In August 2024, Gender Justice and co-counsel Wanta Thome PLC filed a discrimination lawsuit againstthe Academy of Holy Angels, a Catholic high school in Richfield, Minnesota, and the Archdiocese of St. Paul and Minneapolis after they effectively terminated Reyzl Grace, a staff librarian, when she came out as trans.
Reyzl Grace’s story highlights the importance of ensuring that no employer in Minnesota has carte blanche to discriminate against employees simply because of who they are.
We believe the school violated the Minnesota Human Rights Act (MHRA) by refusing to allow Grace, who served as a secular librarian at the school, to reapply for her position on the basis of gender identity and sex. While the MHRA does permit limited exemptions on religious grounds, the Legislature never intended for these exemptions toapply to secular employees.

SCOTUS Chat: Recorded live with Jess Braverman, Gender Justice Legal Director and Erin Maye Quade, Gender Justice Special Projects Advisor
On June 27, 2024, the U.S. Supreme Court issued its decision in Idaho v. United States and Moyle et al., or the “EMTALA” (Emergency Medical Treatment and Labor Act) case, which centers on whether state abortion bans supersede the federal EMTALA law mandating that hospital emergency departments receiving federal funding must stabilize a patient whose life or health is at risk.
In its long-awaited decision, the Court sent the case back to the lower courts, where. It also reinstated a lower court’s ruling permitting doctors to provide emergency abortion care even where such care conflicts with Idaho’s abortion ban—but not before several patients had to be airlifted out of Idaho to receive emergency health care because of the Court's initial decision.
By punting on what should be a straightforward ruling, the Supreme Court effectively condones the denial of emergency abortion care.

“No health plan that covers physical or mental health services may be offered, sold, issued, or renewed in this state that excludes coverage for medically necessary gender-affirming care.”
This is the simple language underlying one of the major accomplishments from Minnesota’s 2024 legislative session: the Gender-Affirming Care Act, Representative Leigh Finke’s 2024 bill codifying Minnesota’s existing mandates for insurance coverage of gender-affirming care. The policy was included in the omnibus Commerce policy bill that passed this session.
Our guests for this episode bring a wealth of knowledge and experience to the discussion, describing the urgent need for codification, the process of drafting and passing this law, and the impact that the policy will have on the many people for whom gender-affirming care is an essential aspect of their healthcare.

On June 13, 2024, the Supreme Court issued a decision in U.S. Food and Drug Administration v. Alliance for Hippocratic Medicine, its first abortion case since the Dobbs ruling reversing Roe v. Wade.
In a unanimous ruling, the U.S. Supreme Court maintained the current FDA regulations on mifepristone, one of the two pills used in medication abortion.
This medication, alongside misoprostol, constitutes the primary method for over 60% of U.S. abortions and plays a vital role in reproductive healthcare beyond abortion, including miscarriage management and treating reproductive health conditions.
As reliance on medication abortion surges nationwide, with over three in five abortion patients opting for this method, the Supreme Court’s decision maintains access to a fundamental aspect of reproductive healthcare.
However, while this ruling maintains the status quo for mifepristone access, it contains troubling language suggesting that doctors with religious objections to any medical treatment could potentially opt out, even if it could result in death or severe harm to a patient. Even where there are no alternative providers to ensure care (in largely rural areas and healthcare deserts, for example)

In this episode of The Gender Justice Brief we talk with The Lawyering Project’s Paige Suelzle about a recent victory for abortion funds—and for the First Amendment—in a case that is likely to have broad regional and national repercussions.
When the Dobbs decision was announced on June 25, 2022, abortion became illegal in Alabama overnight. By the end of that summer, Alabama’s Attorney General threatened to criminalize people who help Alabamians from leaving the state to access legal abortion—including abortion funds like The Yellowhammer Fund, based in Tuscaloosa, Alabama—which had a chilling effect on providers and funds.
Represented by The Lawyering Project, the Yellowhammer Fund fought this threat in federal court, and in May 2024 received a preliminary ruling: their case can move forward, and the fund can resume assisting people while the case progresses.
“The right to interstate travel is one of our most fundamental constitutional rights,” wrote U.S. District Judge Myron Thompson in his preliminary ruling. “Alabama can no more restrict people from going to, say, California to engage in what is lawful there than California can restrict people from coming to Alabama to do what is lawful here.”

In honor of the 10th anniversary of the passage of the Women’s Economic Security Act (WESA), which guarantees nursing rights for Minnesota workers, we are re-releasing our 2023 episode on Pregnancy and Pumping Rights.
In 2014, Gender Justice helped catapult the life-changing package of legislation known as the Women's Economic Security Act over the finishing line. In the decade since, the policies have been further strengthened, solidifying protections for pregnant and nursing employees, creating supports for parents of young children, narrowing the gender pay gap, and more.

Crisis pregnancy centers, or “CPCs,” are anti-abortion organizations that target pregnant people with predatory, deceptive marketing. Their main function is to attract and intercept Black, brown, Indigenous, and low-income people before they access abortion care.
Their goal is ideological, not medical: They want to prevent pregnant people from obtaining abortion services using any means necessary, including by using delay tactics, disinformation, and deception. With nearly a hundred CPCs in Minnesota, they outnumber abortion clinics by about 10:1.
This week Special Projects Advisor Erin Maye Quade and Organizer Jay Belsito talk with our guests, Olivia Crull and Carolyn Handke from the grassroots Minnesota Abortion Action Committee, about the harm that CPCs pose to our community. What can be done to expose them, limit their reach, and stop the deception?

The team discusses Anderson v. Thrifty White, a lawsuit filed on behalf of Andrea Anderson, who was denied service when she sought to fill a prescription for emergency contraception. The complaint, filed in Aitkin County District Court in Minnesota’s Ninth Judicial District, argues that Anderson’s experience constitutes illegal discrimination based on sex, and that denying her service based on her pregnancy-related health care needs violates the Minnesota Human Rights Act.
After the Supreme Court overturned Roe v. Wade earlier this summer, there has been a rise in pharmacists refusing to dispense contraception and emergency contraception to patients. With more than half of states working to ban access to safe, legal abortion care, access to prescription medications, including contraception, is more important than ever. Gender Justice hopes that a future victory in this case shows that people like our client, and countless others across the country who rely on their local pharmacies for birth control, cannot be discriminated against.

- The FDA approved Mifepristone for as part of a two-drug regimen for medication abortion in 2000 with unnecessary restrictions, but during the pandemic, the FDA relaxed rules allowing telemedicine access to the medication.
- After the Supreme Court overturned Roe v. Wade, ending the federal right to abortion, an anti-abortion group went after medication abortion in a manufactured lawsuit Alliance for Hippocratic Medicine vs. FDA.
- Chaos and confusion, inhibiting access to medication abortion, is the current goal of the anti-abortion movement and lawmakers. This is impacting reproductive rights, but there are ongoing legal battles and campaigns to support reproductive freedom.

Providers are working hard to keep abortion accessible in Minnesota, but removing old laws and passing new protective acts is necessary to provide additional protections for patients and providers.

- Dr. Sarah Traxler, Chief Medical Officer for Planned Parenthood North Central States (PPNC), testified on the Reproductive Freedom Defense Act in the Senate Health Committee. Since the overturning of Roe v. Wade, PPNCS has seen a 13% increase in patients coming from out of the region for abortion and a 40% increase in second-trimester abortions.

Efforts to pass SF 165, the Reproductive Freedom Defense Act, continue. This bill is to ensure that all Minnesotans have access to reproductive healthcare and that healthcare providers are protected in providing essential healthcare services.

The Reproductive Freedom Defense Act passed the Minnesota House on Monday with 68 “yes” and 62 “no” votes. The movement cannot be stopped, and Minnesota will have the back of providers and patients who need to come here to get care.
- We also discuss the Trans Refuge Bill, which passed by the Minnesota House early Friday morning. The bill was led by Representative Finke, who spoke passionately about the importance of passing the bill.
- The bill has also been heard by the Senate Judiciary, and Public Safety Committee and hopefully is on a pathway to reach the governor's desk this year.

- NCJW Minnesota has distributed over 200,000 menstrual products since 2018 but seeks a systemic solution.
- The bill has bipartisan support but faced opposition and transphobic language. High school graduates, organizations, and Girl Scouts testified in support.
- NCJW Minnesota is also part of the Communities Combating Hate coalition working on legislation against hate crimes and bias incidents.

- What is it like being at the Capitol again?
- A lot of movement around abortion-related legislation.
- The PRO Act, which would establish a statutory right to choose reproductive healthcare options, including abortion, was introduced quickly and is a top priority for legislators.
- The bill had its first hearing last week, with strong support from providers and patients and opposition from those who do not support abortion rights.
- The PRO Act, which enshrines the right to abortion and other reproductive healthcare, also includes provisions to prevent municipalities from restricting abortion rights and ensures that they provide the basic fundamental right to abortion.
- The bill is a top priority for legislators and could be enacted by the end of the month.
- HF 91/SF 70, repealing Minnesota’s abortion restrictions, has been introduced and had its first hearing last week in the House.
- Many amendments have been proposed by opponents of the bill that are rooted in misinformation and inflammatory language.
- The testimony provided at the hearing was interesting but also a shock for the new legislators and staff who have not had the opportunity to listen to arguments against abortion rights.

Welcome to the Gender Justice Brief, a podcast about fighting for gender equity by breaking down legal, structural, and cultural barriers in expanding protections for all people regardless of their gender, gender expression, and sexual orientation. In this first episode, our host Erin Hart (Communications Director), is joined by Jess Braverman (Legal Director), and Erin Maye Quade (Special Projects Advisor) to discuss what to look forward to in 2023.
Jess Braverman highlights some of the big cases the legal team will be working on in 2023, including a case against the Department of Corrections in Minnesota for the mistreatment of transgender inmates and a lawsuit against U.S.A. Powerlifting. There will also be arguments in January regarding outside groups attempting to intervene in the lawsuit against Minnesota's unconstitutional abortion restrictions.
Erin Maye Quade discusses her transition to a new role as Special Projects Advisor, and her excitement for the growth and expansion of Gender Justice in 2023. She also touches on the importance of intersectionality in the work of Gender Justice, and how the organization will continue to uplift and support marginalized communities.
Overall, 2023 looks to be a busy and exciting year for Gender Justice as we work toward our goal of achieving gender equity and justice for all.
