Bryan Fischer here with today’s Life and Liberty Minute. Civil asset forfeiture is a corrupt practice since it frees police to seize assets of private citizens if the citizens are merely suspected of criminal activity. The Indiana Supreme Court ruled that the seizure of a $42,000 Land Rover over a $400 drug bust was not excessive. The Supreme Court overruled them. So the Supreme Court was morally in the right here. But constitutionally the justices were dead wrong to stick their noses into a state issue. The ban on excessive fines is in the Bill of Rights, which limits only the federal government, and not the states. Indiana’s state Constitution contains a perfectly clear prohibition against excessive fines. If the people of Indiana don’t like the ruling of their Supreme Court, ruling, the solution is not to drag the case to Washington DC, but to find some better judges in Indiana.
