It sounds like smart planning… naming your child or grandchild as your executor, trustee, or power of attorney now so you don’t have to update your documents later. But when that person is still under 18, things aren’t as simple as they seem. Today, Nick explains that while the idea comes from a good place, it can create real legal and practical problems when those roles are actually needed. He also covers smarter ways to structure your plan, so it works when it actually matters, not just on paper.
Here’s some of what we discuss in this episode:
⚖️ Legal Reality: Minors cannot legally serve in fiduciary roles
🚫 Practical Limits: Naming them early doesn’t mean they can act when needed
🔮 Future Planning: Using minors as backup options requires careful structuring
🧩 Real-World Impact: Legal eligibility doesn’t always equal capability

You created your estate plan years ago and your wishes haven’t changed, so why is your attorney telling you it’s outdated? Nick breaks down why older estate documents can create friction, delays, or even roadblocks when your family needs them most. The truth is, even if your intentions stay the same, the laws surrounding estate planning don’t, and those changes can quietly impact how effective your documents really are.
Here’s some of what we discuss in this episode:

⚖️ Legal Changes: Trusts, POAs, taxes, and HIPAA laws evolve over time

Co-owning property can feel like a practical solution, whether it is family inheritance, investment opportunities, or helping someone buy a home. But when the co-owner is not your spouse, you are stepping outside the legal “default rules” that typically protect married couples. That means more risk, more potential conflict, and more need for planning. In this episode, we walk through six of the most common co-ownership scenarios and highlight what can go wrong and how to think ahead.
Here’s some of what we discuss in this episode:
🏠 Co-ownership turns you into business partners

What do you do when your adult children aren’t responsible with money but you still want to make sure they’re taken care of after you’re gone?
Today we answer a question facing many parents about what estate planning options are available when you’re worried about handing over an inheritance to kids who will likely mishandle it. Nick explains the practical, realistic options parents have when an adult child may never be “money-ready.” Whether the concern is financial immaturity, addiction, or lifelong poor habits, we’ll show you why “controlling from the grave” isn’t negative and often the most loving choice.
Here’s some of what we discuss in this episode:
🎯 Not “controlling”, protecting - Supportive guardrails, not punishment.
📝 Trust rules matter - Income-only, installments, or full discretion — you choose.
🧑⚖️ Pick the right trustee - The job must match the complexity.
🏦 Corporate trustees are options - Especially when oversight is lifelong.
🔍 Define needs before picking people - Build the rules, then choose who enforces them.

Thinking about starting your estate plan but holding off because you might buy a business, inherit money, or move across the country? According to Nick, waiting is a mistake, and he’s got a great analogy to explain why. In this episode, he walks through what to do when you know big life changes are on the horizon.
Just like you wouldn’t buy a two-seater sports car if triplets were on the way, you shouldn’t build a short-term estate plan you’ll have to throw away. But that doesn’t mean doing nothing either. Nick explains how to plan ahead intelligently by building in flexibility and “future-proofing” your documents. Waiting for life to settle down is tempting, but estate planning isn’t something you leave to chance.
Here’s some of what we discuss in this episode:

One of the biggest decisions a married couple faces when setting up an estate plan is whether to create a joint trust or separate trusts. The right choice depends on several factors, including how they manage their finances, asset ownership, and estate planning goals. In this episode, we’ll break down the pros and cons of each option and discuss when a joint trust makes sense versus when separate trusts are the better choice.

With home prices continuing to climb, a house ends up being the most valuable asset for many families. However, it can also be the most difficult to deal with in an inheritance after someone passes away. One of the biggest issues people run into is the owner passing away while the house still has a mortgage or a line of credit against it.

The Corporate Transparency Act (which was enacted in January of 2021) has taken effect as of January 2024. Under the new law, small businesses have new disclosure and reporting requirements with the Financial Crimes Enforcement Network. Along with the new requirements, there are significant fines/penalties for being in violation of the law. Listen in as we talk about what you need to know!

Many people automatically think of how to handle or “plan” for their assets when estate planning comes to mind. However, inheriting someone’s assets is only one piece of the puzzle. This is why someone asking “How much money do I need to have before I create an estate plan?” is always the wrong question. Let’s cover a number of estate planning goals that have nothing to do with someone’s assets.

An important (and often overlooked) part of estate planning involves arranging for a person to have their medical needs taken care of. This usually involves a combination of appointing a decision maker (your power of attorney agent or surrogate, depending on the state you live in) and using an advanced directive to affirmatively state your wishes. Most states include certain decisions where you can either make the decision yourself or leave the decision to your healthcare decision-maker.

We’ve spent many episodes discussing how important trust funding is to your estate plan (assuming a trust is a part of your plan). However, the process can be tedious at times. Many attorneys don’t handle the trust funding for the clients (or only provide minimal guidance), which can lead to further trouble. On top of that, various banks, employers, and investment firms can often frustrate clients even further. A good, experienced attorney should be able to navigate clients through any roadblocks, warn them of potential issues, and have options for how to finish the job when issues come up.

When thinking about an inheritance, most families visualize individual “shares” for each beneficiary (whether a $ amount or % of the overall estate). While there is NEVER a substitute for a complete, well-thought-out estate plan, shortcuts and alternative ways to transfer your assets DO exist. Many types of assets allow beneficiary designations, transfer-on-death or pay-on-death designations, succession plans for businesses, etc. One of the most popular questions that clients often ask is about what to do with real estate. Because real estate is usually one of the most valuable assets that families will ever own, choosing the appropriate way to transfer real estate upon passing is very high risk, high reward.

There are proper protocols and procedures for transferring bank accounts, investments, retirement accounts, vehicles, real estate, etc. However, a new type of asset has come into play in the 21st century: digital assets. While the law has tried to play catch-up on how to handle digital assets, there are certain things that can be done now to make sure this part of your estate is properly handled if you become ill or pass away.

As people age, they tend to rely on others to help out. Spouses, children, and other family members often step in to help handle everything from the finances to cutting the grass. If there are no family members that are trustworthy and capable, many look to service providers, caregivers, and other “outside” options. Unfortunately, as people age and become reliant on others, that can make them targets for financial abuse.

Different types of estate plans allow different levels of flexibility. When setting up a trust, the Trustmaker usually has an opportunity to get extremely detailed in the instructions left for the Trustee to follow when distributing your estate after you pass away. The rules you put in place (and how much discretion you want to leave for your Trustee) should be careful considered. It is impossible to think of every situation that could arise after you pass away. However, there are ways to set rules, boundaries, and guidelines while “future-proofing” your estate and planning for the unexpected after you pass away.

After someone passes away, the executor or trustee is responsible for carrying out the wishes of the deceased person and settling the estate. This could include paying bills, settling debts, filing taxes, selling assets, etc. Eventually, it is time for the beneficiaries to receive their inheritance. While it may be tempting to “take the money and run”, this may put their inheritance immediately in danger. Those who are receiving an inheritance from a trust may have opportunities to protect the money they receive from current (or future) problems.

When someone passes away, the “what happens next” is usually dictated by the decedent’s estate plan (if they had one), or by state law, if there was no plan. However, there are special circumstances that apply when a married person passes away but their spouse is still alive. Often times, a family may end up getting “lucky” and avoid some of the major headaches. However, this is not always the case.
