Guest, Ms. Diane Bukowski and Travis Herndon of Voice of Detroit, will discuss the recent article about Ricky Rimmer's Wrongful Conviction.

Rimmer has been serving a sentence of death in prison since March 3, 1976, for the murder of Joseph Kratz, a white car dealer on Detroit’s east side in 1975.The evidentiary hearing was to assess Brady disclosure violations involving DPD Sgts. Leo Haidys and James Harris, who masterminded his 1976 conviction. The two have corrupt, violent and racist histories including their participation, respectively, in the 1969 Veterans Memorial Incident and the 1972 Rochester Street Massacre. Both events played a major role in Detroit’s Black history.Join us for this Conversation…..….

Mistreatment ranged from verbal and physical abuse to denial of quality care and refusal of pain relief. As a result, Black women experienced increased complications during pregnancy and delayed interventions, leading to preventable deaths during childbirth. There’s an urgent need for systemic change to ensure equitable and respectful healthcare for all individuals, regardless of their racial or ethnic background. There’s more African American males in the penal system right now than there were (enslaved) at the height of slavery." As we a closer look at the racial disparities in each state’s use of incarceration — that is, states lock up a larger proportion of people of color than you would expect based on how many actually live there.
Studies by Prison Policy Initiative show that every state locks up Black people at a rate at least double that of white people, and on average, at six times the rate of white residents.

LEAST 17 OTHER CIVIL LAWSUITS PENDING...Alexandre Ansari won a $10 million jury verdict Feb. 9 for damages from his wrongful conviction, the highest amount paid out to an individual involving the City of Detroit to date. Ansari was falsely charged with the 2013 murder of Ileana Cuevas and the shooting of Cuevas’ sister Rosalind Barley and Miguel Figueroa. He was exonerated in 2019, after investigations by the federal Appellate Defenders Office and the Wayne Co. Conviction Integrity Unit (CIU). He was also charged in the murder of Figueroa’s brother in a separate incident later, also involving DPD’s Jimenez, but was acquitted by a jury.

Eyewitness Misidentification, Junk Science, and a Confession...
They were convicted of second-degree murder and attempted murder in the fatal shooting of J.B. Watson on December 29, 2009, while at a red light in Detroit. Three times since 2017, federal and state court judges have ordered a new trial for Darrell Ewing. The judges found that Ewing’s constitutional right to a fair trial was violated a decade ago by juror, not to mention that another man came forward confessing to the murder. Darrell Ewing has a hearing scheduled Dec. 1, 2023, at 1:30 PM for remainder of his motions, Derrico Searcy motion hearing Jan. 4, 2024. Trial set for both March 25, 2024, pending action on motions to dismiss all charges.

Topic: What is Ineffective Assistance of Counsel? How does it contribute to Wrongful Convictions?
Ineffective Assistance of Counsel (IAC) is a legal term that refers to the failure of a defense attorney to provide adequate representation to their client. The Sixth Amendment of the U.S. Constitution guarantees the right to representation by an attorney in a criminal case, but it does not guarantee that the attorney be effective, thorough, or even competent.
Unfortunately, extreme cases of bad lawyering can result in wrongful convictions. To prove ineffective assistance, a defendant must show (1) that their trial lawyer's performance fell below an "objective standard of reasonableness" and (2) "a reasonable probability that, but for counsel's unprofessional errors, the result of the proceeding would have been different."

Nakisha Armstrong, Co-Founder: Wrongfully Incarcerated Family Council
In 2006, Deaunteze Bobo was convicted on aiding and abetting first-degree murder charges...in which there is no shooter convicted of the crime. He's currently serving a life sentence for the 2006 deadly drive-by shooting of James Roberts right outside a bar in north Minneapolis. Mr. Bobo has been committed to his innocence and has appealed to the district court five times for post-conviction relief, arguing ineffective counsel, lying witnesses and discovery of new evidence. All five times, he was rejected. Now Deaunteze and family are demanding the Minnesota's Attorney General’s office to look at the evidence and exonerate him!

"Krystal Clark is an incarcerated person at MDOC Huron Valley Women Facility. Ms. Clark and others have been advocating for their health after becoming ill from the toxic mold inside the women's prison. They even file a lawsuit in 2019.
On August 25th, 2023, federal judge Victoria A. Roberts for the United States District Court for the Eastern District of Michigan dismissed the lawsuit brought by the women prisoners. MDOC stated that " There are no cases establishing a prisoner's right to be free from these molds (Ochotonids, Cladosporium and Chaetomium), that it is not clearly established that any type of mold at WHV is sufficiently dangerous to incarcerated people, and EVEN IF IT WERE CLEARLY ESTABLISHED THAT CERTAIN MOLDS WERE DANGEROUS ENOUGH TO IMPLICATE THE EIGHTH AMENDMENT, IT IS NOT CLEARLY ESTABLISHED THAT PRISON OFFICIALS NEED TO TAKE ANY PARTICULAR ACTION TO REMEDIATE THE PRESENCE OF MOLD."

Mr. Merriweather was framed by cop in 1987 who have been implicated in other wrongful convictions. Willie Merriweather, 68, has contended since his 1987 conviction of three execution-style murders on Detroit’s west side that police framed him because he would not testify against five of his co-defendants, who went free while he was convicted. He says he refused despite vicious beatings by the police.

Dr. Shari Richardson, DSW, LCSW is a Licensed Clinical Social Worker with a Doctorate in Social Work from the University of Southern California (USC). She is an Assistant Professor in the Social Work Department at Medgar Evers College (CUNY) and owns a private psychotherapy practice in New York City.
Dr. Richardson completed her master’s degree in clinical social work at Fordham University and bachelor’s degree in liberal arts with a concentration in Human Services at City College (CUNY).
Dr. Richardson has more than 20 years of experience working with individuals and families involved in the child welfare, juvenile justice, mental health, criminal justice, and homeless services fields. She began her career working with children and families in the foster care system in New York. She went on to work in a specialized behavioral health foster care program, a residential program, and an in-home individual/family therapy program.
Dr. Richardson was also served in several administrative positions, including Director of Quality of Assurance, and Vice President of Foster Care Services. In 2016, she was hired at the College of Staten Island (CUNY) as an adjunct lecturer and field education liaison in the Master of Social Work program. She joined Medgar Evers College in 2019 as a substitute lecturer and was then promoted to Assistant Professor in 2021. Dr. Richardson was also the Field Education Coordinator and assisted the Field Education Director with field placements and other administrative responsibilities. In 2022, she began in private practice providing individual, couples, and family therapy as well as clinical consulting and supervision at a local homeless shelter. She is a mental health normalizer that specializes in trauma, family of origin and relationship issues, stress management, anxiety, depression, grief and loss, and personal growth utilizing an eclectic variety of treatment approaches.
Dr. Richardson serves on several college committees including: the Academic Standards and Regulations, Social Work Conference Planning and Technology committees. She has redesigned several social work courses to be more inclusive of Open Education Resources (OER) thereby reducing overall textbook costs for students. She enjoys teaching a variety of social work courses and hopes that students leave her class feeling heard and valued. Dr. Richardson also strives to ensure students learn first and foremost to gain the competencies and skill sets they will need to be successful in their chosen field of social work practice and become social justice warriors.

"Black men who identify with traditional masculinity roles and ideas across racial and ethnic backgrounds.... have caused men to struggle with being vulnerable and sharing their emotions — making them even more reluctant to seek help. Open displays of emotion, is often frowned upon and not socially acceptable, sending a clear message to some Black men that to be accepted, they must fit a particular gender role in which strength and stoicism are mandatory.
Research has shown that Black men are expected to be strong and resilient physically. They are encouraged to do well in athletics and to engage and thrive in physical activities, but not in activities that promote learning or emotional or mental growth.

People with ADHD tend to get into trouble more than usual, often at an early age. They're two to three times more likely to be arrested, convicted, and put into prison than those without ADHD. Prison is a risky place when you have ADHD.As many as 1 in 4 people in prison have been diagnosed with ADHD – more than eight times the rate in the general population. The rate of ADHD is five times higher in youth prisons and 10 times higher in adult prisons than it is in people who aren't in prison.ADHD affects the parts of your brain that help you plan, manage behavior, and control your emotions and impulses. When those areas don't work like they should, it's easier to give in to urges that could get you into a jam – like driving drunk, getting into a fight, or breaking into a neighbor's house.ADHD causes a few problem behaviors in the teen years and adulthood that increase the risk of legal consequences:Doing poorly in school, skipping school, or dropping outHanging out with the "wrong" crowdBeing defiant or aggressiveBeing unemployedHaving substance use issues.

-Michigan has become the first state to automatically expunge old criminal records for people who have remained crime-free for years.
More than 1 million Michigan residents had their records wiped clean without applying or taking any action themselves. We will discuss this groundbreaking move.
-On April 19, 2023, Second Look legislation was introduced in Michigan. Second Look will give judges discretion to revisit a person’s prison sentence once that individual has served 10 years in prison. This will allow a judge to consider a person’s maturity, growth, and rehabilitation, to determine if the sentence is appropriate.
-Advocate in Michigan have also been working on Restoring Good Time Credits to inmates in Michigan. Inmates in Michigan have endured one of the harshest sentencing guidelines in the United States because of its archaic truth-in-sentencing laws.
Good Time credits incentivize incarcerated individuals to participate in rehabilitative practices. Instead of the imprisoned spending years of their lives in a cell without hope, Good Time allows them to pursue an education, job skills, and discover the power of community redemption and reunite with their families.

Topic: The Reid Technique and Wrongful Convictions,
The Robert Greathouse Story
Today we will discuss the wrongful conviction of Robert Greathouse. Robert is serving a life sentence due to a coerced confession...with the use of the Reid Technique.
According to the Innocence Project, 20% of all DNA based exoneration involve false confessions…. One of the main catalysts for a false confession is the Reid Technique. “Reid Technique” method of interrogation, which is one of the most widely used police techniques in the world. The Reid Technique trains officers to get a confession from a suspect they believe is guilty, no matter the cost.
The nine-step process focuses on a presumption of guilt and uses deceptive tactics to achieve an admission of that guilt. How can an interrogator possibly convince an innocent person that he or she is guilty?
Wouldn’t the suspect know whether or not he or she committed the crime?
-Persuaded false confessions tend to result from long and intense interrogations that may include:
-Repeated accusations that the suspect committed the crime
-Adamant discrediting of the suspect’s denials (for example, by saying that the denial is contradicted by known facts)
-Fabrications of evidence of guilt (for example, by saying that an eyewitness said that the suspect committed the crime, when no such eyewitness actually exists)
-Eventually, an offer to resolve the cognitive dissonance experienced by the suspect (for example, by saying, “it’s possible you repressed the memory of doing it”)

Since the death of George Floyd has much Changed?
2023, as we await to see the Memphis Tennessee police video from the 5 police officers of the brutal beating that led to the death of Tyre Nichols, who was unarmed. Or...The death of the man in the car accident. Keenan Anderson, died after being shocked with a Taser multiple times by an LAPD officer on Jan. 3. 2023.
2022, Deadliest Year on Record, 1,176 people killed by police in 2022, only 1 in 3 were suspected of a violent offense. The majority were suspected of a non-violent offense or no crime at all, while another 8% were killed over a traffic violation.
According to the Washington Post...while the number of fatal police shootings is increasing, fewer are being reported to the federal government. Researchers have said that the overall attempt to track police-involved shootings has failed. There are too many loopholes for police departments to not report their police-involved shootings.

"Not guilty" is not the same as "Innocent."
Innocent means that a person did not commit the crime. Not guilty means that the prosecution could not prove "beyond a reasonable doubt" that a person committed the crime. The courts will never declare a person innocent. It's either guilty or not guilty,
With the recent U.S. Supreme Court’s opinion that pretty much guts a final safeguard against prosecutorial and judicial error or misconduct. It will leave people who have been wrongfully convicted without a court to turn to for justice and increases the likelihood that some innocent prisoners will remain in prison or even executed.... We must discuss why Innocence is not a defense...

By dismantling the mental illness treatment system, we have turned mental health crisis from a medical issue into a police matter… People with untreated mental illness are 16 times more likely to be killed during a police encounter than other civilians approached or stopped by law enforcement. Individuals with untreated mental illness are vastly overrepresented in every corner of the criminal justice system. The high stress of police encounters, characterized by aggressive orders and threats of violence, makes it more difficult for people in crisis to follow orders or control their actions.
People in crisis, we need appropriate alternatives to law enforcement responses. Police are trained to respond to a situation with a goal of protecting public safety and their own safety. They are used to using interventions that are designed to contain somebody that is perceived as a danger or a threat.

According to the National Registry of Exonerations, wrongful convictions statistics show that the percentage of wrongful convictions is somewhere between 2% and 10%. Keeping in mind that there are over 2.3 million incarcerated people in the U. S., that means there's almost 50,000 to way over 200,000 innocent people behind bars.
Wrongful convictions statistics show false accusations are present in 70% of wrongful convictions. Perjury or false accusations are more common in murder cases. Withholding exculpatory evidence was present in 75% of wrongful convictions. In 93 of 143 exonerated cases, evidence was withheld at some point in the proceedings by the police or the prosecution. It’s present in 75% of homicide exonerations and in around 50% of other crimes not involving homicide.

Michigan has the country’s oldest prisoner population, including people in their 80s. Many did not receive regular health care prior to incarceration. Undiagnosed illnesses are often uncovered in prison
To reduce healthcare costs, government officials have increasingly turned to private vendors. But the trail of corruption, death and suffering left behind demonstrates that contracting prisoners’ medical services to for-profit companies is not the answer to the problem
The 8th amendment prohibits cruel and unusual punishment. However, the Constitution does not give more guidance than that...
There are people in the prisons all over the United States suffering pain, permanent injuries, and preventable deaths due to the failure to provide health care,
The 8th Amendment specifically bans:
Excessive bail or fines
Excessive force or brutal treatment
Unsafe prison conditions
Unsanitary prison conditions
Doctors in Michigan prisons are largely contracted. October 2021, The State of Michigan paid $590 million contract to the sole provider of medical care to the state’s incarcerated people.
Today we will also talk to the family members of Theresa Dunlap (Marsay and Takeyla Dunlap), inmate at WHV in Michigan. Ms. Dunlap was diagnosed with stage IV metastatic lung cancer. Theresa Dunlap lay shackled to a hospital bed, battling stage 4 lung cancer and COVID-19 while mold grew in her chemo port due to neglect and inhumane healthcare.

With all the recent police encounters, that have left many victims dead or near death... The Training of Officers...or the lack of it always comes into question.
There is a very thin line between Training policy and Humanity.
Officers are trained to “shoot to stop,” which often results in a homicide, Alexander said. They aim for the center mass of a person’s chest because it is the target they are most certain to hit and is most likely to take the suspect down.

….as we discussed the Supreme Court ruling…
(Shinn v. Martinez Ramirez) …..that people in state prison no longer have a broad constitutional right to present new evidence in federal court to support claims that they weren’t adequately represented at trial or on appeal.
The ruling also narrows the scope of Sixth Amendment rights: It means federal courts can still hear inadequate legal representation claims but can’t consider evidence that wasn’t already presented in earlier proceedings.
Now…federal courts will be compelled in many instances to simply disregard similar evidence of innocence or inadequate representation if it wasn't presented during trial or appeal, including for charges much less serious than capital murder.

Turning A Moment Into A Movement was birthed the day Gerard Haycraft (The Justice for Gerard Movement) was convicted of a Crime he did not do. His innocence did not matter to a system that Wrongful convict's innocent people daily. A little over a year after Gerard's released, he passed away.....
This show is to Honor Gerard and the Movement that was created not only for his behalf, but on behalf of all of those that are innocent and in Prison.
We will also discuss The Trauma of Incarceration was the founder of Silent Cry Inc. Ms. Shawanna Vaughn. Silent Cry Inc. has also worked to raise awareness around Post Traumatic Prison Disorder, underscoring the traumas created by incarceration and calling for training of prison personnel in the basic core competencies of trauma informed mental health care, comprehensive policies for service provision to incarcerated individuals, investments in behavioral healthcare services (including screening, assessment and clinical interventions for trauma) as well as facilitating connection to services post-release.

There are many reasons for this, many of which are rooted in the special developmental vulnerabilities of children. Children and teenagers are categorically more suggestible, compliant, and vulnerable to outside pressures than adults. They are less able to weigh risks and consequences; less likely to understand their legal rights; and less likely to understand what attorneys do or how attorneys can help them.
Black youth are more than four times as likely to be detained or committed in juvenile facilities as their white peers. Forty-one percent of youths in placement are Black, even though Black Americans comprise only 15% of all youth across the United States. Meanwhile in Michigan, Black youth are arrested at over twice the rate of White youth. Black youth accounted for 16 percent of the general population and 35.3 percent of the population with delinquency petitions.
A study of 125 proven false confession cases found that 63% of false confessors were under the age of twenty-five and 32% were under eighteen. Another respected study of 340 exonerations found that juveniles under the age of eighteen were three times as likely to falsely confess as adults.
There are many reasons for this, many of which are rooted in the special developmental vulnerabilities of children. “You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to an attorney. If you cannot afford an attorney, one will be provided for you. Do you understand the rights I have just read to you? With these rights in mind, do you wish to speak to me?”
The Purpose of the Miranda Warning is to inform then arrested person of their Fifth Amendment right against self-incrimination and their Sixth Amendment right to counsel so they can make intelligent choices about whether to waive those rights and speak to the police, whether to invoke those rights and not submit to interrogation, and whether to insist on having an attorney present before and during questioning.
Miranda Rights were first brought into the forefront in the United States in 1966. The United States Supreme Court decision in Miranda vs. Arizona defines the country's citizen's rights when it comes to protecting a criminal suspect's Fifth Amendment rights to avoid self-incriminating themselves when being arrested.
People assume that if they are not read their Miranda Rights, their case will be thrown out. This is not True!. While it is true that police are required to read a Miranda warning when a suspect is in custody, if they do not, the consequence for the prosecution is that any evidence obtained from the defendant from the time that the defendant was in custody (i.e. arrested) and the time their rights were finally read cannot be used against the defendant. However, it does not mean that charges against a defendant will simply be dropped.

We are told to call the police and rely on the criminal justice system to address violence within our communities. However, if police and prisons facilitate or perpetrate violence against us rather than increase our safety, how do we create strategies to address violence within our communities, including domestic violence, sexual violence, and child abuse, that don’t rely on police or prisons?

When we take a look at the phenomenon of environmental injustice, do we even consider how environmental racism is linked to crime.
In Michigan, with all the lead water conversations, first Flint and now Benton Harbor… the focus has mostly been about the physical effects of lead and how it can limit learning. The exposure to this toxin affects brain development in a way that reduces academic achievement and even increases criminal behavior.
Today we want to bring awareness to the effects of lead exposure on criminal behavior. The goal is to bring understanding on how doing more to remove lead could not make people healthier, it will also improve public safety.
Since environmental injustice is frequently a process and product of state-sanctioned institutional violence against communities of color (in the form of polluted air, land, water and human bodies), then what are the implications of reframing it as a practice of treating those populations as inherently criminal and deserving of punishment?
Studies have shown that exposure to lead as a child increased school suspensions and juvenile delinquency, which opens the door to the school-to-prison-pipeline.

David A. Robinson was born in Detroit, Michigan. Attorney Robinson worked for the Detroit Police Department both as an officer and an attorney. He served the Detroit Police Department for 13 years, as legal advisor to the department. He also defended officers in civil litigation. As part of his responsibilities, he was required to teach the legal section to recruits in the Detroit Metropolitan Police Academy. During these same years, Attorney Robinson obtained a part-time teaching position at Wayne State University Criminal Justice Department.
Attorney David Robinson has litigated in the area of police misconduct for both defense and plaintiffs. He has taken, to settlement or verdict, hundreds of police misconduct matters involving the gamut of wrongful arrests to wrongful deaths at the hands of police officers. He has litigated cases in federal court and circuit courts in the tri-county areas as well as courts in the states of Ohio and Louisiana. David associated with Johnny Cochran, Barry Scheck, and Peter Neufeld (of O.J. Simpson fame), in the wrongful conviction case of Eddie Joe Lloyd, which resulted in a settlement of $4,000,000. This case also resulted in an agreement whereby the City of Detroit conceded that all interrogations and interviews of suspects in serious offenses will be recorded, including police chase cases, accident cases and other police shooting cases not resulting in death.
In addition, Attorney Robinson has litigated cases involving the death of pre-trial detainees in Detroit jails which resulted in six and seven figure settlements. The Detroit Jailhouse litigation was instrumental in the closure of the 8th and 9th floors of the DPD lockups. David has also represented citizens who were wrongfully held as witnesses by DPD homicide. These cases were brought under federal civil rights statutes and demonstrated the abject failure of the DPD homicide section to honor the Constitutional rights of Detroit citizens. These cases have resulted in settlements; the most egregious among them was one that involved the wrongful arrest and detention of more than 40 citizens in the investigation of a single homicide.

There has been 3,050 Exonerations since 1989.....that's more than 26,700 years lost, of innocent people going to prison.
The National Registry of Exonerations publish a report September 2020, called "Government Misconduct and Convicting the Innocent" The Role of Prosecutors, Police and other law enforcement... This a report about the role of official misconduct in the conviction of innocent people.
In 54% of exonerations, official misconduct contributed to the false convictions;
usually more than one type of misconduct. Overall, male exonerees and Black
exonerees were modestly more likely to experience misconduct (with some larger
differences by race for a few particular crimes).
30% of exonerations include misconduct by prosecutors, 35% misconduct by
police, 3% by forensic analysts, and 2% by child welfare workers. 12
The overall rate of misconduct varies by crime, from 72% in murder cases to 32% for most non-violent crimes.

Michigan is one of only six states with no policy for Good Time or Earned Time Credits and as such is out of step with the rest of the country. 31 States & the Federal Government provide a way for incarcerated citizens to earn some amount sentence reduction based on their behavior.
* Good Time provides a pathway to redemption for people that have completed their minimum sentence and are successfully prepared
* Time spent in prison should not only be corrective focused but to rehabilitate incarcerated citizens and successfully reintegrate them back into community
* These reforms will help workforce development and improve public safety
* These reforms will reduce the costs of mass incarceration, freeing up funds for greater investment in health
* Strengthens families and improves community stability
The goal is to cut mass incarceration in half by 2030 through, sentence reduction, second look and new sentencing guidelines
* At the current pace, it will take about 50 years to cut the MDOC prison population by 50%
* Recidivism rates are not impacted by length of sentence.
* Truth in Sentencing allows the parole board to become judge and jury all over again for the same crime.--- Which effectively contravenes the 5th Amendment of the Constitution.

We have been sold a bill of goods when it comes to the way the criminal justice system addresses “crime,” and so many things that pull people into that system are minor and could often be viewed as not criminal at all. -Jessica Henry-

While police get must of the blame when discussing Injustices within the Criminal Justice System. Once arrested, the case goes to the prosecutor, who then has the ability to decide whether or not to pursue the case. Most prosecutors don’t use that discretion. Instead, they rely on whatever the police claim is the case. Because of the prevalence of plea bargaining, that can make the police the arbiters of both who gets arrested and who gets convicted. If everyone is pleading guilty, then the prosecutors are not doing their jobs and screening cases, then whatever the police say often stands. That’s a huge problem. You also have a prosecutorial mentality that prioritizes gaining convictions as the win, as opposed to seeking justice; and prosecutors will take all kinds of measures to secure those convictions.
You have public defenders that are often drowning in caseloads, then there are some criminal defense lawyers who don’t do their jobs well, and poor defendants are stuck with whoever gets assigned to them. Again and again, we see the criminal justice system reinforcing divisions that come from poverty. We can go to look at pretrial detention and bail reform, and we can’t forget the Judges…

Reforms discourages, they don’t condemn.. They may ban police chokeholds!” but use qualified immunity to allow police to get away with murder with guns and tasers.
Death Penalty reforms stop the used of the noose, to the firing squad, to the electric chair…to the used of a injection. Nothing about the Death penalty Reform stop the practice…..it didn’t bring comfort to those impacted. The reform only gave comfort to the executioners.
Meanwhile Transformation moves beyond small reformative measures. Transformation requires us to focus on economic justice and political power. Reforms often look for the community to change… Transformations is the community demanding the system to change! Transformation is redefining the idea of Justice, imagining liberation and pushing ourselves to look beyond the normal to address the root causes of our suffering.
In order for us to obtain true Change within our Criminal Justice System…we must first change the mindsets of our communities.

In policing, people often talk about bad apples. Well, bad apples come from rotten trees, and the rotten trees are law enforcement agencies imbued with structural racism. Standard processes for holding police officers accountable, issuing civil payouts to victims of brutality, and rehiring fired officers are a few of the factors that contribute to the entrenchment of racism and police brutality.
Police officers should be accountable public servants who work collaboratively, transparently, and fairly with all of the communities they serve.
Too often, they have not been held accountable. This lack of accountability has eroded community trust and fostered suspicion and resentment. In order to restore police legitimacy, there should be structures in place to promote responsible, accountable policing and measures to ensure that police are held accountable for their actions when they deviate from that standard.

Transforming Justice...by Changing the Narratives.
This week we will explore "Restoring Humanity" w/ Rev. Tia Littlejohn
When we refer to people who are, or have been, in contact with the criminal justice system as “felons,” “offenders,” “inmates,” or “convicts,” we define them by the worst act of their lives, creating a stigma that lingers long after they’ve paid their debt to society.
If we are serious about removing barriers for people with felony convictions, we must change the words we use to describe them.
For centuries, criminologists erroneously regarded people who broke the law as savages and animals... Remember the term "Super Predators" which was first coined in a Magazine article in 1995....The coming of the Super Predators. The article written by a young Princeton professor that did a study on some Philadelphia boys. He blamed these chronic offenders on “moral poverty … the poverty of being without loving, capable, responsible adults who teach you right from wrong.” He warned that by the year 2000 an additional 30,000 young “murderers, rapists, and muggers” would be roaming America’s streets, sowing mayhem. He wrote, “They place zero value on the lives of their victims, whom they reflexively dehumanize as just so much worthless ‘white trash.’"
This dehumanizing "Superpredator" theory had a profounding effect on how the media, Judge, Prosecutors, Police and everyday citizens viewed young black men. The Super predator messaging suspended the feelings of empathy towards young black people and people of color. It is a racist theory that had no crime stats backing.
This is just one of many examples of dehumanization of people. This week's conversation lead by Rev Tia Littlejohn will explore these examples and how we can change these narratives, and reduce stigmas. No one should be defined by just one experience or aspect of their identity. Leading with “people” affirms our shared humanity. How we describe the men and women involved in the criminal justice system should respect their individualism, diversity, and humanity, not flatten their identity and neglect their capacity for growth.

"Many police agencies use the traffic code as an excuse to go on a fishing expedition"
Driving while Black and dealing with law enforcement, is one of the most serious and deadly encounters that could happen to a person of color these days.
Researchers studied nearly 100 million traffic stops and found black motorists are more likely to be pulled over.
The new study, undertaken by Ravi Shroff, an assistant professor holding joint appointments at NYU Steinhardt and NYU CUSP, and his colleagues at the Stanford Open Policing Project, found that in a dataset of nearly 100 million traffic stops across the United States, black drivers were about 20 percent more likely to be stopped than white drivers relative to their share of the residential population.
The study also found that once stopped, black drivers were searched about 1.5 to 2 times as often as white drivers, while they were less likely to be carrying drugs, guns, or other illegal contraband compared to their white peers.

Innocent people are sometimes convicted of crimes they don't commit.
More than half of Wrongful Convictions can be traced to witnesses who lied in court or made false accusations.... Other leading causes of wrongful convictions include mistaken eyewitness identifications, false or misleading forensic science, and jailhouse informants. Faulty forensics also lead to wrongful convictions.
Wrongful Convictions undermined the credibility of our Criminal Justice System and ruined the lives of innocent men and women. African Americans make up 47% of exonerations even though they are only 13% of the population.
Innocent Black people are about seven times more likely to be convicted of murder than innocent white people, and Black people who are convicted of murder are about 50% more likely to be innocent than non-Black people convicted of murder.

Government Misconduct involved in 54% of exoneree cases, 78% of murder cases involving Black defendants....Police Behavior Matters! pt3
This week on Turning A Moment Into a Movement, our guest is Niecola Hlima. She will be discussing the Wrongful Conviction of her husband Vargas Johnson and his brother Marco. This is a story of corrupt police, coerced and concocted lies of witnesses who have recanted in court.
According to the National Institute of Justice, the main contributing factors for wrongful convictions in the US fall into the following six categories:
Mistaken witness or eyewitness identification
False confession
False or misleading forensic evidence, or its misapplication
Perjury or false accusation, informants
Official and government misconduct
Inadequate legal defense
-Between 2% and 10% of convicted individuals in US prisons are innocent.
-2,666 people have been exonerated in the US since 1989.
-Proven innocent people have served more than 23,950 years in prison so far.
-Out of 100 sentenced to death, 4 are likely innocent, but only 2 get exonerated.
-69% of wrongful conviction cases happen due to eyewitness misidentification.
-False confessions account for 29% of wrongful convictions.
-Official misconduct plays a part in 31% of murder exonerations.
-False accusations are present in 70% of wrongful convictions.
With 2.3 million incarcerated individuals in the United States, we can see that the number of innocent people behind bars is anywhere from 46,000 to 230,000....that's too many people!!!!

This week ….we will discuss Police Behavior and how unaddressed misconduct leads to wrongful convictions. Our guest Abdul Hakeem will discuss his own recent experience with Officer misconduct….and how no accountability has lead to many convictions being overturned in Detroit.
According to the National Registry of Exonerations, actions by police officers, including witness tampering, violent interrogations and falsifying evidence, account for the majority of the misconduct that lead to Wrongful Convictions.
Researchers found that misconduct by police is among the leading causes of disproportionate false conviction of Black defendants.
-78% of Black defendants who were wrongly accused of murder were convicted because of some type of misconduct. That number is 64% for white defendants, according to the study.
-87% of Black defendants later found innocent who were sentenced to death were victims of official misconduct vs. 68% for white defendants.
The study found that hiding evidence that is favorable to defendants is the most common type of misconduct.
Consequences are rare….the National Registry of Exonerations study shows that Police officers were disciplined or convicted of crimes in only 19% of exonerations that involved some type of misconduct.
Recently there has been news reports about how troubled Detroit officers have 'slipped through the cracks. The new Chief has created a new unit to look into these officers.
According to DPD new risk Management Unit, The Detroit Police force today currently have 113 officers have tallied at least 30 citizen complaints. 58 have been sued at least five times and 93 have been disciplined at least 10 times—with one officer racking up 85 separate cases of discipline.

Both federal and state prisons punish and correct the behavior of criminals. The biggest federal prison vs. state prison difference lies in the type of crime committed. Federal prisons are for individuals who break federal laws while state prisons are for those who break state laws. Although each system is different there are many similarities. This week we welcome our guest Mr James Jones and Lisa Riley from The Reinvention Center to discuss these differences.

Mr Jones have been an advocate for incarcerated individuals for decades and he brings a wealth of knowledge every Sunday evening on his podcast “The Growth Hour.”
Ms Lisa Riley, also of the Reinvention Center; is from the State of Ohio. She co-host The Growth hour podcast and is a strong Advocate for the Wrongful Convicted. Lisa assist women and men from all over The United States with reentry. Her goal is to help men and women come home to rebuild stronger and better than ever! Ms Riley was formerly incarcerated in the Ohio Women’s State Penitentiary in Ohio for a drug charge so she’s very familiar with the prison system, wrongful conviction and the need for Reform. She feels it’s a Blessing to advocate and being a voice for the voiceless.

Being wrongfully accused and convicted of a crime can lead to serious negative consequences to those wrongfully accused and their families.
A recent study estimated that wrongful convictions occur in 6% of criminal convictions leading to imprisonment. Other research estimates that up to 15.4% of all convictions are wrongful. It been demonstrated that racial and class bias are involved in wrongfully accusing people of crime and that those biases can influence decisions of guilt.
African Americans are burdened by a presumption of guilt that most defense lawyers are not prepared to overcome. As a result, African Americans make up 47% of exonerations even though they are only 13% of the population.

Mr Bennett has multiple degrees including degrees in Corrections Administration, Management and Organizational Development and Marketing. He has also formally studied Community Leadership. His list of awards and proclamations are as extensive as his career success. Prison offer little or no trauma-care or mental health services. No one talks about
the trauma that women experience prior to prison that goes untreated and they become more traumatized by incarceration.
Women in jail are the fastest growing correctional population in the country.
In Michigan, Black people constituted 15% of state residents, but 37% of people in jail and 53% of people in prison. Since 1980, the number of women in jail has increased 362%, and the number of women in prison has increased 239%.
Although men’s jail admissions have declined by 26 percent since 2008, women’s admissions have increased both as a total number
and as a proportion of all jail admissions. Women now make up almost one out of every four jail admissions, up from fewer than
one in 10 in 1983. Since 1970, the number of women in U.S. jails has increased 14-fold—from fewer than 8,000 to nearly 110,000 in
2013—and women in jail now account for approximately half of all women behind bars in the country.

Taking the Blind Denial conversation to the next level. How do we get the Criminal Justice Professionals to take accountability for their role in Wrongful Convictions?
Abdul Hakeem is a steward of justice, a trailblazer who believes in equal justice under the law, as inscribed on the façade of the US Supreme Court building. A lifelong Detroit, he grew up in the city during the 1967 rebellion against police brutality when he and his family had to confront the reality, and the horrors, of institutionalized racism. It was during this era there was an unwritten rule that a black man living with a white woman and her children was met with harassment, threats and physical assaults by Detroit Police.
It was this experience with racism and terror that Abdul Hakeem carried with him throughout his life and made his decision today to confront the powers that be. He reminds them of our democratic principle that we the People have the power to check those in office against governmental abuse of authority. This is why Abdul rises to the occasion and speaks out to confront government abuse, be it police, prosecutors, or other elected officials. That, he emphasizes, is the essence of a true democracy: the right to speak up and not be oppressed for such free speech...

Restoring Good Time policy to Michigan Prisons. Michigan Justice Advocacy is doing a statewide petition drive to show Michigan Legislators that the citizens of Michigan want them to implement a good time policy. A Good Time policy will not only benefit the incarcerated, and encourage rehabilitation, impacted family will benefit and it will also relieve taxpayers of the expensive burden of incarceration. Presently, Michigan is 1 of 6 States in the country without a credit policy for those that are incarcerated. Michigan is #1 in the United States for lengthy prison sentences. The Data has shown that being tough on crime and long prison sentences doesn’t reduce crime or make our communities any safer. In order for incarcerated people to be successful we must explore a different way to incentivize good behavior and give them life tools that they can use once released. Last year, 20 people who had been wrongfully convicted of crimes in Michigan were exonerated. Only one other state exonerated more people in 2020. Illinois had 22. Nationally, 129 people were exonerated.
Twelve of Michigan’s exonerations were people convicted of murder, three were for attempted murder, two were for child abuse, one was for robbery, one was for assault, and one was for selling or possessing drugs. Wayne County Conviction Integrity Unit as a driving force behind the state’s number of overturned convictions. The unit helped with 13 of the exonerations.
Our guest Larry Smith, exonerated February 2021... will be our Special Guest! Since Larry been home he’s been on a mission... advocating for the Over Incarcerated, Freeing the Innocent and Medically Frail! Larry spent 26 years incarcerated wrongfully in MDOC. Smith was 18 when he was sentenced in November 1994 to life in prison without the possibility of parole for first-degree murder and felony firearm convictions. He will also discuss the upcoming Wrongful Conviction Rally on June 4 in Detroit.

Systemic racism has led to the mass incarceration of Black People in America…
As of 2019, Black people are 14% of the U. S. population… and 40% of the U. S. incarcerated population …. for every 100,00 black person, 2,306 black people are either in the prison, on parole or probation system.
Black males were incarcerated at the rate of 4,347 inmates per 100,000 U.S. residents.
There are more African American men incarcerated in the U.S. than the total prison populations in India, Argentina, Canada, Lebanon, Japan, Germany, Finland, Israel and England combined."
There are only 19 million African American males in the United States, but collectively these countries represent over 1.6 billion people.Using data from the World Prison Brief and According to United States Department of Justice there are more Black males incarcerated in the United States than all women imprisoned globally.
A 2020 review study, stated that mass incarceration in the United States "cannot be explained without reference to the centrality of racial politics.
Now….. what will be different about this conversation, We will take a look how Black Police Officers, Black Lawyers, Black Prosecutors, Black Judges and Black Elected officials who possibly thought they were doing the right thing, created problems even more grievous than the one they were trying to solve.

-83%...of DNA exoneration plea cases resulted in identification of the alternate perpetrator
The United States criminal justice system could be so deeply flawed that innocent people are convicted of crimes they didn’t commit, it’s even harder to fathom that some of those innocent people actually felt compelled to plead guilty, often in exchange for a reduced sentence or to avoid the death penalty. When so many innocent people are agreeing to their own wrongful convictions, it’s time to acknowledge that something is very wrong. The plea system is not a bargain; it’s a problem that has no regard for innocence.

When a defense lawyer doesn’t do his or her job, the defendant suffers. Shrinking funding and access to resources for public defenders and court-appointed attorneys is only making the problem worse. The National Registry of Exonerations in which Inadequate Legal Defense (ILD) was deemed a contributor to a wrongful conviction, found that investigative failures were far more frequent than other types of legal inadequacies in the Registry's ILD cases, appearing in 80.6% of cases, while trial errors were found in just 50.8% of these wrongful convictions. In 34.7% of cases, the failures were solely investigative. The larger implication is that the relative dearth of investigators in public defense systems is a problem deserving similar attention as the more commonly understood issue of too few lawyers handling too many cases.
