In our latest episode of Watchdog, join Partner and series host, Shaun Temby, as he dives into the recent ACCC prosecution of Qantas, in what’s become known as the ‘Ghost flights’ litigation.
In this episode, Shaun discusses the use of fine print disclaimers to qualify a strong primary message and the pitfalls businesses can face, whether the penalty negotiated between Qantas and the ACCC was adequate, and three key allegations made by the ACCC, including selling 8,000 tickets to cancelled flights and accepting payments for non-existent services.

In this week's episode of the Watchdog Podcast series, listeners will hear from returning guest Maddocks Special Counsel Christopher Marsh and podcast series host Shaun Temby as they discuss the recently dismissed appeals from both Mazda and the ACCC. Recent Federal Court cases have clarified that conduct doesn’t need to be morally offensive to be unconscionable. The Mazda decision is the first consideration by the Full Court of Appeal applying the new test to determine whether the conduct of a major company towards its customers is unconscionable.

Maddocks Partner and series host Shaun Temby sits down with Special Counsel Christopher Marsh to discuss the Australian Competition and Consumer Commission (ACCC)’s proceedings against Retail Food Group (RFG), which settled in late 2022.
After initial media reports in 2019 about RFG’s questionable conduct in relation to the management of franchisees’ funds (and other allegations), the ACCC investigated the conduct and commenced court proceedings against RFG in 2020.
Given that news of the settlement may have been a surprise to those following this high profile case, Shaun and Chris discuss some key takeaways for both consumers and franchisers in this space.
