With the recent closures of First Republic Bank, Silicon Valley Bank and Signature Bank – three of the top twenty largest banks in the country, it's timely to have a discussion about this topic, share my perspective on the opportunity to acquire assets from these unfortunate situations, and bust some myths and false narratives.
Bank failure occurs when a bank becomes unable to meet its financial obligations and is unable to repay depositors and creditors. When a bank's assets, such as loans and investments, significantly decrease in value or become illiquid, while its liabilities, such as deposits and debts, remain unchanged, the imbalance in the bank's financial position can lead to insolvency and, ultimately, the closure of the bank.
Several factors can contribute to bank failures. These include poor management decisions, excessive risk-taking, economic downturns, asset bubbles, and inadequate risk management practices. Additionally, external factors such as economic cycles, regulatory changes, sudden shifts in market conditions, or unexpected shocks to the financial system contribute to the vulnerability of banks.
Bank failures can have severe repercussions, including the loss of depositors' funds, disruptions in the local economy, and broader systemic risks that can impact the stability of the entire financial system. And it's important to know that they are not confined to any particular region or type of bank. They can occur in both developed and developing economies, and have affected large multinational banks as well as smaller local institutions.

Title insurance is a standard practice that's been around for decades and a required insurance you must purchase in order to close a real estate transaction. There are valid reasons why title insurance is important and very helpful, and in my opinion there are also reasons why we are due for disruption in this particular aspect of the real estate industry.
It's a form on indemnity insurance that protects home buyers and lenders from financial loss sustained from defects in title of property or real estate, because the title insurance company does their research before they will issue title insurance, so in essence they are insuring that the title is clear and ready to be put into your name.
Like the handful of other insurances in our daily life, whether required or optional, we buy insurance policies hoping we never need to use them, for the obvious reasons, but also because it's a well-known and sadly often proven fact, that whether we reliably pay our very costly insurance premiums month after month, decade after decade, the insurance companies still prefer to find loopholes to not pay out claims.

An important term and very timely topic right now in the real estate industry is Debt Service Coverage.
Debt service is the loan against the property. Often with more expensive properties there is multiple levels of debt from 50% low interest rate to mezzanine debt, to 2nd or 3rd mortgages. Essentially it's the full monthly payment that encompasses the whole costs of managing and servicing the property. It's most important, but often unclear when it comes to investment properties.
Lenders want to know if you borrow money against a property, they can be assured you can service the debt that you're applying for. What are the factors lenders consider to establish the Debt Service Coverage Ratio (DSCR)?
DSCRs are dramatically hindered and being affected by the rise in interest rates, which of course brings concern of refinance and default. Borrowers that have been squeaking by with low interest rate mortgages are going to find themselves upside down when they refinance.
The financial crisis of 2008 was born out of large numbers of mortgages going into default, which means borrowers were not able to service their debt.
So what is the quiet sentiment amongst bankers about what's going to happen with these non-QM loans?
And the real question remains... have we learned the crucial lessons we needed to from the great financial crisis?

Oscar Caballero is a bio engineer by trade. His father, a successful rice farmer in Colombia in the 70s and 80s, Oscar was tasked with gaining a higher level of education about farming technology. CAP Rates are a tool to measure pricing in real estate investments. The lower the market capitalization rate for a piece of investment-grade real estate, the higher the price. For both commercial and residential real estate, CAP rates have hovered at historical lows, primarily due to low interests and an excess of cash in the system. Now that rates are rising, it could cause a grand devaluation in real estate.
