Derek Chauvin Trial - Day 14 of Arguments: Thursday, April 15th
Derek Chauvin spoke in court first this morning before the jury was brought in, answering questions by Judge Cahill in regards to testifying. Ultimately, he decided not to testify, and the defense rested its case.
The prosecution announced new evidence had been found by Medical Examiner Andrew Baker. While watching the testimony of defense expert David Fowler, Baker said he found a report of George Floyd's blood gas reading from May 25, 2020. Fowler had presented a slide during his testimony in regards to carbon monoxide playing a role in the death of GF, saying that his Carboxyhemoglobin increased anywhere from 10-18%. The state said they had subpoenaed all records from Hennepin County Medical Center, but somehow this evidence was missed until Baker brought it to their attention on yesterday during Fowler's testimony.
The defense argued evidence was not given to defense until 7:53am this morning, and that the state knew Fowler was coming to present his testimony on Carbon Monoxide and therefore had ample time to find such evidence and prepare accordingly. Defense counsel Nelson mentioned that Dr. Fowler was unreachable on a plane home, and they still only contend that the Carbon Monoxide was only a contributing factor, not the cause of GF's death.
In the end, Cahill ruled that the blood gas readings would NOT be admitted and while Dr. Tobin would be allowed to take the stand again to rebut Fowler's testimony, he was not to reference or mention the new evidence, and if he did; the judge would declare a mistrial right then and there and we would start this process all over again from the beginning.

Dr. Martin Tobin took the stand to challenge the testimony presented yesterday by the defense by way of Dr. Fowler that the compound Carboxyhemoglobin had increased in GF 10-18% due to carbon monoxide exposure.

Dr. Tobin said he the defense was flat out wrong on the 10-18% increase in Carboxyhemoglobin, saying that GF's hemoglobin saturation, meaning how much the hemoglobin was saturated with oxygen, was 98%. So at MAX, there was 2% of Carboxyhemoglobin and the average human regularly has anywhere from 0-3% at any given time naturally.
- The state then challenged the shade thrown by Fowler yesterday on my hero here Dr. Tobin. Yesterday, Fowler had said that he could find "NO LITERATURE ANYWHERE" to support Dr. Tobin's testimony that decreasing the size of the lungs, also decreases the size of the hypopharnyx. proceeded to tell the jury that there is extensive research in that.
- And then under cross, my main man Dr. Tobin is asked if he had any of these studies and if he provided them to counsel and he comes back with a smirk/chuckle and says there are at least a dozen to 20, including on PubMed (published med. journal), as well as some in his report he completed for the prosecution, offering to .... "NAME THEM ALL IF YOU'D LIKE"...... lmaoooooo hahah I love this man!
DEFENSE - NO FURTHER QUESTIONS AND THAT IS THAT!
BOTH THE STATE AND DEFENSE RESTS. Closing arguments and then jury deliberation will happen Monday.

Derek Chauvin Trial - Day 13 of Arguments: Wednesday, April 14th
The defense started out the day by filing a motion for Judge Cahill to acquit #DerekChauvin of all charges without sending the case to the jury because the state has not proven its case, failed to show how GF died, as well as presented a series of conflicting opinions on whether the use of force was unreasonable. It was denied...lol
Next up was the long awaited ruling on whether or not Morries Hall, a passenger in the vehicle with GF would testify for the defense. We heard from Shawanda Hill Yesterday. Hall was subpoenaed by the defense as well and questioned by Judge Cahill this morning in court before the jury was allowed in. The defense has suggested Hall sold GF drugs and that Floyd died of a drug overdose, which means, his testimony would leave him vulnerable to potential criminal charges under Minnesota's broad third-degree murder statute.
Hall said he was not willing to testify because he is fearful of incriminating himself. Judge Cahill found that Hall had a valid Fifth Amendment privilege, and quashed the subpoena.

- Police Sergeant Ker Yang - officers are trained to de-escalate the situation to "pre-crisis levels" and provide whatever help the person may need, including medical attention
- Lieutenant Johnny Mercil - When asked to look at a picture of Chauvin kneeling on Floyd's neck, Mercil said it does "not show an approved neck restraint"; "a knee on someone's neck would not be an authorized tactic to use on someone who is in handcuffs and under control"
- MPD Officer Nicole McKenzie - Mackenzie testified officers are "required to begin CPR if they find a person has no pulse"
- LAPD Sergeant Jody Stiger - "Floyd initially actively resisted officers when officers were attempting to get him inside the police vehicle, and at that point, officers were justified in using force. However, once Floyd was placed in handcuffs on the ground and stopped his resistance, the former officers should have slowed down or stopped their force as well."

Derek Chauvin Trial - Day 5 of Arguments - Week One Down---S1:E6
Two Witnesses Testified Today:
1. Sgt. Jon Edwards - Minneapolis Police Sergeant - arrived at 21:51 to Keung/Lane in Unit 320; told by Lt. Zimmerman to rope off scene until he arrived
2. Lt. Rick Zimmerman - Head off the homicide unit, highest senior ranking official to investigate critical incidents:
- -a knee on someone's neck should "absolutely" be considered deadly force described officers' use of force
- -use of force against George Floyd "uncalled for"
- -"Because of the fact that if your knee is on a person's neck, that can kill them.
- -"totally unnecessary," no reason for the officers to believe they were in danger from Floyd, or in his surroundings.
Second-degree murder, which IS one of the charges Chauvin faces, in Minnesota can be “intentional” or “unintentional” .
The second-degree murder charge requires prosecutors to prove Chauvin caused George’s death while committing or trying to commit a felony — in this case, third-degree assault; punishable by up to 40 years in prison if convicted.
Prosecutors don’t have to prove that Chauvin was the sole cause of George’s death — only that his conduct was a “substantial causal factor.”
Third-degree murder would require a lower standard of proof than second-degree. To win a conviction, prosecutors would have to show only that George’s death was caused by an act that was obviously dangerous, though not necessarily a felony like the 3rd degree assault in 2nd degree.
Under Minnesota law, the perpetrator must act in a way that was reckless and had the risk of causing death; carries a sentence of no more than 25 years.
Prosecutors argued through the appellate courts to add the third-degree murder charge because not only is it easier to prove than second-degree unintentional felony murder, but it also gives jurors more options about how to convict.
Manslaughter, the least serious charge and also the one with the lowest burden of proof, requires only evidence that Chauvin caused George’s death through negligence or consciously took the chance of causing severe injury or death. To avoid conviction on the second-degree manslaughter charge, the defense needs to prove that Chauvin didn’t cause George’s death due to negligence that created by an unreasonable risk —meaning, he didn’t know that pinning him down by his neck for nearly nine minutes, and now 2:44 AFTER Officer Keung said there was no pulse, would lead to severe injury or death.
In Other Words:
- 2nd Degree Murder: Did Derek Chauvin assault (inflict substantial bodily harm) George Floyd which ultimately played a substantial factor(not sole factor) in his death?
- 3rd Degree Murder: Did Chauvin's actions reflect a knowingly dangerous act which demonstrated an indifference as to whether George Floyd was harmed?
- 2nd Degree Manslaughter: Did Chauvin create unreasonable risk, and consciously take a chance of causing death or great bodily harm to George Floyd.
Look at the evidence...and answer those for yourself.

📮New Episode Alert Day 3 of Arguments in the #DerekChauvinTrial for the death of #georgefloyd So much to digest today.... First, we wrapped up Genevieve Hansen, the off duty firefighter who tried to intervene and render aid and began her testimony yesterday. Then, we heard from the store clerk who took the counterfeit $20, Christopher Martin. Next, we heard from Christopher Belfry, a citizen who filmed the exact moments police approached #GeorgeFloyd's car from his car. Fourth, was the very emotional testimony of 61 year old Mr. McMillan, who broke down uncontrollably after watching the bodycam footage which displayed him and his conversation with George. When George began crying for his mother, it became too much for Mr. McMillan to take and the judge recessed. Lastly, was the testimony of Lieutenant Rugel, a police surveillance and body camera expert who is the director of the department who oversea's body cameras in the city of Minneapolis. Through him, the state admitted into evidence and then played all 4 of the body worn cameras for the jury before dismissing for the day. From every angle I have looked it appears that at the moment they say, "he's breathing", however labored, he was; But after that, no. And in less than a minute, Office Keung said he could not find a pulse. 8:26:00pm. So at 8:26:00 they knew he was dead and NONE of them moved. None of them did anything. None of them told #derekchauvin to get off. None of them rendered aid. They got off of a man who but a few minutes ago was screaming and took all 3 to hold down, and now, officers like Lane are at his feet and seen at minute 8.26.03 trying to lift George's leg, which is limp. Today we saw multiple witnesses:
-D. Willams, Martial Artist bystander on video who verbally challenged officers to render aid to George Floyd.
- 4 Minor witnesses including a 9 year old and her cousin, the then 17 year old who recorded the now infamous bystander video
-G. Hansen, off-duty firefighter who identified herself began recording, demanded officers check for a pulse, and then called police on the police
Today I had a guest, Social Justice and Women's Rights Advocate Sierra Knight.
AND THEN.... I had ANOTHER last minute jump in with up intersting legal perspective.

Day 1: March 29, 2021
DerekChauvinTrial Update:
Opening Statements complete, 2.5 witnesses down. Prosecutor Jerry Blackwell said in opening statements that Floyd died from oxygen deprivation, fighting for "one breath at a time," over an extended period of time. Blackwell said Floyd did not die of a drug overdose, as the defense has suggested. Blackwell said Floyd had fentanyl in his system at the time of his death, but that he had developed a tolerance to the drug after struggling with opioid addiction for years. Blackwell mentioned something that I find personally relevant as soon who has relatives who suffer from hard core addictions. Blackwell pointed out that someone who died of an opioid overdose would appear to be asleep. "They're not screaming for their lives, they're not calling for their mothers, not begging 'Please, please, I can't breathe,'" Blackwell said. "That's not what an opioid overdose looks like." On that point, he is right. In his opening statement, defense attorney Eric Nelson offered a different explanation for Floyd's death. He said he would provide evidence to show that Floyd died of cardiac arrhythmia, hypertension and coronary disease, and that the ingestion of drugs and the adrenaline in his body "all acted to further compromise an already compromised heart." Nelson said an autopsy showed coronary disease and an enlarged heart, and toxicology tests revealed the presence of fentanyl and methamphetamine. He pointed out that the medical examiner found no tell tale signs of asphyxiation, and no evidence Floyd's airflow was restricted. He argued the case amounts to more than 50,000 items, saying, "The evidence is far greater than nine minutes and 29 seconds." So there you have that, not that the extra 40 something seconds mattered much, 8:46 seconds was long enough. Nelson said that the attempt to get Floyd into custody was "not an easy struggle." "You will see that three Minneapolis police officers could not overcome the strength of Mr. Floyd," Nelson said.
Nelson argued that police officers must respond to rapidly evolving situations, saying quote, Chauvin "did exactly what he was trained to do over the course of his 19-year career."
Two witnesses were questioned, the third was abruptly cut when the court's live feed stopping working and the judge dismissed everyone until tomorrow morning. The first was the 911 dispatcher. The second was witness who worked at the Speedway gas station across the street from the Cup Foods and had taken several videos of the incident and later gave them to police. And the third, incomplete witness was Donald Williams, the man heard on the bystander video.
