Episode 150. The Future of Gun Rights: Missouri's Legal Battle and the Supremacy Clause
In this episode, Alex Ooley discusses a recent opinion issued by the United States Court of Appeals for the Eighth Circuit regarding the Second Amendment Preservation Act (SAPA) in Missouri. The law, adopted in 2021, aims to prevent state officials from assisting in the enforcement of federal gun control laws that are deemed unconstitutional. The court ruled that the law violates the Supremacy Clause because it purports to invalidate federal law. However, Ooley argues that the court misinterprets the Supremacy Clause and that states have the power to withhold assistance from the federal government in the enforcement of unconstitutional laws.

Episode 149. GOALS, Guns, and the NRA's Future
In this episode of the Forge of Freedom podcast, host Alex Ooley is joined by John Richardson to discuss the conclusion of the bench trial in the case against the NRA by the New York Attorney General. They also talk about John's experience at the First Annual Goals Conference in Knoxville, Tennessee. The conference featured range days, vendor exhibits, and educational panels. The judge in the NRA case did not order a court-appointed monitor but issued an interim decision with six action items for the NRA to address. The NRA and the New York Attorney General are currently negotiating a resolution. The conversation discusses the ongoing legal battle between the New York Attorney General and the National Rifle Association (NRA). The court-appointed compliance monitor is overseeing the NRA's compliance with the judge's expectations. There is concern that without a monitor, the NRA may not make the necessary changes. The conversation also touches on the resistance to change within the NRA and the need for reform. John Richardson announces his campaign for the NRA Board of Directors and emphasizes the importance of electing reform candidates to turn the organization around.

Episode 145. Restitution: A Just Approach to Addressing Crime (with Mary Ruwart)
Dr. Mary Ruwart discusses the concept of restitution as a way to address crime. Restitution involves the offender making amends to the victim by compensating them for the harm caused. This approach focuses on restoring the victim and balancing the non-aggression principle of not initiating force, fraud, or theft. Restitution has been shown to reduce recidivism rates and provide true rehabilitation. The current criminal justice system often neglects the needs of the victim and fails to make them whole. Restitution shifts the focus back to the victim and allows for a more just and effective approach to addressing crime.

Episode 142. The Tyranny of Gun Control with Jacob G. Hornberger (rerun of Ep. 60)
Jacob Hornberger discusses the importance of gun rights and the right to self-defense in a free society. He explains that the right to keep and bear arms is rooted in the concept of private property and the right to sustain one's life. The Second Amendment protects the pre-existing right to own guns and serves as an insurance policy against tyrannical governments. Hornberger emphasizes that an armed citizenry can resist and fight back against oppression, even in the face of a powerful military. He cites historical examples such as the Warsaw ghetto uprising and the American Revolution to illustrate the effectiveness of an armed population. The conversation explores the futility of eliminating all guns and draws a parallel with the war on drugs. It emphasizes the importance of an armed society as a deterrent to crime and tyranny. The discussion also touches on the potential consequences of government confiscation of guns and the need for self-defense. The conversation highlights the role of copycat killings and the impact of government violence on society. It concludes by urging reflection on foundational principles and the need to restore liberty, peace, prosperity, and harmony.

Episode 140. Loper Bright, the Balance of Powers, and Firearms at the Supreme Court
In this episode of the Forge of Freedom, Alex Ooley discusses recent Supreme Court decisions, focusing on the Loper Bright case that eliminated Chevron deference. Chevron deference is a doctrine that gives administrative agencies the benefit of the doubt in interpreting ambiguous statutes. Ooley argues that these agencies have overstepped their authority and become an all-powerful, unelected branch of government. He believes that the elimination of Chevron deference will have wide-ranging effects on these agencies. Ooley also mentions other firearms-related cases and the upcoming Garland v. VanderStok case that will be reviewed by the Supreme Court.

Episode 139. Freedom First: Donald Rainwater's Campaign for Governor
In this episode of the Forge of Freedom podcast, host Alex Ooley interviews Donald Rainwater, a candidate for governor of Indiana. Rainwater discusses his background, the importance of limited government and libertarian values, and his plans for tax reform and drug policy. He emphasizes the need to reduce property taxes and eliminate the state income tax, as well as decriminalize and legalize cannabis. Rainwater believes that individuals should have the freedom to make their own choices and that government should not interfere in personal decisions.
In this conversation, Donald Rainwater discusses the importance of voting based on principle rather than choosing the lesser of two evils. He emphasizes the need to take back our unalienable rights and rein in government when it violates those rights. Rainwater advocates for real universal school choice, criticizing the current education system and the lack of true choice in Indiana. He also expresses his opposition to red flag laws, highlighting the potential for abuse and the infringement on Second Amendment rights. Rainwater addresses the challenges he faces in participating in debates and calls on voters to support his campaign for a smaller, more efficient, and more effective government.

Episode 138. Rahimi, Politics, and Originalism
In this episode of the Forge of Freedom podcast, host Alex Ooley discusses the recent Supreme Court decision in the Rahimi case, which challenged the constitutionality of a federal statute prohibiting the possession of firearms and ammunition by someone subject to a domestic violence restraining order. Ooley argues that while some commentators view the decision as a victory for the Second Amendment, it is actually a loss, albeit not as bad as it could have been. He provides background on Second Amendment litigation and the Supreme Court's previous decisions in the Heller and McDonald cases. Ooley analyzes the court's opinion in Rahimi, highlighting the use of historical analogs and the potential implications for future gun control regulations. The main theme is the interpretation of the Second Amendment and the application of the text, history, and tradition analysis. The conversation highlights the disagreement among the justices regarding the proper methodology for evaluating gun control laws. The dissenting opinion by Justice Thomas is praised for its adherence to originalism and the recognition of the Second Amendment as a barrier to government infringement. The conversation also touches on the potential implications of the decision for future gun control laws.

Takeaways
The recent Supreme Court opinion on the constitutionality of a provision related to the possession of firearms by individuals subject to domestic violence restraining orders was not a victory for gun rights.
The Second Amendment has four main purposes: guaranteeing the states a militia power, promoting the individual natural right of self-defense, supporting the people defending against foreign invasion, and defending against domestic tyrants.
There is a lack of education on the Second Amendment in law schools, and many law school graduates have limited knowledge of the topic.
Understanding the Second Amendment is essential for preserving freedom and protecting individual rights.

Episode 136. ATF Rules on Bump-Stocks and Pistol Stabilizing Braces Shot Down (Cargill and Mock)
In this episode of the Forge of Freedom podcast, Mike and Alex discuss two recent cases related to gun rights: Mock v. Garland and Garland v. Cargill. The Mock v. Garland case addresses the pistol stabilizing brace rule, while the Garland v. Cargill case deals with the redefinition of a semi-automatic firearm as a Machine gun when equipped with a bump stock. Both cases challenge the authority and rulemaking of the ATF, highlighting the need for clarity and consistency in administrative procedures. The Supreme Court's decision in the Cargill case reaffirms that a bump stock does not convert a semi-automatic rifle into a Machine gun, based on the text of the statute. However, there are concerns about the potential for future legislation that could further restrict gun rights.

Episode 122. Defining a Firearm: The Frame or Receiver Rule at SCOTUS (Garland v. VanDerStok)
The United States Supreme Court has accepted a case called Garland v. VanDerStok, which challenges the administrative authority of the ATF. The case focuses on the definition of a firearm and specifically the frame or receiver rule. The ATF argues that incomplete frames or receivers, known as 80% lowers, are firearms because they may readily be converted. However, the Firearms Policy Coalition and the Second Amendment Foundation argue that the ATF is overstepping its authority and changing the law. The case is about limiting agency overreach and maintaining the separation of powers.

Takeaways
The neglect of individual rights in the West has led to violations of property rights, exorbitant fiscal and inflationary pressures, mass surveillance, censorship, and erosion of freedom of speech.
The Western world has taken individual rights for granted and needs to refocus on protecting negative rights rather than enforcing positive rights.
Education about the principles of freedom and the importance of protecting individual rights is crucial to resist the creeping violation of rights.
The public needs to actively enforce the principles and ideals contained in documents like the Declaration of the Rights of Man and the Citizen and the Bill of Rights.
The government's focus on control rather than protecting individual rights is evident in its expansion of surveillance and restrictions on privacy.

Episode 102. Test Your Knowledge of U.S. Gun Laws
In this episode, Alex Ooley discusses a quiz on US gun laws published by The Trace, an organization that promotes gun control. The host acknowledges the bias in the quiz but finds it instructive. The quiz covers topics such as background checks, private sellers, failing a background check, psychological evaluations, timeframes for background checks, training courses for concealed carry, permitless carry, registration of pistols, ownership of certain weapons, minimum age for AR-15 ownership, federal regulators and recalls, and lawsuits against manufacturers. The host provides explanations and critiques for each question, highlighting the importance of individual rights and the potential dangers of gun control measures.
Takeaways
The quiz on US gun laws published by The Trace is biased but provides insight into the perspective of gun control organizations.
Universal background checks may not effectively reduce crime and can lead to universal registration, which is a step towards confiscation.
Requiring training or permits for the exercise of the right to bear arms infringes on individual liberties.
The Protection of Lawful Commerce and Arms Act protects gun manufacturers from lawsuits related to the criminal or unlawful use of firearms.

Episode 29. The Adventures of Jonathan Gullible - A Free Market Odyssey with Ken Schoolland and Aaron Spurling
In this episode, Alex Ooley is joined by co-host, Aaron Spurling, as well as a special guest, Ken Schoolland, the author of The Adventures of Jonathan Gullible: A Free Market Odyssey, a book that tells the story of a boy who becomes shipwrecked on an unfamiliar island after being swept out to sea in a storm. Having previously lived in a relatively free society, in this new strange land he experiences culture shock as he learns of bewildering laws and traditions of the islands inhabitants. The story highlights the absurdities of the laws, the controls imposed on people's lives, and the economic drawbacks of these laws. The laws highlighted are recognizable as common to many countries throughout the world.
As the story unfolds, the part individuals in society play in political decision-making and personal responsibility is introduced for discussion. As Jonathan meanders on his way around the Isle of Corrumpo, he meets the Food Police, Uncle Samta, the True Believers, the Grand Inquirer and the Democracy Gang along the way - along with many more wacky inhabitants whose strange ideas and even stranger ways Jonathan is challenged to understand and straighten out.
Translated into over 40 languages and 44 published editions, The Adventures of Jonathan Gullible has won numerous awards and has been endorsed by Steve Forbes, Walter Williams, John Stossel, Mark Skousen, and Austrian-School economists and educators throughout the world. The Adventures of Jonathan Gullible has become the classic free-market mix of Frederic Bastiat, Adam Smith, von Mises, and Pat Paulsen.
Milton Friedman, a Nobel Laureate Economist said, “It certainly presents basic economic principles in a very simple and intelligent form. It is an imaginative and very useful (book)!"

Freedom is gained and preserved through personal responsibility and a community of people with a similar mission. You are "The Forge of Freedom."
