Based on the contingencies in the offer the home inspection contingency can have different means. Most common is the home inspection results must be to the buyer’s satisfaction. There is also times clients will make their inspection subject to fixed costs for repairs. This means they will only negotiate or walk away if the issue is more expensive than their contingency allows. Based on the contingency they chose to use you then have that power to negotiate.
After the bad home inspection it is time to talk about what your buyer wants to do. You can review with them whether it is best to walk away, negotiate money, or negotiate repairs. In today's episode I talk about how the NAR settlement was by far one of the largest shake ups in the industry in a long time. The last shakeup this big was coincidentally enough the introduction of buyer agency. This is an important step in understanding how we deal with this moving forward.
I also review how one of the biggest changes I have seen since the settlement would be the amount of discussions around commissions. It has agents, brokers, attorneys, mortgage brokers, buyers, sellers, banks, and even the government talking about commission. I think this helps the settlement reach its goal of more commission awareness. I know for most agents it was a time to learn how to talk about commissions inside out to make sure to be ready to speak with clients.
Overall I talk about my experiences when booking showings. So far I have not run into one solid NO on commissions with each agent answering differently. Some listings have offered seller direct commission, some have offered cooperating compensation, and some have simply said I suggest you put it in the contract and we can see what the seller says. It will be interesting to see how this all plays out.

As long as it does not become illegal I think the practice off incentivizing the sale will always favor the seller.

As a real estate agent the difference in getting your clients the house or not in a bidding war is also the difference in being paid or not. In this episode I go over three ideas to help your clients offer get accepted. While it is easy to advise a client to offer more money and beat everyone on the purchase price, sometimes it comes down to the details.
One idea we go over is the closing date. Oftentimes the closing date has a lot to do with a seller's ability to sell and move smoothly. While not optimal some times for the buyer this is a way to improve the offering to the seller. This may allow them to finish out a job or a school year in the home you want. Allowing things like this are a huge perk to sellers.
Another place where we can gain an edge is a great pre approval. Better yet why not get a fully underwritten pre approval so you are almost as good as cash. Remember your pre approval will be judged so make sure it is as clean as possible. Having the lender reach out is just one more way to show it is a great offer.
Lastly we talk about deposits. Often confused with down payments, deposits are often neglected. While a deposit may be money at risk if your buyer intends to keep their word the risk is minimal. The seller's sole remedy for the buyer walking in most cases is this deposit. Putting enough money on the line that the seller can feel confident your buyer will not walk away but if they did there is a good amount of money to cover the damages.

In real estate it is often confused as to who really pays the commission. The truth is it can come from a lot of different people and can be argued a lot of different ways. If we look at the 1099s on most sales it seems the listing brokerage pays the buyers brokerage based on the listing brokerage's contract with the seller. Now that said there are times this does not happen.
Some transactions the buyer pays their agent direct per the contract that they are in with their agent. This allows their agent to show them any home and know they will be paid regardless of what the listing brokerage or seller is offering. That is right I said seller is offering because some for sale by owner listings offer compensation to agents that bring buyers.
The truth is no other industry has so many variables in how and if they get paid. We as real estate agents are used to our pay being challenged and clients asking for discount. To tell you the truth that is why they hire us. We are master negotiators and will always be. Knowing the business inside out will certainly help you once you obtain a client. That said most agents fail by spending too much time studying how to be an expert and not enough time generating leads. The single largest mistake new agents often make is getting into the mindset that you “don't want to bother people”. For lead follow up there are only two answers yes or no, anything short of that it is time to follow up.

Take the person who works at the gym lobby sign in. Imagine how many people they know. Friends and family can be great resources when it comes to referrals. Retiring real estate agents and brokers make great referral sources. They can continue to make a living from their network while retired, leaving you to do the leg work and mail them a check.
In this episode we discuss that in real estate you often hear people refer to your “SOI” or sphere of influence. This is the group of people who you have accumulated in life that know, like, and trust you already. It is understood in business that people who know, like, and trust you are far more likely to use you as their Realtor®. This is why so many top producing agents focus on adding their SOI to their CRM as soon as possible and constantly audit their list. When thinking about who is in your sphere of influence, take time to really break it down. The average person should end up with a list of names and contact information for around 150-300 people without any trouble.
In this episode we discuss that when working as a Realtor®, to talk with another Realtor® outside of your organization about your commission structure, is considered to be a violation of the Sherman Act and is an antitrust violation. Each agent is allowed to charge any rate that they see fit for their services based on the agreement they have with their client. In this episode we discuss that in Massachusetts in order to become a real estate agent you must take a 40 hour course. After the course you need to score a 70 or above on both the state and federal real estate test. As an agent in Massachusetts every two years you must have taken at minimum 12 hours of accredited continued education. This number varies greatly state by state so check with your state board. To become a real estate broker in Massachusetts you must work full time in real estate for a minimum of three years. In addition to that you then must take a 60 hour course and pass both the state and federal testing.
In this episode we discuss that when a client objects to your sales pitch it tells you that something is off. Make sure to acknowledge and own their objections while never denying it. Each time you run into a new objection it shows you a place where your sales pitch was off. Objections show us the questions that were left unanswered by our own sales pitch and that should be added to future pitches. In this episode we go over that Title V is the rules that the state applies to properties serviced by a septic system. In order to transfer property a test must be completed. Title V tests have three types of results a property can pass, fail, or conditionally pass. A conditional pass means the owner will need to do certain repairs to come into compliance with the code. When guiding clients to getting a Title V test done, remember timing can be important so book it early. The test results are good for two years and can be extended to three years with annual pumping.

Always Be Hiring. This week we wanted to talk about how our Real Estate Brokerage is always hiring. We just put up two new positions and are still actively looking for new agents. Our first position is the Managing Broker position. This position takes a management position overseeing our Hanover, MA office. A broker license in MA is required. The other position we opened is a Agent Operations Coordinator position which helps our agents with their leads and deals, making sure that everything is up to date and current. More and more business are opening back up and this means more people will be returning to work. This also could mean that things could be returning to some sort of a normal state. This week I go over the businesses allowed to open back up. If you have clients in any of these areas of business that have been thinking of buying or selling, now is the time to contact them.
Five Must Know Words in Sales. This week I go over five words you must know in sales. These words are presupposition, yes and no, reasonableness, tonality, and body language. In today's podcast I go over each word and what it means in real estate and sales in general. By implementing these five words into your business you can become more successful in sales.
Back to Work We Go. This week we are fully into Phase 1 of the reopening of Massachusetts. This is a great time to get back in contact with your sphere of influence. Send a email, send a letter, shoot off a text. Ask how they are doing and tell them that now is a great time to get back to looking for a home or listing their home. We are not looking to predict the future or predict what this pandemic has done to the world, but for the next few weeks here things are going to start getting back to normal. Get out there and get moving.
The Reopening of Massachusetts. Massachusetts has laid out the guidelines for businesses to reopen in the time of this pandemic. We gathered all the documents put out out by the state and have reviewed the what and when businesses can open. All businesses that were previously open as essential or will be opening need to follow the new guidelines to keep the public safe and stop the spread of COVID-19. I go over the quick list of businesses allowed to reopen and when. What this means for the real estate industry is that clients will be going back to work and current deals in your pipeline might be restarting. Check with your clients, financial institutions, and real estate attorneys to talk about your transactions continuing.
Finding Listings in Any Marketplace. This weeks episode I wanted to go over finding more listings in other places. For sale by owner, expires, withdraws, pre-forclosures, all these can bring an opportunity to land a listing and help a client. I go over the different venues where you can look for these listings and how to talk with the owner to land the listing. With the issues with COVID more and more people might need to list their home and you need to be prepared to help.
Fin That Broken Mindset. This weeks episode I want to tell you to shut off your brain and let your mind go. What I mean by this is too often we let our brain control our actions based on what we have learned and know. What I am telling you is to tell your brain to shut up and let your mind take control. You will be surprised at what you can accomplish. I go over this a bit more in this weeks podcast so take a listen and try it out.
Open House COVID-19 Style. This week I wanted to talk about hosing an open house during this COVID-19 issue. Over the weekend we hosted our first open house and had to come up with a plan to deal with possible buyers going in and out of our clients home. I go over what we did, what was done differently, and how you can handle an open house during this COVID-19 crisis. While others are holding off on continuing their business as usual now is the time to work harder.
Now is the Time to Strike. With all that is going on in the world I wanted to give you a bit of advice. Strike now while others are sitting by waiting for normality to return. When the world finally starts to come back to a normal state you will be at the forefront of the industry. As real estate agents we can still perform our duties to clients as housing is always needed no matter what is happening. Get out there now either by videos, posting on social media, newsletter, whatever you can to be active. In this weeks podcast I go over a few tips on why it is best to strike now and what you can do be at the forefront of now and later when we get back to a normal time.
Getting Creative. In this weeks episode lets talk about being creative in videos. Planning ahead and sticking to a schedule is the best way to release content to your audience. You want to plan out the who, what, when, where, and how. I go over each process of how I plan for releasing information in media like these podcasts.
Things to do Now in a Changing Market. With all that is going on in the world it is hard to predict how the real estate market will look like when things start to get better. Now is the time to position yourself for both the up and the down. From needing to understand quick sales or estate sales to foreclosure and downsizing you should be teaching yourself how to deal with each situation. When the market finally settles in to wither a high or a low you will be prepared to handle any transaction in the moment.
