This week, Joe shares details regarding: 🟡 Talc Update: J&J settled a recent meso case that started in Dallas while working to gather support from 75% of claimants for bankruptcy; Plaintiffs filed a motion for preliminary injunction to prevent J&J from filing bankruptcy outside of NJ in a different bankruptcy court 🟡 Camp Lejeune: Upcoming deadline of August 10th to file administrative claim; with nearly 230,000 claims filed to date we are expecting another 10,000 in the next month and a total of 1,800 lawsuits filed; only 72 cases identified for Elective Option with 31 settlements accepted; this means cases will need to be resolved via trial and an order for selection of first bellwether trial for Tier 1 cases entered this week – plaintiffs will select 3 plaintiffs for 5 injuries and government select 2 plaintiffs for each for a total of 25 cases. Bard Port Catheter MDL Litigation Update: What Plaintiffs Firms Need to Know
The multidistrict litigation over Bard's allegedly defective port catheters continues to rapidly progress, requiring close attention from plaintiffs attorneys assisting harmed patients. During this week's episode, Attorney Joe Fantini provided a thorough update on several major ongoing mass tort lawsuits. He covered recent developments across key cases involving hernia mesh products, the Boy Scouts settlement, as well as emerging litigation around the medications Suboxone and Ozempic.
Starting with hernia mesh, Joe noted a bellwether trial is scheduled to begin next week in New Jersey state court focused on cases involving Stratus mesh. This will be a significant data point, given trials have been rare so far in the hernia mesh litigation. In addition, the federal judge overseeing the largest hernia mesh MDL against C.R. Bard, consisting of over 40,000 filed cases, has ordered the parties to mediate beginning March 3rd and 4th. After years of these cases progressing, requiring mediation is a promising indication that we could see meaningful resolution on the horizon for plaintiffs.
Regarding the Boy Scouts settlement, Joe explained the positive update that the court lifted a temporary stay blocking the settlement after an appeal from survivors seeking more time to submit claims. With the stay removed, the settlement is now moving forward once again, with the claim form deadline still set for May 31st. Assuming forms are filed in time, Joe anticipates compensation will start heading to victims of abuse later this year as the claims are evaluated and approved.
As for newly formed lawsuits, Joe provided details on both the Suboxone and Ozempic MDLs. For Suboxone, the initial case management conference is scheduled for early March before the federal judge in the Eastern District of Pennsylvania. The litigation is focused on patients who took brand name Suboxone to treat opioid addiction for over 30-90 days and subsequently experienced severe dental problems like tooth decay that required oral surgery. The key criteria is that the medication must have been taken prior to an important label change in 2022 warning of these dental risks.
At the same time, Ozempic's initial conference is slated for March 14th. The judge is taking a unique approach to get out in front of certain issues before entering any formal orders. There will be an initial meeting to discuss appointing leadership counsel, the process for case filings and discovery, as well as evaluating whether to segment or group defendants who have varying products consolidated in the MDL. Joe expects the leadership structure will be formalized before the end of spring.
In summary, it's an active period across the mass tort landscape with momentum building on major established litigation like hernia mesh while new cases quickly emerge and ramp up. We anticipate learning much more following the imminent initial conferences for Suboxone and Ozempic.

The litigation financing industry has experienced explosive growth in recent years, with market size estimates projecting it will be a $20 billion industry within the next 4-5 years. This influx of capital has fundamentally changed the dynamics for law firms, allowing them to take on significantly larger case inventories than ever before. PRESENTING Tort Talk Thursdays, hosted by Susan Barfield and Joe Fantini. Experienced mass tort attorney Joe Fantini joins host Susan to provide updates on major ongoing mass tort litigation as of February 2024. Joe begins by giving background on his extensive experience in mass tort law, including working on the plaintiff side, defense side, and clerking for a dedicated mass tort court. This diverse perspective gives him unique insights.
The first case they discuss is the Boy Scouts bankruptcy settlement. After years of negotiations, a $2.4 billion settlement was reached and approved on appeal. However, a group of plaintiffs recently petitioned the Supreme Court to stay the bankruptcy proceedings, arguing that non-bankrupt local councils and individuals shouldn't get liability protections through the bankruptcy. Justice Alito granted a stay, with a decision expected alongside the similar Purdue Pharma case. For firms with Boy Scout cases, Joe recommends continuing to prepare claims materials to be ready when the stay lifts.
Next, they cover recent developments in RoundUp litigation. After a string of defense verdicts in 2022, plaintiffs have momentum again thanks to recent large jury awards by firms like Klein and Specter and Arnold Itkin. With about a dozen more trials scheduled through mid-year, Joe expects global or inventory settlements to pick up.
Another important update, as Michigan repealing its pharmaceutical immunity law, which had provided blanket immunity to drug companies. This opens the door to opioid and other drug injury lawsuits in Michigan for harms occurring after 2/13/23.
One emerging mass tort poised for major growth is Ozempic. With over 10,000 expected cases, the litigation was recently consolidated before Judge Pratter in the Eastern District of Pennsylvania. Joe explains the injury criteria, including 30+ days of use, hospitalized GI injuries 30+ days after starting, and no prior gastric procedures. He anticipates significant activity in the second half of 2023.
Another likely new MDL is baby food litigation, after a prior consolidation attempt failed. A new petition cites over 3,500 plaintiffs. Key factors are autism or ADHD diagnoses 2+ years after 12+ months of baby food use. An early bellwether trial is already scheduled for this summer.

The popular diabetes medication Ozempic is being widely prescribed off-label for weight loss, but it is causing severe and lasting gastrointestinal injuries in many patients. Attorney Jonathan Sedgh with Morgan & Morgan provided an in-depth look at the growing Ozempic injury litigation on a recent episode of The Leverage Report.
Ozempic belongs to a class of drugs called GLP-1 receptor agonists that work by slowing down the digestive tract. In many patients, Ozempic goes far beyond just slowing digestion—it paralyzes the stomach, leading to gastroparesis.
With gastroparesis, food gets stuck in the digestive tract and cannot make it down into the small intestines to be properly digested. This undigested food can form into balls or clusters, leading to bowel obstructions and intestinal blockages. Patients experience severe and persistent vomiting, requiring emergency room visits and hospitalization for dehydration. They end up on IV fluids, unable to keep any food or liquids down.
For many patients, the debilitating gastrointestinal symptoms continue even after stopping Ozempic, indicating the drug has caused permanent damage. The main defendants in the growing litigation are Novo Nordisk, maker of Ozempic, and Eli Lilly, which makes the competing GLP-1 drug Trulicity.
So far, about 60 cases have been filed in federal court, but Morgan & Morgan alone is investigating over 10,000 potential cases. Sedge estimates there could be 50,000 to 60,000 potential cases nationwide based on the volume of inquiries they receive.
Due to the large number of federal cases, an MDL (multidistrict litigation) was recently created to consolidate the Ozempic lawsuits in front of the experienced Judge Pratter in the Eastern District of Pennsylvania. This will help streamline the litigation process.
According to Sedgh, important criteria for Ozempic cases include:
- Treated at a hospital or ER for injuries like vomiting, dehydration
- Persistent vomiting for at least 1 month
- Off Ozempic when they learned of the risks and contact the law firm
He notes key challenges will be proving Ozempic directly caused the gastrointestinal injuries and combatting defense arguments that preexisting conditions like diabetes or obesity were the real cause. This litigation is gaining momentum with tens of thousands of potential cases. Sedgh provides invaluable insights into the Ozempic injury landscape that is still emerging. He stresses the importance of thoroughly screening cases and obtaining all necessary medical records for anyone considering getting involved.
