It's been a minute since I did a show, but what a way to start 2022! Got to talk to Rena Upshaw Frazier from the hit Netflix show "Selling Tampa" today and it was a blast. As fellow Stetson College of Law and Stetson Trial Team alumni, we discussed our time in the trenches and where it led us, Rena on national TV and me finishing off a bag of Cheetos while I try look for my car keys (I kid I kid). Making a pit stop back in Tampa on his way from Thailand to Kenya, my old Khanomtom Tampa Muay Thai buddy stopped by to talk about growing up in the Netherlands, dropping out of high school only to join the air force and obtaining 2 graduate and a Masters Degree. We talk about Ethical Finance, aging gracefully in Combat Sports, Black Swan Events, his path to Brazilian Jiu Jitsu Black Belt and learning Swahili. He and I have chosen very different life paths but I've always enjoyed following his adventures. This is just a good conversation between yours truly and an honest to goodness superhero.

I love this guy's voice and his band Dead Mirrors is on heavy rotation in my car and at work. Jeremy Shiflet is a soft spoken, low key dude with the voice of a demon. Dead Mirrors new album "And He Became The System" is a call to arms and just an all around work of art. Oh what might have been...for minute I was in talks with Steve Cee to work bass for Rath & The Wise Guys but sadly things didn't pan out. Luckily Steve found someone who actually can play bass and has a rad punk band that's playing weekly everywhere and has already put out an EP and single. Steve spilled his guts about coming up in Virginia Beach and false starts along the way to things finally gelling in Florida. Steve is passionate about music and lives it. Great dude, fun talk!

Three things I learned talking to today's guest and democratic candidate for State Attorney in the Sixth Judicial Circuit for Pinellas/Pasco, Allison Miller.
According to Florida Department of Corrections, Pinellas/Pasco counties (the 6th circuit) send more people to prison than any other circuit in Florida.
A Democrat hasn't run for State Attorney in Pinellas/Pasco since 1964.
Allison's opponent and current State Attorney for Pinellas/Pasco, Bruce Bartlett, was recently quoted as saying "One of the things that has made this office so effective is the lack of change".
Now how you feel about these facts may inform how you vote. I used to work for Bruce Bartlett, I like Bruce Bartlett and I'm hoping he'll come on the show to discuss his view. That said, my politics are no secret, we have never had a female state attorney and I am a big fan of change. A lot of my colleagues are nervous to speak publicly about this race for fear of how it may impact their practice. I'm not that smart. I'm not gonna tell anyone how to vote, but I'm going to ask that you listen to this podcast and hopefully Bruce's if he agrees to do it.

Them Henderson kids are purty! If you've not had the good fortune to see the Zutesmas concert every Saturday before Christmas at Crowbar (and before that Gaspar's Grotto) do yourself a favor this Christmas and go. I've been to a squillion shows and The Zutes are by a wide margin the most fun. Matt Henderson, the unofficial leader of band, has been the ring leader of this ode to a fallen friend playing everything from Billy Joel to Fleetwood Mac to Coolio to Mastodon. But that's not all, he's a prolific musician (check out his band wicked surf punk band "Moonthing"), a Father/Husband and brilliant political commentator. Attorney friends may also recognize him as brother to equally good looking attorney, Greg Henderson. Love this guy and you will too.

Kyle too (like Eliot Mayo) is a musical encyclopedia and is a wild man on the drums. I said this before but imagine if Freddie Mercury and Henry Rollins had a baby who sang for The Mars Volta...that'll only kind of give you some idea of what this guy can do. 2020 was the year of Horsewhip and Yashira for me, so to say I'm star struck by today's guest is a bit of an understatement. Alex Bond is an absolute god on the kit and Horsewhip's epic two albums are on heavy rotation in the office. We chatted about his early days in Indianapolis, Motley Crüe, what brought him to the Sunshine State, the early days in Horsewhip and what the future holds. We also killed some beer from Magnanimous.
Comedian and Tampa native, Boomer Nichols stopped by (with his boy Scottie) today to kickoff his birthday weekend. We talked about growing up with Joey Redner and Bert Kreischer, his early days in comedy to opening for Bryan Callen and Tom Segura, and whether Eddie Murphy's comeback will land. Punk Poet, Marc Ganancias, stopped by the studio today with some homemade gazpacho to discuss his life in music and his new book Subset Asylum. Marc is an intense dude, no doubt about it, but deep down beats a huge heart. I love his Policy of Discontent album (think REM meets Social Distortion) and his book Subset Asylum is like some Frankensteined Hemingway, Buchowski, Thompson, etc. I made a friend, and he's a cool dude. Woody Bond stopped by the show to talk about a life of drumming...from learning, to teaching, to touring, recording, writing, filling in, etc. he's done it all and is in high demand. Along with drumming for one of my favorite local hardcore bands, VACANCY, he also plays with Jobsite Theatre, teaches music to special needs children and basically is one of the go to guys if you need a drummer. Super nice and a wicked talent, it was a good chat and I learned why the angle of your Bearing Edge is EVERYTHING!

Ray Cole is the embodiment of walking softly and carrying a big stick...in fact he walks so softly one can only imagine how big of a stick he carries. Anyway Ray has been bringing the art and tradition of Muay Thai (Thai Kickboxing) to the US for the better part of 3 decades. This is not cardio kick boxing, but the sometimes brutal and always beautiful art known as Muay Thai. We talk about his time training and fighting in Thailand, the evolution of the local school Tampa Muay Thai and what the future holds for him and the sport. Brazilian Jiu Jitsu was my first love, but Muay Thai has a hold of the other half my heart and I owe a lot of that to Ray Cole...stay tuned!
The world has a funny sense of humor sometimes. I've been asking Keith Ulrey to come on this show since day 1 but either schedule or Covid concerns have made that difficult, until n....no wait a minute, throw technical difficulties into the pot. Keith and I just had a super fun conversation and now it lays at the feet of show producer, Michael Sinclair to save me (no pressure Mike). Anywho, Keith Ulrey holds many posts in the local music scene as member of the band POHGOH, owner/operator/curator of Microgroove Records, and wearing almost all hats for music label New Granada. But more than any of those things, Keith is emblematic and a manifestation of every thing I love about music and our scene in general. He's cultivated and maintained a life in music that is just as admirable an achievement as any PHD, MD, JD, etc. Gather round (god willing) and listen to what Doc Ulrey has to say (dear lord/Mike resuscitate his mic). Local hip hop artist, label owner, music producer, philosopher, lyricist, mogul MIKE MASS stopped by today to educate me on a whole host of topics I've always been interested in but didn't know where to begin. Mastermind of Wave Theory a local label/promotion, Mike is building upon those who came before him to grow the local hip hop scene into a formidable presence on the national/world stage. You can find him or one of his artists playing the circuit almost any night of the week at Crowbar, Shuffle, The Vault, New World, etc. He's super talented and a sweet dude (don't tell anybody!).
Well that settles it...Matt Burke is the coolest dude ever! His band, Have Gun Will Travel, is one of the, if not THE most successful bands from the Bay Area. We get into our shared worship of The Cure's Disintegration, Mike Valleley and Will Quinlan. We get into the little known history of Daddy Kool Records and references to Jerk Dog Records in popular culture. We deep dive into the role that religion and skateboarding play in his music, and the journey he's taken with his brother and brothers in the band. Matt is a true artist and it appears he's only just begun. I think I could talk to him forever...this might be my new favorite episode. Jay Turner is a giant in the local skate community. Cutting his teeth riding street and vert on both sides of the bay, Jay has had his hands in virtually every possible facet of the continued growth of the art, sport and culture of skateboarding. An early contributor to Skatepark of Tampa, Jay went on to run Central Skate Park in Clearwater (later 688 Skate Park), created and managed competitions throughout the southeast and east coast under the moniker Skateboarding Association of America and even working with Team Pain Skatepark Design. Today he runs Anchor Skate Supply in downtown St. Pete (just 1800 feet from St. Pete Regional Skate Park, in which he played a huge role in bringing about), as well as mentoring and teaching skaters regardless of race, gender or age. We are lucky to have Jay out there keeping skateboarding going.
Frank Lacetena is a big old Punk Rock Teddy Bear! Leading local punk rock staple Slap of Reality for the past 30+ years, he's seen a thing or two. We get into tours of Germany and Brazil, playing hockey with the Hatrick Swayzes and rubbing elbows with the 7 Seconds, ALL, Fugazi and Green Days of the world. The Alec Baldwin of Barely Legal Podcast, Shawn Kyle, came back to add to my historical understanding of our beloved local music scene as well as to hypothesize on how current events may be a blessing and a curse to the longevity of local music. Our second guest today is Brewmaster and lead singer for The Path of Increased Indifference, Tim Ogden. Hailing from Maine and a huge fan of the Boston Hardcore Scene, Tim picked up a guitar at 15 and never looked back. Along the way he became somewhat of a local celebrity in the craft beer world, working with Cigar Bity Brewing, and is now set to begin his new venture with Deviant Libation which will have a presence at The Peninsularium when it opens. After nearly a year of stalking him, Brandon's own, Brian Schaefer, owner of Skatepark of Tampa/The Bricks was nice enough to stop by and give me a generous amount of his time. In the almost 30 years since its inception, Brian has cultivated an internationally revered wonderland devoted to the religion of skateboarding. Appearing in Tony Hawk video games, FUEL TV competitions, collaborations with Nike, Converse and evening Cigar City Brewing, The SPoT as its affectionately known has annually hosted 2 of the premier Pro and Amateur skateboarding competitions in the world, as well as Tony Hawk himself, Andrew Reynolds, Mark Gonzales, Eric Koston, Lil Wayne, Dinosaur Jr. and the list goes on. But conquering that world wasn't enough, Brian then went on to create The Bricks restaurant/bar which anchors Ybor's 7th Ave. with a collection of unique dishes, imbibements and other surreal goings on. Part working class hero, part street philosopher and total shredder, Brian reveals himself in riddles. We spoke for about an hour on each side of the interview and all of it was pure gold. It's not often I meet someone who can match, nay exceed, my level of excitement in talking about music (except Gabe Echazabal) but I've met my match with Nile. THE PREMIER SCHOLAR on all things Iron Maiden, they broke the mold and beat the hell out of the mold maker when they made Nile. Having already achieved family law sainthood, Nile is a gentleman's gentleman but with punk rock swagger. I can't thank Joe Hunt enough for getting him to come on, (ps Nile says you wanted to ghost Dylan just as much as he did).
Greg Baker, mastermind of such local foodie meccas as The Refinery and Fodder & Shine is an exercise in juxtaposition. The five-time James Beard Award semifinalist would have every reason to have an inflated ego and let everyone know about it, but instead he's a kind, soft spoken and somewhat heavy hearted introvert who loves his wife and their dogs. We discuss his early days as a touring musician, seeing Black Flag at the Cuban Club and Iggy Pop at Tampa Theater (sigh), coming up in the restaurant world and the highs and lows of running his own show. Today he does consulting through the Chef Greg Baker Group and seems content. This was a fun one!

Our producer, Michael Sinclair, said you should interview my girlfriend and what a happy accident that turned out to be. Worlds away from the punk/metal lane I normally stay in...her music is just objectively rad. We chatted about how informed her music is by cinema, how her Mother's work in ballet laid the groundwork for her to follow her passion and what it's like to be in a relationship with another creative. Killer guests lately!!! John Nowicki of The Holy Terror and Poetry 'N Lotion came in this morning and didn't disappoint. I told him if Frank Zappa played Jeff Buckley you'd get John Nowicki and The Holy Terror. He calls it "Twangy Dread" which is the perfect description , but his sardonic wit and amazing pool of supporting musicians let a glimmer of hope shine through. Oh and by the way he's left handed playing a right handed guitar, strung for a right handed player, so all the chords are inverted...it was like damned Christopher Nolan movies watching him play. John is a stud and this was heaps of fun.
I'm a huge mark for Eliot Mayo, singer for Vacancy and WREATH, and his insane encyclopedic knowledge of hard and heavy music. We fit about 10 hours of conversation into 45 minutes. He talks fast but all of it is pure gold! I told him I was gonna get a court reporter to transcribe it so I don't miss any band he mentioned. Dmeatree Stoianovich, drummer from Fast Talkers and Hi-Beam stopped by and ironically we spent most the time discussing our respective psychosis...seriously, I immediately fell in love with this guy and his bands are bad ass. This show has been such a blessing introducing me to great music and cool people and Dmeatree is an ALL STAR in all regards. We are definitely having him back on soon.
Lee Pearlman's significant other, Christian Denmon, stopped by today to talk about running a law practice in the 21st century. We got into it. His firm Denmon Denmon & Pearlman have relatively quickly grown into a formidable presence in the world of Personal Injury, Family Law, Criminal Defense & Estate Planning and that is due in no small part to Chris' voracious appetite to learn and implement better business practices. Our favorite Viking Warrior/Avenging Angel/Hand of God, Tom DeGeorge, stopped by the studio today to update us on the outlook for our favorite local music venue, Crowbar Ybor City, and live music locally and nationally. We live in a world that has live music venues, and those have to be guarded by men like Tom. Whose gonna get on the ass of those in power, make the calls, you? Tom has a greater responsibility than you can possibly fathom. You weep for live music, and you curse those in power. You have that luxury, you have the luxury of not knowing what Tom knows, that following the rules...while tragic, probably saves the industry. And following the rules while grotesque and incomprehensible, to most, saves live music. You don't want the truth because deep down in places you talk about parties; you want Tom on those calls, you need Tom on those calls! We use words like bar, restaurant, club. We use these words as the backbone of a life spent creating a live music scene, you use them as a punch line. Tom has neither the time, nor the inclination, to explain himself and what's going on...but he came in today to do exactly that. Either tell Tom 'thank you' and go on your way. Otherwise call NIVA, call your representative, Call Rubio or Scott, support Crowbar Ybor City. Either way, I don't give a damn, what you think you are entitled to.

Chuck Waygood is a STUD...No 2 ways about it! Born in "Sleepy Hollow" (not kidding) he made his way up and down the east coast with dreams of competitive skiing finishing his career at a University of Colorado before making it back to Florida and rising to the top of the Tech Recruiting world. Another one of my amazing cousins, we talk about the highest highs and lowest lows including the loss of both of our fathers. Chucky is a solid dude and one of my all time favorites.

🔲The mold in our school buildings (because the air is turned off all 3 day weekends and at least a week during the summer and every weekend and break during the school year, in hot and humid FL)that gives us (teachers, staff, and students) upper respiratory infections the start of every school year, making our lungs more susceptible to the COVID virus.
🔲the guilt teachers will feel if a student is hospitalized or dies because they accidentally gave the virus to them
🔲the guilt students and their parents will feel if a teacher or her loved one gets it from a student and dies
🔲the backlash from parents WHEN a teacher gets it and exposes students to it.
🔲10 sick/personal days is not enough time to even quarantine and if you used your unpaid FMLA you can’t use it again.
🔲Some teachers/staff might be reluctant to take the time off even if they are exposed because they can’t afford to.
🔲The school system cannot afford to do this in a safe way (automatic soap dispensers, doors, paper towel dispensers etc. Not to mention the cleaning supplies. Teachers already have to pay for even the basics supplies out of their own pay.
🔲The negligent parents who won’t sign their kids up for virtual even if they are high risk.
🔲Teachers who are high risk or have high-risk family members losing their position if they have to do FLVS or take a year off until we have a vaccine.
🔲Middle and high school teachers will be directly exposed to 160 students a day and be in schools where thousands of students and staff are touching, sneezing, coughing, and breathing all over everything every day.
🔲 We already have trouble getting substitutes and we will surely need even more substitutes this year. What will we do when no one wants to risk their lives for the laughable amount of money we pay them? (p.s. most subs are retired school teachers so they are high risk)
🔲The fact that just because we all desperately want things to go back to normal and realize school is a vital part of that, doesn’t change the fact that we shouldn’t be risking people’s lives. Your conspiracy theories and feelings do NOT trump science and medicine.

Besides my beautiful wife, I leaned pretty heavily on him through the death of both my parents and although he did get a hip replacement, that wasn't my fault. Todd is not afraid to make his opinion known and I'm not sure there's a more skilled user of the word "Fuck" or its many derivatives today. We talk about his time as an attorney, handing in his Bar License, addiction and recovery, becoming a marathoner, timing out "pooping" for race day, 2020 elections, Police Reform...I'm sure I'm missing something (oh yeah, Brett Metcalf's feet). My second guest today, Jesse Berkowitz, was my first friend in law school, my first law partner, and the absolute funniest human being I've ever had the pleasure of knowing. As one half of the Berkowitz & Myer Personal Injury & Bankruptcy empire over in St. Pete he and his partner Christian Myer have taken the civil trial world by storm. He and his son Kelley have also become successful in the world of the sports card and memorabilia trade. Shawn Kyle is an American singer, songwriter, artist and multimedia producer. Born in
Tampa, Florida on a side of town known to police and lawyers as "Suitcase City" for its
vagrancy, 80's drug epidemic, and crime; Kyle's own true stories often read like fiction.
Kyle's first exposure to arts and culture came while working on construction sites and
frequenting the old family run businesses in Ybor City and inner city Tampa with his
father as a pre-teen. It was the city's then potent mix of old world and new in the 80's
and 90's that introduced him to artists that led to a job as a furnace glass blower
eventually assisting Dale Chihuly contemporaries, as well as a stint employed by listed
pop-artist and money forger J.S.G. Boggs, all while Kyle clandestinely performed as a
young stage actor fill-in for pay at Colleges he wasn't even attending.
What would become all encompassing to his life for the next two decades however,
would be kicked off by coming across an ad in a magazine looking for an electric
guitarist. Calling the ad, and winning the audition, he stated his age as a baby faced 22.
In reality Kyle had been playing an instrument for just two years and was only 17.
Active work as a touring artist in clubs and college circuit found him alongside a variety
of bands and musicians who would become some of the more influential artists of
Alternative Rock, Americana, and College Radio. Over time as different bands and styles
came and went, Kyle worked into being represented by several of the largest talent
agencies in the world, finding himself a runner up for an Independent Grammy Award
he had no idea he was submitted for, in between colorful moments like cutting demos
with Joey Molland (Badfinger, George Harrison), wrestling Edwin McCain (and losing),
trading jabs with Stan Lynch (Tom Petty, Glen Frey) or having a blackout night with
pre-sobriety Jason Isbell (there may be an Isbell song about Ybor City and that evening).
Eschewing an inherent promise of traditional arts had led Kyle into what would become
an even harder road: two decades of constant bootstrapping work in the hurly-burly of
the rise, fall and recent rebirth of the music industry coinciding with the evolution of the
digital age. Through the disrupting Napster era into the music industry's current rebirth
as a platform for never-ending directly delivered content; music and the business
around it evolved, with the industry in hindsight shaping how the majority of all
businesses and industries now socially function in media and tech from the corporate
world and the government, to record stores and yes, musicians.
After their 10,000+ hours, many musicians that grew within the DIY era found a variety
of skillsets, from video production to auto mechanic work, app development to
marketing and branding, public relations to knowing which guitar will disintegrate to
splinters when smashed on a festival stage. All done by one person, on a moments
notice, learning by experience, on a deadline, because the work had to be done.
Shawn Kyle currently resides in Tampa, Florida, and is owner of Bay Multimedia LLC
which has provided multimedia, marketing and branding for some of Tampa's beloved
independent businesses, a founder of the Music Festival App (on the iTunes Store), and
partner in Be Original Media LLC, providing A/V solutions for the non-profits industry.

He lost my father at age 5 so his mother raised him and his brother on her own. Andrew had a pretty wild childhood and his teens and decided to go to police academy instead of jail. Andrew spent 10 years at sheriffs office. He also worked as professional photographer for 22 years, shooting many bands, along side the typical weddings and family portraits. After his years at the sheriffs office and as a photographer, Andrew decided to open his investigative business in 2011 and ventured into other areas of business (CLC Screenings and in 2019 Carlton Asset Protection and Security). Andrew’s hobbies include playing guitar, his dogs, motorcyles, and paranormal interest.

On this week of the Barely Legal Podcast, Josh Sheridan interviews Loren Pincus of L Pincus Law, PLLC.
Prior to founding his own law firm, Loren worked for seven years at one of the oldest and most well respected civil and criminal litigation firms in the Tampa Bay Area. Before that, he served as an Assistant State Attorney in Pinellas County for nearly five years. While employed as a Prosecutor, Loren served as a Lead Trial Attorney while handling a broad range of both felony and misdemeanor cases, many of which received media attention.
Loren has established an excellent reputation in the community as a trial attorney. He tried nearly 50 cases to jury verdict as a prosecutor, including first-degree murder, capital sexual battery, and DUI Manslaughter. As a civil litigator, he handled cases from their inception, all the way through the litigation process and on to jury verdicts. He routinely obtains favorable settlements and verdicts on behalf of his clients. His experience enables him to anticipate how the other side will proceed in either a civil or criminal matter and effectively respond to their actions.
Loren grew up in Pinellas County. He graduated from Boca Ciega High School and Eckerd College. While at Eckerd College he was a four-year member and Captain of the school's NCAA Division II baseball team. He graduated from New England School of Law in Boston, MA. Loren is admitted to practice throughout the State Florida, the State of New York and the District of Columbia. He is also admitted to practice before the Supreme Court of the United States of American and Federal Court for the Middle District of Florida.
Loren is certified by the Major League Baseball Players Association as an Athlete Agent and currently represents several professional baseball players. He founded Greenline Sports Management, through which he advises both amateur and professional athletes on all aspects pertaining to the MLB Draft, marketing and sponsorship agreements and overall successfully navigating life as a professional athlete.
Loren has achieved an AV Preeminent rating (the highest possible) by Martindale-Hubbell, which is based upon the input of local Judges and fellow attorneys. He also maintains a "Superb - 10 out of 10" ranking on Avvo. He is a member of the Florida Justice Association, the Tampa Bay Trial Lawyers Association and coaches his children's youth sports through Keystone Little League and the local YMCA.
