USNWR Mass Exodus x The End of Non-Competes?? Current Events in Healthcare with Michael Johnson LegalWe are doing our best to keep you up to date on issues affecting our lives and careers as healthcare professionals. In this episode, Dr. Steven Bradley our host chats with a frequent guest and friend of the show, Michael Johnson of Michael Johnson Legal about the impact this ruling by the FTC may have.
Dr. Bradley discusses the significance of medical schools leaving the USNWR ranking system.
FTC & Noncompetes for PhysiciansIn late 2022, the Federal Trade Commission (FTC) issued a ruling regarding non-compete clauses in employment contracts. The ruling stated that such clauses may stifle competition and harm both workers and consumers. The FTC advised employers to re-evaluate the use of non-compete clauses and to only use them in limited circumstances where they are necessary to protect legitimate business interests.
The ruling was seen as a victory for workers' rights and a step towards preventing the abuse of non-compete clauses by companies. Many workers, especially those in the technology industry, have reported being forced to sign restrictive non-compete agreements that limit their ability to find new employment and advance in their careers. The FTC's ruling sent a clear message that such practices are unacceptable and harmful to both workers and the economy as a whole.
Despite the ruling, some companies have continued to enforce non-compete clauses, leading to calls for further action by the FTC and other agencies. Several states, including California and North Dakota, have already banned the use of non-compete clauses for certain classes of workers. It remains to be seen what further actions the FTC will take to enforce its ruling and protect workers from restrictive non-compete agreements. Nevertheless, the ruling is an important step in the ongoing fight for fair treatment of workers in the modern economy.
USNWR Rankings x Mass Exodus of Medical SchoolsIn recent years, some medical schools have chosen to opt out of the United States News & World Report (USNWR) ranking system. These schools believe that the ranking system fails to accurately capture the quality of education and training they provide, and the impact they have on their communities. Instead, they have started to focus on other measures of success, such as the satisfaction of their graduates, the success of their research programs, and the number of patients they serve. By leaving the USNWR ranking system, these medical schools hope to shift the focus away from superficial metrics and towards more meaningful indicators of their impact.

Saying "NO" in Medicine: The Ethics of Speaking Truth to PowerIn this episode of the Black Doctors Podcast, we explore the ethical implications of saying "NO". With recent news of a nursing strike in NYC, what is the ethical and appropriate way to say, "enough is enough"?
Dr. Steven Bradley, our host shares several personal stories in which he said, NO. Listen and share your thoughts! Below are three tips for saying NO:
- Be assertive: Clearly and confidently express your inability to take on additional work, and provide a valid reason for your refusal.
- Offer alternatives: If possible, suggest alternative solutions or individuals who may be able to take on the extra work instead.
- Prioritize your workload: Make sure to prioritize your existing responsibilities and prioritize what work is most important to complete.

Minority Report: Experiences of a Black Man in MedicineIn this episode, Dr. Steven Bradley, our host, shares his experiences as a Black man in the medical field. Despite making up a small percentage of the medical community, Black physicians face unique challenges and obstacles in their careers. Some of the key points discussed in this episode include:
- Facing discrimination and bias from colleagues and patients. This can make it difficult to advance in their careers and can also have a negative impact on their mental and emotional well-being.
- Lack of representation: Black males are underrepresented in the medical field, making it harder for them to find mentors and role models who look like them. This can also lead to feelings of isolation and a lack of belonging.
- Challenges in medical education: Black males may face additional challenges in medical school and residency, such as a lack of diversity in the curriculum and a lack of support from faculty and staff. This can make it harder for them to succeed academically and to feel prepared for their careers in medicine.

Despite these challenges, many black males in medicine are committed to breaking down barriers and making the field more inclusive for future generations. We are always trying to bring more, and we are truly delivering. This week, we are continuing an incredible discussion about mental health in the Black Community. Drs. Danielle Hairston, Kevin Simon and Amanda Calhoun are each highly prolific, dynamic writers, speakers and educators within this space. She has consulted with companies like Google, and Youtube.

- Sociodemographic and clinical correlates of the frequently hospitalized African American patients with severe and persistent mental illness
Dr. Kevin Simon the inaugural Chief Behavioral Health Officer for the City of Boston. He is a Harvard-trained Board Certified Psychiatrist. Dr. Simon serves as an Attending Psychiatrist at Boston Children's Hospital, an Instructor in Psychiatry at Harvard Medical School, a Commonwealth Fund Fellow in Health Policy at Harvard University, and the Medical Director of Wayside Youth & Family Support Network. Clinically, he practices as a Child, Adolescent, and Adult Psychiatrist and Addiction Medicine specialist caring for youth, young adults, and families through the Adolescent Substance Use & Addiction Program (ASAP).

Dr. Amanda Calhoun an Adult/Child Psychiatry Resident . Dr. Calhoun is also the assistant editor of the Connecticut Psychiatric Society Newsletter and an Associate Editor of the American Journal of Psychiatry Residents’ Journal. Dr. Calhoun seeks to expose and eradicate racism in the medical system using a direct and heartfelt approach. Dr. Calhoun’s anti-racism work spans from writing anti-racism curriculum, standing up for her patients in real-time, public speaking, research, and writing. She believes that all doctors should be activists, and that social justice should be integrated with medical education.

Dr. Caves is a Pediatrician with subspecialization in Adolescent Medicine. In this episode, I introduce a podcast refresh. Ethically Sourced is moving to its own show entitled, "Curbside Ethics". This is a noun as well as a verb.
Additionally, I discuss the revolutionary, new medication for Alzheimer's Disease that was recently approved by the FDA, "aducanumab". This medication brings into question multiple ethical issues. There are concerns about the research that developed the risk, benefits and side effect profiles. Additionally there is a question of resources as the medication is extremely expensive and may have a profound effect on Medicare funding.

Dr. Joseph Thomas joins us to share about his life and practice as a Dentist and an Oral and Maxillofacial Surgery Resident. A graduate of Howard University College of Dentistry, Dr. Thomas accepted a Health Professions Scholarship to the United States Navy. Since graduating, Dr. Thomas has practiced in Great Lakes, IL, Okinawa Japan, and 29 Palms, Nevada. He is currently a 2nd year OMFS resident at Walter Reed in Washington, D.C.
Dr. Thomas shares some of the struggles that come with completing dental school. He also talks about the incredible field of oral surgery and their vast scope of practice. In his free time, Joseph volunteers with Dental Helping Hands, a non-profit organization started by several of his classmates from HUCD which provides free dental care to developing and underserved communities around the world.

This week I discuss an article entitled, "Disclosure of Individual Surgeon's Performance Rates During Informed Consent." This topic was discussed on Twitter and I decided to read more. The article presented a very comprehensive look at the issue and discussed the pros and cons of implementation. Overall, the data collection is generally poor quality and difficult to compare across different facilities. It is also difficult to present this data to patients with the appropriate context. Obviously, however, Physicians should be open and honest about their abilities as this allows patients to make autonomous, informed decisions. Breaking news with the passing of new legislation affecting military medicine. For years, service members have been unable to sue for medical malpractice due to the Feres Doctrine. This court case set the precedent that federal employees cannot sue the federal government. There are many cases of egregious medical malpractice with damages that have occurred in the military healthcare system. With the Richard Stayskal bill, there is now a pathway for patients and family members to receive damages. This is an important step to bringing health equity to the military healthcare system. These policies are more closely aligned with civilian torte reform. Please share with any family or friends you may have that are receive care from military physicians and providers. This week I'm tackling a very contentious issue in the world of healthcare. Should we abandon the use of the term "Provider." I present an article that was recently featured in the Journal of the American Medical Association (JAMA) entitled, "Promoting Trust and Morale by Changing How the Word Provider Is Used". The author raising some very good points about how the term Provider is vague and takes into account neither the various levels and styles of training nor the vastly different approaches to providing care. The author makes the point that we are very specific when it comes to informing patients who participates in their care when dealing with physicians-in-training. Patients deserve transparency. Clinicians deserve to proudly represent their respective fields. I think this article makes several fantastic arguments for why we should abandon the term "Provider" and replace it with either professionals titles or a collective term such as clinician. In this episode of Ethically Sourced, I cover two articles. The first is entitled, "High COVID-19 vaccination rates do not equate to equity in communities of color" and it appeared on the KevinMD blog. One of the co-authors is a friend of mine, Dr. Joshua Anthony. This article provides an excellent overview of the healthcare disparities that have been evident in the states since the before the pandemic. It shows how these issues have been highlighted and amplified once again by the inequitable distribution of COVID-19 vaccines. The second article I present appeared on The Hastings Center's website and is entitled, "Instead of Vaccine Passports, Let’s Push for Global Justice in Vaccine Access". It was written by Dr. Gabriela Arguedas-Ramírez, an associate professor in the school of philosophy at the University of Costa Rica. This article provides a very interesting perspective on "vaccine passports." It describes how inequitable the concept is on an international scale. The onset of travel liberations only benefit the wealthiest, most privileged nations. "Professionalism" is a term and concept that is used frequently in healthcare settings. The medical students, resident physicians and attending physicians are often judged on their professionalism. However, too often, this concept of professionalism is not standardized. Certain organizations do delineate their opinions and standards. Unfortunately, professionalism is often a subjective judgement by those in positions of authority. This allows it to be used a weapon; a form of legalized discrimination. In this episode, I talk about several concerns for trainees attempting to navigate this system. Professionalism should not hinge upon self-expression. Going forward, we must either standardize this concept or limit its use in certain settings. Increasing diversity in the healthcare workforce and especially in leadership positions is key to combatting weaponized professionalism. This week's episode features equestrian and surgeon, Dr. Auriel August. She is a viable competitor for the most interesting woman in the world. As a surgery resident completing her research years, she manages to maintain her lifelong passion, equestrian arts. We talk about this and how she leases her mare Roux to practice and compete in her free time. Dr. August shares her incredible story in this episode. As a child, she was always "different". She didn't usually fit in with her classmates. As an engineering major at Duke, she was a triple-minority, a Gay, Black Woman. She talks about how she learned to embrace these labels and be her own, independent self. Despite a strong academic pedigree, she faced challenges when applying to medical school. She has overcome those challenges and now thrives in her chosen field of general surgery. Moving to California for residency provided opportunities to become involved in healthcare innovation. I really enjoyed talking with Dr. August. I found her story incredibly inspiring and I know you will as well. It covers the article entitled: "Minority Tax Reform — Avoiding Overtaxing Minorities When We Need Them Most" which appeared in the New England Journal of Medicine. The article was written by Theresa Williamson, M.D., C. Rory Goodwin, M.D., Ph.D., and Peter A. Ubel, M.D. This article defines and discusses the "minority tax" that is levied so frequently towards minority academic clinicians. This minority tax leads to an increased work load, increased stress and decreased promotion rates. It likely contributes to a high attrition rate of minority physicians from academic medicine. This week we hear from Dr. Scott Porter, an Orthopedic Surgeon who specialized in treating cancer. He shares how he navigated medical school and the match process during the very beginning of the ERAS process. Over the years, he has chosen to practice in academics in-part so that he can give back and mentor the next generation of orthopedic surgeons. Every week I hope that the information presented helps shape your world-view and empowers you to provide more equitable and ethical care to your patients. This week I break down the things I take into consideration when navigating a complex ethical situation. How we approach these conversations dictates how they end. Personally, I like to start by attempting to see things from the patient's perspective. Then I try to discuss my perspective and opinions with a trusted colleague. Departmental and facility policies and protocols may provide some guidance as well. Looping in a "patient advocate" or risk-management can mitigate some adverse outcomes along the way. Ultimately, a structured consideration of many different factors based upon patient goals, history, ethnicity, culture, etc. will help provide the most suitable course of action. This episode discusses a situation that is not-uncommon in teaching hospitals across the country. At some point, physicians-in-training will have patients that would prefer to be seen, examined, or treated by a "real doctors." It is important to attempt to understand these patient's concerns and level of understanding on how the healthcare system works. In this episode, I look at these events from the perspective of the patient, trainee, and attending physician. It is important to prioritize patient autonomy, as well as maintaining an appropriate and supportive relationship with residents and other healthcare providers. I discuss a recent situation I personally encountered and how I successfully navigated the interaction. The Johnson & Johnson vaccine was paused by the CDC after 6 patients were diagnosed with blood clots (cavernous sinus thromboses) several days after receiving their injection. The Advisory Committee on Immunization Practices met to discuss a way forward. Unfortunately, they made no recommendations regarding ending this pause. Dr. Will Parker and Dr. Govind Persad published an opinion piece in The Washington Post entitled, "Extending the Johnson & Johnson vaccine pause for a week was a deadly mistake". They discussed the extensive ramifications of a prolonging the pause based on these extremely low risks of complications. They argue that the ACIP does not have appropriate representation from a public health perspective. After presenting the article, I review the for basic principles of clinical medical ethics and how they are related to this issue. In the wake of yet another episode of police brutality and misconduct ending in death for the victim, I am reviewing this article published in the AMA journal of ethics. Dr. Alden Landry, an Assistant Professor and Emergency Medicine physician was the primary author for this piece. With all of the headlines and events of the last year, there are clearly several widespread issues that need to be dealt with. These issues have significant repercussions on the lives of Black and Brown Americans. These two issues, of course, are the COVID-19 pandemic and the rampant pandemic of police brutality. After identifying the problems, how can we develop interventions to stop them. It is incumbent upon the system that produces physicians and other healthcare providers to incorporate healthcare disparities and police brutality into its education model. This paper goes on to provide eight recommendations that affect both the educator and the learner. Dr. Korie Grayson is a biomedical engineer, chemical engineering researcher, and a diversity advocate in STEM. She is a proud alumna of Norfolk State University where she earned her BS in Chemistry (2012). Korie obtained her MS (2017) and PhD (2020) in Biomedical Engineering from Cornell University. Currently, Korie is a postdoctoral research fellow at the University of Michigan in Chemical Engineering. Her research will focus on the evaluation of novel nano- and microparticles for therapy in neutrophilic, acute inflammatory disease and cancer.
Recently, Korie received the honor of making the “2020 List of Influential African American Women to Follow on LinkedIn” and the “1000 Inspiring Black Scientists in America” list. Dr. Grayson is passionate about increasing the number of underrepresented minorities in STEM by illustrating that representation matters. She is the Diversity Chair for @womendoingscience, a popular IG account that showcases women in STEM from all over the world. She is also on the planning council for STEMNoire, a holistic wellness and research retreat for Black women in STEM.

There is a precedent set by circumstances such as mandatory Yellow Fever vaccination before travel to certain areas. With the implementation of the 2016 Cures Act, there are big changes coming to healthcare. One of those changes include increasing patient access to their healthcare information. Soon patient notes will be available via online portals. This is an incredibly huge adjustment for physicians and providers who are used to writing notes that are read only by other healthcare workers. In this episode I discuss several ethical issues related to open access to patient notes. I also review some recommendations from the American Academy of Family Physicians for how to prepare for these changes. As we close out Women's History Month, we are truly ending on a high note. This episode features Dr. Linda Suleiman, an Orthopedic Surgeon specialized in adult hip and knee replacement and reconstruction. (Dr. Suleiman was two years ahead of me at Howard University College of Medicine, so I've had the pleasure of knowing her since 2010!). She shares how she built her resume and worked to successfully match into this incredibly competitive specialty. Dr. Suleiman was the first African-American woman to complete orthopedic surgery residency at Northwestern University's Feinberg School of Medicine. Dr. Suleiman shares her typical schedule and how she balances her busy administrative tasks. In addition to being an extremely talented surgeon and assistant professor, she also serves as the assistant dean of graduate medical education and the director of diversity and inclusion at her institution. This week, Psychiatrist Dr. Kevin Simon joins the show to tackle this serious and extremely important topic. Dr. Simon and I share examples that we observed and share advice for where people can go for help, including the significance of Title IX. As we continue to celebrate Women's History Month, we are celebrating extra hard this week! Congratulations to Student-Doctor Osose Oboh on matching to the Internal Medicine residency program of her dreams. We were privileged to speak with her and listen to her journey . After working as a professional photographer, she completed a Masters degree in Public Health. She attended Michigan State University for medical school where she was able to complete her clinical rotations in Flint, Michigan. She was able to see the fallout from the Flint Water Crisis first hand and treat the lasting effects seen in the community. Dr. Oboh talks about her leadership roles with the Student National Medical Association. As the President-Elect and not the National President, she worked to pivot the SNMA's Annual Medical Education Conference to a digital platform. She talks about the opportunities available within the organization. Let's talk about autonomy. It is one of the 4 standard principles of medical ethics, and personally, it is my favorite. Thankfully medicine moved away from paternalism and is now actually seeking patient preference and informed decision making. What does autonomy really mean? What does it mean for patients? What does it mean for physicians and healthcare providers? What does autonomy look like in regards to practitioners of the Jehovah's Witness faith or for folks considering receiving a COVID-19 vaccine. I answer these questions and more as I attempt to provide a baseline for encouraging patient autonomy. This week I am reviewing an article from the Journal of the American Medical Association, entitled, "Mandating COVID-19 Vaccines." This incredibly thoughtful and comprehensive piece discussed some of the pros and cons that policy-makers must consider when decided when and if to implement COVID-19 Vaccine mandates. Key take away points include: 1. Currently the mRNA vaccines available in the US are under emergency use authorization. (It would be a bit premature to mandate a vaccine under EUA). 2. There are already certain vaccine mandates in place. (Childhood vaccines and Influenza vaccines for healthcare workers.) 3. Businesses have some leeway under the Equal Employment Opportunity Commission (EEOC) to compel employees to submit COVID test results as a condition of employment. I talk about the significant need for Black physicians to pursue (or at least consider) careers in academic medicine. In this episode we hear from Dr. Shani Scott, an Internal Medicine Physician and Assistant Program Director in New York City. We were classmates together at Howard University College of Medicine. After completing residency, Dr. Scott chose to practice in New York so that she could directly combat healthcare disparities in the Bronx. In this episode, she talks about her daily role as an academic Internist, how she manages her private clinic patients and supervises residents with their patient panels. She was a young, Black woman who's cervical cancer cells were preserved and used in research for the past 70+ years. Her story resulted in restorative justice from a major academic medical center as well as reform in clinical medical ethics. This is the first in a two-part series featuring Psychiatrist Kevin Simon, MD. Together we tackle this issue head on. We discuss Dr. Simon's experience receiving the vaccine and examine the process of ensuring the "right" people are being vaccinated in the "right order". We discuss the apprehension expressed by certain communities and some of the contributing factors. In the first part of this discussion, we review several papers published in the Journal of the American Medical Association regarding this topic. One article in particular discussed the ethics and legality of prioritizing communities of color for vaccine distribution. This episode just scratches the surface regarding the ethical principles being followed for this vaccine rollout. You will definitely want to tune in next week to catch part two of the conversation. In this episode I sit down with Dr. Beti Asnake, and Anesthesiologist practicing in California. She talks about her pathway into medicine and the specialty of anesthesiology. Originally from Ethiopia, Dr. Beti came to the US at a young age and progressed through the challenges of learning a new culture and navigating the process of becoming a physician. Anchored by her faith, culture and family, she succeeded and is now working to help others with similar backgrounds succeed.
We talk about Mulu Mentor, a program she established (now in its second cycle) that provides mentorship to underrepresented, minority pre-medical students. This program guides mentees through writing personal statements, mock interviews, MCAT study tips and more!
After completing residency, Dr. Beti completed a fellowship in Global Health and Equity at the University of California San Francisco. Through this program, she was able to teach and develop self-sustaining educational resources for anesthetists in developing countries. With the onset of the COVID19 pandemic, Dr. Beti was instrumental in the UCSF's response. She led the conversion of operating rooms to be able to manage COVID+ patients. She also led intubations teams that managed these complex and infectious airways.

This Veterans Day we are saluting the women and men that have sacrificed so much in service to our country. We are privileged to feature Dr. Antonio Webb, who enlisted in the Air Force and served for 8 years, including a 5 month deployment to Iraq. Dr. Webb's life has taken many twists and turns and he has documented this in a book entitled, "Overcoming The Odds." During this episode, Dr. Webb talks about how he joined the service with the goal of becoming a surgeon. While on active duty, he took courses at community colleges, earning his degree and completing the prerequisites for medical school. His journey only intensified as he had to apply multiple times to medical school. His hard work has clearly paid off. Dr. Webb earned his Doctor of Medicine degree from the prestigious Georgetown University, then completed a rigorous orthopedic surgery residency program followed by a fellowship in spine surgery. Dr. Italo Brown is an Emergency Medicine Physician practicing in California. After graduating from Morehouse College, he earned his Master’s Degree in Public Health before attending Meharry Medical College. After completing residency, Dr. Brown attended Stanford for a fellowship in Social Emergency Medicine. Italo shares a typical day in the life of an Emergency Physician at a busy Level 1 Trauma center. Dr. Danielle Hairston is a double-boarded Psychiatrist and residency program director at the Howard University Hospital. (She was also my resident when I was a medical student at Howard University College of Medicine). In this episode, she shares a glimpse into her practice as a Psychiatrist and how she interacts with her team of residents and medical students. Dr. Hairston is advocate, effecting change for the state of mental health in the black community. She shares how she was initially discouraged from pursuing a career in Psychiatry, and how she ultimately decided to follow her calling. We discuss her pathway to medicine, which included the ODASIS pipeline program at Rutgers. Dr. Hairston discusses current events including the pre-hospital use of ketamine (a powerful sedative) to treat “excited delirium”. Episode 3 features Dr. Ed McDonald, a Gastroenterologist, Chef and Nutritionist practicing on the Southside of Chicago. I was fortunate to work with Dr. McDonald during residency and to still call him a friend and colleague. He tells his story about becoming a GI doctor and the many years of training that took him from the University of Michigan, to Northwestern, Rush University Medical Center, and finally to the University of Chicago. Dr. McDonald is a Chicago native and he proudly serves his community, doing his part to impact healthcare disparities related to nutrition and colon cancer screening. We revisit an article Ed wrote shortly after the release of The Black Panther, entitled, "6 Reasons Why Colon Cancer Doesn't Exist in Wakanda." The article is posted on his blog: The Doc's Kitchen, where he posts health and wellness information centered around nutrition and his culinary expertise. In addition to his medical training, Dr. McDonald is a graduate of the prestigious Kendall College School of Culinary Arts. As a chef, he uses delicious recipes with health conscious ingredients to promote healthier lifestyles. He talks about his role on the hit Food Network Show, "The Sandwich King." In addition to her practice, Dr. Chi started a non-profit organization, “Reality Speaks” which provides mentorship, guidance and support to student-athletes. “Reality Speaks facilitates student-athletes through a series of specialized programs dedicated to the successful transition after sports, while enhancing individuals’ mindset to be motivated beyond athletics.” Dr. Chi and I first met in 2010 when we were attending graduate school at The University of South Florida. In the 10 years that have transpired since, we have both come a long way and I had a fantastic time catching up before, during and after this interview.
