates how the sport functions at the collegiate level.

In this episode, I break down three key reasons why Judge Wilkens declined to confirm the House v NCAA settlement during the April 7 hearing:

1) Future Athlete Impact- Judge Wilkens expressed concern that the settlement could unfairly affect future student-athletes who weren't part of the case and had no opportunity to object, potentially settling a troubling legal precedent. She asked the attorney to provide legal precedent to justify the 10 year Injunction which will impact future student athletes.

2) Roster Limits - She challenged the immediate implementation of roster size limits, suggesting that current student-athletes should be "grandfathered in" to protect their roster spots or that limits should be phased in over time.

3) $600 Dollar Review on Third party NIL Deals - Judge Wilkens questioned the logic behind questioning deals over $600. She pressed the attorneys to explain how the $600 limit would benefit student-athletes.

Judge Wilkens did not Approve the Settlement in the House vs. NCAA case. In a nutshell U.S. District Court Judge Claudia Wilkens said "Taking things Away from People is not A Good Idea" She didn't like the restrictions the parties placed on 3rd party collectives, the cap of 20 million dollars, or the fact this settlement would apply to a person who is 6 years old and didn't have representation in the settlement. The parties have 3 weeks to come up with a more fair and consistent settlement.

On April 23, 2024, the Federal Trade Commission voted to finalize a new rule to prohibit employers from enforcing noncompetes against workers.

•The Commission has determined that noncompetes are an unfair method of competitionand therefore violate Section 5 of the Federal Trade Commission Act (“FTC Act”).

•The final rule prohibits employers from entering into new noncompetes with workers on or after the effective date.

•The rule also prohibits employers from enforcing existing noncompetes with workers other than senior executives.

•The rule takes effect 120 days from publication in the Federal Register.

3% A Number That is Not Gross, Its Disgusting

I have eluded to frustration with percentage based fee structure in the current market in sports industry.

Heres Why

Breaking Down 3%: it may seem like a nominal fee until I break this down into real usable numbers 1. Coaching and playing is simply what you do to support your family. 2. I am coaches wife and I am in charge of our family finances my husband salary has a huge impact on our monthly finances. If you have a pen and paper you may want to follow along and write this down so you can see what 3% actually means to your pocket book. 3. Let take $100,000 Gross Salary-that is the salary offered by the institution or pro team before taxes 4. The federal tax rate is 10%, 15%, 25%, 28%, 33%, 35%, 39.6% depending on the amount you make after your taxable income. For the purposes of this exercise I am going to use the 33% tax rate. 5. State taxes vary. I will use 10% some states may be higher, some lower, and a few states have no state income tax.

  1. 5% is an amount you may contribute to a qualified 401K

  2. 33% plus 10% plus 5% = 48%

In numbers this means at 100K divided by 12 = 8,333 gross pay

After 48% is deducted your net pay is roughly $4,150

  1. Agent Fees of 3% of 100K= 3,000

  2. Agent Fees of 4% of 100K = 4,000

Although a 3% fee is defendable on per hour basis for attorney fee on $100,000 contract negotiation. You are almost paying one month salary to your agent.

One Million Dollar

Here’s where is get interesting. Lets do this based on One million dollar deal. You may be saying hey I don’t make one million dollars well over a 2-3 year multi year deal you might make that much.

Here what those numbers look like:

1,000,000 divided 12 = $83,333 per month

after 48% is deducted your net pay = $41,666 month

3% of million is $30,000 4% $40,000 which again is almost one month salary. As a mom of college aged children that amount will be what you will need to pay college tuition.

I do this for a living and that amount just really doesn’t pencil.

At 30,000 a year that is probably your second biggest expense next to housing.

If an attorney charges $500 per hour and average contract negotiation takes 5-15 hours 2500-7500 dollar fees.
