The Cole Memo was a document originally drafted by former US Attorney General James M. Cole in 2013. The Memo was sent out by Cole to all US attorneys published through the Department of Justice on August 29th, 2013. The theme of the memo was priorities that prosecutors and law enforcement should focus only on relating to state-legal cannabis operations. Michigan Emergency Regulations, Rule 19. (1) An applicant for a state operating license may temporarily operate a proposed marijuana facility in the State of Michigan, that would otherwise require a state operating license if certain conditions are met. The Department of licensing and Regulatory Affairs (LARA) has issued emergency administrative rules for the purpose of implementing the Medical Marijuana Facilities Licensing Act (MMFLA). The emergency rules are needed to enable LARA, through its Bureau of Medical Marijuana Regulation (BMMR), to fully implement the MMFLA. Also, discussed in this episode are the capitalization requirements in which an applicant shall disclose to operate and maintain a marijuana facility. The State of Michigan’s Department of Licensing and Regulatory Affairs (LARA) released an advisory bulletin today to inform and advise prospective medical marijuana licensees regarding stacking of medical marijuana class C grower licenses. Additionally, (LARA) released an advisory bulletin to inform and advise prospective medical marijuana licensees regarding co-location of medical marijuana facilities. It is the intention of LARA that multiple licenses will be allowed to co-locate in the same facility if conditions are met. All this information can be found on LARA’s website. Senate Bill 594 introduced by Senate Majority Leader Arlan Meekhof would allow for the creation of private public police force. LARA consulted with the Michigan Attorney General’s office regarding facilities and dispensaries currently in operation and determined that any regulatory action will require an administrative rule. The department’s intent for the emergency rule is to consider any operation of a facility-that would otherwise need to be licensed under the MMFLA-as a potential impediment to licensure if continued after December 15, 2017. LARA will begin accepting license applications for all facilities on that date. This applies to all facilities defined under MMFLA. THIS APPROACH WILL ALLOW EXISTING OPERATIONS TO WIND DOWN WHILE ALSO GIVING ADEQUATE TIME FOR PATIENTS TO ESTABLISH CONNECTIONS TO CAREGIVERS TO HELP ENSURE CONTINUITY OF ACCESS. The State of Michigan sued M22 for trademark infringement. Eventually, a Federal Judge dismissed suit in favor of M22. This show discusses the issues surrounding the lawsuit and breaks down Trademark Law. Todd is a huge fan of M22.com  M22 filed for Federal Protection under the mark in 2006 and was granted registration in 2007. In 2012, after the 5 year period allowing for contestation, the mark became incontestable. Years later, Michigan Attorney General, files for trademark infringement. Federal Law, is the law of the land and in the end Federal Judge throws case out.
