(Director's Note: This episode was recorded in November 2021. However, due to Typhoon Odette as well as its consequential damages and delays that affected most of us here in Cebu, we have only managed to put this out this month.)
Our episode guest is no other than Atty. Ferdinand Gujilde, Commission on Elections (COMELEC) Cebu Regional Election Attorney. As an election lawyer with the COMELEC for over 17 years, Atty. Gujilde is among the established personalities in this field of law in the country and has authored election law books. He is also a law school professor and newspaper columnist.
Extensive discussions on the conduct of the automated elections amid the Covid-19 pandemic, proposed election law amendments such as the option to substitute candidates in political parties in cases of withdrawal, and the salient features on the recent COMELEC Resolution for the upcoming May elections are in place this March episode.
Here are some highlights of this episode:
• Substitution of candidates “Substitution pertains only to persons belonging to the same political party because in case of withdrawal, death, or disqualification, there is a party representation that must be continued. As opposed to independent candidates, they do not have a party so there is nothing much to be continued except for barangay elections”.
• Return to the two-party system “Because of the multi-party system has been abused, these candidates, they have actually lost grasp of what is actually a political party”. It’s not anymore a political party based on principles, it’s now a political party based on convenience and probably survival. So we do not actually see real political parties now”.
• Media advertisement regulations “Media entities are mandated by law to furnish the COMELEC with the copy of the contract of advertisement within five days from the date of execution. Because of that, the COMELEC is informed of the duration, frequency, size, and more importantly, the cost of the advertisement”.

In this 1st Episode of Season 2 of the Open Bar podcast, we talk to Cebu City Councilor Joel Garganera who heads the city’s Emergency Operations Center. He has been at the forefront of the fight against COVID-19 in Cebu City.
Joel discusses with attorneys Jayson, Ria, and Kara the issues surrounding the strategies employed to encourage people to get vaccinated. Is there discrimination against those who have not had their vaccination? Are personal liberties at stake? How does the “No Vax-No Work Policy” reconcile with DOLE Advisory No. 03 Series of 2021 which prohibits discrimination against unvaccinated employees?
These and other questions the podcast tackles, including how Cebu City is doing with its vaccination program and the challenges it has faced and continues to face.

Finally, we have come to a close. In our season-ender of the Open Bar, we are featuring the team of lawyers who are behind the monthly podcast of the Integrated Bar of the Philippines (IBP) Eastern Visayas Region.
Moderated by Atty. King Anthony Perez, content consultant, this special episode is joined by hosts Attys. Jayson Jorvina, then-governor of the IBP Eastern Visayas Region, Ria Espina, former president of IBP Cebu, and Kara Mae Noveda. Also joining the twelfth and last episode this season is Atty. In this episode of The Open Bar, we highlight the current vaccination efforts against Covid-19 amid the ongoing public health crisis. Joining us in this episode is Infection Diseases Specialist Dr. Bryan Albert Lim who has been at the forefront of emergency response in Cebu since the beginning of the pandemic.

Prosecutor Ingemar Macarine welcomes the year by motivating our listeners to stay fit and healthy amid the hustle and bustle of lawyering.
We have the rare opportunity to converse with Tubigon, Bohol-based public prosecutor, environmental advocate, and triathlete Ingemar Macarine, who is dubbed as “Pinoy Aquaman,” after his widely publicized long-distance swims in open waters. Among Macarine’s swimming milestones are the 10.34-kilometer Limasawa-Padre Burgos swim in Southern Leyte, 2.7-kilometer swim from Buluan Island to the Buluan Port in Ipil, Zamboanga Sibugay, almost 18-kilometer Pamilacan Island-Panglao Island swim in Bohol, 18-km Cebu-Bohol swim, and his 2.85-kilometer swim overseas, from Alcatraz to San Francisco, California.
In this January episode of the Open Bar, Macarine recounts the beginning of his fitness journey and the balancing act between lawyering and training as a triathlete. He also shared encouraging tips to maintain good health despite the demands of the legal profession.

The Department of Health (DOH) has recently disclosed that at least 3.6 million Filipinos have experienced mental disorders amid the ongoing Covid-19 pandemic. The World Health Organization (WHO) has even anticipated that the next pandemic would involve mental health problems as a result of the current public health crisis.
Deviating from the usual professional and academic concerns of lawyers and law students on our podcasts, the seventh episode of the Open Bar brings into the spotlight the need to address our mental and emotional well-being.

As we celebrate the Rule of Law Month this September, the Open Bar, a monthly podcast initiated by the Integrated Bar of the Philippines (IBP) Eastern Visayas Region, brings to you Her Excellency, Vice President Maria Leonor “Leni” Gerona Robredo.
A female lawyer, Vice President Robredo has dedicated significant portions of her career to government service, legislative work as a former congresswoman, counsel for indigents at the Public Attorney’s Office (PAO), and as an alternative lawyer for Sentro ng Alternatibong Lingap Panlegal (SALIGAN).
In this special episode, she expressed her insights in the handling of the Covid-19 pandemic, which is now on its sixth month in the Philippines, the impact of women leaders, and the initiatives of the Office of the Vice-President (OVP) in dealing with the ongoing public health crisis.
The Vice-President also shared her personal experiences on the difficulties of studying law and the lessons she had learned after taking the Philippine Bar Examinations twice. She also recounted the days of being a public service lawyer which plays a pivotal role in assuming the role of Vice-President. As a final note, VP Leni calls lawyers to question and challenge the status quo as instruments of justice.

Philippine Association of Law Schools (PALS) Atty. Marisol Anenias spills the details of the necessary preparations and adjustments made among law schools to meet the challenges of the new normal as we continue to battle the effects of the Covid-19 pandemic.
The Universidad de Manila College of Law Dean is also the first female guest of the Open Bar.

• Collaboration of law schools “We (law school deans) started with sharing (our experiences) and I believe it is a good way to do baby steps on what we are planning to do”.
• Student admissions “There are some areas where admissions are affected. It’s not just the schools themselves, some students feel that it is not yet the right time (to enroll).”
• Learning management systems “One of the disadvantages is that the internet infrastructure is not strong and I hope the government can remedy that”.
• PALS Live Lecture Series “There are possibilities here because you know you just don’t limit yourself to the four walls of the classrooms in your college. Now, it’s a universal classroom.”
• Mental health of students- “The stress is exponential and aggravated.”
• Challenges of law professors “This is a full-length semester where you are able to prepare. This is also a time to check whether we are as effective. This is only the way to go, we have no other way to reach students. We cannot do face-to-face classes this time because it is not safe.”
• Clinical Legal Education requirement for future Bar Exam takers “legal aid through instructional materials on online platforms, test areas of electronic legal aid have commenced”
• Tips for law students “Use the technology to your advantage. Read, learn, persevere. Don’t just limit yourself because we are not built that way. We are built to keep learning and find out new things”.
