Why is Indiana criminal defense and personal injury attorney Mark Nicholson called the Battery Man? Because his first criminal jury trial was a battery case.
The case was called the Big Buford Battery case. They charged his client with throwing a big Buford sandwich at the manager through the drive-thru window. Then going through the drive-thru window and battering the manager. It was all captured on video.
The verdict: Not Guilty!
Henry County, Indiana â In a March hour-long interview, Henry County Sheriff John Sproles stated, "You know, I'm not concerned about bogus tort claims."
Sproles had only been a police officer for three years in 2022 when he easily won the Republican primary, which featured four contestants, and went on to become sheriff.
Notices of tort claims have been issued to Sproles's department in an abnormally high amount in the sixteen months since he took office. There are twelve claims as of Thursday, and the issue has grown costly. Additionally, it has affected Sproles's ties with other county leaders.
Sproles said, âThereâs been no judgments against me. No claims paid out. These will all see their day in court."
Here, the Sheriff is not being forthright. The insurance company has offered settlements and attorneys have been employed on behalf of the county. However, as of yet, there are no verdicts or jury awards.
Pursuant to Indiana law, one must make a claim against a municipal government within six months following a loss or harm. That only holds open the plaintiff's option to file a lawsuit.

The Hendricks County prosecutor is dismissing 79 cases and reviewing two dozen more. The actions are related to a misconduct investigation into a now former Plainfield police officer who is facing charges.
The Plainfield Police Department did not reveal exactly what prompted the investigation. However, it did state Officer Valentin Khazin resigned Wednesday after the police chief "initiated disciplinary action." Khazin was charged with official misconduct, a felony, and false informing.
According to investigators, Khazin attempted to coerce a person to make false accusations against another police officer.

Inmate Marquette Antoine Neal was subdued by jail guards with "less lethal" bean bag rounds after he allegedly disobeyed commands, according to a statement from the Henry County Sheriff's Office on Tuesday.

INDIANAPOLIS â An Indianapolis police officer who was accused of striking a man in handcuffs in the face during an arrest in 2021 entered a guilty plea to a federal crime on Monday.
Sgt. Eric Huxley entered a guilty plea to one count of deprivation of rights under color of law in U.S. District Court. According to The Indianapolis Star, the charge carries a possible term of 10 years in jail, a $250,000 fine, and three years of supervised release after prison.
Huxley, who was fired from the Indianapolis Metropolitan Police Department following the altercation in September 2021, has not yet been sentenced. In October 2022, a federal grand jury indicted him for allegedly using excessive force to arrest Jermaine Vaughn.

SPEEDWAY, Ind. â The Indianapolis Motor Speedway is putting out a warning after discovering some people are selling counterfeit parking passes for the Indianapolis 500 online.
Police are investigating the crime and leaders at the track want to make sure fans don't get scammed.
The Indianapolis Motor Speedway (IMS) is warning fans about fake parking passes for the Indy 500. Hundreds of fake parking passes were sold online last year and the problem has returned.
At the gates of the track, IMS has taken away more than a dozen fake parking passes, turning away fans who unknowingly purchased them. To avoid buying used or counterfeit tickets and parking passes, IMS recommends that fans only purchase from authorized sources.
Itâs also important to note that all parking is sold out inside the Indianapolis Motor Speedway for the Indy 500. Fans should be aware of scammers selling fake tickets and parking passes, as they will not be accepted at the gate.
In addition to purchasing from authorized sources, fans should also be wary of buying tickets or parking passes secondhand. If something seems too good to be true, it probably is.

The Indianapolis Metropolitan Police Department will no longer send firearms kept for safekeeping to a lab for testing, according to a new policy.
The move was made in response to an investigation that revealed the department provided data to the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives for inclusion in a national database and sent every single gun to the ballistic lab for testing.
Second Amendment advocate and gun rights attorney Mark Nicholson stated, "This change will dramatically impact anyone that had their guns taken by IMPD. Additionally, the city and county may face several lawsuits, including a potential class action lawsuit from people who think they have been wrongfully denied possession of their firearms."

A new bill unanimously passed by Indiana Republicans and Democrats alike will prohibit cops from lying to children as part of interrogation efforts to secure confessions.
Senate Bill 415Â passed through the Indiana Senate on Monday with a 48-0 vote after previously making its rounds through both the House and Senate. The bill will now be sent along to Governor Eric Holcombâs desk where it will await being signed into law.
The new legislation states that any statement made by a juvenile during a police interrogation would be inadmissible in court if the juvenile is under the age of 18 and has been knowingly lied to by a police officer.

Two officers were recently indicted in the death of Herman Whitfield III. Now the Indianapolis Fraternal Order of Police is calling on police officers to no longer respond to mental health disturbances.
Mr. Whitfield apparently was killed by when police were called to his parentâs house on April 25, 2022. He was having a mental health crisis which led to his parents calling 911 for assistance. At one point, he was handcuffed, on the ground and said "I can't breathe."

Qualified Immunity: How Does It Work?
One case that highlights both the absurdity of qualified immunity and the extent to which officials may go under its protection is Black Lives Matter D.C. V. Trump, the ACLU-DCâs class-action lawsuit challenging the vicious and unprovoked attack on civil rights demonstrators in Lafayette Square on June 1, 2020.

Video from Madison County Community News Networkshows the Indiana State Police SWAT Team tearing through an Anderson home, looking for a suspected fugitive. They said they used the BEARCAT (Ballistic Engineered Armored Response Counter Attack Truck) after attempting to get 47-year-old Barry Willis to come out of the house for four hours Wednesday.
After the person got out safely and was cooperating with police, ISP said Willis had barricaded himself in the house.
So, a perimeter was set up and the SWAT Team came in. ISP said negotiators and SWAT tried to make contact with Willis over a PA system, then used the BEARCAT to send gas into the residence.
They said all tools they used did not bring Willis out until teargas was deployed into the home. Then, Willis surrendered but not before a huge hole was torn in the side of the house.

No Charges Following the ceremony, the Los Angeles police division confirmed in a statement that it was âaware of an incident between two people in the course of the Academy Awards program. The particular person concerned has declined to file a police report." The two people are Chris Rock and Will Smith, of course.
