On this Conveyancing Matters chat, Lorraine and Stu discuss a sensitive topic for estate agents - sales progressors.
There are, of course, many excellent estate agents supporting conveyancers. But there are a lot of sales progressors who do not interact well with the conveyancer on a transaction and we would argue, in many cases, do not speed the progress of a matter.
Lorraine and Stu worked out that conveyancers probably spend on average 2 hours per day dealing with chaser calls and emails from estate agents - that is a whole working day per week when conveyancers are not doing conveyancing work. Is this a good use of conveyancers time?
Lorraine and Stu acknowledge that conveyancers should try to keep their agents up to date, where the client permits them to do so.
In this week's Conveyancing Matters chat, Stu and Lorraine continue to think about the fall out regarding the clumsy handling of the roll out of the 5th edition of the Property Information Form
This has led to confusion and discord amongst conveyancers
The Law Society has confirmed that the new form is not compulsory for CQS firms until next January, but the issue could have been avoided if conveyancers who are at the coal face doing the work had been consulted in the first place - how often do we find ourselves saying that?
Ask the people who are doing the job!

In this Conveyancing Matters chat, Stu and Lorraine are joined by Simon Lumb from the National Deeds Depository
This is a company which offers property logbooks - a sustainable, digital record of data information relevant to a particular property
Simon chats about the challenges of how property logbooks are made sustainable - the central point is that the data must be accessible and possible to update for future transactions relating to the property
What is interesting about Simon and his approach is that he has recognised the importance of brining together various organisations that offer property logbooks - and some of them have come together to form the Residential Logbook Association. Together RLBA have a louder voice and a seat at the government table. Watch this space for interesting progression in this area!

In this Conveyancing Matters chat, Lorraine and Stu discuss a County Court case reported by the Law Society’s Gazette in which a conveyancing firm avoided a negligence claim because their terms and conditions did not extend to advising the client about road development schemes in the locality.
The case does not set a precedent – but it is interesting as it shows how important it is for conveyancing firms to have well drafted T&Cs setting out what a firm will do for a client in a conveyancing transaction.

Russia’s invasion of Ukraine has led to international condemnation and a raft of economic sanctions against Russia and many of its citizens.

Guess what? There are still law firms out there that will include their bank details in an email.

In the current volatile conveyancing market, it is essential for all involved in the process to give a consistent message to clients – but this is not happening. Clients will hear what they want to hear and it is often the conveyancer who gets the blame for any delays; whether justified or not.
They mention the recent case where a law firm was awarded £25000 in damages from a client who posted a negative review on Trustpilot. What would you have done?

The recent Conveyancing Matters chat about what conveyancers do and our follow-up poll on the lender’s Certificate of Title generated interest and comment and prompted Stu and Lorraine to think about the relationship between conveyancers and lenders.
In most conveyancing transactions the conveyancer will also act for their buyer client’s lender. But with the increased risk on many conveyancing files and our duty to report to lenders, should we regularly be acting for buyer and lender in the same transaction? Or is the prospect of a conflict-of-interest just too great?
Do you ask your buyer clients if they have been put on furlough or are facing redundancy prior to exchange of contracts?
Do you decline to act for a lender if you recognise a conflict-of-interest?
Lenders are our clients as well, but Stu and Lorraine wonder whether we are reaching the point where separate representation might be more appropriate.

So much is being said and written, at the moment about conveyancers and conveyancing delays, so Stuart and Lorraine have decided in this Conveyancing Matters chat to talk about some of the detail of what conveyancers do on every file.
Not the endless AML, due diligence, file opening and form filling – but the actual technical work on the investigation of title upon which our buyer clients and lenders depend.
They also want to dispel some of the myths – how many practitioners submit the Certificate of Title to a lender before all search results are in or enquiries raised, supposedly to make sure they are ready to proceed? How many exchange without knowing whether a restriction can be complied with?
The value of a property depends on the rights that it enjoys. If there is no legal access and no services, a property is worth a lot less and might even be unsaleable. It is the job of the conveyancer to find that out. And advise on it. Properly.

Stu and Lorraine could not ignore the execution of the so called SDLT ‘holiday’ to 30.06.2021 at the current level (and to 30.09.2021 at £250,000), so in this Conveyancing Matters chat they talk about the announcement and its impact on those in the profession.

Our chat with Mike Day made us realize that we have a lot more to say about anti-money laundering and its impact on the work of conveyancers.

Stu and Lorraine are delighted to welcome back to Conveyancing Matters Mike Day from Integra Property Services.
In addition to being a property market guru, Mike offers training on many key areas affecting property professionals; so, with the introduction of the Legal Sector Affinity Group anti-money laundering (AML) guidance in January 2021, we decided it would be a good time to discuss the AML regime with him.

Conveyancers sometimes forget that lenders are in business to make money and they will repossess a property if the borrower fails to keep up their repayments. We advise our clients of this risk – but what about the conveyancer?
What is the position of the conveyancer if the lender repossesses and sells at a loss? Will they have a go at the conveyancer? You bet they will! We must ensure that our files are Handbook compliant.
And there are many people doing conveyancing work now who have not come across negative equity.

Stu and Lorraine really enjoyed this Conveyancing Matters with Mike Day of Integra Property Services. We enjoyed a wide-ranging chat about the property industry. Mike is an experienced and respected voice – and he shares some of his experiences of 45 years in the industry (he started when he was 3….!).
Mike has some very insightful things to say to conveyancers - he is one of the few people who acquired two firms of solicitors and turned them into licensed conveyancers.
Mike has an interesting view on conveyancers and what they can do to try to take more market share and develop their businesses. Mike helps firms with strategy and gives some advice to coal face conveyancers to help improve their processes right now.
We talked about conveyancing firms embracing IT and prop tech, the current state of the market and whether conveyancers should offer out of hours appointments. We also talk about property logbooks.

In this Conveyancing Matters, Stu and Lorraine were delighted to chat with Shaun Spalding from Avant Advisory. Shaun is an accountant but has branched into IT, finance and project management so he is perfectly placed to understand the professional pressures that law firms face – whilst being able to bring a refreshing perspective to thorny issues such as electronic signatures, case management systems and attitude to risk.
Shaun gave some really practical ideas for conveyancers to think about when looking at the risks of cloud-based storage and electronic signatures as well as discussing the ‘Uncle Albert’ attitudes to change! (You’ll have to watch it to understand that one!).

In this Conveyancing Matters chat, Lorraine and Stu give themselves a right of reply! Stu has some files in his office which can be seen by our lovely viewers, and a Conveyancing Matters viewer simply assumed this meant that Stu’s firm uses paper files. Nothing could be further from the truth – but in this video, Lorraine and Stu chat about the ‘paper vs digital’ files argument. As Stu says, there is an assumption that paperless is the better route to communication – but is this necessarily the case? And as conveyancers still have to deal with unregistered titles and have to keep files for many years to comply with regulatory requirements, going completely paperless is not always as easy as it seems. HMLR has announced that from 27.07.2020 it will accept for registration documents that have been signed by electronic means. A great day for conveyancers, surely?
