YouTube 'Bad Faith' Takedown Notifications and Counter-Notifications - Subjective Bad Faith in 9th Circuit
If someone is taking down your YouTube videos and trying to monetize it (causing you monetary losses), or filing bad faith counternotifications the United States Copyright laws may come into play. Under the DMCA section 512(f) anyone who knowingly materially misrepresents a filing with regard to copyright (takedown notice or counter-notice) can be held liable for bad faith, if they subjectively had a bad faith intent or motive, meaning their bad faith can be shown or proven with some type of evidence that indicates their subjectively held belief is objectively unreasonable (i.e. no reasonable person would have entertained or believed they had a valid position). This is my opinion only and is not legal advice or a substitute for legal advice.

Software Audit Essentials - Handling Vero Software Legal Demand Letters
In this episode of Vondran Legal Hour, Attorney Steve® discusses our experience handling cases with this firm. It has not always been easy. We seek to negotiate these cases in good faith, but it is not always easy" says software piracy defense attorney Steve Vondran. We have seen their demands range from offers in the low thousands of dollars on up to hundreds of thousands of dollars. Many people are shocked and amazed when the receive the letter, or the phone call, from Vero (a Hexagon company) alleging willful copyright infringement . Many do not use all the products they are being charged with. Many have no idea someone inside their shop installed and/or used the software depsite anti-piracy policies and procedures that are in place to try to deter improper unliensed use of software programs.
At any rate, if you receive a letter from this company, as of the date of this intellectual property podcast, this is our general experience dealing with them, and their inside counsel who was not overly motivated to get anything done. This podcast represents our opinions only.

DMCA Takedown Notice Law Firm - What happens when a seller infrines your copyrioghts or trademarks on Etsy?
Attorney Steve®, the Copyright Infringement Lawyer discusses the ETSY DMCA notice and counter notice process when a company feels another person is selling infringing, counterfeit or "copycat" items on Etsy. Basically, a person alleging infringement or jewelry, books, shoes, music, calendars, posters, wedding items or creative items (subject to copyright law) sends Etsy a DMCA infringement notice. The seller gets a copy of the notice and can takedown the infringing product on its own, or can challenge the claim and file a "counter-notice" or "counter-notification." These documents must be filed in GOOD FAITH or risk facing a 512(f) "bad faith dmca" claim.
If a counternotification is filed, the original complaining party has 10 days to file a lawsuit seeking an injunction (more info below) and notifying Etsy of same. Strike 3 Holdings, LLC says it is not interested in making money in Torrent lawsuits being filed in masse across the United States
In this episode of Vondran Legal Hour, Attorney Steve addresses extrajudical statements being made (while active lawsuits are pending across the U.S.) in major press such as the Miami Helard. In this show, Attorney Steve seeks to give his opinion and his point of view regarding the settlement practices of Strike 3 (we have handled a bunch of these cases and have unique insight), which in our opinion do not seem to match the statements being made by the adult bography company to the press.
We have a right to rebut the statements being made in the event a potential juror would be reading these statements. We have pressed opposing counsel for a fair retraction and it appears that will not be forthcoming.
