In this episode of April 2023's Trending Topic, Brittany Reimer and Suzana Goncalves take a deep dive into the most recent Government policy changes and amendments to the Real Estate Marketing and Development Act and Foreign Buyers Ban. This chat looks into the advantages and risks associated with the BCFSA amendments for developers, as well as the unforeseen consequences of the Foreign Buyer’s Ban and the much-needed shift in the policy to avoid further supply shortages.
The BC Financial Services Authority (BCFSA) has introduced amendments to the BC Real Estate Marketing Act, allowing developers to begin marketing at an earlier stage, potentially reducing the lifecycle of the development process and reducing financial exposure for developers. However, having an accurate estimate of all costs before sales is important, as it can be difficult to have an accurate picture as early as the third reading. Developers must also be wary of the 12-month allowable window to achieve construction financing and a building permit, which remains in effect with this change.
MLA Canada’s Cameron McNeill On BC’s New Presale Marketing Changes
The amendments to the Foreign Buyer's Ban allow non-Canadians to buy residential property expressly for housing development, bringing more homes into the marketplace. The changes also mean that the bans no longer apply to vacant land zoned for residential/mixed-use, and they have increased the threshold for which a company is judged to be "foreign-controlled." These changes may give more leeway for non-Canadian entities to invest in BC and could be a good thing for capital flowing into BC and investments being made in neighbourhoods, thus strengthening the market.

FINANCIAL VOLATILITY AND MARKET UNCERTAINTY IN THE WAKE OF SILICON VALLEY BANK COLLAPSE
The financial system has been experiencing significant volatility due to factors such as changes in interest rates and liquidity issues faced by banks like Silicon Valley Bank. This has resulted in wild fluctuations in the bond market and interest rate forecasts. The difficult financial environment is not just limited to banks but is also affecting other industries, such as real estate. Developers who acquired assets in a low-interest environment are now struggling to operate and steer their operations while holding costs are increasing significantly. Despite the potential for rate cuts, there are still many unknowns, and the situation remains volatile.
STRONG PRESALE ACTIVITY IN METRO VANCOUVER SIGNALS IMPROVING MARKET CONDITIONS AND EXCITING LAUNCHES AHEAD
The Vancouver presale market is showing signs of improvement, with strong sales and absorption rates in March, especially in larger tower and wood frame programs. Perla was a standout program, with 110 deals by the end of the month. April and May are expected to be important months for the Vancouver presale market, with 14 programs actively marketing and preparing to come to market over the next two months. Some of the notable programs include Portwood in Port Moody, Citizen by Anthem, and Sequoia in Surrey. The decrease in launch activity in the Fall and Winter months has allowed active programs to absorb remaining inventory and make way for new projects coming to the market. Feature projects this month are Soto on W28 by Forme Development, and Nolita by Fifth Ave Properties.
BENCHMARK PRICING INCHES UP
The real estate market is showing signs of recovery with increasing resales transactions and a steady increase in benchmark pricing, a positive industry trend. Interest rates have also stabilized and come down, leading to restored stability and confidence in the market. However, despite these positive trends, the market is still not as competitive as it has been in the past and is approximately 28% below the 10-year season average. The market's supply side remains depressed, with low inventory levels and a 35% decrease in new listings year-over-year. This is due in part to homeowners hesitating to list their homes when there are few options to purchase elsewhere, creating a circular reference. Additionally, people may be hesitant to list their homes if they believe the market is at its bottom and they could sell for higher prices. However, the supply is expected to catch up as the market continues to warm up.

“We had a government lead real estate slump, but our basic real estate fundaments remained strong. Vancouver enjoyed strong population growth, constrained new housing supply, and low cost of debt. But the impact was on consumer confidence. Homeowners and investors were waiting and watching. Overall values softened – especially detached – concrete presale off some 20% from the highs that were just 24 months earlier. And yet, townhome values remained reasonably resilient. However, overall values were not strong enough to support new development activity, so projects of all types paused, leading to a supply shortage,” explains McNeill.

"We could get lost in this question all morning.
Bill 28 was introduced by the BC government on July 25. 2016. The Bill amended the property transfer act overnight and included an additional 15% transfer tax on foreign entities buying property in Metro Vancouver.
The purpose of this policy was to reduce demand in specific micro-markets where it was believed that foreign demand was concentrating its home-buying activities.
In the lead up to enactment, various neighbourhoods in Metro Vancouver, experienced aggressive price growth, including active neighbourhoods like West Vancouver, Shaughnessy, Marine, and UBC. The immediate impact of the policy proved to be effective on specific markets, wiping away years of equity growth.
What you will not read about, is how the appetite for Canadian real estate was not snuffed out, but merely redirected. As a result, the same buyer groups that this policy was aimed at, redirected their interest towards presale condos, spurring one of the biggest presale price growth markets on record.
From 2014 to 2018, presale in every market doubled in value, with much of this growth occurring post-Bill 28.

Lalonde discusses what that time was like for him as someone early on in their career:
“I recall the fear that many homebuyers had, most of it from more experienced generations who had witnessed crippling debt of the ’80s and ’90s.
When the 5-year fixed dropped below 5%, there was a wave of demand to secure home security, as many believed this would only be available for a moment in time. This created a frenzy on demand, which was felt from 2003 thru to 2006.”

The early days are what we like to call 20 years ago, back in 2001. One of the headlines that caught much attention back then was a comparison of Vancouver and Toronto, named: Canada’s Global City is Not Toronto. When looking at how this comparison has evolved in today’s real estate market, McNeill expresses that both cities have always had a lot to offer:
